Complaint: My current mortgage company CIT Bank N.A. scheduled a foreclosure sale of my property on XX/XX/XXXX. My servicer skipped several mandatory steps before to move forward on the foreclosure procedure ; with only five months behind, they will foreclosure my home. Cit trustee 's attorneys didn't provide information requested on my response to their Deb & Mortgage Validation Letter submitted on XX/XX/XXXX ; moreover, CIT moved forward with this foreclosure even before they accomplished their own 30 days allows to me to respond to their debt validation letter ( DVL letter received on XX/XX/XXXX ). The facts for my request for a loan modification submitted using Hope Loan Port ( case number available by request ) are : - Property is my Primary Residence and only one property. - The main reason for my hardship was the continuous disagreements that begun to arose with my husband, and unfortunately continue escalating until XX/XX/XXXX, the date that he decided to move out of our marital home and left me responsible for all home expenses, including mortgages. Since that day, I was trying to make my best effort to keep all accounts currents ; in few months I exhausted all my savings, income, even valuable stuff that I sold for less than the real value just to continue paying my mortgage on time. Unfortunately, in XX/XX/XXXX, I couldnt continue, and I fall behind with my financial obligations. - As result of this situation, I also fell into a deep XXXX, a condition that worse my financial situation because I was unable to work for some days. - Since XX/XX/XXXX I began receiving financial counseling from XXXX, a local non-profit organization ; with them, I was able to create a budgeting plan and prepare this present request to save my home. - As an agreement with husband ( now separated ), he will continue paying the two car loans listed on my credit report. Also, currently, I am working with XXXX in a plan to address all my unsecured debt balances. - My second mortgage is in the process to being transfer from XXXX XXXX XXXX to XXXX XXXX XXXX XXXX XXXX ; I hope that after obtaining a reasonable workout with CIT Bank, I can move forward a negotiate some agreement that allows me to continue paying this second mortgage too. - For now, my emotional health and finances are getting better, I move forward in my life, and I want to keep my home. I made during last weeks so many cuts in unnecessary expenses ; now I am confident that I will do it by myself, just I need my mortgage company understanding and common sense to avoid one more foreclosure on our community. - A complete package was submitted to CIT and is waiting for a review and a response, this package included ; Bank statements, pay stubs, hardship affidavit, XXXX, XXXX, Third party authorization, taxes XX/XX/XXXX, taxes XX/XX/XXXX, Driver license, utility bill, HOA statement, affidavit for no car loan payments listed on my CR. affidavit of counseling received to handle unsecured debts and second mortgage.

Complaint: Financial Freedom, a branch of XXXX XXXX, in XXXX, Texas paid the real estate taxes for the last part of XX/XX/XXXX and most of XX/XX/XXXX ... as is their right ... on our reverse mortgage. We got no notification that Financial Freedom had paid the real estate taxes until we got a call on XX/XX/XXXX, followed by a letter on XX/XX/XXXX demanding the {$4600.00} by the end of the month or the company would start foreclosure proceedings. I tried to make a repayment schedule, but the bank used the excuse that we spent about {$120.00} more than my wife and I received from SSI ... approximately {$1900.00} and my " XXXX '' retirement fund of {$110.00} per month. Although we offered to send Financial Freedom {$500.00} per month, our offer was refused out of hand. This seems to be a case of " get rid of the reverse mortgage completely '' or a predatory practice. We are still willing to repay them {$500.00} per month, and we told them so, again by phone, but they still refused. I don't know where Financial Freedom got its financial information.

Complaint: I had applied for a loan modification last year and was working with the CIT bank. During the process, I was to have all documents in by a certain date. However, as I was going through the process, I was working directly with the underwriter to get the bank exactly what they were requesting. The information I was sending was getting rejected so I had to keep sending in different things to satisfy their requirements. When I finally gave them everything to their satisfaction, they denied me based off of the fact that I didn't give them all of the information by the date they requested. I don't understand how they could do this as I was actively working with the underwriter of the bank. So basically, the bank gave me the run around and waited until after my due date for all of the information to be approved and denied me because it was after my due date when they received and approved my information.

Complaint: To Consumer Financial Protection Bureau : On XX/XX/XXXX - I received the documents from my bank denying me of a Modification due that I make too much money, on this document they sent me I make {$7100.00} a month, which is in-corrected I make {$27.00} an hour which a month would be {$4300.00} before taxes are taken. ( {$3200.00} after taxes ) ( they have copies of my pay subs ) I applied for the Modification and was deny both times. I pay for Child care that come to {$1500.00} dollars a month. Plus cost of living. Credit cards are max. I have been on top of all of the paperwork and still they deny me an opportunity, I have been making my payments on time, but {$2600.00} Dollars a month is a lot of money for a single mother And grandmother to do on her owe. I bought at the end of 2008 when the market crashed and dont know how I was approved, for the loan to be honest with you. I have also applied for Keep your Home California for the principle Reduction. Please HELP ME with all this Modification loan. I need an affordable housing, me and the kids. a payment that I can make, with out going hungry. I know its a choice to take care of Grand-kids, but I couldnt see them go to Foster care and, Not knowing where they would be, or have someone XXXX ; XXXX ; or XXXX them. the parents are in XXXX and in XXXX XXXX. Let me know what else I can do on my end. Thank you very much.

Complaint: We had leased phones from XXXX/CIT Finance LLC located at XXXX XXXX XXXX XXXX XXXX XXXXXXXX, XXXX, FL XXXX on XX/XX/XXXX. We were always in good payment standing. In XX/XX/XXXX, we downsized from our storefront XXXX XXXX to a 5th-floor space. We also downsized our employee force to meet ends. When we interrogated the new leasing agents for the phone installation, they informed us that their building did not have wired phones but only digital phone connections. I went back and told the company to take the phones back and cancel my account. They keep insisting that I have to pay for 60 months. It clearly says, the XXXX, CIT Finance LLC are authorized to purchase the equipment but they told me they can not. I see it clearly mentioned in the contract. I went to their legal department to cancel this account and take the phones back, they informed me that the only time they will do that when you business structure has changed. I told them, my business structure did change. I downsized and the new building and ALSO does not support wired phones from CIT. All of a sudden, they said that is not enough reason to cancel the account. I have already paid {$2900.00} for 34 months until XX/XX/XXXX. The original lease was 60 months at {$86.00}. They invoiced me for another $ XXXX-Total buyout with equipment keep. This is not fair. They need to take the equipment back. Kindly resolve this matter as we do not need the phones and we paid them enough already. This contract and terms are very ambiguous. I was told I would receive this bonus if I kept an average daily balance of $ XXXX in this account for the first three calendar months AFTER I opened this account. I was also told I would receive this bonus within 45 days of the third month. So I should have received this bonus by now. I opened this savings account in late XXXX of 2017. I did in fact keep this balance through the months of XXXX, XXXX and XXXX. I have not received replies to my two most recent emails concerning this matter.

Complaint: XXXX XXXX, XXXX Consumer Financial Protection Bureau Re : COMPLAINT Financial Freedom Reverse Mortgage Loan # XXXX Property : XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, CA XXXX Dear Sirs : My mother, XXXX XXXX, had a reverse mortgage with Financial Freedom. She XXXX XXXXy on XXXX/XXXX/XXXX and we decided to purchase the property. It was quite a feat just to get the pay-off amount from Financial Freedom and each month that passed meant another $ XXXX in interest payments TO Financial Freedom plus the HOA at my mothers house which is {$630.00} / month. Even my attorney mentioned how difficult this company is to deal with. Once we did get the pay-off amount ( {$210000.00} ), we paid it off. See letter from XXXX XXXX, Lien Release Representative, indicating the mortgage was paid in full on XXXX/XXXX/XXXX ( Attachment # 1 ). Youll note the handwriting on that letter. Those are notes from some of the times I called to try to get help. The property ( XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, CA XXXX ) is in a senior community and is a co-op. The legal document for this property is called a Membership Certificate. Financial Freedom has misplaced this document. I didnt even realize I need this document to present to the Board at XXXX XXXX in order to be accepted as a resident until we went there on XXXX XXXX, XXXX with our bank statements, tax records, legal document and credit scores and were told everything looked good, then they asked for the Membership Certificate. Our contact at XXXX XXXX XXXX is XXXX XXXX XXXX. Since XXXX I have made MULTIPLE phone calls to Financial Freedom ( only to get the Customer Service Department which notes that you call and supposedly forward your info to someone who cares and will get back with you.doesnt happen. ) I sent correspondence to XXXX XXXX since she was the one who authored the letter stating that they received the funds to pay off the mortgage in full on XXXX/XXXX/XXXX. Heard nothing back from her. ( Attachment # 2 ) I finally was told by a Customer Service person that XXXX XXXX in the Lien Release Dept. finally admitted they cant find the original and are working on getting an original copy -- whatever that means. I called on XXXX/XXXX/XXXX and the person I reached recognized my dilemma from a previous conversation ( I didnt even document that one I guess ) .she took pity on me, checked with a supervisor and advised me that the only way I would get anyones attention was to send a complaint letter. All my inquiries, emails, etc. didnt constitute complains, I guess! I sent the complaint letter on that same day, XXXX/XXXX/XXXX ( Attachment # 3 ). I got a response dated XXXX/XXXX/XXXX ( Attachment # 4 ) acknowledging receipt of my email.it was a letter, not an email.so unprofessionalthey stated that they forwarded my inquiry to XXXX XXXX, Escalations Specialist who would contact me within 1-3 business days. On XXXX XXXX XXXX sent a letter ( Attachment # 5 ) to my attorney, XXXX XXXX XXXX, refuting some of my facts. He states they discussed the Certificate with me on specific dates.which they did..BUT Im the one who initiated the phone calls and all I got was their Customer Service people..who, again, just documented the call in the computer and then who knows what happened to it. Youll see in the next to the last paragraph of XXXX XXXX letter he states that their Title Resolutions Team has obtained a copy of the original Certificate (? ) and is currently working with their title vendor to obtain the replacement. He states that IF the certificate was not issued in the next 30 days ( which would have brought us to XXXX XXXX, XXXX ), they would provide me with a written status update. The only updates I have received are as a result of ME CALLING XXXX XXXX XXXX!! Just another stall tactic! Please see my email dated XXXX/XXXX/XXXX to XXXX XXXX in response to his letter of XXXX to my attorney ( Attachment # 6 ). It indicates that according to XXXX XXXX XXXX of XXXX XXXX, a replacement Certificate will not suffice. The only two acceptable documents will be the original Certificate or a Lost Instrument Bond. I provided XXXX XXXX with the Insurance company name and agent who XXXX XXXX XXXX uses along with phone # and email address. I called XXXX XXXX after the XXXX XXXX and asked for an update. He has nothing new to offer me except for the fact that Financial Freedom WILL cover the cost of the Bond..Why wouldnt they??? So now Im just waiting for them to figure out how long its going to take for THEIR VENDOR to get this done!!! This is ludicrous and I cant believe these people are in business. Its one stall tactic after another. My mother owed {$52000.00} on her property when she took out the Reverse Mortgage. We had to pay {$210000.00} to pay it off. Thats no ones fault.my mother was XXXX when she XXXX XXXX and it was her decision to get the reverse mortgage. Seems it gained my mother a little over {$400.00} a month and COST over {$600.00} in interest each month. I JUST WANT THE MEMBERSHIP CERTIFICATE SO I CAN GAIN RESIDENCY IN XXXX XXXX. IF we decide to rent this property to recoup some of our money, I have to wait one year AFTER we become residents to do so.THUS, every month Financial Freedom is unable to provide adequate paperwork to satisfy XXXX XXXX, is one more month well have to wait before we can rent the property IF we decide to do so. This has been an emotional roller coaster. Not only did I lose my mother, but have spent almost an entire year dealing with these inept ( or maybe just crooked ) thieves. PLEASE HELP!
