Complaint: XX/XX/XXXX I applied for a Business cars and provided only my business information such as my TIN #. There was a SS# request section in addition to the TIN request section. I declined to put my Ss# in this section because I did not want to mix business credit with the personal credit. Once the application was completed. I received a email stating that to send additional documents for processing. Just as I was getting ready to send the documents capital one emails a decline letter, stating they would send the information about the decline within 10 days. Shortly after and because I’m signed up with Credit Monitoring through XXXX XXXX, I received notification that my “personal”credit had been accessed.I immediately called Capital one and was told that my credit was declined because I placed my TIN in the Ss section . I agreed and informed the representative that I did so because it would not let me move forward without entering some type of data in the section.As mentioned earlier the application requested a TIN, which was provided; and several sections later requested my personal social.Upon inquiring about the reason for decline prior to me being able to submit the requested documents, the representative informed me that even though I applied for business credit my personal credit must be accessed. I then informed the representative that clearly they were able to access my credit without me having to provide it because my credit monitoring application just alerted me that CAPITAL ONE accessed my credit. The representative was unable to make since of the actions of CAPITAL ONE and only stated that I had to reapply which would result in yet another credit pull. I escalated the situation and still was unable to resolve. Finally, one day later I receive another email stating that I was declined because Capital one was unable to move forward because of a fraud alert that was placed by my on my XXXX bureau that didn’t contain a contact phone number for them to reach me to confirm that I did indeed apply for credit. However, as stated earlier if indeed they were unable to move forward on the application, why didn’t CAPITAL ONE just decline the application and request further information instead of pull my PERSONAL CREDIT Without my permission, compromise my score, only to provide me with conflicting denial reasons.I am requesting that you further investigate the actions that took place in this business credit card request.Thanks

Complaint: I have a CapitalOne Platinum card where I have a $XXXX minimum payment due each month that I had set to be automatically paid from my bank account each month. I had this set up when I first received the card. Upon moving to my new house, my billing information and address changed which messed up my automatic billing and all communication with the company via mail. I do all of my communication with the credit card companies through the mail and this is how I check the amount of money that is due on my card and if my payments had successfully gone through. Therefore, relocating to a new address caused my automatic payment to fail which caused me to be delinquent on my CapitalOne Platinum credit card account for the month of XX/XX/2018. Not knowing that my automatic payment was messed up caused this issue and it was compounded when my address change caused the mail that the company was sending me to go to my old address. This cut off all communication with me and the company and I was unaware that I was missing a payment until an associate at CapitalOne called me in XX/XX/2018 to let me know that the account was delinquent. I then immediately made the payment that I was owed to the company.

Complaint: About 3 years ago I was hospitalized In could not pay you need bills and I was living with my parents for a month after for recovery. I had 2 capital one cards, That were marked 3 months late payments and my account was restricted and shutdown. When I finally got the opportunity I called them and they promised if I paid the full balance that day they would correct the late payments due to the situation and "unrestrict" my cards. I agreed paid both in full right there and requested 1 be cancelled and I would just keep the 1 card in total. So they took my payments reassuring me they would be marked on time for the time I was in the hospital. Canceled the 1 card due to my request. 3 years later the other card is still restricted And they never marked either one paid on time like they had agreed . I have disputed this probably 10 to 15 times over the last 3 years I have called them multiple times over and over asking for supervisors writing letters and no one is holding up What I was told. I feel like I was taken advantage of by someone who wanted to get credit for taking a payment on a Restricted accounts. Today I called and they told me it's impossible for anyone to fix anything. I just want them to mark my payments on time like they promised on both cards.

Complaint: On XX/XX/2019, I discovered that Capital One Bank had closed my account and reported me as "deceased" to credit monitoring agencies. I have told Capital One Bank that I am alive and well. I have filed disputes on the report from Capital One Bank with XXXX, XXXX, and XXXX. At this point I have great concern that Social Security thinks I'm dead as well and that I may not get my scheduled benefits. I am unable to log in to my Social Security account online, so will try again on Monday to contact them. At first I thought this rather humorous, but if I have problems with Social Security benefits it won't be funny at all. I suspect that this has happened as a result of the massive data breach that occurred at Capital One Bank.

Complaint: I opened a line of credit while paying in the check out at XXXX XXXX XX/XX/XXXX for around $130 after providing my social security number. I thought the bill was paid as I continued to receive mailings, online orders and coupons at my current address. I discovered in XX/XX/XXXXthe bill was not paid, had additional late fees the account was sold to a debt collector. I have found out my XXXX capital one bill and credit card was being sent to a combination of my old and current addresses so I was not receiving any mail from them. Capital one will not accept responsibility for the error and is not able to wave the late fees or recall my debt from collections as it is not their account any longer and XXXX XXXX XXXX is not willing to accept less than $XXXX to clear the debt. I still have not received any mailings from XXXX XXXX XXXX because they are using the address provided by XXXX capital one. I do not believe this error is my fault in any way. I do acknowledge I opened the account near the amount of $XXXX but due to a clerical error on the behalf of XXXX or XXXX capital one my credit score has gone from XXXX to XXXX over the course of a year.

Complaint: Capital One change my billing date with a last minute notice. I call them to ask why my billing date was just change at a last minute. I talk to some one at Capital One and discuss I wanted my date to stay at and on the XXXX of the month. I was on the phone for 45 minutes back and forth been transferred to talk to some one higher up. I was told that the XXXX of the month to the XXXX of the month. I called back to ask where is the letter that I was told that would be mailed out. Got the run around on XX/XX/2019 more run around was told no such call I did not call. Capital One transferred me to 3 other people like a cat and mouse game. I called back Capital One Bank Rep was very rude talking all crazy. Capital One Bank seems to have issues one rep telling me her date change and all that has nothing to do with me and is not professional in any way or has nothing to do with my issue is and the date that a rep said was going to be on the XXXX XXXX I have XXXX accounts and was stated would be adjusted to the XXXX of the month. Call back on XX/XX/XXXX9 and told now it 's going to take 3 months to adjust but Capital one just change it at last minute. One excuse after another 3 months now. Capital One Bank seems to be having financial issues with there credit card clients paying on time so now it appears there just trying to change things for there benefit and give customers the run around.

Complaint: I put a down payment on a puppy through XXXX. The "breeder" who asked for the downpayment had me send him the money through XXXX, and explicitly requested I send it "friends and family" as oppose to business so he could avoid the "fees". I did as he requested. He told me I would have second pick of a female XXXX available in XX/XX/2019. In XX/XX/XXXX I contacted the Breeder and he informed me the puppies had not been born yet, and even when they were, I would have to wait 3 months after that to receive the puppy. I told him this was unacceptable and asked for a refund. He refused. I asked XXXX for a refund, they said because I sent it friends and family, and not as a business, I had no "seller protection". I then disputed it with my credit card company, Capital one. I explained to capital one that I NEVER received a puppy NOR have a I received a refund and its now past XX/XX/XXXX. Capital one did its investigation and sided with the seller because they ran the WRONG TYPE of investigation. Instead of running it as services not received... as I described, they ran it as refund not processed. And because I couldn't show proof of a processed refund -- they denied my claim. When I called back to Capital One-- they said they understood the validity of my concern- but there is nothing they can do because they can't dispute an item twice. So then I tried to follow up with the breeder AGAIN. He flat out told me he will NEVER give me a dog NOR a refund. And I have a emails showing such. But yet I'm stuck with a $XXXX credit card bill (interest charged AND LATE FEES) because they backdated the charge and put it on my account.I don't know who is responsible-- XXXX or CapitalOne-- but I know I have buyer protection at the very least through the credit card. I purchased a good and never received it. Also- I don't know if this matters or not.. But I paid OFF my credit card and CLOSED the account with Capital One because I had an issue with them previously reporting incorrectly on my credit report... They reopened my account to add this charge even though I have a letter saying the account is closed with a XXXX balance.

Complaint: I filled a dispute with XXXX XXXX about this capital one account ending in #XXXX the account was previously deleted by XXXX XXXX and XXXX but was reinserted 2 weeks later after the dispute was already closed. XXXX XXXX assured me that they sent over proof that i have had my information compromised before and it was documented i talked to a representative at capital one by the name of mary and she said she would help me out after i sent over proof that i have experienced identity theft on my credit profile and for the record they already have a police report and affidavit that was forwarded to them from XXXX XXXX but they still continue to report it on my credit report. I will attach the same documents to this complaint that i will be sending to capital one i will be sending these letters in the mail on XX/XX/2019 the letter will include proof of identity (drivers license social) Another notarized affidavit and police report and also an alert from XXXX XXXX sent to me on XX/XX/2019 saying it looks like my personal data may have been compromised once again. Also the account ending in #XXXX is extremely late which is affecting my score even more i have never been late on my two accounts that i have with capital one but they put a third account that belongs to someone else ruining my report .

Complaint: On XX/XX/2019, I went to use my Kohl's credit card at the store but it was declined. Then my mom went to use hers to pay for the purchase. Hers was also declined. A manager came over and stated the store declined it when we tried to use it in her presence. I had to use another card to make the purchase but was entirely mortified by the fact my card was denied. While I made the purchase with another card, I was told I had to call Kohl's to address the issue. When I spoke with Kohl's oon the phone, they said the computer automatically closed my account for inactivity. When I questioned who authorized it, I was told it was done automatically and no authorization was given. I questioned why I was not notified and was told they me they don't notify anyone when they cancel the account. So obviously their policy is to close accounts and embarrass customers at the time of purchase by telling them in front of customers that their cards are declined.

Complaint: I am forced to issue this complaint about Capital One as a matter of course due to their unwillingness to validly explain their case, and their continued and seeming willful obfuscations and continued emphasis on insisting that all their corporate actions are upstanding. This is a valid dispute, despite Capital One’s intimations to the contrary, on account of Capital One furnishing derogatory data damaging my credit and using the unconscionable tactic of pushing through some judgment, getting a clerk to sign off on it that shows up on my public record. Capital One, it seems, has chosen to ignore about half of my points in my last dispute. I’m assuming because they can’t answer those and haven’t been able to in the last two months they’ve had to answer them? Consumer protection laws were put into place to protect the consumer from the abusive practices that entities like Capital One and their agents are known to engage in and have a lengthy history of engaging in. Furthermore, It is not my responsibility to verify my data with Capital One in order to obtain the same hearsay documents (loan agreement without the terms of a contract, copies of bills of half the years the account was allegedly in existence). It is not my responsibility to verify this, it is Capital One’s responsibility to verify their accuracy when they are furnishing derogatory data and claiming to have a judgment. If, as Capital One states, they are not obligated to provide affidavits attesting to the accuracy of all the documents they sent in their last answer regarding their business records, then all they forwarded was hearsay documentation, regarding those two 200+ page PDF files with the bills from XXXX on. This is not a customer service complaint about a XXXX fee, or some other minor matter, this, and my prior complaints are complaints to the CFPB about Capital One’s egregious violations of the Unfair Deceptive Abusive Or Acts Or Practices (UDAAP). Yet they continue to “verify” the veracity of the data they furnish. Since Capital One states in their response to me that they don’t have to provide affidavits about attempts to “void a lawful debt you owe Capital One”, I will use the definition of the word, “verify” in its legal sense. As per XXXX XXXX XXXX, XXXX XXXX, Verification is “Confirmation of correctness, truth or authenticity by affidavit, oath or deposition.” By continuing to verify data and willfully refusing to work within the parameters of “lawful”, as Capital One phrases it, they are engaging in a fraudulent misrepresentation of the circumstance, a violation of the UDAAP. In my last complaint I referred to the court’s refusal to acknowledge my interrogatories of the facts of the judgment they allegedly entered against me. Sending a generic form showing the verdict doesn’t show the standing of the case. It doesn’t show how this court fulfilled the NYS civil procedure, in particular 3215 (f), particularly upon Capital One’s states refusal in their response that they have no need to submit affidavits. The court’s refusal to respond to my certified letters and Capital One’s continued forwarding of this statement that there was a judgment and lack of explanation as to how this clerk who signed off on this judgment didn’t commit a fraud on the court by not attesting to following the elements of state law in this matter. Capital One states in response to my last complaint that XXXX XXXX XXXX “followed all applicable laws and regulations in the handling of your account.” Well, I wasn’t quite expecting them to say they don’t follow those laws. Given their past track record, which I documented in my last dispute, their statement of following laws and regulations doesn’t hold much weight. I don’t need to communicated with XXXX XXXX XXXX. I have not entered into a contract with them nor have I consented into any agreement with them of any sort and have no interest in any business dealing with them, nor want them in possession of my personal identifying information, and as they are not furnishing derogatory data to the bureaus they are not my concern. They are merely agents of Capital One’s in this matter and it is Capital One that I am filing this complaint about. Also, as per the attached Affidavit of Service I closed in the response, the process server attests to having communicated with a “Mr. XXXX”, who allegedly was qualified to speak on whether I was a member of the military or not. The due diligence here wasn’t due diligence enough as there is no Mr. XXXX qualified to speak on my status in any way, shape or form. That affidavit should be voided on account of perjury. Capital One, in their response, and despite their claim that Capital One follows all laws and regulations, still has not addressed the point I raised in my last complaint that they violated the Fair Credit Reporting Act (FCRA) by never having notified me in the first place that they were placing derogatory data about me to the bureaus. My “request” for Capital One to cease furnishing derogatory information about me and their continued act of “verifying” said information without having establish a basis for verification in its legal definition, established by Capital One’s stated and willing refusal to submit any affidavits attesting to the accuracy of this data, is not a request. It is a demand, as Capital One continues to willfully contravene their own statement that they follow all laws and regulations. Furthermore, as I have no accounts with Capital One, I demand they remove all of the data they have in their possession on me. On account of the recent data breach of over 100 million customers, it is apparent that Capital One cannot guarantee and certainly appears to be incapable of guaranteeing the security and privacy of any information they possess. Their transgressions towards the consumer that I have documented here and in my prior complaints, combined with their disregard for safeguarding customer data make it clear that this is a company that consumer protection laws were created to safeguard the consumer against!
