Didn't receive enough information to verify debt
Complaint: In a letter dated XX/XX/2019 addressed to XXXX XXXX XXXX and sent to all three ( 3 ) Credit Bureaus, the following document was attached as Proof of Claim in connection with the following accounts : XXXX, XXXX.
In the responses from XXXX XXXX XXXX a summary of the accounts were sent and in the previous complaint to the CFPB ( Case # XXXX ) the document included the account and activities from the previous owner of the accounts but no documentation was included addressing the specific claim of XXXX XXXX XXXX 's rights to collect this debt. In the letter in response to CFPB, XXXX simply claim that " With the purchase of these accounts XXXX acquired all ownership rights, including the right to collect on these accounts and to report to the consumer reporting agencies ( known as " credit bureaus '' ), IF ELIGIBLE. '' The mere act of purchasing these accounts does not make XXXX ELIGIBLE to collect on these accounts. None of the following conditions have been satisfied : 1. XXXX MUST furnish a copy of any signed agreement debtor has made with debt collector, or other verifiable proof that debtor has a contractual obligation to pay debt collector.
2. XXXX MUST furnish a copy of the original promissory note/agreement redacting my social security number to prevent identify theft and state that your client named above is the holder in due course of the note agreement and will produce the original for my own and a judges inspection should there be a trial to contest these matters.
3. Produce the account and general ledger statement showing the full accounting of the alleged obligation that you are now attempting to collect.
4. Identify by name and address all persons, corporations, associations, or any other parties having an interest in legal proceedings regarding the alleged debt.
5. Verify as a third-party debt collector, you have not purchased evidence of the alleged debt and are proceeding with collection activity in the name of the original maker of the note.
6. Verify you know and understand that certain clauses in a contract of adhesion, such as a so-called forum selection clause, are unenforceable unless the party to whom the contract is extended could have rejected the clause without impunity.
7. Verify you know and understand that credit card contracts are a series of continuing offers to contract and as such are non-transferable.
8. Provide verification from the stated creditor that you are authorized to act for them.
9. Verify that you know and understand that contacting me again after receipt of this notice without providing procedurally proper validation of the debt constitutes the use of interstate communications in a scheme of fraud by advancing a writing, which you know is false with the intention that others rely on the written communication to their detriment a violation of United States Code TITLE 18 PART 1 CHAPTER 63 Sec. 1341.

Overdrafts and overdraft fees
Complaint: I have a checking account with Capital One. I was overdrawn for {$7.00} and wasn't notified that I was. I have gone to one of their locations to turn off the overdraft twice and still, nothing has changed. After being charged with many overdrafts fee 's of {$35.00} each day and not being able to receive a new debit card after it expired a month ago, I went to close my accounts with Capital One. Capital one banker was unable to close the account because of my negative balance. I would have no problem in giving {$7.00} to close the account, however, the fees that I didn't know about accrued to over {$140.00}. Capital One banker was able to remove {$70.00} worth of fee 's but was unable to remove the rest of the fee 's, therefore leaving me unable to close the account. With the current negative balance, they are still allowing charges to be placed. I am looking for all of the overdraft fee 's to be removed and to reverse all those additional charges, so I can close the account.

Problem with fees
Complaint: I made the payment to Capital One on XXXX the XXXX from my bank account and it was applied on XXXX the XXXX and I was charged a late fee of {$38.00} on XX/XX/XXXX. The fee was reversed as I called an complained as I am never late. I attempted to make a payment today XX/XX/19 and was advised that the payment was {$130.00} as opposed to the {$94.00} that should the payment since there was a credit of {$38.00}. Instead I was advised that the payment could not be lowered since the cycle had passed and the statement went out already after the credit for the late fee. This sound crazy as XXXX and makes no sense. The payment should not be increased by the {$38.00} if the fee was reversed no matter if the billing cycle has passed or not. This is absurd, interest can't and should not be charged on the balanced based on the late fee, so why would my payment be based on the reversed late fee?

Application denied
Complaint: I applied for a Kohls store credit card at the store on XX/XX/2019. There was a snafu in keying in annual income, so the store personnel had me repeat the application process, and told me the credit issuer would send me an email asking for annual income. We waited several minutes for the email, and it never came. I waited for either an inquiry from Kohls or the credit card itself thinking they may have obtained what they needed. They never came.
I received two denial letters Sat, XX/XX/2019, and called their customer service # on XX/XX/XXXX and XX/XX/XXXX. I was connected both times to their voicemail, and told to leave my contact information, and to expect a return call. I made these calls during business hours, and havent received a return call.
One denial letter states the reason Excessive Obligations in relation to income.
The other denial letter states reasons 1 ) Available credit on open revolving accounts is too low ; 2 ) No usable real estate account ; 3 ) Time since oldest revolving account opened is too recent ; 4 ) No retail revolving accounts with a valid credit amount.
Kohls letter states my credit score is XXXX. Kohls issues their credit cards through Capital One, N.A.
I have four credit cards ; the ones I use most frequently are a Venture Capital One Mastercard, currently with a balance of under {$50.00}, and an XXXX Mastercard, issued through XXXX, currently with a XXXX balance. I use the Capital One card frequently, and pay the balance as soon as I receive my merchandise, and have NEVER carried a balance over to the next billing cycle, nor have I paid any interest on a balance. I use the XXXX XXXX XXXX occasionally, and have never carried a balance to the next billing cycle, and have never paid interest on a balance. Im not certain how old these two accounts are, but Im sure its at least 1-2 years or longer. Ive had the same checking account for 35 years and have never bounced a check.
Our home and cars are paid for. My husband and I owe nothing to anyone.
Kohls claims they made their decision on information received from XXXX. I requested my XXXX report today.
I havent been able to resolve this since Kohls hasn't returned my calls. There is no option to wait on the line for the next available representative, as all other companies I deal with do.
Im concerned this issue will affect my credit score, and concerned that Kohls is not responsive to my requests to resolve the denial issues.

Complaint: Regarding Capital One Payment History The payment history that is reporting from Capital One Mortgage is incorrect.
Capital One transferred the mortgage to XXXX in XX/XX/XXXX.
Prior to the transfer a forbearance/modification with Capital One was in place to correct the payment history and clear the matter. The agreement with Capital One was in effect beginning XX/XX/XXXX.
The modification was initiated due to a National Disaster ( Louisiana XXXX Flood XXXX ).
We contacted Capital One in XX/XX/XXXX to request relief due to the flood. Capital One created a forbearance plan ( attached ), then they suggested we apply for a modification agreement to reduce payments and defer the payments missed during forebearance. We agreed and Capital One initiated the first Modification and said the history status would be cleared to show no late payments. We submitted the borrower assistance packet in XX/XX/XXXX, and months later Capital One denied the application. They kept calling telling us to refile the application, new rules were in place. So, we filed again and it took over a year to come to a conclusion of the agreement. The agreement was effective XX/XX/XXXX. The modification terms were finally set in place and the agreement was to make three modified payments for XXXX, XXXX and XXXX. They told us that even though the previous payments were reporting late, once the modification was completed, all of that would be cleared.
The first two payments ( XXXX and XX/XX/XXXX ) were made by us as agreed, then the loan transferred to XXXX/XXXX. We called Capital One and XXXX to find out what we should do and were told that in order to complete the agreement, to send the last payment to XXXX and they would comply with the agreement. So, we completed the agreement by paying the last payment ( XX/XX/XXXX ) to XXXX.
However, Capital One did not hold up their end of the agreement. We contacted Capital One several times to clear the matter up, but we were told that all files were transferred and they did not have any record/evidence of the modification.
This matter should be cleared up immediately and our history and payments corrected as promised by Capital One.
Also, the status says 90 days late, but no payments were ever 90 days late. I have all of my bank statements with payment history.
Please let me know if I can supply any further documentation.
Our credit file history has been incorrectly tainted for well over a year, and as a result we have had to pay higher interest rates for loans obtained.
Please provide a status update to me within 15 days.

Complaint: In XX/XX/XXXX, due to continuing problems with fraudulent attempts to obtain credit using my name and social security number, I froze my credit at all three credit bureaus. On XX/XX/XXXX I received a letter from XXXX XXXX XXXX XXXX, a debt collection agency, claiming I owed them {$630.00} for a transaction using a debit card at XXXX XXXX XXXX, where I have never been. When I called them, they informed me that the transaction used a Capital One debit card. I then called Capital One and was informed that they had opened an account using my social security number and the name " XXXX XXXX '' ( I am XXXX XXXX ), but they could not explain why this account was opened despite the credit freezes in place, nor would they tell me which of the credit bureaus had given them the approval to do so.

Complaint: I have been a CapitalOne cardholder for over a year, paying on said card perfectly. In fact, the bank has increased my limit ( at no request from me ) more than once due to my perfect payment history. In XXXX 2019, I was the victim of identify theft for which cards were fraudulently applied in my name at XXXX, CapitalOne, XXXX, etc. I have placed fraud alerts on with all three bureaus. On XX/XX/XXXX, I received a letter from CapitalOne stating my existing card had been closed with NO explanation. I immediately called to inquire as to why as I had paid perfectly. I was told it was due to returned payments, which was false as I know my payment history, and then told that a Secured Card had been opened fraudulently in my name ; therefore, they closed my existing card as well as a precautionary measure. I was told at that time by XXXX, a Fraud Dispute Manager, that my card would be re-opened and that I would receive a letter within ten days confirming the re-opening. She also indicated the Secured Card would be marked as fraud so that my credit would not be affected in any way. After hearing nothing for more than ten days, I called Customer Service on XX/XX/XXXX. After nearly an hour on the phone explaining the issue to the rep and hold time while he researched, the call was disconnected and no one had the professional courtesy to call me back. I called later that same day and spoke with a Fraud Dispute Manager named XXXX. I explained, yet again, the issue that my card had been closed and that I needed access to my card as I was leaving the country in less than a week for vacation. She assured me she would look into why it had not already been re-opened and that she would personally follow up on the issue within a few days. On XX/XX/XXXX, I called again and spoke with XXXX, another Fraud Dispute Manager. She indicated she would update the reason code to reflect fraud on the Secured Card that was opened in my name and confirmed that a re-open request was submitted on XX/XX/XXXX. Im unsure as to why she could only see one re-open request being that I called back in XXXX. XXXX advised she would submit another request to re-open my existing card but that she wasnt sure it would be opened again. I explained it is not right that my card hasnt already been re-opened due to the fraud that was out of my control. On XX/XX/XXXX, having heard nothing further, I called and spoke with a gentleman whose name was unclear when he picked up the call. He was another Fraud Dispute Manager. After explaining my issue and continued frustration, the call was disconnected at about 17 minutes into the call. I waited a few minutes and he did not call me back to resolve my problem despite verifying my cell was a good call back number. I called back and XXXX, a Fraud Dispute Manager, took my call which totaled about 35 minutes ( employee ID XXXX ). After much research, she indicated she identified the hiccup and that the Secured Card was never actually closed as fraudulent ; therefore, the re-open requests had been ignored. She stated she would personally have it updated to close as fraud, and that she would personally follow up with me within 7-10 days. She believes my card will be re-opened 7-10 days after that. CapitalOnes supposed Customer Service needs an overhaul. When a call is disconnected, the rep should have the professional decency and the ability to make an outgoing call ( one rep informed me they didnt have access to outgoing lines ). No one has taken ownership of the issue despite repeated promises to me over the phone. I have spent several hours on the phone trying desperately to resolve this issue and I am fearful that the closure of my existing card is steadily affecting my credit score. I am in the process of buying a home, and if this affects my credit score, I will have no choice but to file suit against CapitalOne for my damages. I have attempted to send a letter but no where can I find a dispute resolution or complaint department on their website.
