Complaint: XXXX client, XXXX XXXX is a victim of identity theft. She was notified by Capital One of a fraudulent application submitted with her information without her consent. An inquiry was made into her XXXX, XXXX and XXXX credit report related to that application XX/XX/2018. A formal dispute of that application was then provided to Capital One to have that inquiry removed. Rather the read the information provided Capital One named the fraud investigator to a non-existing account. Capital One has done this same activity several times in the past and this continues to put the information of our clients and the public in danger. Capital One is in violation of the FCRA and my clients consumer rights.

I feel like that they are discriminating me because my credit was stolen buy it is fixed now. I have other cards and they have no problem lending me money but this bank messed my credit up because I did not know about hard Inquiries and Im trying to buy a house and Im homeless because I feel Capital one and XXXX XXXX are discimating me for someone opened account under the cards the off that was not me .I have almost 30 Inquiries from both of them. I meet all the qualifications and I know people that have worst credit than mine are getting an account.

Complaint: In XXXX I certified mailed a dispute letter to Capital One Auto Finance to dispute a account that was showing up on my credit report. I have attached my initial letter, the copies of the signature card information from where their company had signed for my letter dictating all that I was disputing, and began the clock of 30 days to place disputed remarks of my dispute on my credit reports. The only response I got was from them mailing a copy of statements. There are many violations that I will be submitting in a court of law, as well as laws that the company broke in not upholding the standards set before them from the FCRA, and the FDCPA. I have pulled my credit from all 3 credit bureaus and have attached the proof for you to examine that the credit reports are time stamped 31 days after they signed for my letters, and one of the major violations they totally neglected to do is mark my account as disputed on my report, and/ respond with court approved documentation within the time frame with verifyible documents that would hold up in court that the debt was in fact my debt. I demand that they remove the debt reporting to my credit report immediately, and that you as well as the attorneys general offices, and XXXX hold them accountable for the noncompliance of these said violations and laws that have been broken. I want it removed, and it is my rights. My letter clearly explained what I would do if they did not respond accordingly. I have a well documented case and have all intentions of taking care of it legally if they do not comply.

Complaint: In XXXX of 2018 I applied for the XXXX card with Capital One Bank, they approved my card but told me that my credit score was XXXX, I checked my credit report at XXXX as they suggested and it shows my credit score is XXXX with XXXX, XXXX with XXXX, and XXXX with XXXX. Capital One Bank told me that my APR would be 23.99 % because of the XXXX credit score they made up instead of 13 they advertised for people with excellent credit score. I believe that Capital One lied about my credit score just to give me a higher rate on my credit card. I called them to try to resolve this issue after I received my actual credit report but they said that they were not able to lower my rate. After I told them that I would like to close my account they told me that I would never be able to open an account with them again. All of their customer service reps were polite and professional at all times.
