Complaint: Capital Bank has reported me on 2 closed accounts opened 8 years ago that do NOT belong to me ; I would have been XXXX years old when these accounts were opened. The closed accounts have negatively impacted my credit score and my ability to maintain a good credit score. I have repeatedly called Capital one to remove my name and information from these closed accounts but my attempts failed. I ask that Capital one remove my association with these cards immediately. The accounts are closed accounts on my credit report, please have them REMOVE from my credit report as they do NOT belong to me and opened by someone else when I was XXXX years old.

Problem with fees
Complaint: I called Capital One to see if they have a valued customer credit for the annual fee since we are in the holiday season. The representative advised that there is nothing available. Several years ago I had an issue with the annual fee with one of my other Capital One cards and a supervisor advised that they can switch my card to a Quick Silver card in which it does not have an annual fee. I am wondering why this associate could not suggest another Capital One card that does not have an annual fee. I asked if there was another card that Capital One can offer which does not carry the late fee. The associate finally did provide a solution to transition into Venture One card which does not carry an annual fee. This was done however In feel that Capital One should adjust this annual fee since I have been a loyal customer for many years and I have many accounts with Capital One.

Complaint: I was looking to get a scooter with the cash I had on hand somehow I ended up with a motorcycle with a {$10000.00} price tag. The sales person got a credit line of {$10000.00} for me from the bank. the bank was capital one and XXXX XXXX. I know it was my fault, to begin with, to trust these guys, I didn't realize until I realize that I have to make the monthly payment on a motorcycle that is not even suitable for me. So I contacted the bank and asked them to take the motorcycle away and to settle the account. I tried over and over again but they never showed up to pick up the bike. I had cash {$3000.00} when I first started looking for a scooter but at the end, I ended up with a {$10000.00} debt. I even asked them to let me sale the vehicle to someone, but they will not release the lien.

Complaint: today is XX/XX/XXXX of 2018 i got an email that there is a change on my credit report.
Im trying now to pay my credit cards so my credit score will go up.Any way i sign in to the report and i see that was an inquire under my name and social security.
I suspect for long time that my credit score is low .cause im always paying my credit cards on time .The reason i thought is law, my husband had an XXXX card and he got for me also a card .Ans he straggle paying it and XXXX close his account and it react his credit.
but this morning when i got that email i got really scared .a few weeks ago someone used also my debit card but since i check my online banking everyday immediately i called my contact at the bank and they issue for me a new card.

Problem using a debit or ATM card
Complaint: On XX/XX/18 Capital One 360 allowed an online unauthorized debit card payment to XXXX in the amount of {$2400.00}, overdrafting a checking account that was not opted in for any overdraft agreement between myself and CapitalOne360. I disputed the item as fraudulent and was given the disputed amount back on XX/XX/18. On XX/XX/18 CapitalOne360 reversed the credit again unlawfully overdrawing the checking account to {$2400.00}. On XX/XX/18 I disputed the unauthorized amount again as fraudulent and was told I may or may not be allowed to dispute a second time. I inquired about my having never opted in to overdrafts on the account in the first place and the representative would not appropriately answer my questions and only preferred to confuse the situation by not looking back to the original overdraft date of XX/XX/18. This overdraft was not only fraudulent but was unlawfully taken on an account not secured by overdraft protection agreement and also surpassed the daily threshold amount on ACH payments regarding online debit payments for a simple checking account without any regard for contract or statutory legal limitations.

Told you not to respond to a lawsuit they filed against you
Complaint: Some time in XX/XX/XXXX, or somewhere close to that year, these two men a XXXX one and a XXXX one came to me and told me that they were going to put a lien on my house after they asked me if I had a house. I told them that I was not paying the debt because I had no income or job. They had me to sign something to which he told me that they would place a lien on my house if I did not pay the debt when I got a job. In XX/XX/XXXX, I got a job and was working on paying some people that I had borrowed money from and was going to add the law suit in as soon as I could. However, without contacting me that had a Sheriff to serve a garnishment at my job to embarrass me. They set an amount without notifying me of {$310.00} or something like that. I went to the court to file a slow payment because of these people continued viciousness I don't know what to do. Since I filed to pay {$20.00} a month I have done just that and on Friday, XX/XX/XXXX, some lady called and asked to speak with me and started asking for my social security number and date of birth and address and I would not give it to her. I asked her what did she want with me and she needed to verify the call or she would have to disconnect the call. We did this back and forth twice and I told her I was not giving her any info I didn't know her or why she was calling me. I then disconnected the call. She stated she was representing XXXX and XXXX and phoned me from XXXX. I am paying the garnishment to Capital One via the Collection Agency and they should not be contacting me.

I called Capital One twice on XX/XX/XXXX which over 60 days from my last deposit to find out why I have not received my {$500.00} savings bonus.
Both reps claimed that I needed a balance of {$50000.00} or one deposit of {$50000.00}. That is not in terms I agreed to. There is nothing in the terms about having a balance of any amount besides earning 2 % on {$10000.00} or more. Also, there is no clear indication that only one deposit worth {$50000.00} would qualify for the bonus. Especially when most banks do not allow that much to be deposited to an external account on one transfer without fees and paperwork. They refused to credit my account {$500.00}.
Capital One is trying to pull a fast one by changing their terms to fit their needs while trying to make money off consumers.

Complaint: I have two complaints : ( 1 ) Deceptive advertising ( 2 ) Capital One is refusing to let me know what my balance is and debiting from a checking account I do not authorize.
1.Capital One conducts periodic account reviews. XX/XX/2018, is my twenty forth month of on-time payments. As a result, Capital One increased my credit limit automatically ; I did not ask for a limit increase. However, Capital One informed my card is restricted and it can not be used until all of my authorized users mail a copy of their drivers license and social security card.
I currently dont have any authorized users and believe this is cumbersome because I use to have 7 authorized users a few months ago ( I requested to have my authorized users removed in XX/XX/2018 ). The representative said I still need to have my authorized users verify their identity because they want to make sure they consented because it affects their credit. The agent further said its mentioned in my card holders terms and condition insert.
However, Capital Ones website promotes the use of authorized users and has an entire page dedicated to the promotion. Their websites states : ( highlighted in relevant part ) Together, you can maximize your cards benefits.
What is an authorized user? An authorized user is someone you add to your account without any additional application or credit check. They'll get a card with their name on it and share your line of credit. As the primary cardholder, you'll still be responsible for all charges and, if you have a rewards card, you'll earn on every dollar they spend.
Ready to add someone to your account? It only takes about a minute : Tell us their name, phone number, Social Security number, and date of birth. Double check the info is correct. Thats it! Well send you a card for them to start using right away.
Also, I read the totality of their online terms and conditions, additional disclosures, and Patriot Act Certification. The word authorized user is not mentioned in all three online disclosures ( press Ctrl+F to search by key word ).
I believe this is deceptive advertising. Under the Federal Trade Commission Act : Advertising must be truthful and non-deceptive ; Advertising must have evidence to back up their claims ; and Advertising can not be unfair.
According to the FTCs Deception Policy Statement, an ad is deceptive if it contains a statement- or omits information- that : Is likely to mislead consumers acting reasonably under the circumstances ; and Is material- that is, important to a consumers decision to buy or use the product.
Capital Ones website is misleading because they omit information that is vital and relevant to authorized users. I was lead to believe adding authorized users only takes a minute and is easy as 1,2,3 as their website promises. And this was the case at first, until now, I need to have 7 of my previous authorized users photocopy and mail their drivers license and social security card to a company they don't conduct business with and do not feel comfortable sending in copies of their personally identifying information in an era of the XX/XX/XXXX, XXXX, and XXXX XXXX XXXX breaches and fraudulent activity conducted by XXXX XXXX employees ( opening accounts in customers names without their consent or knowledge. ) If Capital One placed a disclosure on their website or on their online terms and conditions then this would be fair, however, this was never informed to me until after the fact.
Second complaint : 2. I called Capital One on innumerable occasions, and they are refusing to tell me my current balance. It is relevant to know my account balance in order to make a proper payment. Capital One is also refusing to confirm payments I recently made. I need to know what payments posted in order to know my new balance. I want to make my payment in full but I am not able to do so because they are refusing to let me know my balance.
Also, a manager names XXXX, gave me an erroneous balance ( on XX/XX/2018 ). He told me my balance was {$470.00} which is not possible. My balance was around {$500.00} the month before, however, I made two payments for the month of XXXX ; first payment for {$35.00} and second payment in the amount {$100.00}. I have not made any new purchases and do not have any recurring charges with any merchants. It is improper for a financial institution to refuse to let the consumer know their account balance. I have a right to know in order to make payment.
Also, I called Capital One on XX/XX/2018. I informed the manager I became aware Capital One debited my XXXX XXXX checking account on my due date ( XX/XX/2018 ) for {$35.00}. However, I already made a payment for my XX/XX/XXXX billing cycle for {$130.00}. My minimum due is {$25.00}. There's no reason to debit my checking account when I made two manual payments over the phone using my XXXX XXXX account. I told the manager I no longer consent to any autonomic bill payments from my XXXX XXXX account. The manager egregiously said he can not do anything about that. This is clearly illegal.
Please be advised, I had this account for two years and never had a late payment or missed payment. I am considering filing suit.

Complaint: As of XX/XX/2018, I have made 4 payments totaling {$750.00} to XXXX XXXX XXXX XXXX XXXX, however none of them have been credited to my account. They have all been paid through Capital One Bill Pay and Capital One shows that all payments have been processed ( Exhibit A ) and cashed ( Exhibit B ). However, XXXX XXXX shows they have not received any payments since XX/XX/2018 the last payment they show was in the amount of {$280.00} ( Exhibit C ). I have received a delinquency letter ( Exhibit D ) and have been charged at least one late charge ( Exhibit E ). I do not want XXXX XXXX to report my account delinquent to the credit reporting agencies.
As soon as I noticed this problem, I contacted Open Sky on XX/XX/2018 and spoke to XXXX ( around XXXX XXXX EST ). She took down my phone number in case we were cut off. She said she would have to start an investigation and she put me on hold for so long we were either disconnected or she hung up. She made no effort to call me back. From the absolute void of information from XXXX XXXX since then, it looks like she made no effort to launch the investigation either.
To date I have not received any notices from XXXX XXXX about the investigation, not to mention over Seven hundred dollars of my money missing. In short, I do not believe XXXX started any investigation and I find that criminal in light of the credit problems and monetary losses that are clearly foreseeable. The payments are as follows : XX/XX/XXXX {$100.00} XX/XX/XXXX {$100.00} XX/XX/XXXX {$250.00} XX/XX/XXXX {$300.00} Unfortunately, I have so often found myself in the position of being told lies, incorrect information, etc. it has become necessary to file complaints with the CFPB just to get someone in authority interested the problem I do not want to find late payments have been reported to the credit reporting agencies, and I am apparently the only one who is trying to find a solution to my missing money.
I have filed this complaint against both XXXX XXXX and Capital One in the event Capital has not remitted the payments to the correct account. Something is wrong and it appears the answer lies in one of the two Defendants.

Complaint: My husband was contacted by a company by the name of XXXX on XX/XX/XXXX. He did not go into a detailed conversation with the person because the person was asking for me under my maiden name. My husband then forwarded the callers information to me, along with a case number. I then called the number back ( XXXX ), selected the appropriate prompts and gave my account number to an XXXX XXXX. Mr. XXXX then proceeded to tell me that I owed a debt of {$800.00} to household/XXXX/XXXX under my maiden name. He advised that the XXXX account was opened in XXXX and that numerous attempts were made to get in contact with me regarding the debt. He advised that XXXX is a litigation firm and that an action was being prepared to file against me.
I told Mr. XXXX that I was not aware of the debt and could he give me more information, such as an exact date that the account was opened, when the account went into collections, etc. He could not give me exact dates on anything. He then proceeded to tell me the car that I was driving in XXXX and listed several of my family members that I listed as references when I opened the account. This is when red flags went up, because I would have never listed those sources as references for something like a loan.
As such, I continued the conversation with Mr. XXXX. I asked what my options were and he said that we could settle or that I could dispute the claim in court. I then asked him to send me a document stating the nature and details of the debt and a link to pay the settlement. He told me that he would but then advised that they were not set up to take online payments. We ended the call, but I still could not remember this debt.
After receiving some sort of document to sign from a docusign company, I called XXXX back and again received Mr. XXXX on the line. I asked him for more details such as the full account number, XXXX debt collection license number, XXXX mailing address and the exact date of the debt. He could not give me any of this information and became very defensive. He told me that I can, " do two things with the information that he provided ; Take the information and pay the debt or take the information and go to court. '' I then advised that I was trying to gather as much information as I could in order to make sure that XXXX is, in fact, a reliable debt collection/litigation firm. We then ended the call and I proceeded to call XXXX to find out more about this debt.
XXXX could not give me any information because they did not have any record of the debt. They then referred me to Capital One who acquired Household/XXXX XXXX. After speaking to two representatives at Capital One, it was determined that no such account ever existed. I have not been in touch with XXXX since. However, I received a call and an email today ( XX/XX/XXXX ) from XXXX XXXX XXXX regarding the same account, but the amount requested was different. XXXX sent over a document with the amount owed and the original creditor, but that was all of the information that would have been helpful to me.
I then called and spoke with a representative who was not able to give me much information either. She said the account was opened in XXXX and payments stopped in XXXX. She then got testy and said she was trying to help me with this matter and that she can simply not the file that I refuse to pay and send the matter to court. I advised her to go ahead and note the file because I would not be paying anything until they could provide me with more details of this debt.
