Complaint: On approoximately XX/XX/18 I received a mailing offering me the opportunity to apply for a Capital One Quicksilver Card. I navigated to the capital one website and discovered there was also a promotion promising a XXXX credit if I am approved for the card and spend XXXX on the card within 3 months. The conditions indicated to qualify I must click apply now on the site. I clicked apply now was approved and spent the required amount within the required timeframe. When I called about my promised credit I was told I didnt qualify for the offer. First I was told it was because I have other products with capital one. When I advised this was my first quicksilver account and the site does not state that I do not qualify if I have other capital one products just if I had an existing account. I advised that because I didnt have an existing quicksilver account I should still qualify. Then the representative changed their tactic and claimed I did not qualify because I had entered in the offer code indicated on the mailing I received. I again explained that nowhere on the site does it state that I could not qualify if I input the offer reservation number. Capital one has still refused to grant the promised credit. They did not clearly disclose that I could not use the pre qualification or that having another capital one product would disqualify me from the offer. This appears to be a situation where the company has advertised two offers and no clear easily understood indication that the consumer is not eligible for one or the other. Bait and switch.

Complaint: My issue pertains to a recent interest charge from Captial One. As of XX/XX/, the balance on my account was for {$510.00}. This amount, which included interest on that amount of {$11.00}, was paid in full on the payment due date ofXX/XX/2019. My credit card balance was {$0.00} until this morning, XX/XX/, when I checked my account on my phone and saw that I had been charged another interest charge of {$11.00}. The only description on Captial One 's app of the interest charge was for " purchases made on XX/XX/2019'', of which there were none and, as of the writing of this complaint, remains as such. I called Capital One for an explanation and all the representative told me was that this interest charge " was for previous account balances from XXXX and XXXX ''. Obviously, this explanation was not satisfactory and I'm quite dumbfounded as to how I can be retroactively charged interest on a balance that was already paid in full, and which I was lead to believe, according to their billing statements, included any and all interest charges accrued. I will not allow Capital One to hoodwink me into paying interest charges that they know are completely and utterly fraudulent.

Complaint: I went to make an urgent deposit into my Capital One account at an ATM in the XXXX store at XXXX XXXX XXXX, XXXX, MA XXXX in XX/XX/19 at XXXX because I needed this money to be available to cover a debt on the same day, but the machine swallowed my deposit of {$570.00} and returned me {$30.00} saying they were kneaded and simply after that it shut itself down by restarting the system without completing the deposit in my account and giving me any receipt. I contacted Capital One but the same just said that I could just open a claim and wait for at least 7 days for the answer being that I needed my money right away and being that it was a problem even filmed by the cameras from their machine shop.

Complaint: I have multiple accounts with Capital One, including a business checking & savings account for one of my businesses. I attempted consolidating one of my external business accounts by opening a second business savings @ Capital One. Unbeknownst to me & without any notice, Capital One froze my business accounts simply due to requesting to open a savings account online ( which is the same way that our accounts were initially setup ). I found out about this only by calling into XXXX XXXX Cust Serv. after my business debit card was declined. During this time, I literally had no access to even see my accounts online & couldnt even see my account balances. Upon speaking with Capital One, I asked to speak with an exec level supervisor or manager to confirm whether or not our ACH deposits and payments would still be processed in spite of the temp frozen account status ; The Manager/Supervisor EMPHATICALLY confirmed MULTIPLE times that all ACH payments & deposits wouldnt be effected by this status and that they would FOR SURE still be processed per usual. Therefore, I didnt have a reason to make other arrangements for our outgoing payments and inbound deposits. However, I was given false information by the aforementioned manager & all of our deposits & payments were rejected. Consequently, our largest personal loan account was reported as being 30 days late, we lost a premium domain potentially worth several thousands of dollars, our business was ( and still is ) reported to XXXX ( which has caused several rejected ACH payment fees ) - and all of this due to this payment not going through, in spite of being given a definitive guarantee that it would absolutely go through. Additionally, due to the 30 day late payment status, our loan account was now subject to several thousands of dollars in retroactive interest charges. I immediately contacted Capital One & they accepted responsibility for the error and guaranteed to compensate us for any losses due to their error and that they would do so in a timely manner. Unfortunately & to our continued detriment, Capital One didnt stand behind this guarantee/promise, in spite of us sending countless documentation supporting our losses. I sent countless emails to their executive office and to the general counsel, but didnt receive a response for almost 2 months at one point, at which time they offered us $ XXXX for a matter that has cost us far more up to this point and will ultimately end up costing in excess of $ 50- $ 60k +. Due to Capital Ones continued inaction, our loan account is now standing at 120 days past due with a balance of just over $ 12k and our credit has now crept just below 600 ( our scores have always been well over 700+ ). Further, two of our current creditors have significantly reduced our credit line ( 1. XXXX it XXXX - {$26000.00} reduced to {$10000.00} 2. XXXX XXXX of XXXX XXXX XXXX - {$7000.00} closed by creditor due to very recent and significant delinquency reported ). This is now creating problems for my business, as we used the XXXX XXXX for an on-file Card for our largest Equipment wholesaler and now we are maxed out, which caused our utilization % to balloon from 20-25 % to 80 % +. I have spoke to Capital Ones retained attorney through XXXX XXXX and have provided all supporting documentation, including info directly from our credit report & directly from XXXX, yet I am still being subjected to methodical delays and evasive tactics by Capital One, all while being subjected to what has been a snowball effect due to how long Capital One is taking to do what they promised they would do. I have consulted with our attorney and in order to simply begin the litigation process, we would be required to pay a $ XXXX retainer fee. I feel as if we are now being disrespected more and more each day that Capital One fails to make good on their promise of compensating for their admitted errors. Lastly, my wife is XXXX XXXX XXXX and this is adding stress that she shouldnt be subjected to during this important stage of her XXXX, yet Capital One has essentially implied that they could care less, which I can only assume is because they have no one to hold them accountable for mistakes that they openly and expressly admitted ( and did so in writing via a signed & notarized statement that I requested in an attempt to mitigate further losses ). I have requested additional information from their attorney and they continue to act as if they just dont care to hear my requests. I understand that there are likely hundreds of claims that are without any merit whatsoever and I have been consistently reminded of this by Capital Ones attorneys, but I have provided ample ( even excessive & certainly repititive ) documentation to substantiate my losses, unequivocally speaking. The ridiculous part about all of this is that it all stems from me requesting to do something as simple as opening a 2nd Savings Account and trying to bring an additional $ XXXX on deposit with their bank. We have absolutely ZERO culpability in this matter whatsoever, as we simply requested to open the aforementioned 2nd savings. Please provide assistance ASAP, as this has now been ongoing for nearly 7 months now. Thanks for any help youre able to offer - we greatly appreciate it. Complaint: A few months I sent a letter to XXXX XXXX stating I could pay my debt of {$270.00} for a lower amount of {$100.00}. The rep from XXXX informed me yes I could pay the debt for lessons it would be reported as such and they would also require debt be deleted from my credit file with all 3 major bureaus. I sent a check and a copy of the email that I received from XXXX which stated as such. They sent me a letter back k stating there are restrictions on the letter they did not agree with. I also looked on the website which they stated they would delete trade lines from credit reports for payment that may be less than in full. I sent them a personal check stating to pay off my debt and they sent the letter back. Why would such a company state they would take payment for less and a rep stated they would take less and on the website states the same thing. What kind of company does not follow what they post

Complaint: Yesterday on XX/XX/XXXX of 2018 capital one closed my credit card due to 3 return payments. After the first two retired payments in XXXX I called caplital one to see why the payments werent goin mg through. I talk to a supervisor she checked my account routing and transit number and made a suggestion that we check for accuracy on the number and it would be best to reset the account and routing number from my bank account. She then advised me to try the payment again and if it fails to call back. On XX/XX/XXXX I tried to make a payment of {$200.00} which also was returned. yesterday on XX/XX/XXXX I called Capital One to see what the issue was upon calling them I found out my account was restricted and then closed the same day. When I talk to the fraud department they said that my account was closed due to the THREE return payments and it was a violation of their policy .When I spoke to the supervisor from Capital One about the first to return payments she advised me to make another payment and if it returns to call capital One back I dont understand how my account was closed if I supervisor from Capital One are representative of Capital One advise me to make a third payment which led to the closure of my count I called capital One yesterday on XX/XX/XXXX to which they were not helpful at all they said that theres nothing they can do even though the supervisor from a previous phone call advise me to make a third transaction with my bank account. when I spoke to the supervisor from Capital One about the first to return payments she advised me to make another payment and if it returns to call capital one back I dont understand how my account was closed if I supervisor from Capital One are representative of capital one advised me to make a third payment which led to the closure of my account I called Capital One yesterday on XX/XX/XXXX to which they were not helpful at all they said that theres nothing they could do even though the supervisor from a previous phone call advise me to make a third transaction with my bank account

Complaint: Violation of the US Constitution 's Fifth and Fourteenth Amendment : I was not aware of any legal action against me from Capital One Bank prior to a shortage in pay on XX/XX/2019. After noticing my paycheck was minus several hundred dollars, I contacted my employer 's Human Resources Representative to see if they forgot to include my overtime pay. The Representative contacted payroll and then informed me of a GARNISHMENT they had received. I asked for an email copy of all records they had regarding this matter, went online to AZ Public Court Records, and then contacted the Superior/XXXX Justice Court to inquiry how this was possible. On XX/XX/2019, I called the Clerk of Courts and told them I had never been notified ( Served ) a summons, and wasn't aware of any legal action pending against me. The Clerk told me the Process Server 's ( XXXX XXXX ) told the court that I wouldn't open the door for him when he knocked, so Judge XXXX XXXX amended the the summons to where the process server could simply leave it on the door. I work nights and try to sleep during the day time with as much white-noise as possible. I do not get out of bed every time someone knocks on my door as this would be equivalent to someone working day shift being disturbed in the middle of the night ; from it being solicitors selling windshield replacements, newspapers, tamales, etc. The Clerk went on to say that she spoke with me directly about the pending court hearing and that I told her I needed to get back with her after checking some information. This NEVER happened! I go to the court once a month to pay a fine to the Clerk of XXXX Magistrate Court, a different Clerk in the same office.
