I did not receive any statements from you since XX/XX/XXXX 2. The government had informed you that my card was compromised 3. But you did not inform me.
4. You locked my online card account.
5. I can not access the card account online because I am still locked out 6. Someone had taken over my account and changed the address so the statements, I believe were sent to that address.
7. You were delinquent in your duty in not sending me the statements and above all for not informing me of the fact that my account was compromised and that you had locked my account.
Actions taken by me 1. In XX/XX/XXXX. I was made aware of past due payments by an e-mail and I immediately called Capital one and paid {$150.00} over the phone.
2. When I spoke to the person over the phone, I told them that I did not receive any statements and to please send them. She promised to do it but never did, and neither did she inform me that my account was compromised or had been in locket down.
3. I wanted the statements to make sure that all the charges were accurate.
4. If I had known about the fraudulent situation, I could have initiated action to get a new card.
5. On XX/XX/XXXX, I called Capital one and asked them again to send me the statements. They promised to do it but never sent it to me. Again, I assume it was sent to that fraudulent address. Even at that time you did not inform me of the fraudulent situation.
6. On XX/XX/XXXX I got an e-mail advising me of the past due amounts. I immediately called and paid it the past due sum over the phone. It was only on this occasion I was told that the account was under lock because of a fraudulent situation.
7. I then got the address changed back to the correct address. I then requested statements which I received on XX/XX/XXXX 8. On XX/XX/XXXX, I I spoke to XXXX ID XXXX and requested a refund. He said it is my responsibility.
9. I am still locked out online Considering the above, I am requesting that you refund all past dues fees as shown above, because you were negligent in ; a. Not sending my statements b. Not informing of the fraudulent status of my account c. To continuing to lock me out of online.

Problem with fees
Complaint: This letter is in regards to my mother, who is a former Capital One credit card holder. She has give me power of attorney so I am authorized me to act on her behalf.
On XX/XX/XXXX, she called Capital One to pay off her balance and close her account. She was told she had to pay a {$21.00} fee to close the account, and she did so, paying a total of {$1100.00} over the phone.
She received a transaction statement for the period from XX/XX/XXXX to XX/XX/XXXX, acknowledging that payment and saying that Capital One owed her {$1.00}. Then another statement, for the period from XX/XX/XXXX to XX/XX/XXXX, claimed she owed {$30.00}. The following day, XX/XX/XXXX, I wrote to Capital One, explaining the situation and asking them to close her account and stop billing her.
A few weeks later, she received another bill. Finally, in mid XXXX, I called Capital One and was told that the first time my mother called, the customer service rep made a mistake and my mother had not been given the amount of interest owed. That interest was continued to grow each month. The customer service rep said that she would erase the interest from the account, and my mother would owe nothing. Last week she received another bill for {$88.00}.
I called again on today, XX/XX/XXXX. The rep on the phone had all of the information -- knew the entire history about the agreement to waive the interest fees -- and said that the previous rep had not completed the update properly. She assured me that it would now be taken care of and that a XXXX balance would be reflected on the printed statement my mother receives within one or two billing cycles. Thats the part that makes me nervous because that is what I heard last month. She also said that the waiver of interest would not apply to future purchases or cash advances. However, the account was closed in XXXX, so there will no longer be any more transactionsonce they remove the {$88.00} interest payment from the account. My concern is that Capital One will keep charging interest on the interest it had charged before, in the hopes that my senior citizen mother will just give up and pay it.

Threatened to sue you for very old debt
Complaint: I was called from a blocked number on XX/XX/XXXX threatening that I would be served with " papers '' about a debt if I did not call in 24 hours. They left me a phone number of XXXX. They also called my mother 's home with the same threats against me. Leaving the phone number of XXXX. That number belonging to XXXX XXXX XXXX XXXX, XXXX.
On XX/XX/XXXX I answered the call from blocked number and spoke with XXXX XXXX. Mr. XXXX informed me that he is with the county, and he was to serve me with " papers ''. I asked Mr. XXXX to verify what county he was with, but he refused to give me that information, replying, " What does it matter? '' He then provided me with a phone number to call. When I called XXXX, I began speaking with a women that did not identify herself or her company. I asked her what their calls to me were regarding. She stated that I was being charged to attempt to " Defraud a Financial Institution '' and " Theft of Goods and Services ''. I asked her on what grounds, and she referenced a Capital One Card that had be paid and closed in XX/XX/XXXX. I informed the women that that account was paid and closed on that date, and referenced the case number in Missouri XXXX.
She responded that it did not matter and I was still being charged in XXXX XXXX County. Further search of Missouri XXXX shows no open cases again me. I asked her for verification of the debt, and she stated that I was sent something in XX/XX/XXXX, but they would not provide me with any evidence of the account or the mailing they allegedly sent.
She again warned me that I was being charged and I asked her to not contact me again.

Complaint: My complaint is about Capital One opening the Money Market Account and getting the Bonus.
The details are : Open a 360 Money Market account and deposit at least {$50000.00} between XXXX XXXX ET on XX/XX/XXXX, and XXXX XXXX. ET on XX/XX/XXXX, XXXX and entering the promotion code " OFFER500 '', then Capital One will deposit the {$500.00} bonus money into my account within 60 days after completing the above conditions.
At the beginning of XX/XX/XXXX, I contacted the bank for the {$500.00} bonus which should be paid by the end of XXXX and the manager told me I am not qualified for their promotion.
His reason is the total new money deposited into my MMA is less than {$50000.00} and I have a saving account with their bank before.
My answers to their concern are : 1. According to their requirement, the cumulative deposits should work on the similar bonuses, and my total deposited amounts are more than {$50000.00}. Meanwhile, the cumulative deposits are always working for Capital one other promotions and for their other clients.
2. The saving account I have was opened in XXXX with XXXX. After 10 years later, it was transferred into Capital One due to the business changes. I do not open any saving accounts with Capital One directly before.
Based on all the facts I presented, I think I am qualified for their requirements, and they should deposit {$500.00} into my MMA immediately.

Card was charged for something you did not purchase with the card
Complaint: In late XX/XX/2018 I was notified by Capital One of unlikely charges on my VISA card XXXX. I checked online. Replied immediately that eight were NOT mine, but were for activity on the east coast while I live in Oregon.
XX/XX/2018 Cap 1 sent a letter saying " you won't be liable for any unauthorized charges. '' A XX/XX/2018 Cap 1 letter said " We're happy to tell you that your fraud investigation with Capital One is now resolved .... As part of our {$0.00} fraud liability promise, you were not held responsible for any fraudulent charges. '' BUT XX/XX/XXXX Cap 1 wrote that XXXX XXXX did an investigation that found no fraud for two flights on XXXX XXXX, going DC-XXXX-XXXX, for {$50.00} and {$620.00}, so I should pay.
I sent a letter of protest to both persons in the Cap 1 fraud squad, pointing out that 1 ) I had the card always in my possession, even used it in XXXX XXXX OR the same day as one fraudulent charge was rung up on the east coast.
2 ) Never told anybody else the card number.
3 ) The only other person with the same name as mine I know is my son in XXXX.
They did not take the trouble to answer me, only let the billing go ahead.
I wrote in protest to the Cap 1 CEO. An aide sent me the same listing of charges deemed fraud and the two flights deemed not fraud, i.e., that I was to be responsible for east coast flights charged to that card despite the fact that I was always in XXXX XXXX OR. Cap 1 said " our research confirmed that the actions taken on your fraud investigation were correct. '' Whatever their " investigation '', it did not include even contacting me!
Consequently, I do not want to pay for a spree done by someone unknown to me and 3,000 miles from where I am.
