Complaint: On XX/XX/19 I spoke with XXXX at Capital One, who advised me of plans to bring all 3 of Capital One Accounts update. For the first credit card he advised me if I paid XXXX on XX/XX/19 and then another payment of XXXX on XX/XX/19, the remaining past due balance of XXXX would be waived. Then for the 2nd card I was advised I needed to make one single payment of XXXX on XX/XX/19 and the remaining past due balance of XXXX would be waived and for the last card. I was advised to make a single payment XXXX on XX/XX/19 then past due balance of XXXX would be waived. I asked XXXX multiple times if this information was correct and he assured me everything he was saying was accurate. I made all the following payments on the given dates, only to contact Capital One on XX/XX/19 and to be advised the information was incorrect or they had no idea, or the payments just made my account current and they would have to review the calls, As a Capital One card holder, I think their business practices are scrupulous and what makes it so bad it was on a recorded phone line and their reps should not give false information in order to get a customer to make a payment. On XX/XX/19 I spoke with a very condescending and rude rep by the name of XXXX XXXX, who first claimed the call was from XX/XX/19 then she placed me on hold and came back on the line and claimed the the rep didn't provide me this information, and I requested to speak with a Manager or someone else the rep refused.

Complaint: The last time I used this store card the balance due was {$1200.00} in XXXX, XXXX. By XX/XX/XXXX the total increased to {$5700.00}. I identified to the customer service agent that these were charges of identity theft and was laughed at. I obtained an attorney In XXXX, XXXX after numerous harassing phone calls were made to my cellphone daily as well as mailing letters requesting payment. On XX/XX/XXXX a letter was mailed to the company explaining that an attorney had been obtained and to stop all contact with me. Now I was informed that during the month of XXXX, XXXX my ex-wife was notified on her cellphone and letters were mailed to her new residence and she was never listed on the account.

Complaint: My complaint is against Capital One 's failure to resolve my account dispute in a fair and timely manner. I was clearly a victim of fraud that is potentially costing me over {$22000.00} This was an inheritance scam. A " friend '' had allegedly inherited some {$20.00} XXXX dollars. The amount was deposited into an account in the XXXX XXXXXXXX XXXX. I have a confirmation letter and will be happy to produce it on request. The money could not be released to her without the payment of attorney fees and bank fees. She did not have money for the fees so offered me a substantial part of the inheritance for helping her get the necessary money. The plan was that her " Banker '' friend would send money to me by making payments on my Capital One account. I would then send the funds to her by means of electronic money transfers or purchasing and mailing very desirable good that could be sold at a high profit, such as cell phones. Several such account payments were made to my account throughout the late summer and fall of XX/XX/XXXX but within a few days of them being credited to my account, Capital One would return the payments as " unauthorized '' and debit my account for any money spent before the payment was returned. At no point did Capital One issue any warning or express any concern over what I thought was a legitimate deal. I actually called and inquired about the returned payments in hopes of clearing up any problems that were experienced. I was told by Capital One that I should talk to the bank that was sending the money. Within days I received a letter from Capital One, dated XX/XX/XXXX that said my account had bee closed and that I owed a balance of {$21000.00}. The bill had included {$7500.00} for purchases after the first third-party payment was made to my account, {$1000.00} added after Capital One had increased my credit without my request or even consent and {$14000.00} for the returned payments. Capital One had been approving payments from my account virtually 3 times my credit limit! I called Capital One about the account. They had sent me nothing but a statement. I contacted my attorney and he immediately indicated that this was a common scam or fraud and that I should not be held accountable. I notified Capital One by e-mail and explained the general nature of the fraud and asked them to investigate. This was on or about mid XX/XX/XXXX. I had heard nothing from Capital One for two months, not eve a response to my attorneys letter. I phoned Capital One on XX/XX/XXXX and inquired about the progress of the investigation. I spoke to a lady in the Fraud department who told me that nobody wanted to touch it. After some minutes I was told that the investigation would be conduction by one of their most experienced investigators and it was hoped it would be concluded that night. It is XX/XX/XXXX and I still have not heard form Capital One. That is over 60 days since my phone discussion and about 6 months since I asked for an investigation.

Complaint: On XX/XX/2019, I received a letter from Capital One, stating they deactivated my old card due to due fraud on behalf. I was to be reimbursed for the fraudulent activity. I received a new credit card, not allowed to activate it. After weeks of sending proof of identity, they called my energy supplier to confirm my residency. I was then told Capital One closed my account because I missed a payment on my old card. I didn't have the card in my possession and was told I had a returned check payment. I tried to explain that the person that stole my wallet/phone had access to all my information.

Complaint: On Sunday, XX/XX/2019 a fraudulent charge appeared on my bank account as a debit card purchase in the amount of {$100.00} this charge appeared as " XXXX XXXX XXXX XXXX XXXX. This charge was a charge back initiated by someone that we sold some electronics to over 5 months ago. this is clearly fraud. Its my understanding that capital one has zero percent fraud liability for their debit cards, however when I attempted to contact them over this issue ( twice ) they seemed very unsympathetic to my case and could not help me, I needed this money desperately to buy my prescription medicine. This fraudulent charge has stolen {$100.00} from my bank account and I need this money back as soon as possible.

Complaint: There are two inquiries that were placed on my credit report on XX/XX/XXXX from KOHLS/CAPONE and on XX/XX/XXXX from CABELAS/XXXX, I sent the credit bureaus a dispute letter asking them to verify the inquiries because I did not authorize the company or anyone to submit any application. All that I received from XXXX and XXXX was a copy of the credit report saying that this company verified or validated these two inquiries. What I received from the credit bureaus is not enough to validate these inquiries. I received the copy of the credit report on XX/XX/XXXX, this applications were submitted fraudulently.

Complaint: On XXXX XXXX 2019, I noted three fraudulent transactions on my card. I immediately notified Capital One and they flagged all three and removed the transactions. On XXXX XXXX 2019, one of the charges reappeared, at XXXX for {$67.00}, dated for the XXXX now. I reported this one as well, and received assurance that it was a duplicate and would be removed/investigated with the others. On XXXX XXXX 2019, I received notice that the XXXX transaction was deemed legitimate, and the others would be kept off. I called to dispute this the same day and was told that it was seen as legitimate for being delivered to someone at an address I've never had, with the same last name as me. The address they were provided by XXXX, which the representative also gave me, is not one I've ever had anything to do with and the name on the purchase was clearly <firstname> <lastname-that-matches-the-stolen-info>. I was told the charge would be removed. Today, XXXX XXXX 2019, I was notified by a separate spending-tracking app that the charge was not removed or otherwise was reapplied to my account, dated XXXX XXXX 2019. Capital One is charging me for something I didn't buy because it was already delivered to the thief 's address.

You are not allowed to just claim something is verified and not provide the actual documentation and sworn affidavit of verification. Failure to do so is and NOT verified! Thats what the courts say, so I reject your claim of verification for this alleged account.
