Complaint: I am filling this complaint because I have submitted a modification packet since XXXX . I was told to keep submitted additional documents to make sure my loan continues the review. However when I called Wells Fargo to get an update I was told that I have a schedule sale date for XXXX XXXX , XXXX . I was shocked because I have never den ied Wells Fargo to reach out to me in case anything additional was needed. I am still willing to work wi th Wells Fargo. H owever today I spoke Agent XXXX id # XXXX . From the re-entry team XXXX stated that due to my active sale date . Wells Fargo i s refusing to review my modification packet even though it was submitted 30 days before my sale date. Therefore I had to involve my investor XXXX XXXX I open a case number- XXXX . Due to all the fraudulent and deceptive practices Wells Fargo is using in order to deny me any assistance. When I spoke to my investor I was advised by Agent XXXX there was no respond from my lender. I have the right as a home owner to be review for a modification. I have also advis ed Wells Fargo my husband income is enough to be provided an affordable mortgage payment. My husband and I have attended workshops for struggling home owner like ourselves and have created a stick budget to make sure we cut lots of unnecessary expenses to make sure we can present a surplus to Wells Fargo. Our intentions are to keep our house with an affordable mortgage payment.

Complaint: In XX/XX/XXXX I discovered that my credit report was showing a 30 day late payment fro m Wells Fargo Dealer Services from XX/XX/XXXX . I n XX/XX/XXXX I mai led in my monthly payment for the correct amount ( {$290.00} ) and ON TIME ( XX/XX/XXXX ). W hen I received my XX/XX/XXXX bill/statement, I discovered that my new bill was for {$410.00}. At that point I looked at my checking account and discovered that someone had incorrectly entered the XX/XX/XXXX check amount for {$190.00} instead of the amount the check was written for. I immediately called Wells Fargo Dealer Services. I explained to the customer service representative that I talked to what had happened and even asked them to look at their image of the check and they could see it was written for the correct amount. The person I spoke too acted as though it was n't a problem and told me just to mail in the next payment as usual, to which I did. The next payment was mailed i n on XX/XX/XXXX a nd for the amount of {$410.00}. At that point I never thought anything else about it, and only until I checked my credit did I discover that W ell 's Fargo had w rongly reported to the credit bureaus that I was 30 days late on my payment. <P/> After discovering this, I immediately filed a credit dispute with all XXXX credit bureaus as well as contacting Wells Fargo Dealer Services. I was told b y the Wells Fargo Customer Services Representative that I should fax a letter along with my supporting documents to their Credit Report Dispute Resolution Unit. I did exactly that, sending them a letter as well as a copy of both the XX/XX/XXXX and XX/XX/XXXX checks as well as the dates that both checks were pro cessed through my bank. This was faxed to them on XX/XX/XXXX . On XX/XX/XXXX I received a letter from t he Credit Dispute Resolution Unit ( Wells Fargo ) stati ng that they verified that the information submitted to the credit reporting agencies was accurate and asking that if I had any cancelled checks or other records I should sub mit to Wells Fargo. I HAD ALREADY PROVIDED THE CANCELLED CHECKS WITH PROCESSING DATES IN THE INITIAL COMPLAINT. I called Wells Fargo again, a nd asked to talk to someone in th e Credit Dispute Resolution Unit. I was told that they were correspondence only, and there w as no one I could actually talk too. I then asked to speak to a supervisor and apparently I have been put on another dispute resolution case. Each of the XXXX credit bureaus have apparently updated their information to show the payment amounts for XX/XX/XXXX and XX/XX/XXXX but the 30 day late payment has remained, apparently becaus e Wells Fargo has " verified '' their report.

Starting XXXX / XXXX / XXXX , Wells Fargo has been calling me trying to collect the debt, even after I informed them that this in illegal! Today, XXXX / XXXX / XXXX , someone named XXXX or XXXX ( he said it quickly ) called me on my cell. I immediately informed him that he was was not allowed to contact me about m y debt or at all via phone. He became angry and then threatened to sue me. He said, oh well, that 's okay, I 'll just contact our attorney.

As a result, account is being collected, late fee was imposed, and interest rate was increased. Customer was not notified of any problems. I received an email and a confirmation number stating the payment was made. I have previously used this account to make my payments to Wells Fargo. Previously i had never had any problem but it seems to be an attempt to scam customers. After calling Wells Fargo i was insulted by representatives. I was denied help, and communicated instead with Executive office at Wells Fargo.

SUBSEQUENTLY I RECEIVED A DENIAL NOTICE FROOM WELLS FARGO EVEN WITHOUT SENDING ALL DOCUMENTS. I ATTACHED MY APPEAL TO WELLS FARGO FRAUDULENT DENIAL IN THIS COMPLAINT. First, I was not reviewed for all loss mitigation options like HAMP tier 1 or tier 2, National mortgage relief settlement modification, all in-house modification programs and according to Supplemental Directive 16-02 attached. 2 . I appeal the proprietary fixed-rate modification denial Reason financial situation shows the ability to afford the payment.My hardship contains a change in circumstance which makes me eligible specifically reduction in hours. Based on my investor, My investor allows for modification with change in circumstance. My change is circumstance is evident with me starting a new position and reducing my income has made it very hard to get back on track. With my car payments, insurance, household expenses, maintenance, repairs, all play a part in the review for a modification. And the Obama program eliminated the debt to income ratio, when Government introduced HAMP in XXXX still effective until XXXX XXXX , XXXX , see attached Supplemental directive 16-02 3 . Attached is Supplemental directive 16-02, Which cl early states I am eligible for HAMP if I submitted 1 component of the loss mitigation application to Wells Fargo in which I submitted several, Wells Fargo has to allow me to enter into the Making Home Affordable program. They misplaced and lost so many of my mortgage assistance applications in XXXX . Because I submitted 1 component of the Loss mit application to Wells Fargo/ASC, this makes me eligible for HAMP tier 1 and or tier 2. I request a re-evaluation and acceptance into HAMP and or all loan modification programs available. ATTACHED IS Supplemental 16-02 and Supplemental directive 12-02. Everything is on file with Wells Fargo team, there is no other docs supporting this appeal. Complaint: mortgage payment increased without notice from approx $ XXXX to $ XXXX . I have automatic payment setup ; my account did not have enough to cover the {$570.00}. They called me stating that I owe {$570.00}. I did not know why it was {$570.00}. The caller did not know. therefore, I told the caller to research, call me back and I will pay if it is something I owe them. She did not call me back with the answer. I received another call again. eventually, someone was able to transfer me to someone who could help with the issue. I told the lady I never received a notice stating that my mortgage payment has increased. Change of mailing address was reported. She said someone from executive mortgage department will contact me. XXXX XXXX , mortgage officer, called me. I explained my issues. She said she will research and call me back. in the mean time, next month 's payment was coming due. I said I can not pay for something I do n't know what I am paying. XXXX XXXX called me back eventually and explained. I payed the two monthly payment I owed. However, I explained to her that I should not have been charged late fees and also that I was charged overdraft fee from the other bank. She said she will look into it. she asked me to fax her bank statement. I faxed it. few days later, when I called her, she was not in her office. Later someone else called me back. she said she will be working on my case. I also requested that late payment should not go on credit report since it is not my fault. I was never late with my payment before this incident. She said she will mail me some document where I can request not to go on my credit report. I never received it. During this time, many times I had to correct my address. they say it is incorrect in the system. It almost sounded like the person before typed it incorrectly. it happened several times. mortgage officer said I need to give her exact date when I initially requested change of mailing address. I do n't have those dates because I did not think I would need it. I feel that they do n't care about their mistakes. they are not willing to work with you. I paid both payment as soon as they explained to me why my payment has increased. late payment on my credit report will hurt my credit. I was charged late fees and overdraft fees due to wells fargo pulling {$570.00}. If I had known my payment has increased, I would have made sure there is enough money before they pull the mortgage payment. I was never late on my payments before this. This is very frustrating and disappointing. I feel helpless. They are big company and I am just a small person. I feel they do n't care. It is not fair. In future, I will never do business with them. This will be my last mortgage and last acct with wells fargo.

Complaint: Wells Fargo is sc amming clients with available balance discrepancies ( holding money ). Then charging " overdraft protection transfer '' fees. On XXXX I noticed I had a low balance on my checking account that would not be sufficient to cover my pending transactions. I moved everything that was visible to me on XXXX in my savings account back into my checking accoun t ( {$4.00} ). Thi s brought my balance up to cover all pending transactions. That night , Wells Fargo moved money back out of my checking account and posted it to my savings for " Save as You Go '' transfers for over the weekend transactions. This money was held and was not visible for me to transfer with the {$4.00} on the XXXX . I was n't aware these save as you go transfers were even pending. Because they moved ( posted ) this money late night of the XXXX after, this caused my checking account to drop below the amount needed to cover the pending transactions. Wells Fargo then charged me a fee of {$12.00} to move the money from my savings back into my checking to cover the pending transactions. So Wells Fargo held transactions from my Savings, moved the money on the night of the XXXX when I already had a low balance in my checking, which caused the balance to fall below what was needed to cover the pending transactions. They then charged a fee to move the money back to my checking that they JUST moved the same night to my savings. If Wells Fargo wo uld have left the money in my Checking account instead of transferring it to my savings, the balance would have been sufficient to cover the pending transactions and I would not have been charged an overdraft protection transfer fee. Wells Fargo s hould have some sort of " checks and balance '' in their programming that prevents their systems from moving money to savings accounts when the balance in the checking is just sufficient to cover pending transactions.

Complaint: Had a mortgage modification approximat ely three years ago with Wells Fargo, have been making my payments on time during this period but recently when I called them to discuss a new mortgage they told me the mortgage has never been re affirmed therfore it does n't appear on my fico score or with the credit bureau? And Wells Fargo s aid they ca n't talk to me about a new mortgage until this mortgage is re confirmed? They suggested I call my bankruptcy attorney and have him, repair this oversight? I have done this but have n't received a reply from my attorney? As I am doing this complaint at the same time I wrote a request to my attorney, how do I get this mortgage w ith Wells Fargo re affirmed so they will talk to me?

Complaint: On XXXX XXXX XXXX I traded my XXXX XXXX XXXX for a XXXX XXXX XXXX pursuant to an accident on XXXX XXXX XXXX . My wife did not like the old car after it was repaired and we opted for a newer different car. The XXXX dealer did not make the next timely payment nor payoff to the prior finance company ( WFDS ). I received a late notice and submitted a {$600.00} loan payment by telephone on XXXX XXXX XXXX . Subsequently I have tried to get my refund from WFDS who advises me they sent the payment on XXXX XXXX XXXX to my old address. On numerous occasions I notified WFDS by telephone that my new address is in XXXX , VA and not XXXX , VA. They are holding m e hostage to t heir procedures claiming that I have to sign and submit an affidavit that I did not receive the refund - in other words putting the burden on me for their inefficiencies. Plus to add insult to injury they did not send a postage paid return envelope. Based on the time value of money, WFDS is procrastinating refunding my overpayment plus an additional {$46.00} from the original payoff transaction. I contacted them in early XXXX XXXX when we moved into the new house so they would have the correct address. I also contacted them in XXXX , XXXX and XXXX . They claim not to have a record of the change of address until my follow-up complaint in XXXX . I have not seen their payment. I do n't have any idea where or if the payment was sent. I have no control over what they are doing with their procedures. I would also propose that a fair penalty to them would be 10 percent of the refund if they ever get it resolved.

Complaint: To whom this may concern, I am having significant trouble with the customer service of Wells Fargo & Company ("WFC") and having even more trouble with WFC recognizing my consumer rights. By way of background, WFC has been reporting a number of false records to my credit report, including but not limited to reporting my living address as XXXX XXXX XXXX XXXX as well as failing to report debts as in dispute - potentially in retaliation for me contacting the CFPB, OCC, and other regulators concerning illegal marketing practices of WFC. To follow up on my previous concerns, WFC claims that their current submissions to my credit report abide by the Fair Credit Reporting Act ("FCRA") but nothing could be further from the truth. Indeed, WFC has submitted different information concerning loans that look identical to different credit reporting agencies. The records and information submitted to XXXX and XXXX are not only not supported but also conflict with each other - raising serious concerns as to what information WFC is reporting on consumers and what process they use to verify that information. For my personal situation, XXXX reports that a WE EFC loan with an amount of XXXX was opened on XXXX XXXX XXXX . However, XXXX reports a similar, although not identical loan of XXXX wa s opened on XXXX XXXX XXXX . I would like to know, why WFC company is reporting similarly looking loans with conflicting information and produce a detailed report of how WFC reports "open dates" and what information is being reported to credit bureaus. I want to know if the information reported to credit bureaus is backed up with a written and valid consumer contract. As well as WFC to clarify whether these two accounts are referencing one loan or they are two different loans. The above instance of conflicting information is just one example, I would like WFC to clarify why for at least the past 3 years they have reported conflicting and different information to credit reports that do match associated consumer contracts. I have attached a number of screenshots for your review.

Can't get other flexible options for repaying your loan
Complaint: As of XXXX my student loan interest rate has been hiked up to XXXX %. They have increased my monthly payments, due to this interest increase, without any notification prior. I find it outrageous, and feel this bank should be ashamed of itself for charging a student loan such a large interest rate. In the years I have been making payments, I have not seen the amount owed decrease 1 cent ; in fact, it has increased by thousands of dollars. During a time of financial hardship in XXXX , I was unable to defer payments through Wells Fargo , they only allot 6 months of this and mine were used. Because of this I started to incur late fees that added up to a couple hundred dollars while I would work on trying to find a way to make a payment. I left so many messages asking for these late fees to be reduced for hardships and never heard back from a represe ntative. All of this is unreasonable to me, and I find a negative impact on myself, mostly financially but also personally with struggling to accommodate all my student debt ; it also potentially impacts my family in the respect that they cosigned the student loan.

Complaint: On XXXX XXXX , XXXX , I was contacted by Wells Fargo Bank, who I hav e my mortgage with about a Payment that I owe. I spoke with " XXXX '', he said I had an outstanding payment of {$1600.00}. I did not know what for but I complied and paid {$1200.00} by phone and the difference of {$430.00} would be paid with my next mortgage payment of {$540.00} bringing it to a total of {$970.00} which was paid on XXXX XXXX , XXXX . I made another payment of {$520.00} on XXXX XXXX , XXXX and then another payment of {$1000.00} for XXXX XXXX and XXXX XXXX XXXX payment. XXXX took this payment. On XXXX XXXX , XXXX , I spoke with a XXXX and she says she did change to back the loan to automatic withdrawal as this was how this account was set up from its inception. XXXX apparently did not do the automatic withdrawal and again in XXXX I receive a call from XXXX XXXX XXXX XXXX , XXXX . He took payment from me over the phone for {$2100.00} and says this was payment for XXXX XXXX , XXXX - XXXX XXXX , XXXX . He told me the next payment would be due XXXX XXXX , XXXX and that I have a grace period of 17 days before a late charge would be assessed. From then I have been going into the bank branch of Wells Fargo Bank to pay my mortgage payment twice a month and this same incident has started again and I need some help as they now want to foreclose on my house for {$4200.00} of which I can not get a proper explanation why do I owe this money. and I am still paying my payments in a timely manner. On XXXX XXXX , XXXX I spoke with XXXX employee # XXXX , he said he will generate a work order and in the mean time to continue to make payments in the banking center so as to stop the harassing phone calls I have been getting. He did not follow through as the calls continued. I then call again and spoke with XXXX ID # XXXX on XXXX XXXX , XXXX she advise to go in bank and bring as much proof of receipts of payments. I then spoke with XXXX XXXX . She will submit account history. I made a payment with her over the phone for {$440.00} confirmation # XXXX not sure if this was a partial payment or what. She sent me a payment history but that did not explain anything more to me. In the meantime I continue to pay my mortgage in the banking center. At this time I am exhausted and need some closure to this problem. Please help. Another thing to mention is they changed my ACH, my automatic withdrawal without my authorization.
