Complaint: In XXXX I had a XXXX , I contacted Wells Fargo f or a temporary payment plan while I was in recovery.As I called to make sure that I did not default on my mortgage I got different stories. The end result was to reapply for a loan modification.Then ASC was the servicer. I work in a resturant and have a 20 % investment in the job where I work. Wells Farg o/ASC req uested tax return from the XXXX where I work. I had to beg the owner to allow me to show the tax return from their business.Now after going through all of that the person that was working on my file was transferred and the new woman assigned said that they did not need it. If I sent Wells Farg o/ASC wha t they requested today in the next two days they would say the Underwriting was asking for this or that ..and then come to find out it never made it to Underwriting yet. Then there is re-entry and they told me that there is absolutely nothing that I can do to save my home from foreclosure. They said I have used all of my chances and they will not consider any help for me! I have saved money that I could pay a good faith down payment and go on trial payments toward a plan to save my home. They absolutely would not discuss it.

This is for both of my accounts checking and savings. I am not necessarily requesting that my account be re-opened or allowed to continue to use the Bank service, as I have already taken my business to your largest competitor and I am no longer in need of Wells Fargos services. <P/>I have previously requested a review/appeal of my case, which were denied. Ive been also charged for transferring available balance from my saving account to my checking account were they were opened and wrongfully posted deposits that were made in my saving accounts were reposted on my checking account preventing me from depositing my paycheck and continuing to use my own account.However a review of my account history for the last 5-year will reveal a very low claim rate as well misuse of my account. Ive been a Wells Fargo customer since XXXX, since where I first opened a college account in XXXX XXXX Nevada I havent misuse my Bank privileges or committed any kind of fraud. I feel that any reasonable person would conclude that closing my account, charging me fees, restricting me from using all features and being able to keep doing business with the Bank are excessive and my be viewed by some as punitive or as already stated, an unnecessary abuse of power and perhaps even contrary to the laws of some states. That being said I have no problem with, and agree to being charged the money used. <P/>Please be aware that replying with the standard this is part of the terms of service that you agreed to will not satisfy my request, or deter me from filing my complaints with the agencies listed above on the morning of Friday XX/XX/XXXX. Complaint: I opened several accounts wit h Wells Fargo afte r filing a Chapter XXXX Reorganization Plan. Every time, I deposit a check, they place unreasonable hold on my funds. Each time I deposit checks into my account, Wells Fargo has a different reasoning for placing a hold on my funds. If the check exceeds XXXX , there is a hold If the check exceeds {$5000.00}, there is a hold Meanwhile my funds are on hold, they are charging me overdraft fees for my automatic withdrawls. I do NOT think it is fair at all, they have my money and are holding it unreasonably. XXXX , from Pennsylvania and her Supervisor XXXX , no last names NOR employee numbers were available. They further went to explain how the Federal is HO LDING a portion of my check for Further Verification and Processing. They claim that Wells Fargo has N OT been given the funds even though the issuing bank has released all of the funds. This is troubling to me in that i paid over {$200.00} in Bank fees last month. Complaint: The complaint about treatment by Wells Fargo Home Preservation. I started working with the family in XX/XX/XXXX, XXXX XXXX asked me to contact his soon to be ex-wife XXXX, and assist her with the family home located at XXXX XXXX XXXX in XXXX CA XXXX. Either refinance, Loan modification, or something. The XXXX were getting a divorce, XXXX XXXX wanted XXXX XXXX to have the family home in XXXX, a grant deed was prepared, and recorded in the XXXX of XXXX records. I contacted the Wells Fargo Home Preservation team back in XX/XX/XXXX. I worked with XXXX XXXX, a Home Preservation Specialist at Wells Fargo Home Mortgage. An impasse was created during this time because of the pending divorce. Very little could be done until the dissolution of marriage was completed. ByXX/XX/XXXX an agreement for the dissolution of marriage was at hand. This allowed XXXX XXXX of Wells Fargo to request an appraisal and in XX/XX/XXXX an appraisal was prepared by XXXX XXXX of Wells Fargo Residential Valuation Services. It is interesting to note in part of a summary of value was $ XXXX. Yet on page 3 of her report the value of As-is value of site XXXXmprovements to be only $ XXXX. XXXX told me, the new loan amount would be the appraised value. When I looked at the document back in XX/XX/XXXX I only saw the XXXX number, but now in reflection I saw the XXXX number. So here is the question should the new loan amount be $ XXXX, XXXX, which is the amount stated in a letter dated XX/XX/XXXX by XXXX XXXX, or what the borrower got stuck for XXXX?? In that letter dated XX/XX/XXXX I personally reviewed all of the terms of the Loan Modification with XXXX under the Trial Period Plan What I believe is fair is XXXX + XXXX = XXXX. The XXXX represents the deferred amount. The interest rate as described in Section 2 of Loan Modification document seems fair. Including Section 3. The rest of the sections of the Loan Modification agreement were boiler plate issues. At this time we went from working with XXXX XXXX to a XXXX XXXX, this complicated matters. XXXX and I had no relationship. He was gruff, and did not care about our mutual client The XXXX. XXXX attitude was sign it or we will foreclose. He had sent the documents to the borrower directly and not to me. XXXX had said XXXX XXXX was not going to be on the documents. Yet when we received the documents XXXX XXXX name was in fact on them, but he did not need to sign them hmmmm something is not right. We asked XXXX he became evasive, going back to if you dont sign them we will foreclose. He would not allow us to ask questions. I talked it over to both XXXX XXXX and XXXX XXXX and I told them they ( Wells Fargo ) are now only giving us a loaf, but loaf is better than nothing. I instructed my client to sign, allow things to heal and we could go back and slay the dragon ( Wells ) later. And finally now of us work for free. My compensation was to be included I had expected to get paid for helping get this very complicated Loan Modification. I had hundreds of hours into this and I nothing, Zero, nada, zilch. I had hope to get paid 2 % of XXXX or about {$18000.00}. Heres what I think Wells Fargo needs to do. 1 Remove XXXX XXXX name from the mortgage. Since he is not on title and the divorce decree also states he does not to have any ownership, why is his name still on it? Especially since Wells Fargo change the loan number from XXXX to XXXX. He did not sign any of the paperwork, so why are you reporting that he is on the loan when in fact he has nothing to do with loan number XXXX? Only XXXX XXXX qualified for the Mortgage on the property not XXXX XXXX. 2. I want Wells Fargo to reduce the amount of the mortgage from XXXX to {$400000.00} as stated on the appraisal bought and paid for by Wells Fargo and prepared by a staff Appraiser of Wells Fargo. 3. I want Wells Fargo to give XXXX XXXX an Equity line of Credit in the amount of {$200000.00}. The house is original, the home from the day it was built back in XX/XX/XXXX and there is only 1 permit back XX/XX/XXXX for lighting for the tennis court. The home has not had any upgrades since it was built, now its falling apart, Its a fixer up of a mansion. 4. I need to get paid, Ive been at this for the past 5 years {$18000.00} and counting. All of the other terms of the Loan Modification will remain the same.

Complaint: From XXXX We have a working relationship now. However, I was asked to file this report. Wells Fargo kept charging me {$30.00} a month for each business account when it was supposed to be free. The accounts were opened in XXXX XXXX , NV where I had my XXXX XXXX XXXX XXXX . I live in California. No matter where I called to straighten it out and get credited, it did not fix. First of all they claim they can only credit back 3 months. I first noticed it after {$800.00} was dwindled down to nothing. I dro ve t XXXX hours round trip to XXXX to get this problem fixed, same result. When I asked for help in XXXX , California on XXXX XXXX , they said we have to close the account and make a new account to fix the problem. Of course each checking account comes with a separate savings account. So they changed it to {$20.00} a month fee but told me it was free. Later in XXXX XXXX I asked for help. I went to the XXXX XXXX XXXX and XXXX locations. The same thing happened reopen another account and another and another. I dont even know how many times this went on. For sure more tha n 4 ac count changes for my two business checking and two required business saving accounts in just the city of XXXX XXXX . Now I have a free account only I have {$150.00} Tranfer into savings and the next day transferred back {$150.00} to checking and I have to have bill pay active or they will have a fee. Another option is to have a huge daily average in the account at all times. I am not doing that. Last week I asked a couple questions and they gave me wrong information.

Complaint: In XXXX XXXX my husband 's employer XXXX went on strike at which time paying our mortgage became difficult.We were offered a forbearance program through wells Fargo in which we would make reduced payments for 6 months and then apply for permanent modification at end.We made all payments on time when it came time for modification everything requested was sent in and then modification was denied saying we could afford payments.We can afford payment however they requested.the arrears of mortgage payments up front and we did not have XXXX XXXX dollars so they sent a foreclosure notice with only thing offered being short sale or deed in.lieu.This has been our home for 32 yrs so we went to our local bank to refinance only to be denied because wells Fargo had reported our mortgage delinquent since beginning of forbearance.Now no one will finance us with a XXXX credit score and we can not even qualify for a home equity line to save our home even though we have XXXX in equity.So we will be losing our home if no one will help us!

Complaint: My payment wa s ~ {$1100.00} a month from several loans totaling over {$100000.00} ( at the same bank ). I only earned about {$20000.00} annually and could n't afford to make a payment with rent, food, and living expenses. My cosigner, my grandmother, could n't afford to help because she only earned social security that I was told only amounted to ~ {$800.00} a month. After the bank soaked up my savings to pay these installments on time, I called them to negotiate a better loan payment that I could handle. I applied to hardship and we were both denied because " we did not make enough money ''. They instead insisted that I find a new cosigner to refinance my loans and that would lower the payment. Sometime in XX/XX/XXXX I got the loans refinanced with my parents as the new cosigners. This made the payment lower, but only to ~ {$900.00} a month. I moved back home to not pay rent and save money, but it rose over the course of time and is currently a t ~ {$94 0.00} a month. I still make only {$22000.00} annually and because my parents are also supporting my brother 's education and their own financial monthly payments, th e ~ {$940.00} a month payment is too much for them to help out with. So last month ( XX/XX/XXXX ) we tried to work with hardship at this bank again, and today we were denied, but not because " we do n't make enough money '', but because " we make too much money ''. They told us they understand students ca n't make these monthly payments on their loans, so they are more interested in the financial income of the cosigners. However, they do n't consider the monthly expenses of the cosigners or the borrowers. They look strictly at the income. My complaint is against this bank because they knew that my parents became cosigners on a loan that was n't theirs, without looking at their financial expenses, and assuming they could pay based off their income alone. They have n't been fair to us or our financial situation.

Complaint: Hello and Good Afternoon, I am reporting this to see a change how credit card companies/banks applied payments every month to their account holders. I have Wells Fargo Ban k credit card for more than a decade. As per banks and Consumer Finance Protection Bureau policy, the last c hange that was made to protect the consumers is applied payment to higher interest rate account. I have purchases worth {$1600.00} on the the credit card with minimum amount of {$28.00} due this month. I am willing to make {$300.00} payment. I am not sure if I will be able to make payment next month toward the remaining balance. In order to secure next few months minimum payments, I would like {$300.00} applied to next 5 months. This way I will secure my minimum payment for next 5 months. Also, the in this process, my principal balance will be reduced immediately. If the bank/credit card company would allow this, then I will be saving late fees, insufficient fund fees etc. I have called them to make payment arrangements for next several months ; however, credit card company 's policy would not allow this change. {$300.00} can be applied to principal balance and I would still responsible for minimum payment following months regardless of my financial resources. Also, if the payment is not made or return, there will be additional charges and fees. I hope to see this change to avoid late fees and other charges resulting me of financial help. Complaint: I opened my account in XXXX XXXX XXXX promised I am opening a veteran account and would be charged no monthly service fee. If you check my bank statements attached you will find that they did not charge me service fees. I kept calling Wells Fargo every month once i found out and was able to get the fee reversed each time spending hours on the phone and at the end of the call having their representative state that this is a one tim e courtesy refund and my rebuttal of I do not accept this as a one time courtesy but a need for you to fix the promise made when I opened the account. After the 4th time and going through several managers I decided to just close my account, because XXXX offers premier bank accounts to their veterans with safety deposit boxes, and keeps their word to veterans. So I am out all of those monthly service fees they kept charging me for years, and this leads to yet another reason I am writing. After closing my bank account 2 co mpanies, XXXX and XXXX , sent me refunds to my account on file, they instructed me that typically the bank sends the money in the form of a check to the recipient or contacts them. I called Wells Fargo , they claim no refunds await me, and yet both companies state Well Fargo, " has the funds. ''

Complaint: Under the Consumer Financial Protection Bu reau ( CFPB ) new rules , dual-tracking when the servicer moves forward with foreclosure while simultaneously working with the borrower to avoid foreclosure is restricted. Servicers can not start a foreclosure proceeding if a borrower has already submitted a complete application for a loan modification or other alternative to foreclosure, and that application is still pending review. To give borrowers reasonable time to submit such applications, servicers can not make the first notice or filing required for the foreclosure process until a mortgage loan account is more than 120 days delinquent. Fair Review P rocess : The servicer must consider all foreclosure alternatives available from the mortgage owners or investors those with decision-making power over the loan to help the borrower retain the home. These options can range from deferment of payments to loan modifications. And servicers can no longer steer borrowers to those options that are most financially favorable for the servicer In our case not matter have many times we have submitted the complete application and all requested documents to the Re- Entry, we are being den ied, by Wells Fargo Mortgage claiming due to the property negative Net Present Value ( NPV ) evaluation and that we did not provide all the required documents.. When we request a full appraisal and which documents are missing in writing, we are b eing told by Wells Fargo Mortgage employees, We are not in Loan Modification Review therefore we dont qualify for an appraisal to determine the correct NPV. This is a process the bank has implemented to make sure they can navigate around Dual Tracking Laws to deny a home owner from ever being consider for a Loan Modifica tion and to unlawfully foreclose on home owners. More disturbing, the re-entry never respond to us in writing nor even return numerous telephone calls to them. No Foreclosure Sale Until All Other Alternatives Considered : Meanwhile Servicers must consider and respond to a borrowers application for a loan modification if it arrives at least 37 days before a scheduled foreclosure sale. If the servicer offers an alternative to foreclosure, they must give the borrower time to accept the offer before moving for foreclosure judgment or conducting a foreclosure sale. Servicers can not foreclose on a property if the borrower and servicer have come to a loss mitigation agreement, unless the borrower fails to perform under that agreement.

Complaint: I`m trying to refinance with a bank and when they ran my credit report, they said my Fico score was very low and most likely will be denied because Well Fargo mortgage company not showing that I`m making monthly installment. Because XXXX I went bankrupt but I called the bank to reaffirm them, that I will continue making monthly payment that was being automatic withdraw from my bank account. And all this time payment was never stop while I was going through the bankruptcy, never late or missed a payment! So I e-mail them my issue and they e-mail me back with the number to there bankruptcy department. On XX/XX/XXXX I call the number they gave me and I spoke to a rep and she said I was suppose to submit a letter by my lawyer but I told them when call why you didn`t you tell me that and her response was not our job to advise you what to do! If I have known that 6 years ago, I would have brought it to my lawyer attention and because of this matter I missed out on low interest rate. Rep, told me to fax a letter asking proof of payment from to XXXX to present time to show banks I`m making payment. But the bank I`m going through said that not good enough to up my score! Thank you, XXXX XXXX Sent from my iPhone '' They have my name correctly spelled and they have my correct email address. However, I do not have an iPhone and I never sent that message. I checked my XXXX account and did not find any such emails sent from my account I have since changed my settings.Meanwhile, XXXX did not immediately call me to verify after she received the XXXX XXXX email, but she replied to that email on XXXX / XXXX / XXXX at XXXX XXXX as follows : " I am not sure what you are referring to as a transfer we have money in the account please send me the info XXXX '' Then fake XXXX XXXX replied on XXXX / XXXX / XXXX at XXXX XXXX with these details : " Transfer {$6700.00} to the Vendors [ sic ] banking information below.
