Complaint: Hello, The office of the comptroller has referred my complaint to your group. Wells Fargo has engage in extremely misleading practices and should be penalized. I am attempting to file a formal complaint against Wells Fargo for deceptive practices. I have scans of the written correspondence between them and I that can be provided. My email address is XXXX. On XX/XX/XXXX, I logged into my wells account to look at the credit card bill. At this time, I was presented with a popup notification while logged into the credit card account. This popup was viewed by myself and my wife, XXXX XXXX. She can be contacted at XXXX XXXX XXXX. This popup very clearly offered a settlement of our credit card balance. The offer was not ambiguous. It offered a settlement for our outstanding credit card balance.
The offer was time sensitive and had to be responded to that day. If I agreed to the offer, I would pay XXXX on XX/XX/XXXX and two weeks later, I would be asked to pay XXXX on XX/XX/XXXX. This offer clearly said settlement. The offer referenced the entire outstanding balance. Each of the payments that encompassed the settlement WAS LARGER THAN THE MINIMUM PAYMENT DUE AT THAT TIME. My wife and I debated this offer and agreed to accept it. It was a painful choice and enormously difficult for my wife and I. {$2300.00} for us meant forgoing other payments in order to settle this one card. We decided it was too valuable and we could not refuse. This would reduce our debt significantly and we agreed to the offer. I made the payment and two weeks later, made the second payment as requested. In XXXX, I received a statement showing we still had an outstanding balance with Wells Fargo. This, I attributed to slow reporting of the settlement as it processed through their systems. On XX/XX/XXXX, I checked the account status. It showed no change, so my wife called the bank. The call center employees then proceeded to give multiple versions of what the payments I had remitted were for and denied they offered a settlement.
We requested escalation. I hope they recorded these calls as my wife shot down all their illogical claims about why we were paying XXXX we didn't have when we didn't owe that much at the time. Wells Executive Offices, Consumer Credit solutions XXXX XXXX XXXX XXXX XXXX XXXX extension XXXX sent us a written reply " they were investigating the matter and would reply by XX/XX/XXXX. His letter is dated XX/XX/XXXX. I then logged into the account, took screenshots of the payments and dates from my wells checking in order to preserve the records. I then mailed them a very clear, written complaint with the screenshots and correct order of events regarding their settlement offer. I formally requested they retain all documents relating and communications related to this matter. I also requested they provide the DIGITAL REPRESENTATION that was presented to me via their website. Wells Fargo on XX/XX/XXXX then mailed me a letter that described their verbiage as'you 've been approved for a payment arrangement on your total amount due of XXXX you may make two payments by the following dates : XX/XX/XXXX and XX/XX/XXXX '' It goes on but their second paragraph acknowledges WE ARE UNABLE TO PROVIDE A SCREEN CAPTURE OF YOUR SPECIFIC ONLINE SESSION, however, the verbiage above is what was presented to you. We can also confirm there was no offer of a settlement. This is a complete misrepresentation, complete falsehood, based on no facts in their possession. The company has refused to provide us the actual offer that we received. Their offer, our acceptance, and the compensation we sent them should constitute an enforceable contract. This is not what their popup offer showed, not even close. Wells refuses to provide or review the actual offer we accepted. We suffered blows to our credit by forgoing other bills to accept their settlement. This is absolutely unacceptable.. We received a digital offer of settlement, we accepted it, we relied on their offer, to our detriment, we provided consideration. Please fine these lying thieves into the stone age and force them to honor their crystal clear settlement offer to my wife and I. Thank you.

Complaint: I have noticed that WF PLL have placed an inquiry on my XXXX and XXXX credit file dated XX/XX/2019. As you probably know, Credit Reporting Agencies treat inquiries as a statement of fact and will not allow a consumer to dispute them. I requested WF PLL and XXXX and XXXX to verify these inquiries. Since it is against federal law ( Fair Credit Reporting Act -- 15 USC? 1681b ) for an entity to view a consumer 's credit report without a " permissible purpose, '' I am writing to inquire as to their alleged purpose, for doing so since I did not apply for employment with their organization nor did I request credit from their organization. Based on the evidence in my possession, this inquiry was performed under false pretenses as described in the clear language of the law. 15 USC 1681n ( a ) ( 1 ) ( B ) states, in part, " in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer as a result of the failure are { { {$1000.00} } }, whichever is greater ; ''

Complaint: On XX/XX/2018, my authorized user purchased a visa application in the amount of {$120.00}. This was able to be cancelled and refunded since he never went through the biometric processing. I was told this would be refunded within 12 weeks ( after Wells Fargo allows disputes ). When I contacted Wells Fargo about this, they told me I was unable to dispute the purchase since it is after their internal deadline of 90 days to begin a dispute.

Complaint: There are three derogatory statements on my credit report. I am not sure who or why these derogatory statements were made. the identified company is identified as WF EFS. This may have been a school loan through Wells Fargo. This is may be from a loan my daughter had taken out and I served as a co signer. To best of my understanding my daughter had set up regular payments through her bank. As she lives outside of the United States, her payments went through several banks and eventually through her US bank ( XXXX XXXX XXXX ) Again to my understanding there was a change in way Wells Fargo processed payments and or collected, Neither me or my daughter were notified that the payments were not being processed until after three months had not been processed at which point they attacked my credit report. Which how I found out about the problem. There was no prior notice The money was in the accounts and available for payment. When I found out about the payments not going through we contacted the banks and made the necessary corrections. I attempted to contact Wells Fargo regarding a resolution, it was like talking to a wall, and got nowhere with the Wells Fargo From that point forward all payments have been made on time through an automated payment process. And the loans have been completely repaid.
I see that what I believe are these derogatory comments still on my credit report.

Complaint: I took a loan out from my Wells Fargo 401 ( k ) in XXXX of 2016. The repayment plan is {$300.00} on the XXXX and XXXX of every month for 60 months via an ACH credit transaction initiated by Wells Fargo. 9 times now over the first 3 years of repaying this loan, Wells Fargo has taken out a double payment of {$600.00}. Each time this happens I have to spend an inordinate amount of time on the phone explaining the issue and following up to ensure I am re-credited the over drafted amount. I have also asked them repeatedly to identify the cause of this issue and work to rectify it. This should be a simple transaction for any bank, particularly one the size of Wells Fargo. At this point I have lost all confidence in Wells Fargo as a banking institution and their ability to correct their errors. They clearly don't care about their customers and I'm convinced they won't do anything to fix this issue until a federal agency steps in and forces them to. I am asking for your help. Complaint: This particular account situation that is lately filing on my own credit document has unfavorable relation to my personal ability to obtain a present loan application. I highly recommend you generate verification that WELLS FARGO DLR SVC/ has been reported completely in accordance with the Fair Credit Reporting Act regulations, it's really a serious problem to mis-report. Moreover, I was never 120 days late in any of mypayments and I'm not greatly tuned in to the date opened so I prefer to ask your confirmation of the aforesaid item too. My proper request must be investigated as soon as possible and confirmed to be correct. Thanks!

Complaint: On XX/XX/19 I made an error that has now caused my funds deposited on XX/XX/19 to be frozen for 10 days.
I inadvertently transferred money from one account to another, only problem is I to the to and from backwards. As soon as I hit the OK button I realized what I had done. I called Wells Fargo to see what my options were.
My options were to put a {$31.00} stop payment on the transfer, which didn't make sense because I don't have {$31.00} to spare. Well the XXXX transfer out of my checking from the other account hit so I called to see if we could do an {$18.00} reversal, it was an error on my part, however ; it happened.
This error has sense caused my checking account to accrue 6 or more overdrafts which now Wells Fargo put a 10 day hold on a deposit that I depend on to pay my bills, get medications, doctors appointments.
I have explained to Wells Fargo that I am XXXX, do XXXX to try and offset some of my expenses until Social Security makes their decision.
I have set a lot of bills to be paid automtically, hence the Overdrafts. Once I received the email that they were holding my funds. I called and explained to them I am XXXX and need those funds for XXXX purposes and Bills.
Being continually penalized {$32.00} for bills that I have set to pay automatically, while the money is there I find ridiculous.
They have told me once the hold comes off they can give me partial credit for the overdrafts. That is not going to help someone is XXXX and unable to make a living.

Complaint: XXXX keeps reporting accounts that are in someone else name and social security number. The following items on the enclosed PDF file are not mine. There is an alternate social that XXXX keeps reporting and can not get it through their head that the alternate social being reported IS NOT MINE and all the creditors have verified this and told me they removed the item, but yet XXXX continues to report it. I have enclosed a printout of the items, every item in YELLOW is NOT MINE, also a copy of the latest three police reports filed. The two addresses in yellow are not mine either.
