Complaint: Volkwagen XXXX XXXX and Volkwagen Credit, made an improper " hard '' credit inquiry in 2014 resulting in subsequent adverse credit decisions including denial of credit or higher interest rates. I authorized XXXX inquiry during an application of the lease of a vehicle. I contacted the reporting credit bureaus who referred me to Volkswagen Credit and its agent, Volkswagen XXXX XXXX. To date, only Volkswagen Credit responded and refuses to remove the inaccurate data. I do not dispute that I applied for the loan and authorized a credit inquiry. The dispute is about the number and timing of the other unauthorized inquiry.

Complaint: In XXXX of XXXX I attempted to log into the VW Credit website to make a payment, setup automatic recurring payments, and update my contact information. For reasons I do not understand, VW Credit had disabled this functionality which was previously available through the online account management portal. Instead, the website said I needed to call if I wanted to make a payment. I called and got an automated recording that said that VW Credit was closed and I needed to try again during normal business hours. VW Credit did not allow me to leave a message.
Later in XXXX, XXXX, I tried to call again during normal business hours and received a recording that stated VW Credit was closed for a company-wide meeting. Again, VW Credit did not allow me to leave a message.
On XXXX XXXX I logged into the website and submitted a web form stating : " I used to have auto-pay setup and my bank changed my checking account numbers. I tried to set up auto-pay again and the website said to call. I tried to call during normal business hours and the recording said all employees were at a company-wide event. I want to get auto-pay setup and I would like all documentation of late payments expunged. XXXX XXXX Account Number : XXXXX XXXX XXXX '' Even though I indicated I had been having trouble reaching VW Credit by phone ( and VW Credit later stated they had XXXX the online access because they wanted to talk with me via phone ) and even though I provided the best phone number by which they could reach me, VW Credit declined to call me. On XXXX, XXXX at VW Credit stated VW Credit did not call in reply to my message because I did n't explicitly state that I wanted them to call me.
When I submitted the web form it was because I had been unable to reach VW Credit by phone - after multiple attempts - and I was unable to make payments through their website. When I submitted the form I was not given any indication or expectation as to how they would be returning contact with me. I expected them to call me and that is why I provided my phone number in the web form. When submitting the web form I was not told, " Please check your messages on our website in a few days for a response. '' I was given no expectation as to how VW Credit would reply and I was n't even aware there was a " Message Center '' on their website where they could leave a message for me. As far as I knew, it was just yet another attempt by me to contact VW Credit that resulted in yet another dead-end.
On XXXX XXXX, XXXX I received a call and voicemail from VW Credit which I returned within minutes. I spoke with someone who said that VW Credit was calling because my car payments were past due. The call eventually escalated to XXXX in the XXXX office who told me that my account was out for investigation and VW Credit went through extraordinary measures to reach me. This is extremely frustrating given these facts : It is not fair that VW Credit can disregard their responsibility to accept payment, refuse to be available to their customers or allow their customers to update their information, and then blame their customers for failure to pay and negatively affect their customers in this way.

Complaint: On XXXX XXXX, 2015 Volkswagen sold me a XXXX Volkswagen Jetta " Clean Diesel '' for {$24000.00}. This vehicle was sold using fraudulent inducement by Volkswagen - the car contained a emissions testing defeat device and violates Unites States and California laws for vehicle emissions. Volkswagen has admitted to cheating on emissions tests and intentionally installing the defeat device.
My car purchase was financed by Volkswagen Credit, also known as " VW Credit '', which is a wholly owned subsidiary of Volkswagen Group of America. The vehicle sales contract was based on fraudulent inducement and the sales contract should be rescinded. I have sought formal rescission of the contract through legal means. I have contacted VW credit and requested that loan payments for the vehicle be suspended until resolution regarding the sales contract is obtained. The VW Credit representative I spoke to denied any request for suspension of loan payments and threatened to report me to the credit bureaus for any late or missed payments. VW credit offered no other means of resolution despite holding a car loan contract based on fraudulent actions.

Complaint: I entered into a vehicle lease for a XXXX Volkswagen Jetta at XXXX XXXX Volkswagen in XXXX, XXXX in XXXX XXXX. The lease was supposed to run until XXXX XXXX. However, I received XXXX in XXXX XXXX. I was XXXX for a total of 184 days. While at training, I attempted to terminate my lease under SCRA, but Volkswagen denied my application because they said SCRA would not apply if I was not XXXX out of the U.S. I applied twice more after that and still continued to be denied. Eventually, in XXXX, the dealership told my mother they would take the car back and she turned it in without issue. However, in XXXX I received invoices from the dealership stating that I was behind two payments for XXXX and XXXX XXXX. After calling the dealership, they told me that they had not completed the process for turning in the vehicle and that those two payments would be taken off of my account. However, in XXXX XXXX I received a statement from the Volkswagen credit department out of XXXX saying that I owed {$13000.00} for the remainder of the lease. I went to the XXXX XXXX legal office for help. The XXXX called the credit department informing them of my rights under SCRA and they told me to reapply to them since they are the ones authorized to process vehicle turn-ins. First, they gave me a fax number which did not work. Then the XXXX was able to email my paperwork to the credit department and I received a receipt that they received the email. However, after a week went by, they said they still had not received my email, even though they sent me a receipt notice. After re-sending the paperwork, they denied my application again citing that SCRA did not apply to me because I was not out of the U.S. and I was not on XXXX XXXX for more than 180 days, even though my orders show I was. The XXXX again called the credit department to inform them that they were incorrect and told the XXXX that they would look at it again and contact us when they reviewed it. I have still have not heard back, even though they are continuing to send me invoices. The XXXX and I feel that Volkswagen is being completely unresponsive and is not honoring my right to legally early terminate my lease under SCRA and at this point want to seek assistance from the CFPB.

Complaint: We have leased a XXXX XXXX in XXXX XXXX and it was more in the shop than with us. In two months we have had over XXXX rental cars and have tried to resolve the issue with VW. Before leasing the XXXX we have traded in a XXXX XXXX and were promised to receive XXXX for it. The monthly lease for XXXX was XXXX with residual of XXXX.
We did not have a chance but to bring the XXXX back in XXXX and traded it in for a XXXX. Monthly lease of XXXX and residual unknown. However, we have not gotten any credits back or any downpayment made towards the firs lemon car XXXX and have gotten additional fees added on the XXXX for trading in XXXX after less than three months. We have always paid on time and in full. In XXXX and XXXX XXXX I became laid off and contacted VW to ask about my options. We were told that for two months we do not need to make the payments since we were enrolled in some protection plan. Still, we have made payments as much as we could and have been reported to the credit bureaus as making LATE Payments! And all we did was make additional payments while we were not required to. This information has been disputed but VW did not agree to correct it from our records. In XXXX XXXX we have had transfers in amount {$2100.00} going to VW towards the Lease. As I realized that something was wrong and contacted VW we were told that they would refund the money as it gets transferred. On XXXX XXXX we still have not received anything back we decided to pay off the XXXX and trade it in for a different brand. The payoff amount was quoted XXXX and that day VW electronically also transferred additional XXXX from my checking, although the dealership had paid all of the quoted balance of. We called several times to get the money back since we no longer had the car and did not authorize the transfer but no-one called us back and we never received any money. We have inquired several times to receive written disclosures and all documents and payments received from the VW Lease and Finance office and no-one ever has sent us anything but that the balances are paid off. We are requesting the additional {$2600.00} that was taken from our debit in XXXX and XXXX to be immediately refunded to us, as well as any missing downpayment that should have been transferred to XXXX after XXXX was a lemon car. We have tried to dispute it through our banks but they were also not successful of it. We also require the late payment wrongful reporting to be corrected of the consumer reports and we hope you can help us to achieve this within next 30 days?

Complaint: In XXXX XXXX, I purchased and financed a vehicle through Volkswagen Credit. Shortly after, Volkswagen admitted to having deceived its customers through fraudulent emissions practices in it 's diesel vehicles. The vehicle I purchased was a XXXX XXXX XXXX, a diesel car that was impacted by Volkswagen 's fraudulent practices. I have contacted Volkswagen Credit on several occasions to request that the take the vehicle back and eliminate the loan from my credit. I have been told that if I stop paying the car loan, the car will be repossessed and will impact my credit score significantly. I have continued to pay the loan and am current, but feel that there is rampant fraud throughout this issue. I do n't believe myself or other consumers should have an obligation to continue to pay on financing for vehicles that were sold deceptively. I have made no progress working directly with Volkswagen. Seeing as the company sold and financed a fraudulent product, I am hoping that you can help me.

Complaint: On my credit reports with XXXX, XXXX, and XXXX is a repossession from Volkswagen Credit , Inc. with a deficiency balance of {$2000.00}.
I previously disputed this account information in XXXX 2015 with all XXXX credit reporting agencies and Volkswagen Credit , Inc. verified the accuracy of the account with all XXXX credit reporting agencies.
I then sent letters directly to Volkswagen Credit , Inc. to attempt to resolve this matter. It should be noted that each credit bureau lists a different contact address for Volkswagen Credit , Inc. which obviously complicates the resolution process. Of the XXXX letters sent, XXXX was returned to me by the USPS as an invalid address ( which is a violation of the FCRA for a creditor to fail to provide proper contact information in a credit report ) and the other XXXX letters were ignored. These letters were sent Certified Mail, Return Receipt and I received confirmation of delivery for the ones delivered.
A subsequent follow-up letter was also ignored.
On XXXX XXXX, 2015 I sent Volkswagen Credit , Inc. another letter, to their Collections/Recovery/Credit Reporting department in XXXX, XXXX. In that letter, I reminded them of their obligations : Under the laws of the State of XXXX, the Uniform Commercial Code, and State RISA and MVISA statutes : A deficiency can not be claimed unless all of the required notices were properly and timely given, and all of the allowable redemption and cure time limits were adhered to.
I requested such documentation be provided within 14 days, as is my right.
As no such documentation was received by me within the allowed time-frame, the alleged claim of a deficiency is considered null and void, and any continued collection activities, or continued reporting of this invalid claim on my credit reports will be considered a violation of the FDCPA and FCRA.

Complaint: To Whom It May Concern : I 'm writing this letter as an appeal to Volkswagen Credit to work with me on resolving a late payment dispute which took place in XXXX of 2014.
On the morning of XXXX XXXX, 2014, when I went outside I noticed that my XXXX XXXX was not in the driveway. I called the local police station to report it stolen and was informed by the police department that the car had been repossessed. My wife and I were stunned. We could n't imagine why that would have happened and were sure it was a mistake. My wife called VW Credit USA as soon as their office opened to straighten things out. The representative informed her that they had not received a payment since XXXX, 2014. My wife keeps very good track of bills and went through her files and realized she had not received any bills for the XXXX or late payment notices from VW Credit USA. Upon further discussion it was ascertained that VW Credit USA had the wrong address on file, a non-existent address at that. When my wife asked why I had not been contacted by phone of the missed payments, VW Credit said that they had called. Asked what number they used it was discovered that they had my telephone number wrong as well. My wife pointed out that we have had a good history with VW Credit USA, having financed XXXX other cars with them in the past. This was acknowledged as well as the fact that they still had access to the information from those transactions. When she realized that they could have used that information to contact us but chose not to, she further questioned the representative. It was then found out that VW Credit also had my correct email address in the old records, yet never used it. When my wife pointed out these errors the representative became argumentative, even telling my wife that " just because I did n't receive a bill does n't mean I should n't have paid it ''. At that juncture she realized that she could not reason with this person. It was particularly maddening to be told that they had sent someone to the non-existent address for a " home visit '' and still did not realize the mistake, yet managed to have the reposition company make their way to our correct address when they wanted to come and reposes the car in the middle of the night.
I do n't know where the problem of misinformation was generated ; either upon the sale of the car at XXXX XXXX where I had provided them my personal information or at VW Credit USA. I do know that both establishments have refused to take any responsibility for the error. While we did manage to get the car back the same day, it was quite a project to do so, especially since everyone would be closing early to start the XXXX XXXX holiday weekend. It cost us in fees well over {$400.00} to get the car returned. VW Credit USA was very difficult to work with, regarding their ability to retrieve information faxed and emailed to them, at their request, by our insurance company pertaining to our insurance status and by the repossession company acknowledging receipt of payment. As it turns out, the most helpful people were the ones we dealt with at the repossession company.
It is unfortunate that my credit had to take a hit, but once done it is not easily undone. I am asking that VW Credit in consideration of my past prompt payment activity and the error made in having my incorrect contact information on file will consider forgiving the late payments and in a goodwill gesture adjust my credit report accordingly.

Complaint: I was nearing the end of my first vehicle lease and went to XXXX XXXX XXXX to discuss my lease end options. The car had some obvious cosmetic damages that I pointed out to the sales representative. After speaking with the sales representative, he assured me that leasing another vehicle was my best option in order to avoid having to pay for excess wear and tear on the previous vehicle, so that 's what I did. 4 months into my new lease I got a bill from VW credit for all of the damages on the old car, over $ XXXX. I was sure that there as some mistake and went to the dealership. While there we reviewed my contract together and the lease termination was processed as a turn in, instead of a trade in, thus leaving me financially responsible for both cars. They denied ever telling me that I would n't have to pay for the damage on the car and since leaving there I have been unable to get a hold of the XXXX, they have been incredible non-responsive. I have filed a complaint through VW, the debt is now with collections and I do n't have the money to pay it. For someone without money for a down payment, or to buy the old car, it would make XXXX fiscal sense for me to lease a new car. The option that I thought that I was taking was the only way for me to pay nothing out of pocket. VW offered to make my final payments on my old car, and my first payment on my new car, and nothing down. It was the only way for me to not spend any money in the transition. At the least, I would have had the car inspected and opted to fix it myself through a certified mechanic friend before returning it to VW because it is common knowledge that the most expensive repairs are through the dealership. All of this was in XXXX of 2014.

Complaint: I am the primary contract holder on an account with VolksWagon Finance Company. The secondary signer filed bankruptcy. This account was not included in the bankruptcy case. VW Finance blocked my access to online payments and stopped sending my monthly statements, eventhough this account is not included in the bankruptcy case and I have not filed for bankruptcy. I have called several times to get a print out of my account. The rep states that account is current, but they are unable to email or mail me a statement. I am referred to a Debt Collection Company. I keep trying to explain that the account is not being paid by a collection company. I have not received any statements of my account from the company. When I call the number that is given for the company, the rep says they will email a statement to the lawyer who handled the case and he will forward it to the client who filed bankruptcy. She has not received anything. When she contacted the lawyer, he stated he would mail it or forward it in an email when he received it, but he never did. I do not understand why I can not get a statement of my payments and balance as a contract holder when I am making payments every month and have never been late.
