Cont'd attempts collect debt not owed

Debt collection: Auto

Debt was paid
Complaint: As on all XXXX of my credit bureaus Toyota motor company has filed inaccurate information on me, they refuse to remove it but under by it 's very name, the Fair and Accurate Credit Transactions Act places new emphasis on accuracy of information in consumer reports. XXXX FACTA sections aim to improve the accuracy and integrity of information as well as give consumers a new right to dispute data included in reports directly with the company that furnished it. These sections are : Accuracy guidelines for financial institutions and creditors that furnish information to credit bureaus. ( FACTA 312 ( a ), FCRA 623 ( e ) ( 1 ) ). Ability of consumers to dispute information with companies that report to credit bureaus. ( FACTA 312 ( c ), FCRA 623 ( a ) ( 8 ) ). This information has to be removed or I am going to sue Toyota motor company for false inaccurate information. This needs to be done ASAP. This is a clear volition of the credit act, it was removed from all three bureaus and then placed back on again this again is a violation of the credit act as well

Complaint: I returned my XXXX XXXX XXXX on XXXX XXXX, XXXX, to XXXX XXXX XXXX in XXXX XXXX, VA, upon the maturity of a lease. However, I received a bill in the amount of {$970.00} on XXXX XXXX, XXXX. The bill included a $ XXXX lease payment, {$350.00} disposition fee, despite the fact that I received a confirmation over the phone on XXXX XXXX, XXXX, that these charges will be waived after my spouse 's lease of a new XXXX. He did end up leasing the vehicle to save on charges. The most disappointing fact was that the bill included {$410.00} charge for a windshield chip. I do not recall the chip. When I was dropping of the vehicle, the dealer conducted the inspection and never mentioned the damage. I was told during the phone call that the third party inspection conducted on XXXX XXXX, XXXX, revealed the damage. My suspicion is that something happened to a windshield between drop off date on XXXX XXXX XXXX and XXXX XXXX XXXX. I tried to explain my situation to Toyota Financial Services, but no one could help. I do believe that there is a flaw in the Toyota 's system of lease returns. Consumers have to be informed by Toyota about the third party pre-inspection option. This has to be a required step during a lease return, so as a consumer, I witness the revealing of a damage. Otherwise, I am feeling that I am being billed for a damage that has been caused by someone else. Moreover, if I would have known about the damage, I could have fixed the windshield myself through my insurance for much more cheaper price. I believe that I had a coverage for windshield repair. It would cost me {$0.00}. Now, I am in the limbo of Toyota 's policies with an obligation to pay {$410.00} for something that I have not done. In addition, I had to call Toyota Financial Services 3-4 times to waive the charges for disposition and XXXX lease payment. I had to spend 1-2 hours each time to explain the situation and promises Toyota Financial Services have given me. Luckily, XXXX XXXX XXXX ID # XXXX had a time to discuss my situation and listen to me. We were able to agree on waiving $ XXXX XXXX lease payment, and {$350.00} disposition fee because they promised to do so if my spouse leases new vehicle. Despite spending hours over the phone with customer service representatives at Toyota Financial Services, no one was able to remove {$410.00} charge for a chip on a windshield. I was planning to write to Toyota 's corporate office, but came across the CFPB. I do hope that this complaint will require some policy changes at Toyota Motor Sales Matured Lease Services. As I mentioned before, I do hope that the pre-inspection will become mandatory prior to lease returns unless consumer waives it in written form and states that they wo n't disagree with post lease return charges on damages. I also hope that Toyota will be able to reimburse charges to consumers who truly believe/d that they were billed wrongfully. Thank you,

Complaint: I filed a complaint on Toyota Motor for reporting inaccurate payment information on my credit and dropping my scores tremendously and defaming my character. They answered untruly and I am not able to log in to provide proof from my bank showing that I was not 30, 60, 90 or 120 days late on my payments nor did any of my checks get returned unpaid. Toyota removed 3 of the late payments but reported them as unknown. I made my payments and they need to report it. Please help me with this matter

Complaint: I wanted to pay off my lease. So I went to the website and I got the payoff figure. I was instructed to call the hotline to make a payoff. After calling them, they could not give me specific instructions on how to payoff my lease. They said to go to the bank and have the payment wired. They could not provide me a reference number to wire the payoff funds. They said the bank would know where to route it. I said I was uncomfortable with this approach. Then they said to go to the dealer. I went to the dealer and the dealer stated that they do not process payoffs and I needed to go through TFS. I called TFS again and they instructed me to make a payment online. So after calling TFS again, they said to make a payment instead of my normal reoccurring payment. I submitted a lease payoff payment of {$30000.00} on XXXX XXXX and it cleared my bank account on the XXXX. I called to follow up on the XXXX and they advised that I needed to fax documentation in. This was never told to me in any of the conversations with TFS. So I faxed the documentation in, and I went on to the website and now it shows I owe 2 months payments and I have concerns that I will be reported to the credit bureaus. I followed up again on XXXX XXXX and I was told that XXXX page of the document was n't received and they needed that page sent in. I sent it in that day and followed up today. Today I was told that a different document was missing and the payment was returned back to me. I then pushed to speak with a different person and they said they have received my payment and they have all of the documentation required. My concerns are as follows : - I sent in money and they received it- No one contacted me to provide any paperwork - When I sent the paperwork in, no one contacted me to say they received it or that they were missing anything - Once my money and the first instance of paperwork was received, I believe my account should have been frozen with no more payments be required until further notice. At the very least I should n't have to make the full monthly payment. I am currently late {$880.00} on a $ XXXX payment. - Each time I contacted TFS they had little to no idea how to process a payoff, what was going on with my account, and how to handle it. - I had to spend at minimum 30 min but up towards an hour on each phone call. I made at least XXXX6 phone calls just to payoff my lease.

Problems when you are unable to pay

Consumer Loan: Vehicle loan

Complaint: My XXXX Prius was repossessed more than 6 weeks ago. I telephoned Toyota Financial Services ( TFS ) for guidance. I was told to wait for their letter. The letter came about a week later, and I read it. In accordance with that letter, I sent a check for the payoff amount ( {$2500.00} ). The check was sent " return receipt requested. '' I received the return receipt indicating that on XXXX XXXX, a TFS employee ( " XXXX ) in XXXX XXXX, Iowa signed for the check. Nothing happened. I telephoned TFS at a their phone bank in Arizona, as directed in the letter, and inquired repeatedly about my vehicle. Each phone call requires anywhere from 22-42 minutes of waiting time. Each person who answered the phone could not tell me what the status of the check was or the status of the Prius. Indeed, I was advised that I had to find out what TFS in Iowa was doing with the check. ( I 'm in DC and not associated in any way with TFS. ) I telephoned a Toyota dealership near where I live ( XXXX Toyota in XXXX ), and asked for their assistance. I was told to send a cashier 's check and that was all that was needed. Just before going to get a cashier 's check, I checked my bank account. The check sent to Iowa was finally processed. At the time the check was processed, three weeks had elapsed. At this time, I can not get TFS to release the car. Indeed, I can not get anyone to tell me what the status is of my car. AND in the interim, I am told that the repossession company who took the car is charging me a daily fee plus towing fees, and other fees. I am XXXX years old. I am relying on friends and neighbors while trying to get my Prus back. At this time, however, I have no belief that I will get my car back. Please help.

Problems when you are unable to pay

Complaint: From the onset the purchase with Toyota Financial Services, we were given bad service. We were invited to purchase a vehicle through their Bankruptcy Program for people who just filed. We were offered a a few vehicles that were not worth the amount money that they were asking for. We were also told that we were denied credit by all other lenders except for Toyota Financial Services, unfortunately, we received a few weeks later from XXXX XXXX stating that we were approved but we did not respond. So currently, after struggling with payments but attempting to pay them, I was finally able to pay in full an amount tom bring my account current. i made a payment on the TFS website and received the message that the payment was received. My husband called Toyota to confirm a few days later and was told that the we were all set and our next payment is due at the end of the month. On XXXX XXXX, 2016, I called Toyota because I noticed that called and was informed that they did not see the payment and it did not post and is still due. My husband was offered to pay our usual monthly amount ( about {$400.00} XXXX, but my husband insisted that they get to bottom of why the payment was not made. The manager was put on the phone and we were met with aggression and disrespect. She treated us as if we were playing a game and not trying to fix out account issue. So we hung up and called the bank who Toyota insists is the cause of this issue. When we returned the call to Toyota to get more information, we were placed on the repossession list and I was informed that it was effectively immediately. We requested for XXXX to XXXX hours to figure this problem out and fix it, but they refused and we are now losing our car when I clearly tried to make a payment. Their customer service, both at XXXX Toyota in XXXX and on the telephone at Toyota Financial Services, has been by some, aggressive, confrontational, and not a good representative of what a good car service should be.

Complaint: I was financed by Toyota financial services [email protected] % interest my credit score at the time was XXXX and so was my cosigner low XXXX 's. the terms of the loan were for 60 months, I asked for a simple interest loan. I was told if I paid early my money would apply towards the principal balance, that did not happen, all my payments were applied mainly to interest and a very small portion to principal. During the course of my loan I did take XXXX deferments with the understanding that they would be added to the end of my loan. So my maturity date would have been XX/XX/XXXX but it ended XX/XX/XXXX. So each month I was paying a little more than the balance due to help prevent further interest charges, but I did not see any benefit during the life of my loan. Every statement did not have any late fees or " other charges '' due on my statements, then I look at my final payment on XXXX/XXXX/16 for {$3900.00}, I was appalled. Where did those charges come from? I inquired with Toyota Financial and they advised it was from my XXXX deferments, and interest during that time. {$3900.00} in interest and fees? That is unfair, unreasonable, deceptive and predatory. I have asked three times for my payment history and have not received it. I took out a loan to pay my final payment of {$3900.00} because I did not want my account to charge off or to not receive my title.

Problems when you are unable to pay

Consumer Loan: Vehicle lease

Complaint: Debt cleared then re-emerging after new sale was made. I leased a vehicle XX/XX/XXXX which was totaled XX/XX/XXXX. GAP coverage, insurance, and individual coverage from the branch of Toyota were all applied to my balance to cover for the vehicle and the vehicle itself was auctioned off. I had received a letter notifying me that I had around 20 days to pay off a large sum of money ( approximately XXXX $ ). I could not pay this amount so it was put into collections. XX/XX/XXXX, I returned to the same Toyota dealer who originally leased me the vehicle to clear up any debt I may owe and possibly consider another vehicle, as I needed one to commute to work. After over an hour with the finance manager, and him making several calls to Toyota financial and Toyota Motor Credit Corp, we came to a resolution. The finance manager assured me I did not owe any sum of money to Toyota Motor Credit Corp, as did the individuals from TMCC we were speaking with about my account. I was entirely prepared to make a cash payment settlement at this time, but was assured I was clear of debt. After this all took place, the finance manager quickly addressed my need for a means of transportation and introduced me to a floor sales representative who had then sold me a vehicle for just over {$12000.00} under Toyota Motor Credit Corp. This is the car i still possess today, and make 100 % on time payments for each month. However, I received a letter in the mail today dated XXXX XXXX, XXXX stating it was a claim for collection from Toyota Motor Credit Corp in the amount of {$7400.00}. I feel that there has been a violation of the Consumer Protection Act in that I was taken advantage of, and even misled about information regarding any debts, in order to make me purchase another vehicle. This deception caused me to purchase a vehicle unaffordable to me in the event I owed such debts. Purchasing a more affordable vehicle and resolving the debt would have been my course of action had I not been deceived. However, instead I have been almost tricked into purchasing another vehicle and lied to about the true details of any debts owed.

I was told that I would be able to put the payments that I would miss on the end of the loan, so my account would not go late and would remain current. I was assured by the representative this would not result in me being reported late. It would however, result in my loan being extended. I agreed with the assurance that my credit would not be late. Nevertheless, I was given the wrong information, and Toyota reported my account late. I have tried the last 8 months to no avail. Complaint: Upon routine leased end-of-term car turn-in XXXX/XXXX/XXXX to XXXX XXXX in XXXX XXXX, XXXX, we discovered our XXXX/XXXX/XXXX lease agreement had been hand-altered post-signing XXXX/XXXX/XXXX to make it appear 1 ) there was a {$350.00} disposition fee ; and 2 ) that the total lease amount was higher. Neither change was initialed by anyone -- and we were not given a copy of the change at start of lease. I believe this is illegal and violates the Federal Consumer Leasing Act Segregated Disclosures provision. This was a Connecticut " closed end motor vehicle lease agreement XXXX pay lease, '' i.e. we paid the entire amount upfront on XXXX/XXXX/XXXX. Upon our own investigation this past week, we discovered our original paper lease copy and the XXXX dealers digital version actually do match. The copy held by Lexus Financial however is the one showing hand-marked alterations. We first brought the discrepancy to attention of the leasing financing company ( Lexus Financial Services of XXXX XXXX, XXXX ) XX/XX/XXXX as we prepared the car for return. They denied us. At turn-in at the dealer XXXX/XXXX/XXXX, we explained the issue to the XXXX finance manager XXXX XXXX and showed him a copy of our original lease agreement. He agreed with us there was no fee and said it should all be straightened out by Lexus Financial once all the paperwork from turn-in has been received. He said if they raised the issue again, just send them a copy of our lease agreement that showed no dispo fee. XX/XX/XXXX we received 3 calls from Lexus Financial " pre-collections dept '' reps asking for the {$350.00} fee. They insisted they had a signed copy of our lease showing we agreed to that {$350.00} fee upfront. We asked for them to send us a copy. They insisted it must be mailed not emailed or faxed to us, and we ultimately received their copy by USPS mail ten days later XXXX/XXXX/XXXX. In the meantime they sent a collection letter and bill for the {$350.00} with no mention of the issue. They gave a deadline of XXXX/XXXX/XXXX. I immediately replied with my own letter, a copy of my lease agreement, and told them I would report them to the XXXX AG if I did not hear back from them by XXXX/XXXX/XXXX that this issue was resolved. Instead, they then called me early the morn XXXX/XXXX/XXXX asking me when I was going to pay up. At that time I decided to drive right to the dealer and get this sorted out face-to-face with their help. I met again with XXXX Finance Manager XXXX XXXX XXXX/XXXX/XXXX at XXXX pm, he again showed me that their digital copy matched mine. He nicely called Lexus Financial while I was in the room with him and talked them into faxing him their copy of the lease. It was at this time we all learned their copy was hand-altered and not initialed. No one who had signed our original lease agreement was still employed at the dealership to validate. XXXX showed it to the current XXXX XXXX who apologized and said " it would be taken care of. '' He said he and XXXX had not seen such a hand-altered lease agreement like this before and that it was highly unusual. Everyone was cordial. There was some mention that disposition fees were not required up until XXXX/XXXX/XXXX, but that the policy changed XXXX/XXXX/XXXX and since Lexus Financial did n't acknowledge my XXXX/XXXX/XXXX agreement until XXXX/XXXX/XXXX someone just added it on manually - not asking for my approval, not giving me a copy, and apparently not noticing it was a one-pay lease and all charges were already paid at signing XXXX. I believe this is all illegal under the Federal Consumer Leasing Act Segregated Disclosures provision. I asked the GM XXXX/XXXX/XXXX for an apology letter from him and/or Lexus Financial and a confirmation the dispo fee had been removed and was not due. 5 days later Lexus Fin confirmed their records still show I owe it. I also suggested they investigate to see if other lease agreements were altered during that timeframe.
