Complaint: I have received several calls to collect a debt. I would be fine paying the bill if the person on the other line had n't called me offensive names and threatened to sue me. When asked to speak with her supervisor she has been belligerent and rude. I am uncomfortable receiving calls from this company. They have called me several times a day for the last three weeks.

Complaint: XXXX, therefore we had to move to another property and leave the one we are currently short selling. Since I am on a fixed income, I can only pay one mortgage and that is the one where I do not have to go up and down the stairs. TCF Bank has made this process very difficult, asking XXXX questions, asking for all sorts of documents, everything was provided to them. All we want is to do a short sale and get with our lives, but once again TCF is making this very, very hard for us to do. I am XXXX, on a fixed pension income, married with a woman who can not work because she has to take care of me, can not live at the property where TCF is the bank XXXX, what else do they want to understand I HAVE A HARDSHIP! They wo n't do a short sale, they wo n't modify my loan, they wo n't do a deed in lieu, therefore they are pushing me to foreclosure!

Complaint: My name is XXXX XXXX and I would like to relay an unfortunate story of my experience with TCF National Bank. It is my contention that TCF is conducting fraudulent, misleading, and deceptive practices, in transactions regarding the processing and posting of checks, and subsequent overdraft fees charged by the bank.
I had only been a customer at TCF for about XXXX months when I decided to write my first check to a business for tree services, for {$170.00}. I was watching several times daily for the check to come thru on my online account register, as my TCF account was used on a daily basis.
On Tuesday, XXXX XXXX, at the end of the business day ( XXXX XXXX ), I checked my account balance, and saw a positive balance of {$180.00}, indicating that the check had NOT posted to my account, by the end of the business day, on XX/XX/XXXX. On Wednesday, XX/XX/XXXX, I saw that the check had posted to my balance ( both available balance and total balance ), and had brought my available balance into the negative. Seeing this, I deposited {$100.00} into the account prior to the end of the business day, and brought the balance back into the positive. In other words ; I had a positive available balance at the end of the business day on XX/XX/XXXX, and then again on XX/XX/XXXX. There was not any one day that my account was in the negative, at the end of the business day, while banking at TCF bank. Not ever.
However, TCF apparently was desperate for their {$37.00} overdraft fee, so they decided to get creative. Even though TCF did not process the {$170.00} check until XX/XX/XXXX, they changed their records to reflect that it posted to my account on XX/XX/XXXX, even though it had not. When I went into the bank the day the check posted on the XX/XX/XXXX to deposit money so the check would not overdraft, the teller told me that the check had posted that day ( not the previous day ). But by XX/XX/XXXX my online account register showed that the check posted on XX/XX/XXXX, which it had not!! This is Fraud!!! My available account balance was {$180.00} at the end of the business day on XX/XX/XXXX according to TCF 's online register and the check had not posted, but the bank fraudulently changed the date on their records, to show that the check posted to my account the day prior!!
The transaction information report that I printed off the TCF web site, showed the " Date/Time Initiated '' as XXXX XXXX on XX/XX/XXXX ( curiously 1 minute before the next day ), yet it also showed the " Date/Time Posted '' as XXXX XXXX on XX/XX/XXXX, earlier in the day!! This was blatantly false, and what I consider fraud! How could the check be initiated a minute before midnight, yet posted earlier in the day? The check did not post to my account until XX/XX/XXXX, yet they cookedtheir records to show that it posted the previous day, so that they could swindle {$37.00} from me.
On Thursday XX/XX/XXXX, I went to my local TCF branch ( XXXX location ), and spoke to a rude and indifferent branch manager named XXXX. XXXX told me that even though my available balance showed a balance of {$180.00} at the end of the business day on XX/XX/XXXX, and that the check was processed on XX/XX/XXXX, it was ok for them to back date the check to the prior day, because the check was processed through the federal reserve bank, and that may not have shown up on my available balance until the next day ; thus they get to charge their overdraft fee. When I explained that I had never had an overdraft of any kind while a customer at their bank, XXXX early rolled his eyes. XXXX was rude, indifferent and extremely condescending towards me during our conversation. Needless to say, XXXX refused to waive the one and only overdraft fee that I had received while banking at TCF. This practice of backdating checks to the prior day, even though it had not posted until the following day, is straight-up fraud. At the very least, I am owed my {$37.00} back.

Complaint: From XX/XX/XXXX - XX/XX/XXXX, I had a personal checking account with TCF National Bank. During this time, I suffered the loss of {$19000.00} in overdraft fees due to the following profiteering Bank practices : Reordering of Transactions : Instead of posting items based on date received, TCF Bank manipulated the sequence of customers ' transactions to generate more overdraft income. The Bank was very sophisticated in squeezing as much as possible from customers like me, frequently pushing what had once been a single overdraft fee of {$35.00} to XXXX or XXXX overdraft fees ( {$100.00} or {$170.00} ) or even more. This practice has been widely condemned and many Banks have been fined for it ; TCF Bank is acknowledged as XXXX of the worst offenders.
NSF Placement : The Bank essentially charged " fees for fees '', deducting any overdraft fee BEFORE other charges, enabling them to charge multiple fees. When the Bank changed overdraft fee calculation, my fees doubled/tripled. Most heinous of all, this process was virtually impossible to stop, because you could not tell when and how the Bank was going to manipulate the process and charge more fees. As a Judge in another Bank case said, " Under this system, a bone-crushing multiplication of additional overdraft penalties is categorically assured. " Applying Deposits Last : Over time, TCF Bank became more and more adept at making sure that deposits were processed after debits. In one very obvious instance, I deposited cash into my account, which should have been immediately applied to my balance. I then went to a store and made a purchase, which went through. But later the Bank charged me an overdraft fee, claiming that I had made the purchase before the deposit. In this case I had the time stamps from both transactions, but the Bank unbelievably refused to consider a refund. This was just XXXX example of how TCF Bank " gamed the system '' to steal my money.
Misinformation : I regularly used the online account information to check on the status of my account. But I soon realized it was designed to mislead and misinform the customer. For instance, it always indicated that your balance " included all pending transactions ''. But when I was charged an overdraft fee for an item, I was told it " was pending but not included in the calculation of the balance ''. Supervisors were never immediately available and almost never called back. The more I questioned, the more the Bank refused to give answers or consider refunds. In XXXX letter to me, the Bank actually stated that if I did not like their policies I should just leave. I realized that the pattern of deception was deliberate, and anyone who asked too many questions was definitely NOT welcome.
Transfers : For a number of years with TCF, I was either able to complete a transfer or it was declined ; I was never charged an overdraft fee. Then I noticed that the Bank would approve transfers ( and my balance would show adequate funds online ) and then after the fact I would be charged an overdraft fee. Upon my inquiry, I would always be told that I had taken the transfer out AFTER a charge had been processed in my account ; but online my account had shown adequate funds ( including pending transactions ) and regardless the Bank had approved the transfer. I could not have been aware of a negative situation but the Bank surely would have been and could have declined my transfer. Instead, they approved it and charged me an overdraft fee.
The predatory practices of this Bank deprived me for years of a huge part of my income ( I believe at least 75 % of the charges were deceptive ) and cost me enormous stress and lost time trying to find remedies. I live with the understanding that I should have changed banks years earlier ; but still, everyone has a right to be protected from this outright theft. I am therefore seeking the assistance of CFPB in recovering these fees.
