Complaint: I am a personal check account holder with T.C.F. National Bank. I was the victim of check fraud and forger y. Two checks, one for {$2500.00} and another for {$5500.00}, were forged on my account. The bank doesnt dispute this. However in a letter of determination regarding the reimbursement of my {$8000.00} from their fraud and forgery department they determine that my " failiure to exercise ordinary care in safgeguarding your checks substantially contributed to the making of the forged signature. '' Dated XX/XX/XXXX . Signed by XXXX XXXX XXXX and Forgery Investigator, TCF National Bank. A little over a year ago, on XX/XX/XXXX , I was arrersted on an outstanding traffic warrant in the parking lot of a hotel where I had planned on spending the evening. I was approache d by two officers who immediately put me into custody in the back of a police cruiser. I advised t hem I was in between residences and that my vehicles contents needed to be secured. I had just bought the used vehicle that day and I had temporary tags on it. After I was taken from the scene in police custody to jail someone stole my vehicle while I was in jail and took possession of my checks and other belongings and committed fraud against me and forged my signature on two c hecks. A report was filed with the XXXX Police Department by my father after going to pick up said vehicle from hotel parking lot and determining it was gone. On or abo ut XX/XX/XXXX , still incarcerated, I ask my father via telephone to look at my checking account balance. He relays to me that a check for {$2500.00} had been cashed and that a check for {$5500.00} was pending! I have him put a stop payment on that immediately via telephone. I, through my father, advised the bank that the {$2500.00} and {$5500.00} checks were not authorized. I 'm charged {$35.00} stop payment fee and I was glad to pay it. But then inexplicably I 'm reimbursed the stop payment fee the next day, XX/XX/XXXX , because the bank went ahead and cashed the check anyway! A full day after I advised them that something nefarious was happening with my account. I worked with the bank as much as possible. Providing police reports on my arrest etc. Which, by the way, has nothing to do with me being the victim of a crime here. Now TCF National Bank is victimizing me.

Complaint: My HELOC with TCF National Bank was initiated on XXXX XXXX XXXX . TCF Bank managed the servicing of this and the loan/account number provided was XXXX . I had been making payments through the designated online portal until XXXX XXXX when my access to this appeared to be blocked. I was presented with an error message stating my login details were invalid. Believing this was a website issue I gave it a day or two before trying again, but was met with the same error message. I attempted to re-register the account online, however when I entered my account number and last four digits of my social security number the system said it was unable to locate an account. I called TCF customer care and explained issue and inquired if my note had been sold and/or if it was now being serviced by someone else. The customer care representative stated the note had not been sold, that TCF were still the servicers and while they had no answer as to why the portal was not working they suggested I mail payment instead. Thinking this would be a one off payment I went into my bank and got a cashiers check ( at my own expense ) and sent this to the address listed the my TCF payment envelope supplied with the statements. XXXX XXXX XXXX XXXX , MN, XXXX Through the month of XXXX I made several attempts to login to the TCF payment portal to see if the access issue had been resolved, but was still getting the same error message. Not wishing to miss a payment I decided to initiate paying my monthly loan payment via the XXXX XXXX XXXX XXXX ( XXXX ) bill payment system. I set this up to automatically send out a bill payment check on the XXXX of each month, to the above listed address. The last attempt I made to access the online payment portal was in late XXXX and it was still denying me access ( see Exhibit A ). On or around the XXXX of XXXX I received via mail, a servicing transfer letter stating my note had indeed been sold to XXXX XXXX XXXX XXXX ( XXXX ) effective XXXX XXXX , XXXX . In this letter it stated that while the note had been transferred, that XXXX does not itself service the loan. The servicer was to remain TCF Bank and I was provided a new address below for all correspondence ( see Exhibit B ) : TCF Mail Code XXXX XXXX XXXX XXXX XXXX XXXX , MN XXXX As per the new instructions I made XXXX payment via the XXXX bill payment system to above TCF address. It is worth noting that by the time I was informed of this change I had already made XXXX and XXXX payments. However I had not received any correspondence stating there were issues with the manner in which these payments had been made. In XXXX , out of the blue, I received a letter from TCF Bank explaining that as per my request they would no longer be contacting me using automated phone messaging services ( see Exhibit C ). I had made no such request and thought this to be highly irregular. I called TCF customer service and re-confirmed the contact details of my account and at no point during this call was informed of any issue with the account. XXXX 's payment was sent the same way as XXXX and having not heard anything different I believed all was well with the account. In XXXX upon receiving and reviewing the statement I saw the payments for XXXX , XXXX and XXXX had not been applied to my account. Shocked to see this I called TCF customer service and was told the reason for this was due to an account number discrepancy as a consequence of the loan transfer. More specifically, and contrary to what was referenced in the transfer letter, the representative indicated that XXXX had its own account numbers. The customer service representative assured me that they would be able to apply the payments and correct this issue on their end, but at that time was not able to provide me with an alternative account number. Prior to sending XXXX payment I once again called TCF to inquire as to what my new account number was. I was told the only account number on file was XXXX ; the same account number listed on the TCF statement and the same one I have had all along. Not wanting to be late with a payment I sent XXXX check in the same manner as before hoping that the issue would be rectified on the servicers end. In XXXX , as feared, the statement revealed that this issue had not been resolved. I called up TCF customer service and explained how serious of an issue this was and asked to speak to a supervisor. I was told there was no one available at that time to take my call. Feeling desperate and that I could not leave the issue unresolved for any longer, I called the main telephone number to TCFs corporate office and explained the issue to the operator who then transferred me to the customer advocacy department. I was assigned a customer advocate by the name of XXXX who I was told would become my point of contact. XXXX explained that her role was to ; audit previous payments on my account ; rectify the current non-application of payments to this and to monitor the account moving forward to ensure this was fully resolved. XXXX also explained that the reason the payments were not being applied was that the loan number used by the new note holder is different from the loan number originally issued when TCF Bank originated your loan. I asked for this alternative account number but XXXX was unable to provide me with this. I had also noticed that TCF were now reporting XXXX , XXXX and XXXX payments as unpaid to the credit bureaus. This angered me as I had been told by customer service representatives that my check payments had been received, but not applied to due a supposed account number discrepancy and therefore this was not an issue of non-payment. I spoke to XXXX and explained the situation and asked for this to be corrected and be provided with a letter confirming this so I may use to reverse this on my credit report. I was provided a letter that stated that TCF was in possession of my payments for the months of XXXX , XXXX and XXXX but these could not be applied due to a different loan number being noted in the check memo line ( see Exhibit D ). However it is worth pointing out that the transfer letter I received from XXXX referenced the same loan number I was originally provided by TCF ( see Exhibit B ), which is the same account number cited in my monthly statements. Believing that from here the customer advocate would work diligently to resolve the issue I gave XXXX some time to do some research. We touched base a few times through the months of XXXX and XXXX where I was told that she was working with the servicing department and XXXX to fix the problem. In XXXX I received a new statement still showing a growing past due balance indicating that TCF had still not resolved this issue ( see Exhibit XXXX ). I also received a letter from XXXX XXXX XXXX XXXX notifying me that they had filed a notice of default. In this letter they cite the name of the creditor as XXXX , the servicer as TCF and the loan number as XXXX ( see Exhibit F ). As of XXXX my credit report shows that TCF is reporting XXXX , XXXX , XXXX , XXXX and XXXX as unpaid, but XXXX as paid ( see Exhibit G ). This is not what is reflected in the account statements sent by TCF. It appears that in addition to not applying payments received and withholding my checks, that TCF is not accurately reporting to the credit bureaus.
To this day I am yet to receive any correspondence from TCF or XXXX regards any new account number to cite when making payments. I hold both TCF and XXXX responsible for why my payments are not being applied. It is clear I have made all reasonable attempts not only to pay my monthly loan payment to TCF, but also in contacting TCF to try and resolve this issue. Please find attached as Exhibit H copies of all the checks sent to TCF for XXXX XXXX to XXXX XXXX . This left me feeling helpless as without being provided the correct account number my payments are not being applied and if I do not send the payments I would be defaulting on the loan ; it is a no win situation. Adding to this misery is the fact that these bill payment checks are cleared funds, so I am still out of pocket the loan payments. This issue has had an enormous negative impact on my life. As a consequence of notice of default I am being contacted daily, by phone, email and mail by individuals and companies offering services to help me avoid foreclosure. Additionally my XXXX XXXX provider, XXXX , sent me a letter stating that under the terms and conditions of the XXXX contract, XXXX can come to the home and remove these panels believing their assets are at risk. They have also suggested that they would pursue legal action against me to protect their assets. This is all very XXXX indeed with me needing to take time off work to try to resolve this and it is starting to take a toll on my health leaving me very anxious. I have had to seek medical intervention and counseling as I struggle to come to terms with the situation. Despite spending many hours trying to resolve this with TCF, I fear this has gotten out of control and I am requesting that the CFPB investigate TCFs servicing practices.

Complaint: I reviewed my checking account bank statement from TCF Bank and I saw several unauthorized charges to a XXXX accoun t ( XXXX XXXX XXXX transit card ). They were small in dollar totals, XXXX a charge and when I reviewed older statements I saw these charges several times dating back to XXXX of XXXX . Although it never made me bounce a check I inquired a t TCF what these charges were for and the very nice teller stated when TCF sent out new debt cards they were linked to public transit. I asked when was I opt-in to this service and I was told I did n't, it was mention in the disclosure of the new debt card. I would love to know how much money TCF has made in over draft/NSF charges by others not knowing their debt card was being hit with a charge every time they boarded a train or bus. This seems to be a very clear UDAAP violation by not telling us, the TCF customer, about thi s service.

Complaint: XXXX of this year, I received a new debit card in the mail from TCF Bank. I activated the new card promptly. I live in XXXX , and most days I commute to XXXX XXXX using XXXX XXXX XXXX 's XXXX XXXX XXXX " XXXX XXXX XXXX or buses, which use a fare system operated by XXXX . Through school and paid for with my tuition, I have a U-Pass with unlimited rides with XXXX . To get on a bus or train, I wave my U-Pass over a card reader, and a screen lights up green informing me I have provided acceptable fare. Like many people, I do not remove my U-Pass and individually scan it over the card reader ; rather, I wave my money clip containing several cards and cash over the reader to save time. Since XXXX XXXX , this has never been a problem, but that changed with my new XXXX XXXX debit card. Unbeknownst to me, between XXXX XXXX and XXXX XXXX , XXXX charged my TCF debit card instead of the U-Pass for a total of {$120.00}. TCF Bank and XXXX never informed me that their debit card could charge at transit card readers, and I was unaware a checking account could even possibly be charged in such a way. TCF Bank refused on multiple occasions to refund me the {$120.00}. XXXX refused to even look into my case, flatly stating " no refunds '' despite me having a U-Pass with unlimited rides.

Complaint: I am currently unemployed as of XXXX XXXX , XXXX , and am working very hard to find employment, in fact I have several job interviews lined up for next week. I am a single mother of XXXX children, XXXX with XXXX XXXX and we live in the lower of my duplex so that I have help with the mortgage payments. I have my first mortgage wit h TCF Bank as well as a line of credit and 2nd mortgage. I have been working with the loss mitigation team with TCF t o refinance my first mortgage since last XXXX as this mortgage had a balloon payment due in XXXX XXXX . I contacted a mortgage broker who put me in touch with a mortgage company, XXXX XXXX XXXX , specifically XXXX XXXX . XXXX XXXX has had previous experience dealing with TCF. At this time the automatic payments on my mortgages ceased, please note that previous to this point I NEVER missed a payment on any of the three mortgages for the years I had them. XXXX XXXX contacted everyone she could at TCF and found that no one would accept my payments on the mortgages to make them current so that I could qualify for a new mortgage with her company.. I have emails from XXXX XXXX as well as XXXX XXXX at TCF. XXXX XXXX was no longer able to help me at this point because she could never TCF to take my payments to make me current. As of XXXX I began again with working with TCF Loss Mitigation a nd XXXX XXXX . I sent all the information again including proof of payment in full of unpaid property taxes. I didnt hear from them at all until I received a call at the end of XXXX . They were going to work with me until I told them I had lost my job. Also, at this time is when I was informed that I had never reaffirmed the first mortgage after my bankruptcy in XXXX . I contacted the law firm that did my bankruptcy, XXXX XXXX XXXX , and they said they never received the reaffirmation paperwork from TCF. The attorney said that he would contact their attorney but hasnt heard from TCF. Why had t hey been accepting my monthly payments if I had not reaffirmed the original loan. At this time, the beginning of XXXX , I contacted XXXX . I turned in all the paperwork and sent the paperwork to TCF. XXXX XXXX from TCF loss mitigation admitted to receiving all the paperwork XXXX and I sent to TCF. Now I have received a foreclosure summons dated XXXX XXXX , XXXX . This is dual tracking. I need to be able to either refinance through TCF or be able to find another mortgage company. I do not want to lose my house.

Complaint: My job relocated me ov er 3 ho urs away from where my house with t he TCF ba nk mortgage was and I continued to make my payments however I was paying for XXXX mortgages plus went through a divorce and times were hard. I went to the bank to see if they could help me out. They said I qualified for doing a short sale however they set the price so high that my realtor said it would never sell based on the market and what houses were going for. I relayed this to TCF but they would n't lower the price. Paperwork was signed in XX/XX/XXXX . I asked if there was a time span in which it had to sell by or if they would lower the price, I couldnt seem to get a straight answer out of anyon e from TCF. At one point a round XX/XX/XXXX I was contacted by them saying I had to make a decision and either continue as is as the short sale was no longer an option and may not be again in the future depending on my circumstances or else they would start foreclosure action. I had no offers on it. I was also current with my payments and told them they couldnt start foreclosure as I was making my monthly payments on time. I had simply gone to my bank to see what they could help me out with without going through a foreclosure process if I were to stop paying. I was not treated as a very valuable customer. The only option I was left with then was doing a deed in lieu of foreclosure as I thought it was a win win situation for both the bank and me without either side having to incur high expenses of retaining an attorney and I wouldnt have to affect my great credit and they would have the house free and clear. Well that didnt happen. They would only do it by holding me responsible for another {$10000.00} saying I had to come up with which I am paying them back each month. They wanted {$15000.00} so I had to hire an attorney to tell them I had no money to pay them and they reduced it to {$10000.00}. I was in this predicament due to all of the mortgages I had and them not reducing the amount of the house when it was put up for sale as a short sale for the amount the realtor suggested. I was also told that they had to report the deed in lieu of foreclosure to the credit bureaus however it would show my loans as being satisfied with them. Well come to find out they reported it to the credit bureaus inaccurately as an involuntary repossession and I didnt know this for well over a year when I tried to refinance the house I was living in which is with a different lender. The new lender I was working with showed I still owed {$45000.00} to TCF. I then re-contacted TCF in XX/XX/XXXX and t hen was told that they had reported it inaccurately and they would correct it. They apparently submitted something to the credit bureaus. So now this affected my credit for well over a year and to what extent I will never know but enough that I couldnt take advantage of the lower rates to lock into a new loan with the house I am currently living in. My application was denied due to the delinquent past credit obligations that were showing up on the credit bureau reports which ended up being the amounts that TCF took as a loss when they sold the property. This shouldnt have appeared on my credit report ever. I then had to wait for 8-10 months to pass before attempting to try for another loan again. They wouldnt reduce the short sale price when I asked them to and come to find out they sold that property for {$85000.00}. If they had allowe d me to lower the price in doing the short sale it would have sold and they wouldnt have held me responsible for any additional money. I believe they did the higher price knowing it wouldnt sell so they could stick me with a new loan having to pay them back on a property I no longer own. I think they prey on people that are between a rock and a hard place and they dont care if you are a long term customer ( which I was for many y ears ) and tha t they affect your credit.

Complaint: XXXX XXXX in XXXX Va XXXX ( XXXX ) XXXX pulled and sent my credit information to multiple banks not only without my consent but after I plainly told them I was working with them and another dealer and I wasnt letting either pull my credit until I saw who gave me the best offer. Well I had bought a car from XXXX a few months back and they evidently pulled my old application and used my information to do a credit pull anyway probably thinking theyd force a sale on me. I called them and asked them to remove these illegeal inquiries and they refuse. I have the text messages from them where I plainly stated they in no way had my permission to pull my credit and that they better not pull my credit. The next day my credit monitoring showed they still did it. I called and they told me I have to call the bank directly I did and this bank made it clear they work with dealers not consumers I want this company held accountable.

Complaint: What a nightmare situation. On the last week of XXXX I accepted a subscription for {$120000.00}. Paperwork prepared by our company attorney. I received a series of personal checks from the investor from different accounts equaling the {$120000.00}. On XXXX , XXXX I made the deposit at a branch TCF bank. Prior to the deposit I had a positive balance, money that cleared a year ago, in the thousands. On XXXX , XXXX my account had been put in the negative the {$120000.00} plus my available balance. I called and spoke to a rep who was very helpful in explaining this was not normal and that my original balance would be made available again the morning of XXXX , XXXX and the deposit of {$120000.00} should be available the morning of Friday the XXXX , XXXX . On XXXX , XXXX the deposit of {$120000.00} was not made available so I called to see what the status was. I was told by a rep that I would need to ask my investor to get verification of the checks from his banks in order to release the funds. Meanwhile TCF had already contacted the issuer themselves to verify he had issued the checks. My investor stated he did issue the checks and those funds had already been taken out of his account on XXXX , XXXX . On XXXX , XXXX I received a letter from TCF stating it had the deposit of {$120000.00}, they released {$5000.00} of it and the rest would be made available on XXXX , XXXX . On Saturday the XXXX of XXXX I noticed the deposit and my original balance had been released. Keep in mind I own an upstart and these funds were what we needed to green light our project. Ive been working on my company for over 750 days to get to this point. In the morning of Monday XXXX , XXXX I gave my vendors the go ahead to move forward. At around XXXX pm Monday XXXX , XXXX I check my balance to find out TCF put a hold on my entire balance again, the {$120000.00} deposit along with my already cleared funds. I called TCF only to get a run around and the only information anyone would give me was it was In Review On Wednesday XXXX XXXX I went to a branch location to see if I could get some help figuring out whats going on. I met with the Assistant Manager of that branch and she was trying to be very helpful. I explained the situation and she confirmed something wasnt right. She made a phone call and was told the account was In Review and that it would all clear by XXXX XXXX . She had no clue why the bank would hold funds already cleared so she recommended she talk to he r manager and see if they could release some of those funds. I stated I didnt need the funds as much as I needed to get the situation resolved. She went and spoke to her manager and her manager came to speak to me. The manager of that branch was cold, calculated and lacked the empathy one would expect given the situation. Kept giving me the standard theres nothing we can do and I understand your frustration She then contradicted the information given to the assistant manager and s aid they didnt know when the account would clear and that is was In Review On XXXX XXXX I visited the same location to drop of bank statements given to me by my investor showing all of the funds had been released to TCF on XXXX XXXX . I spoke to the same assistant manager and she faxed and called to check the status. She said all she can tell me was the account is In Review Since then I cant get any answers and my attorney has sent a letter via email and mail. We still cant get any answers and today is 22 days since the deposit. I get TCF has The Right but does having the Right make this right? How is it I get no answers, no correspondence and no path to resolution? Now, Ive green lighted my projects, vendors are getting antsy and my credibility is on the line all because TCF doesnt extend a professional courtesy. Also, I started this account over a year ago with a deposit of several personal checks equally {$64000.00} and that was cleared within two bu siness days. To date, XXXX XXXX , XXXX no one from TCF has attempted to contact me given this situation and our company attorney has attempted to make contact with TCF 's Lead counsel with no avail. Complaint: I have been usin g TCF Bank until recently when I read about the unfair ways they are " tricking '' their customers into overdraft fees. I have had NUMEROUS issues with them and they continued to do it. I switched banks, but still have a couple auto withdrawls and a weekly automatic deposit. I looked at my account and was charged {$110.00} in overdraft fees today. I called TCF and they said there were several items that caused the overdraft. When I looked at my account yesterday, it was positive, with XXXX pending withdrawls and automatic deposit. It did n't make sense at all why I would be charged XXXX fees. They refused to help me and I hung up the phone.

Complaint: First of all, when I got this personal loan ( consolidation of debt ) through TCF Bank they setup my home mortgage account as collateral ( as a back-up in case I didnt repay back this loan ). I have had this loan for 10 years already and the loan amount hasnt really gone down, hasnt even made a dent to what is the outstanding balance. To top it off on my statements it always states an 8.50 % interest but I think its actually higher ( this occurred when in 2008 I was unemployed and missed a couple of payments ), but this interest detail was never stated when I took out this loan. The representative at the bank misled me with this information. Apparently the interest was always suppose to stay the same and not go up. I have many times tried to refinance this loan, bu t TCF Ba nk has always been difficult in doing this for me, they have setup alot of roadblocks in refinancing my loan. They have always given me a hard time in releasing the loan subordination letter, trying to talk and communicate with them is like talking to the wall.

I received a package from XXXX XXXX XXXX with the instruction and a check {$1900.00} issued by TCF National bank XXXX Account Number XXXX . The instruction said to make deposit to my bank and the money send out by XXXX . I also received a lot of Email and text as name on XXXX XXXX and asked me to do it. I wired out {$820.00} to XXXX XXXX in Texas on XXXX / XXXX / 17 and {$810.00} to XXXX XXXX in Texas on XXXX / XXXX / 17 . After I wired them out, the check deposit was returned and no able to use the check. I currently lost money {$1600.00}, wire fees {$23.00} and bank returned fee {$25.00} ; totally {$1600.00}. I have already called and send Email, but I w o n't be able to contact them. Please find them and get money {$1600.00} back from them. I attach all copy 's of the proofs.
