Complaint: There has been non disclosure and various instances of fraud. There has been illegal loan assignment and transfers. SELENE FINANCE is attempting an illegal foreclosure. I have received and NOTICE OF DEFAULT with intent to ACCELERATE. They have not answered any questions or proven they have standing to foreclose. Issues that Caused irreparable damages:1. Security deed has fraud on its face and is forged. 2. Contract based on fraud due to none disclosures. 3. Notice of default sent prior to assignment ( 2010 ) 4. XXXX XXXX was never given 30 day notice prior to the scheduled foreclosure sale5. Foreclosure Sale date set without ownership6. Assignment filed with forged document7. Assignment has fraud on its face8. Assignment appears to be robo-signed9. MERS transferred Security Deed without express written authority from owner10. MERS transferred Note without express written authority from owner11. XXXX accepted fraudulent and forge assignment and file into the public record12. XXXX stated XXXX XXXX is owner of loan/note13. SELENE FINANCE is servicer and according to Federal Law a servicer can not be an assignee. 20. SELENE FINANCE stated XXXX XXXX is owner of loan/note21. XXXX XXXX has stated to me verbally that they do not own any loans22. SELENE FINANCE is currently fraudulently being paid thru XXXX XXXX 's existing chapter XXXX bankruptcy23. Complaint: This incident started XXXX XXXX with XXXX XXXX XXXX, I was for a loan modification that my daughter had applied for to reduce her interest rate, my husband is a cosigner on the account so it has directly impacted him. During the time of the loan modification XXXX XXXX XXXX sold the loan to Selene Finance, which in turn took until XXXX of XXXX to complete. In the mean time she was making all payments as requested by XXXX XXXX XXXX, completed the trial period of restructured payments assigned by XXXX XXXX XXXX to redo the loan with a lower interest rate on XXXX of XXXX. Since then she has been getting late notices and has been put in the credit bureau for non payment due to the change of payments made by XXXX XXXX XXXX and XXXX XXXX, the amount of payment were changed by the bank from {$930.00} to XXXX, but during the course of the transition between banks and them modifying the loan it took a year and them holding the payment in an unapplied funds account causing credit damage to them and my husband. We are still fighting with them and the credit bureau to fix this matter, my husbands score went from excellent XXXX to fair XXXX, he closed a business down with perfect credit and now due to the lack of concern on the banks concern has had his credit ruined due to someone not being able to do there job. We do hope you can help rectify this matter. We will be glad to send you all documentation to support this issue.

Complaint: My loan was sold to a company called Selene Finance which has been a NIGHTMARE from the start. We have been " in the process '' of a loan re-modification for the past 15 months. Our home is now being foreclosed and Selene says they have never received XXXX document from us. WE HAVE ALL THE RECEIPTS, of over XXXX re-modification process being denied, never stating a reason. I have shown that i have no only savings in the bank but also a steady income. I started to research online and they have an F on XXXX, their reviews are all the same, the want nothing more than to foreclose on your home and make a profit for their investors. XXXX XXXX who runs his own investment firm is also the CEO of Selene Finance. This is mortgage fraud and my family and i are about to lose our home due to the fraudulent actions of this company. Please help.

Complaint: We we prey as first time home buyers that were not represented at closing so did not fully understand any of it. No disclosures on the issues of the home. The loan was through XXXX XXXX and XXXX who closed due to fraudulent loans and so our second payment ever was rejected back in 2009 the loan has transferred XXXX and no they are foreclosing since we ca n't afford an attorney we are lost with no options. Complaint: " DO NOT CLOSE THIS COMPLAINT '' I have contacted this office on numerous occasions regarding the issues with my mortgage company. Since XX/XX/2014, I have had nothing but issues with how things are handled. I reached out the VA office XXXX XXXX XXXX XXXX to assist me with the loan modification and getting things completed. After receiving the the XXXX package XXXX XXXX XXXX ) from Selene Finance I realize that the documents were expired ( probably the ones that should have been mailed out back in XXXX XXXX and the discrepancies with the information listed. I emailed XXXX XXXX the copies and she agreed that I should not sign them. She advised me that she was working closely with the VA Coordinator from Selene Finance. Shortly afterwards I received another loan modification ( XXXX XXXX ) ; which I returned to Selene Finance unsigned, with a note stating for the XXXX time that XXXX XXXX is no longer on the recorded on the deed of this property since I was advised by previous lender to remove him in order to do a deed in lieu ... if Selene Finance was really doing their job then they would know this already. Before sending the package I tried calling Selene Finance numerous times at the phone number listed on the documents only for the number to be busy each time. I do n't find them to have any concern for resolving my concerns. I thought with all of the incentives that mortgage companies receive for loan modifications I thought this would be completed.

Complaint: Loan originally with XXXX XXXX XXXX XXXX who transferred the loan [ without the proper notification ] to Selene Finance during the middle of a Loan Modification Request. Selene came back with unreasonable Loan Modification terms : extending out the term of the loan ; increasing the interest rate from 2.875 % to 5.375 % ; having the Note balloon in 17 years [ which would have been the orignal date the mortgage would have being paid-off, and the Balloon payment is for over {$180000.00} at that time! ]. None of this was disclosed to us until we received the Loan Modification paperwork, and Selene Finance 's pressure to immediately sign the Loan Modification documents. In our opinion, XXXX through Selene Finance are attempting to defraud us under the guise of a Loan Modification.

Complaint: After Selene began servicing the loan, they in turn sent the following to me : 1 ) an XX/XX/XXXX 'Validation of Debt Notice ' letter and 2 ) a XXXX page document dated XX/XX/XXXX titled 'Loss Mitigation Notice of Determination Letter ' - this letter was a form letter that outlined XXXX things ( Modification - 'Approve ', DIL - 'Eligible ', & Short Sale - 'Eligible ' ). It said, if I wanted to proceed, sign the form or call them by XX/XX/XXXX ( I signed the form XX/XX/XXXX and sent it to my HUD Housing Counselor and I personally sent the signed form electronically, on XX/XX/XXXX, with return receipt ( which Selene opened XX/XX/XXXX ). In the meantime, I had XXXX days to dispute the XX/XX/XXXX 'Validation of Debt Notice ' and I did so via Certified Mail ( in the form of a Qualified Written Request ) on XX/XX/XXXX. In time, the assigned SPC direct dialed me on XX/XX/XXXX and asked what I wanted to do, I told them I want to remain in the home and I was waiting on their response to the Debt Validation QWR, because there were Corporate Advance fees and other amounts shown on the Monthly Mortgage Statement, when compared to the total on the Debt Validation Letter, which were unexplained ( the total amount due is still inconsistent ) ; I had yet to get a Trial Modification Agreement. On XX/XX/XXXX Selene sent a written response to my XX/XX/XXXX Debt Validation QWR and indicated on page XXXX of their letter that I had a Trial Modification that started on XX/XX/XXXX. I never received a Trial Modification Agreement or even a 'Verbal ' agreement and they had just called me to discuss the loan on XX/XX/XXXX. Therefore, the Housing Counselor did call Selene on XX/XX/XXXX XXXX stated the they needed communication stating I did not have an attorney, thus the Housing Counselor confirmed to me this was faxed to Selene ) ; as follow-up, the Housing Counselor called Selene again on XX/XX/XXXX and the Selene agent could see a monthly amount in their system, but they did not see where an actual Trial agreement was sent to me or communicated ; the Housing Counselor was curious too, because Selene never stated what 'type ' of Modification they recorded. On XX/XX/XXXX, the Housing Counselor emailed me, to see if Selene had sent a Trial Modification ; they had not. By XX/XX/XXXX the Housing Counselor checked again with me to see if Selene had corresponded ; they had not. After patiently waiting, on XX/XX/XXXX, I called Selene and asked what was going on with the loan and was told they could not tell me anything, because I had an attorney ( I never had counsel with them ; my Housing Counselor sent the letter stating this back on XX/XX/XXXX ). On XX/XX/XXXX, I was told by XXXX to DISREGARD all prior Selene communication. I resubmitted a Modification Package on XX/XX/XXXX ( it was promptly denied on XX/XX/XXXX and I had called that very day for an update and was not informed of this ). Then, I appealed the denial on XX/XX/XXXX ( Selene responded in a XX/XX/XXXX letter saying I could not appeal, because I was revealing new information, thus the appeal was not valid - Selene again told me to submit another Loan Modification Package ). Also, on XX/XX/XXXX, Selene finally responded to HUD that I had refused their Loan Modification - Selene did not say this in their CFPB response on XXXX. I submitted another loan modification package on XX/XX/XXXX ; Selene notified me that it they would make a decision by XX/XX/XXXX. I called on a few times each week thereafter and was told, on XX/XX/XXXX the Underwriters review was complete and it was sent to the Quality Control Team. On, XX/XX/XXXX and I was told the file was denied on XX/XX/XXXX ( not enough income ) and the QC Team 'Approved ' this on XX/XX/XXXX.

Complaint: I have a complaint against my mortgage Co Selene Finance. XXXX XXXX XXXX XXXX XXXX, TX XXXX phone # XXXXXXXXXXXX XXXX sold my mortgage to Selene. I had an agreement with XXXX that if i paid before the end of the given month i would not be charge late fee. I was not behind on my mortgage. Once this was sold I also contacted Selene and asked them to do the same since we live pay check to pay check and my husband gets paid on the XXXX sometimes going past the XXXX which the mortage is due by. they would not comply with this. To make matters worse I was out of work due to an opperation and did not get paid right away. The mortage was due so we sent in {$1100.00} not the full {$1400.00}. What we did pay was the principal and interest and some towards the escrow for taxes and insurance. They cashed the check but said they can not credit the account because they do not post partial payments. So now my statement shows {$1100.00} unapplied and am considered late. I want them to post the {$1100.00} and not consider me late. What else can I do. I also want them to work with me to not charge the late fees which are building up. What can I do. Please advise.
