Complaint: I have an urgent situation where I am doing everything I can do to save my home from XXXX XXXX XXXX who has very recently sold my mortgage to Selene Finance in order to avoid their obligation to me under the XXXX Loan Modification mandate and numerous representations and promises made directly to me over the last two and one half years by XXXX XXXX XXXX. I am the " XXXX for the Pattern of Deception that XXXX XXXX XXXX has employed to avoid completing a XXXX Loan Modification on my primary residence that the bank unilaterally started back XX/XX/XXXX when the bank contacted my Chapter XXXX Bankruptcy attorney to get his permission to " make me a special offer '' ... ..which I accepted and have faithfully submitted everything that the bank has asked for over and over, again and again, over the last two and one half years.
During the last two and one half years XXXX XXXX XXXX has told me that " I met all the criteria '' for the XXXX Modification, " that if I get XXXX modification, that I would get all XXXX '', as I had XXXX mortgages with XXXX XXXX XXXX at the time, ( the bank gave me a XXXX modification on my Arizona rental home ), was told IN WRITING, " that all of my appeals were valid '', " your mortgages DO QUALIFY for a XXXX modification '', and as recent as XX/XX/XXXX was told by the Vice President of Customer Resolution, XXXX XXXX, " that the only XXXX issues that are keeping you from obtaining your XXXX Modification are valuation and income '' ... XXXX XXXX concurred that we adequately addressed XXXX those items in my most recent review, yet, instead of approving the XXXX Modification XXXX XXXX XXXX XXXX decided to sell my mortgage to a third party investor that is serviced by Selene Finance XXXX Selene Finance just told me that they do not offer the XXXX Modification and they just offered me a horrendous " modification '' that I can not afford and that is nothing like what was represented or promised by XXXX XXXX XXXX.
What is particularly egregious is that XXXX XXXX XXXX intentionally interfered with my Chapter XXXX Bankruptcy by telling me that " I met the criteria '' for a special modification under the XXXX where my principal would be reduced 39 %, all of my back payments would be forgiven and my new interest rate would be 2 %. The bank went out of their way to get me to accept their " special offer '' and to take the path that the bank had wanted me to take rather than other options that I had at the time. Furthermore, I told my single point of contact, XXXX XXXX that " my # 1 concern was my primary home and should I just apply for the XXXX Modification on that mortgage? '' XXXX XXXX, told me, " No, you should apply for all four mortgages at the same time, because if you get XXXX, you will get all XXXX. '' I detrimentally relied on that direction from XXXX XXXX XXXX because ultimately I was approved for the XXXX Modification on an Arizona rental property which was not important to me, and to make matters worse, XXXX XXXX then tells me that the approval of the XXXX modification on the rental property changed my ratios so now I was not qualified for my primary home!!! I did exactly what the bank told me to do! I accepted the bank 's offer. I took the path that the bank had wanted me to take. Now, in retrospect, it 's crystal clear that XXXX XXXX just wanted the XXXX XXXX XXXX XXXX mortgages to be OUT of my Chapter XXXX Bankruptcy and the bank did approve the smallest loan but did not approve the other XXXX mortgages and have been pushing me to do short sales on the other XXXX ever since ... ..in fact, I did do a short sale on one of my rentals as a good will gesture on my part hoping that it would help save my primary home. I ended up losing over {$500000.00} on that property and now XXXX/Selene Finance wants to force a horrendous " modification '' onto me or foreclose on my primary home.

Complaint: The issue that I am having with Selene Fiance is unprofessional service and avoidance of reviewing my updated documents that were requested of me to send for a modification that would enable me to keep my home. I am working with a HUD approved agency and I have signed a completed package and dated with all information requested three times. The first XXXX was rejected and I filed an appeal with additional income included which was rejected for insufficient income and I complained to my counselor and Selene. My counselor spoke with Selene Finance and they acknowledged that it was an oversight on their part for not including the additional income. The application was resubmitted. Once this was done they did not reply for over 60 days and when called for status checks I was under review then I was told that the old letter that was sent to me for the previous submission was my outcome. The fact is ; they did not consider the XXXX application that I sent them. This has caused me to become further and further behind on my mortgage payments and my unpaid balance is rising so that it could become impossible for me to keep my home of 14+ years. I received the XXXX request XX/XX/XXXX to send several items again that were already sent. This is a repeat of the mortgage disaster that began XX/XX/XXXX where mortgage companies disrespected the home owner. I am appealing to the CFPB because this has got to stop, these institutions need to be held accountable and pay for their mistakes and not charge the consumer all the cost. I should have a FHA modification and if they have caused me to have more months then I qualify for they should be removed and any additional charges that I may receive. I am retired and on XXXX and my uncle lives with me permanently. I am writing to let others know that they are not alone with the mistreatment that we homeowners are experiencing from these servicers.

Complaint: I have been trying to get a modification for my home " primary residence '' for over a year now. I send the documents that the servicer " SELENE FINANCE '' requests, but they continue to ask for the same documents on a repeated bases, nothing seams to move in the direction of a modification. I was told that the file would go to underwriting, but then they say that more documents are needed, and then they ask for the same documents. I have a foreclosure sale date scheduled for XXXX XXXX 2015.

Complaint: My name is XXXX XXXX and on XXXX XXXX, XXXX I was injured on the job. Since XXXX XXXX, XXXX I have not been working and only receive workers compensation checks of {$330.00}. My workers compensation lawyer, XXXX XXXX XXXX has sent XXXX XXXX a letter explaining my financial situation and my income. I have lost my vehicle, home furnishings and anything I had of value to try to pay my mortgage.
On XXXX XXXX, XXXX I made a payment of {$810.00} to a Representative named XXXX my confirmation number was XXXX. I have been watching my checking account daily for this to come out of my account as I live day to day and keep a very close eye on every penny. Today I called and spoke with XXXX and asked about the payment I made on XXXX/XXXX/XXXX, she said that it had been deleted. Much to my surprise I asked why and she could not give me an answer. I asked if I could please make that payment again and to please note my account that I had made the payment on XXXX/XXXX/XXXX.
I suspect that the payment was deleted because when I first tried to make the payment on XXXX, I spoke with XXXX and he would not accept my payment because it was only a XXXX month payment and he said that per their policy he needed me to pay two months. I told him that I couldnt pay two months as I cant forsee if I will have {$810.00} by the end of the month. I tried explaining to him numerous times that I am due a settlement here very soon and plan on bringing the account up to date. I asked to speak with a supervisor and while on hold I hung up and decided to call back and speak with someone else. When I called back and spoke with XXXX she immediately took my payment without a problem.
This company calls me at least XXXX times a day. I block the number and they call from a different number. They send people to my house taking pictures and leave notices on my door. I have confirmed that I still live in this house and to not come back on the property and not to be taking pictures, however, they still do it on a monthly basis. Just a few days ago the man who came out here was armed with a weapon on his hip. I told him not to come back on my property. We have received up to XXXX letters a day from them. It 's ridiculous.
I am paying Selene a payment every month, they will not take partial payments, or anything. I have explained over and over my situation. I dont like being behind on payments, and I have only 2-3 more weeks to go and everything will be fine again. I just want them to take my payments and stop harassing me. Besides a letter from my lawyer and me telling them what has happen to me I dont know what else to do.

Complaint: I bought home in XX/XX/XXXX taxes were escrowed for {$3800.00}, my loan was transferred to Selene Finance in XX/XX/XXXX my property taxes were {$4900.00} so there was an escrow shortage according to Selene the amount was {$750.00}. In XX/XX/XXXX I paid for the shortage in my escrow. My mortgage increased by {$62.00} to make up the escrow shortage. In XX/XX/XXXX my property taxes were {$3100.00}, a difference of {$1800.00}. In XX/XX/XXXX I was two month behind on my mortgage but I had not received credit for my overage in escrow from Selene Finance. My loan was transferred to XXXX XXXX XXXX in XX/XX/XXXX but Selene Finance never transferred over that there is an overage in escrow for XX/XX/XXXX. I was behind two months because I was working on a modification with XXXX XXXX a t Selene this lasted for 9months. When XXXX XXXX XXXX got my loan my mortgage payments should have been {$1800.00} but this was never reflected because I was on a payment plan with Selene to pay {$1900.00} because I had requested a modification. I paid this extra amount for one year and still no modification nor credit for {$1800.00} for XX/XX/XXXX. In XX/XX/XXXX my flood insurance decreased by {$530.00} so now for XX/XX/XXXX my mortgage should be around {$1700.00} but I was still paying XXXX {$1900.00}, because Selene never transferred that new escrow and payment plan. I kept telling XXXX that I was owed escrow amounts from Selene they said that they could not do anything I had to go after Selene. This seemed ridiculous to me, but I called Selene and they said they transferred over the escrow to XXXX. After much debate with XXXX they finally reviewed my account in XX/XX/XXXX and saw that I was owed {$2600.00} for escrow and for the overage in payments I was making I had to debate with them for over 6 months for this to happen, but they still did not credit me for XX/XX/XXXX. A new person started to work on my modification at Planet Home lending XXXX and we came up with a plan for me to pay {$1900.00} for XX/XX/XXXX in XX/XX/XXXX I would pay {$4500.00} in XX/XX/XXXX I would pay {$1900.00} and XX/XX/XXXX I would pay XXXX and my account would be up to date for XXXX 's payment of {$1700.00}. So from XXXX to XXXX I would pay them {$14000.00}. Ok so let 's do the math. They credited me for {$2600.00} for XX/XX/XXXX shortage, I continued to pay monthly payments of {$1900.00} to cover past months. I have a suspense account with about {$1000.00} in that account in XX/XX/XXXX. If we add all I have paid and what they were proposing for me to pay the total would about {$14000.00} as credit to my account from XX/XX/XXXX to XX/XX/XXXX.I called every month and I kept asking them about the numbers being wrong they told me they would work itself out. Instead of their plan I paid the {$1900.00} in XX/XX/XXXX, XX/XX/XXXX {$2500.00} in XX/XX/XXXX I paid {$1900.00} in XX/XX/XXXX they are asking me to pay {$7100.00} in XX/XX/XXXX to cover XX/XX/XXXX, XX/XX/XXXX XX/XX/XXXX and XX/XX/XXXX. Then in XX/XX/XXXX I should pay my regular {$1700.00} a total of {$13000.00} inclusive of XX/XX/XXXX payments versus their proposal where I would pay {$14000.00} inclusive of XX/XX/XXXX, a difference of roughly of {$13000.00}, not to mention what is in my suspense account of about {$1000.00}. I try to explain to the people at XXXX the numbers and they do not seem to get it where are their numbers coming from? And why have I not received credit for my {$1000.00} in the suspense account I am attaching a statement from them I printed showing they did not give me credit for my suspense amount as per the conversation I had with XXXX on XX/XX/XXXX. Where is my escrow from XX/XX/XXXX and my extra money in the suspense account.

Complaint: I am reporting to you a Complaint against Selene Finance XXXX XXXX XXXX - Loan # XXXX ) who has fraudulently reported me to the Credit Bureau for a mortgage loan debt that was discharged on XXXX XXXX, 2013. The Chapter XXXX case number was XXXX. The Honarable XXXX XXXX XXXX was the United States Bankruptcy Judge granting the dismissal. This loan has been transferred to three different Servicers in the last year. Selene previously reported it to the Credit Bureau but removed it after being informed by the Trustee of the Case. They just reported it again. It has caused me to be turned down for an auto loan, and to be approved for a lease on a new apartment. Their reporting dropped my credit score XXXX ( XXXX XXXX points. No other Lender has done this to me accept for this non-bank Servicer, inexperienced in Loan Servicing Matters. The are also guilty of " Dual Tracking '' as they are considering me for a HAMP MOD, while continuing to move forward on foreclosing on my property. Complaint: Selene Financial bought my home loan and are now the servicer for the loan. They have promised me a loan modification without any resolution. They have send a anonymous person posing as a real estate agent taking pictures of my property and providing me no proof of anything or paperwork. The so called agent or spy as I would want to call them took pictures inside my house and of not just the property but also of our personal pictures on the wall. They do n't tell you why they are there just to evaluate the property and Selene does not even give you a notice.

Complaint: We are currently in the process of refinancing with another mortgage lender and requested on XXXX XXXX, 2015 to have our current mortgage company, Selene Finance, send a copy of the note to the new mortgage provider. We were advised it will take 7-10 business days. On the XXXX and XXXX business days, we were told that Selene had up to midnight on the XXXX day to send it and they would take the whole day. On the XXXX day, the note was still not sent so we called and were told that the XXXX previous employees we spoke to were incorrect and that it can take up to 30 days if not requested in writing as verbal requests are " put in a pile ''. We then spoke to a manager, XXXX, to complain that XXXX different Selene employees advised us incorrectly which is unacceptable. We were told that she would escalate it and would not promise anything as far as timing. We even had to ask her to call us with an update on the situation. Selene acquired our mortgage in XXXX 2015 and this is the XXXX issue we have had with the company in 7 months. Their Customer Service department is absolutely horrible ( not helpful, not trained, incompetent ), and I would advise anyone to stay away from this organization as there are PLENTY of other mortgage service providers who can provide you with better service.
