Complaint: Loan servicing has been transferred multiple times and the original servicer never complied with the Court Ordered Stipulation on a confirmed Chapter XXXX Plan. The servicers are all in contempt of court and need to correct the servicing on this account. I have written multiple times to try and get this corrected going back to 2012 and no one is correcting the account and they are charging me fees for eroneous inspections that had the servicer corrected the account, none of these fees would have been assessed.

Complaint: On XXXX XXXX XXXX I executed a trial modification with Selene Finance who claims that they are the servicer on my loan. I brought to my counsel 's attention at the time that there were some discrepancies in the modification. The main issue being that the calculations within the document were not the same. The outlined trial modification agreement asked for a payment of {$5300.00} on XXXX/XXXX/XXXX, which was prior to the date we had to accept, and then the monthly payment was to be {$2500.00} on the XXXX of the month there after.
Had we taken the option to have the payments ACH'ed from my account the payment structure was {$3500.00} on XXXX/XXXX/XXXX, {$2900.00} on XXXX/XXXX/XXXX and then a monthly payment of {$2500.00}. Over the term of the trial modification there is a difference of {$3900.00} between the XXXX. I accepted the trial mod as there was no response ever given and I feared losing my home. Every month I made payments timely. In XXXX of XXXX I was offered a permanent modification. The terms stated that the principal and interest payment was {$580.00} and the taxes and insurance were {$220.00} making the monthly payment {$800.00}. We reached out to Selene thru my new counsel and questioned the new payment and addressed that as per the trial modification there was to be a forgiveness on the deferred payment of {$100000.00}.
On XXXX XXXX we received an addendum to the permanent modification that was a {$75000.00} principal reduction. This again not being what was outlined, we asked again for the modification to be reviewed and offered in line with the trial mod. On XXXX XXXX, XXXX we received a new permanent modification. This time the principal and interest payment was {$1700.00} and the taxes and insurance were {$800.00} making a monthly payment of {$2500.00}. Again there in no forgiveness on the deferred payment as outlined in the trial modification. We have continuously asked for an explanation, a calculation of the payments received since XXXX as these were not deducted in the final modification and a modification that is dated in line with the present day. The XXXX modification still states XXXX.
On XXXX XXXX, XXXX there was a Notice of Sale given with a sale date of XXXX XXXX, XXXX. I have not missed a payment to date, and all I have asked for is clarity and a modification as I executed back in XXXX of XXXX. None the less, Selene moved for a sale date on my primary residence. This too being a breech in the trial modification outline that stated as long as we remained current under the terms of the agreement the foreclosure will be placed on hold for the term of the agreement. This being the second breech as they moved for summary judgement on XXXX XXXX XXXX after I executed the trial modification agreement and Selene accepted my money and continuously did since XXXX of XXXX.
In addition, to these issues as stated in the trial modification the lender will report the loan to the appropriate reporting agencies with the comment " paying under a partial payment agreement ''. My credit report just states that I am 120 days + delinquent. I have made payments as per outlined in my agreement and agreed to my end of the agreement. All the while Selene has broken and violated almost every portion of their end of the agreement. They have not offered a permanent modification in line with the trial modification, moved for summary judgement and a sale date on my home, and break FCRA and FDCPA statutes I feel that I am being bullied and manipulated into signing something just so that I do not lose my home in 21 days.
They are constructively using elder abuse as they know I am a XXXX. I also have asked who the " lender '' is and have received no response.I am entitled to know who the lender is, especially when the modification papers state that Selene is servicing for XXXX XXXX. When i mentioned XXXX XXXX I was told they are not the lender.

Complaint: Selene Finance has been reporting my mortgage loan delinquent to all credit reporting bureaus despite the fact that the mortgage was part of Chapter XXXX bankruptcy settlement dating back to 2011. I have made numerous attempts over the past three months to discuss my account with customer service representatives, but they refused to discuss my account insisting that the attorney who handled the bankruptcy years ago was listed on the account and that they would only talk to him. Once I contacted the attorney, he refused to write a letter to Selene Finance authorizing them to discuss the account with me unless I paid him {$350.00} for the letter. Unable and unwilling to pay for the letter, I was forced to seek another attorney to handle the matter with Selene. For days, Selene refused to acknowledge the letter faxed by the new attorney. Once the new attorney spoke to XXXX XXXX at Selene, she refused to acknowledge the bankruptcy discharge and indicated Selene " did n't care. '' Selene is now claiming I have to start a dispute with the credit reporting bureaus. So my credit status remains unresolved despite the fact that I have gone through all legal procedures and expenses to resolve this financial loan legally. Selene refuses to acknowledge and honor the United States Bankruptcy court order and my credit issues remain unresolved. I did a deed in lieu of foreclosure with Selene Finance a long time ago. The property was sold immediately because it was in perfect condition. Despite all these legal procedures and efforts, Selene Finance, continues to violate my rights under the fair consumer reporting laws with blatant disregard for the the federal and state consumer protection laws. Bank finance criminals receive better protection under the laws than I have received over a measly mortgage loan legally discharged under the protection of the " law. ''

Complaint: Following a series of financial hardships due to medical and work slowdowns, we were working with Selene Finance on a modification of our mortgage.
We begin discussions with them on XXXX/XXXX/16 at which time we were assured by Selene that any other action would be placed on hold. We completed the package and returned to Selene on XXXX/XXXX/16. Without knowledge to us, the home was sold at auction on XXXX/XXXX/16 despite having been reassured multiple times that this action was placed on hold. On XXXX/XXXX/16 we received an eviction notification from the new owners of our home for 8 years where we have raised our family of XXXX children. Also on XXXX/XXXX/16 we received approval of our loan modification from Selene. Over the full course of attempting to work our a financial arrangement, we were moved from department to department and even had to deal with multiple law firms representing Selene through the process. Following this notification, we emailed and called Selene without response. When we indicated that we believed they had failed to honestly and legally represent themselves. We received a secure email link within the hour that contained a very intimidating letter that was not only factually incorrect, but written in a legalese that is difficult to understand.

Complaint: I have been trying to work with my lender for the past 18 plus month to approve a short sale of my property. I explained to the lender that my income had been reduced as I am a sales person that make commission and I had to take care of my father who had came to live me with me and my wife due to XXXX. My father passed away without life insurance and it was up to me to pay for the funeral arrangements as well as take care of his affairs. Between the reduction in pay as well as taking care of my terminal father I was unable to pay my mortgage as well as mortgage on the house my wife and I were living in. I racked up substantial credit card debt just to take care of everyday living expenses furthering my hardship. Most recently my wife lost her job and I recently had a XXXX. After my wife XXXX she was in the hospital for more than two months furthering our debt and non ability to pay on my property. My realtor has procured several viable buyers over the past year and half but each time Selene Finance prolongs the process by requiring multiple paper work that has been submitted before as well as asking for an increase to the selling price, essentially pricing out the market. This has been an burden to my family as well as to my financial well being. I ruined my credit in order to partake in the short sale process only to find that Selene Finance is not interested in allowing a short sale on the property. I am the sole earner in my family, with a XXXX, medical bills, as well as a mortgage on my wife 's property to pay on. I simply can not afford to pay two mortgages, two HOA fees, two utility billings on any type of salary I currently make. I need any help as possible to get from under this property. Selene Finance is not interested in helping me with this situation as the past almost two years have shown.

-- -- -- -- -- -- -- -- -- -- -- We dispute the remarks and information provided by Selene Finance in their response. The fact that they responded to you at all is worthwhile, since we wait and wait for them to respond to us.
The loan was transferred from XXXX to Selene in XXXX 2014, not XXXX 2014. If the loan was transferred in XXXX, why did we make payments through XXXX 2014 to XXXX? The proof of the payments is included in the excerpts we have provided within the Selene Finance document.
Furthermore, they are not complying with the repayment agreement, and we were in danger of non-compliance on the second payment, because they did not take out the ACH debit as they stated they would, and as we signed for. Were it not that we called them at the last minute and made a phone payment, they would have found us deficient in our agreement - because of their inaction.
Please review the comments inserted throughout the attached Selene Finance response document as our dispute to their findings. Our resolution to this would be to have a complete and thorough audit of our account, between Selene Finance and us as the consumer, to fix this mess. It does not help that they provide a more thorough response to a complaint than they do to the actual person whose loan they service.
