Complaint: I have a Mortgage Loan serviced by " Selene Finance ''. I tried for about XXXX Years to get a HAMP Loan Modification. The Loan changed hands of Servicers but my application was declined multiple times. I was so frustrated with the process that finally I applied for a Short Sale in XXXX XXXX. This process went on for over a year .In fact the Buyer Offered more than a full offer but they declined the Offer. The Loan outstanding is about $ XXXX. The Buyer progressively increased the offer and his final ALL CASH Offer was $ XXXX. But demanding $ XXXX, Selene Finance declined the Offer, strangely Now, they have scheduled an Auction of my Property on XXXX XXXX, XXXX. I am left with no option but to re-instate the Loan or lose my house in Auction. I got their re-instatement quote of {$220000.00}, only yesterday, although I have been following up through my XXXX XXXX for about a month now. I am working very hard to arrange this sum. As it is a very large sum of money, I request your good selves to arrange to postpone the Auction by 1 more month, so that I can arrange this money.

Complaint: Selene, asserts that my loan delinquency first began on the date of XX/XX/2016. However they received payments from me in the amount of {$1500.00}, which posted on XX/XX/2016. This payment would have covered XX/XX/XXXX and XX/XX/2016. I also posted a payment with Selene in the amount of {$900.00} on XX/XX/2016 and I have the receipt to prove it. I was then instructed by a supervisor named XXXX at the time, to make double payments again in the amount of {$1500.00}, and this " plan '' would bring my account current XX/XX/XXXX. The payment of {$1500.00}, posted on XX/XX/2016. I had even made my payment for XX/XX/XXXX, on XX/XX/2016, via money gram this payment was returned with the others to my surprise. However something strange happened during the time I was completing the payment plan. I received a notice that my loan ownership was being transferred to XXXX and the next thing you know ; all of the payments that I had made to Selene were sent back to me. My arrangement was likely broken by XXXX, the alleged new owner which only has interests in foreclosure to my home rather than working with me. The fact that I had a previously outlined agreement in which to bring the loan current shows gross negligence on the part of not only Selene, but also the alleged new owner XXXX. XXXX and Selene, is and has attempted strip my property of all its positive equity and foreclose on my home, illegally. This type of greed and deception has been identified on multiple levels with this matter as well as past case law will provide against Selene and its constituents of cronies. Furthermore, per the non-judicial foreclosure process in Texas, it is required that there be a " power of sale clause '' within A paragraph in the mortgage that authorizes the non-judicial foreclosure process is be used. There is no " power of sale clause '' within any paragraph of my mortgage, allowing for a non-judicial sale in the event of my default. My loan was not 120 days delinquent at the time it was remanded to foreclosure review which is in violation to Texas non-judicial foreclosure procedures. Selene had not applied payments properly which in turn distorted my payment accounting ledger in Selene 's system. Furthermore, my loan was referred to a foreclosure attorney on XX/XX/2016, during my regular communication with Selene. I received no default notice of any kind from the alleged foreclosing attorney XXXX, XXXX XXXX XXXX XXXX XXXX XXXX # XXXX, XXXX, TX XXXX. I have not received a 30 day breach letter in pursuant to the terms of the deed of trust and XXXX XXXX XXXX, has violated all forms of precursory events required by law, prior to auction sale can occur. I demand and implore your agency to place an " automatic stay of execution of sale '' to my home based on the violations outlined within. I 'm prepared to file federal civil litigation action as well as a temporary injunction order, to fight this heinous abusive behavior of my predators. Selene, XXXX and XXXX XXXX XXXX, will pay for their transgressions and will be held accountable for what they 've done.

Complaint: We represent a client for purposes of providing homeowners insurance as a licensed brokerage in the State of New Jersey. Recently we submitted an invoice to Selene Finance, LLC for LOAN # XXXX. Selene Finance has an extraordinarily expensive force placed insurance policy for this client. We submitted an invoice and a properly signed, fully conforming, client signed application to Selene Finance for payment in lieu of the force placed policy. In addition the client telephoned Selene Finance and verbally authorized the payment of the insurance policy. Selene has refused to pay the invoice without justifiable reason. The client telephoned and indicated that Selene was difficult to deal with ( the client has difficulty with English ) and that they would not provide a justifialbe reason. Selene has a very expensive and very lucrative force placed policy for this client. Attempts to resolve the matter with Selene resulted in an impasse and once again, no legitimate, legal justifiable reason for denial of payment of the policy. Upon information and belief Selene is engaging in Gate Keeping activities and placing illegal, illegitimate and fraudulent and abusive artificial impediments to borrowers who have force placed policies in order to reap a greater financial benefit. The force placed policy in question here is exorbitantly expensive, offers little or no protection to the homeowner or their possessions, solely covers Selene and in the event of a catastrophic occurrence or claim would benefit Selene Finance more than the homeowner. When it was indicated that complaints would be filed unless the matter was resolved Selene employees replied " You have to do what you have to do '' and patently refused to pay the invoice. The seminal reason for Selene 's denial is a handwritten note on the insurance application which Selene claims violates its internal standards. The application itself is not for Selene, is superfluous to the process for Selene and is for the carrier, and conforms in all ways with federal and state laws, and with carrier guidelines. The submission of the application was solely to demonstrate the clients authorization to place the policy. Once again the client phoned in and verbally authorized the payment of the insurance. It is clear that Selene 's artificial impediment is intended to delay placement of force placed policies, wherein the financial benefit of these extremely expensive policies would yield to their benefit. Quite simply, Selene is abating the client 's clear verbal and written authorization to their own financial benefit. This qualifies as fraud, waste and abuse, is of the worst business practices, is a violation of federal and state standards and because it was stated that this is Company policy it is clear that there is a pattern and practice of deceptive acts and practices being committed by this financial institution. Please address this immediately as the estimated cost to the American consumers at large may be XXXX dollars due to an ongoing deceptive act and practice. The financial injury to this client continues to mount each day the policy is not placed for non payment due to the direct and fraudulent acts of Selene Finance, LLC, its agents and assigns. Thank you for your kind attention to this matter.

Complaint: To Whom It May Concern : Please help me ; I want to keep my home. For the past 7 months, I have been cooperating with XXXX XXXX XXXX and now Selene Finance to provide all the documentation required to modify my first mortgage which is a 30 year Conventional Jumbo ARM. I have attempted several times to get written confirmation from Selene Finance that my documentation previously submitted to XXXX XXXX XXXX was transferred. This has yet to happen. Despite Selene Finance 's unreasonable deadline requests to provide for additional documentation ( which I have submitted every single time on a timely basis ), they seem to be more focused in foreclosing my property instead of helping me keep my home which I have worked very hard since 2003 to pay and maintain. Therefore, this written description serves as my written request to submit my official complaint against my loan servicer, Selene Finance, in helping me modify my mortgage due to the following : 1. Unresponsive : loan resolution department head has yet to return my repeated phone calls 2. Contradictory requests for missing documentation : Despite providing " missing documentation '' via certified mail on a timely & repeated basis, Selene Finance letters are unsigned, repetitive, confusing, and contradictory. 3. Confusing follow-up process : my first mortgage was recently transferred from XXXX XXXX XXXX to Selene Finance. 4. Wrong focus : instead of helping me modify my mortgage due to continued financial hardship as a result of a recent separation from spouse and therefore loss of dual income, Selene Finance refuses to help, does not offer any options ( lowering my rate and/or extending the term of my first mortgage -I have XXXX mortgages on my home- ), and worse-yet facilitates the selling of my home by requiring to dialogue with realtors who are not specialists in modification. Since it is my firm desire to keep my property, I look forward to speaking with a CFPB representative either in person and/or via phone. Please note I have kept diligent records and can show tangible proof Selene Finance committed surprising number of errors that often are grounds to challenge a foreclosure action. Since time is of the essence, I thank you in advance for your immediate attention & response to the contents of this written complaint.

XXXX explained that they could not fit the 4 percent on the modification and I will have 4 months of a trial payments. If I did not want to receive this offer XXXX stated unless you have {$8000.00}. XXXX explained after the 4 month trial payment the mortgage can increase due to taxes. XXXX instructed me to do XXXX and all instructions will be included in the modification package once received. Question was will this Loan modification will be a permanent modification.

Complaint: Selene Finance LP took over my mortgage fom XXXX on behalf of the holders of the XXXX XXXX Loan Trust, Mortgage-backed notes, Series XXXX is the owner of the account, and sps is the mortgage servicer of the account, which gave it to Selene Finance, who put me under a Trial Modification Plan from XX/XX/2015 to XX/XX/2015, paying {$700.00}, plus an additional amount was previous the trial modification. Selene never offered an modification after the full amount of the Trial. I would like my money back since I was not given a modification. I gave money which I did not receive any financial help from selene, plus, they sold it to XXXX.

Complaint: I have been dealing with XXXX XXXX XXXX and it 's collections agencies for several years now. I do have a modification and I got behind in my payments due to the horrible and damaged economy here in XXXX XXXX. I tried everything possible to find adequate work. I finally was able to get a position as a XXXX and It too a very long and lengthy time for me to be approved to be able to XXXX. During that time, I tried to find other work, as well as, work as a hair dresser. The economy was so damaged and bad, that not alot of people came in for services. I worked with XXXX XXXX XXXX and then their collectors, XXXX. They were realtively nice to a point and then some of their people got very nasty as I was calling them to let them know what was going on. I was assured and told that it is happening all over the place. I was switched to Selene Finance and they were monsters and terrible gangsters with me and my account. They were extremely nasty. Once, I was able to pay my bills as the funds starting coming in from both the XXXX and my meager social security, I sent in cashier checks from XXXX. The first check was never sent back to me and the other ones were held for a period of time and then sent back to me. I then sent them a personal check in the amount of {$4600.00} to cover the amount on the bill of {$4500.00}. which cover the entire amount due. They sent back the check and said that it was late. It was not late for there is both a grace period and the fact that I mailed the check the same day that I dated it. I had sent in Cashiers checks from XXXX and they did n't and would n't accept the checks. I now put up the amount of the money due in an account at XXXX since they refuse to take any checks what so ever. Now, they say that I oue over XXXX due to the fact that we went to court. I have legal aid and the lawyer, XXXX XXXX, was sick. I did n't know why we were in the court at all. The judge, XXXX XXXX talked about other things and did n't really address the issues of the bank not taking the checks for the bills that were due. I am an educated man who is XXXX, and do not have any where else to go. I will not live or stay in the streets. My home is all that I have and have worked hard all my life to be able to live a decent life. I do not smoke or drain alcohol or do any illegal drugs at all. I do have XXXX and I am just besides myself. It seems that they have wanted my home for the last several years. The values are coming up again and their is again some equity in the value of the home. I know that they have been know to throw people out in the streets and allow them to die. Please help me. I ca n't stand the tension and the horrible things that I see coming towards me. I am a good man and I have helped out many people but to be treated this way, is unbelievable. I do have {$7100.00} in the bank for the bank but they even tell me that I ca n't talk for myself anymore. Only the lawyers, who did n't fight for me,, is the one who has to talk for me. I DO N'T UNDERSTAND AND CA N'T ALLOW THIS TO GO MUCH FURTHER!!!! They seem that they are after me, to kill me and to take my home. There are structural issues with the house due to the fact hat the HOA signed off on all the defects and structural damage to the XXXX homes that are in the community.. Please help me, before, they XXXX, who wo n't allow them to touch me Thanking you in advance for any and all the help that you can give to me. They are pushing me to have a XXXX. I just want to be able to live in my home in a peaceful and decent manner. XXXX XXXX

Complaint: On XX/XX/XXXX, I received via mail a letter package of frivolous letters dated XX/XX/XXXX and XX/XX/XXXX, along with documents that Selene has had since XX/XX/XXXX that allegedly they claim they did n't received and/or missing pages which prompted my first complaint in which Selene continues to falsely claim they did n't received pages and/or missing pages to the new, pages not readable. This is unacceptable and I am asking that this matter be properly investigated as to Selene 's blatantly attempt to prohibit the sale of the property. As I stated in my complaint, case number XXXX, on XXXX XXXX, 2016, Selene is intentionally prohibiting the sale of the property in which Selene has had a legally executed real estate sales contract for the property since XXXX. Moreover, on XXXX, I spoke with XXXX who serves as a Selene Customer Service Representative. It was confirmed by XXXX that the documents my Realtor, XXXX emailed to XXXX again on XXXX, via XXXX letter of " short sale '' dated XX/XX/XXXX, was received on XXXX and XXXX confirmed the documents were readable and she would send an email to XXXX XXXX to call me ; needless to say, she did not return my call ( XXXX recorded conversation of XXXX ) in which Selene states their calls are recorded. Once again today, my realtor XXXX XXXX has emailed and faxed these same documents per XXXX XXXX 's letter of short sale dated XX/XX/XXXX. These frivolously letters and the falsely claim of not receiving pages and/or missing pages to the new, pages not readable is unacceptable and I am asking that this matter be properly investigated as to Selene 's blatantly attempt to prohibit the sale of the property.

Complaint: Seline Financial was requesting increasing escrow funds due to increased taxes, and insurance, they were asking for a full escrow funds to be double as it was last year in order to maintain the same amount of our monthly payment. XXXX sent them the escrow funds but they still increase the monthly payment from {$1600.00} to {$1700.00}. They put the escrow funds we sent in to a suspense account, do n't know the reason for and on top of that they asking for flood insurance which we already paid for in full until XX/XX/2017. I called them several times, always excuses that they will review the account and call me back, as of today they have not contacted me. My XX/XX/XXXX payment is due XX/XX/XXXX and still showing the new increase amount. Attached is the escrow paid funds, new requested payments, and an statement on this account. Complaint: I requested in writing for Selene Finance LP to provide me with the the " input values '' and review the Net Present Value analysis/model used in making the calculations for the " NPV Test '' along with the date the process was completed in writing according to HAMP guidelines and Selene 's in house modification programs. I have right to a copy of the property valuation report. I also requested in writing for a copy of the pooling and servicing agreement, investor guidelines and the name/entity of the investor for the loan. I was never provided with anything from Selene Finance LP in accordance with PART 1024 -- REAL ESTATE SETTLEMENT PROCEDURES ACT ( REGULATION X ) Subpart C -- Mortgage Servicing CFR 1024.38 ( b ) ( i ) ( ii ) ( iii ) ( iv ) ( v ).
