Complaint: I am in foreclosure and will likely lose my home even though I never once missed a mortgage payment prior to its filing in XX/XX/XXXX. Original lender was XXXX, after foreclosure filing, loan has been re-assigned numerous times causing more issues, delays, etc. as every time they do this, its like starting all over again with new attorneys, new servicers, etc. Now, its with Selene Financial who lies, cheats and breaks the law. After 4 years of constant run around in court, I was finally offered a Mod in XX/XX/XXXX which I agreed to even though I was being erroneously/fraudulently foreclosed upon with proof I had never missed a payment to XXXX prior to foreclosure filing. I agreed just to be done with this mess, rebuild my life and put these years of XXXX behind me and my family. Selene finally sent a Mod pack 6 wks later, I returned it completed almost immediately. No response from them in writing, just their attorney ( XXXX ) telling my attorney all was ok. Selene attny lied to my attny repeatedly in the last few months while pushing case to a trial last week on XX/XX/XXXX when he knew trial should be stopped as we were in Mod negotiations. Selene attny lied to the judge at trial claiming the Mod pack was never returned when it was emailed directly to him 6 months ago! Judge advised in court that he would be ruling in favor of Selene because it appeared I had taken no action to save my home! This is not true, Attorney XXXX for Selene Finance LIED TO THE JUDGE. Every time the judge asked the status of the mod, XXXX remained silent while deferring the question when HE was the only one who actually knew the status of the mod! 30 mins after trial, the mod offer was faxed to my attny, dated 6 weeks prior with an expired deadline! I have been fighting for a total of 8 yrs over this loan. Loan originated in XXXX, by late XXXX XXXX repeatedly claimed all kinds of mysterious fees, escrow re-calulations, etc I modified in XXXX just to clear the slate and put an end to their constantly moving target. Was very diligent about my payments after that having everything on autopay but in XXXX it all started again. After a year of more mysterious fees, recalculations and more moving targets, I retained an attny to assist resolve whatever the matters were, etc. Another year of efforts while continuing to pay the monthly mortgage and whatever else they said I owed but would n't explain or provide documentation for but no relief to their mayhem and finally foreclosure filing in XXXX when I never missed a payment. I have been fighting in court for 4 yrs since. Banks will not provide discovery, will not submit witness lists/exhibits legally, etc. Selene Finance calculated a trial by ambush then lied to the judge regarding the status of my loan and loss mitigation efforts. My only possible option now is to allow myself to be strong armed into an unscrupulous predatory mod agreement before the judge renders the final ruling in a few weeks but I have no faith that Selene and their unethical attorney XXXX will honor it anyway. My fear is they will take more of my money with promises of resolution and pull another illegal, unethical maneuver. I was a financially responsible homeowner with NO other debt other than my mortgage when I purchased my home. I put down a 25 % down payment of $ XXXX on a $ XXXX purchase, invested another $ XXXX into upgrading the home. I signed a conservative 30yr fixed loan I could easily afford. I had owned homes before with no issues and to this day have no idea how all this even happened. I have paid $ XXXX in legal fees over 4.5 years trying to save my home only to have Selene Finance lie in court after taking a case to trial that should not have been in trial. I am a single mother. My home was all I had. They have taken everything from me.

Complaint: For over 18 months I have been submitting documents to Selene to get assistance with my home mortgage. They do not notify me of any missing documents they might need, nor will they tell me why they continue to not assist me. They call XXXX and XXXX times a day and are very threatening. They refuse to take any payment since XXXX 2016, saying that I had to pay the full amount due or they would foreclose immediately. This past XXXX ( after at least XXXX written applications/requests for a loan modification for my home ) they finally carried thru with their threat. For the next 2 months they harassed and harassed me with numerous calls and messages each day and they refused to negotiate and only wanted the full amount due ( approx. {$14000.00} ). Finally with no option left, I filed CH XXXX bankruptcy. During the next 30 days I again, called Selene to see what I could do to keep my home. They said there was nothing that could be done, except to stay current and let the Bankruptcy proceed. In middle XXXX I had my case dismissed without prejudice due to my circumstances. Since then Selene is back to harassing me and giving me false hope and information. Last week, XXXX I re filed an application for Loan modification, as once again my house is in foreclosure. I have repeatedly asked for a different contact person as the one I have XXXX is abusive and is very prejudiced against me. Selene does not follow the FTC or CFPB guidelines and continues to be harassing and threatening. In XXXX they did not send me any notice that my house was in foreclosure, and as of today I have not receiveed anything for the current status. I need your help. My income dropped, it was XXXX and now only XXXX. I am the only provider and I need to keep my house. The deny my requests saying I can afford to pay the arrears within 3 months, but I can not afford to make my payments. Please investigate this company, as they continue to break FTC and CFPB guidelines regarding collection practices. They follow no guidelines but their own. Thank you!

Complaint: I was having financial difficulties due to job loss and the death of both parents 2 months apart. I ask Selene Fine for a modification on my mortgage because I had gotten behind 10 payments ( XXXX ). I attempted a trial modification but it was unsuccessful. I requested another modification but per Selene Finance HUD does not allow XXXX modifications within a 24 month time frame. I tried to explain to the customer service person XXXX, that I did not have the first modification. He proceeded to tell me that I did complete and in addition I had too much debt to ratio and even if they could have done another modification I would not be able to afford it because I do not have enough income

Then recently the loan was transferred/sold from XXXX to Selene Finance. The loan should not have been transferred. Selene is now contacting the seller requesting payment and have not confirmed that the loan is paid. They are threatening foreclosure too.

Complaint: Selene Finance and their foreclosing attorneys XXXX have violated the " dual tracking '' statute under XXXX XXXX regulations. I have been actively negotiating a short sale with loss mitigation at Selene Finance. We are still in the negotiation process and in active open loss mitigation file and while trying to negotiate the short sale they simultaneously are foreclosing on my property. I ask the CFPB to intervene in this matter. For Selene Finance, a debt collector and their debt collector attorneys are violating the dual tracking laws. The sale date is set for XX/XX/2017 According to XXXX XXXX, Selene 's negotiator/underwriter on my loss mitigation file stated that the short sale offer to purchase the property needs to higher. We asked for a copy of the XXXX or information regarding the XXXX and they refused to give any information. We would like to reach a fair price but they need to disclose to the consumer their justification of the higher offer. I ask the CFPB investigate Selene Finance and their attorneys for acting in bad faith. Placing a foreclosing sale date in the middle of a short sale/loss mitigation negotiation.

Complaint: I have been working with Selene Finance for almost a year now. We started a loan modification which started in XXXX 2016 in which the first payment had to be {$1700.00} and sent by XXXX or XXXX XXXX. They received that payment. The next payments from XXXX to XXXX were {$890.00} and they were paid {$890.00} every single month. I got a call from the agent that was working with me throughout the modification in XXXX asking me when my payment was going to be made so they could go ahead and finalize my modification as soon as the payment was received but that never happened. What I got was an excuse that they were too busy to finalize my modification. After the final payment while I was waiting on papers in XXXX that never came I sent it my original payment of the {$630.00} being that I had not heard from Selene any more except for receiving a foreclosure letter during the modification which I was told to ignore and they do n't know why it was sent. When I sent in the original payment I got a call stating that if I wanted them to finalize my modification I needed to send in an additional amount of {$250.00}. I asked them to send me a letter stating the foreclosure was in error before I sent in anything and I got that on XXXX XXXX, 2016 by XXXX XXXX. It also had a letter attached with XXXX XXXX who was listed as Team Lead. However even after making that payment I never received my modification papers or even heard anything else from Selene until XXXX XXXX from a XXXX XXXX. I was told the morning of XXXX XXXX, 2016 that a letter had been mailed out to me on XXXX XXXX, 2016 stating that I needed to make my payment in order for them to continue with my modification. I gave XXXX the payment over the phone that same day during this particular conversation only to pull a letter out of my mailbox on XXXX/XXXX/2016 saying I would not be getting my modification. I paid every payment during that trial period exactly the way I was told every single month. I got the run around for 3 months and this company who I had read at least XXXX complaints about the same exact experiences and this company continues to get away with the same tactics on taking people 's homes. I 'm not understanding how they continue to keep getting away with this to people they are suppose to be trying to help. We did everything that was asked and here I am reeling about trying to save my home when this is what I thought I had been doing for the past couple of months.

Complaint: Hi My name is XXXX. I recently applied for a modification loan with the company that is now servicing my loan. I sent in all the required documents and the company Selene Finance. A representative showed up at the property which I have rented out and gave all the details of my current loan to my tenants. Told them I was behind on my mortgage payments and they could send in the rent payments to the Mortgage company directly instead of me. They gave details about my private information which is a major violation to the privacy act. I was so upset I called them right away to file a formal complaint. They said they cold not do anything and they were sorry this happened. I am writing them a formal letter and also filing a complaint with your agency. I hope this type of behavior is corrected so it does not happen to another consumer. Thanks, XXXX

Complaint: In XXXX of 2014, I received a delinquent notice from XXXX XXXX. I was informed that my note had been sold to XXXX by XXXX. I informed the customer service rep that I had not received a letter informing me of my note being serviced by a new provider and that I made my house payment on time to LoanCare. When XXXX purchased my loan, I called them to find out what was going on. A XXXX rep told me that I had no escrow balance, no homeowner 's insurance, and they were charging me their hazard insurance. A XXXX rep told me to resolve my escrow issue I would have to contact XXXX. When I contacted XXXX they told me XXXX is my servicer and I need to contact them. I was later informed later by XXXX they wanted {$1500.00} for advance deposit to escrow. I was informed that it was XXXX 's policy to keep a reserve of money up front for escrow. I refused to give them that much money up front. I told the rep, " I do not care about your policy, because that is not what I agreed to '' His reply was something like " I need to read my contract because XXXX can ask for whatever they want and I could lose my house ''. I informed the rep that I was paying my house insurance out of my pocket since both LoanCare and XXXX refused to reply to XXXX 's attempts to collect from both mortgage providers. I also wanted to know why such a large amount of money was being asked of me since my property tax was paid on XXXX XXXX, 2014 and XXXX took over XXXX XXXX, 2014. XXXX would have a complete year to collect escrow from me and according to my monthly statements LoanCare/Selene withhold an additional {$300.00} a month for escrow. I feel none of this would have ever happened if XXXX or both mortgage providers would have worked with me and addressed my questions. Instead I was met with threats of losing my home and constant remarks that I owe and just pay. I am also frustrated that later they increased my P & I payment from {$860.00} to over {$1000.00}. I was told that since I did not pay the {$1500.00} advance deposit that they altered my house payment to reflect the {$1500.00}. Under RESPA I can only be charged 2 months ' worth of escrow so the {$1500.00} is too much. I would have been fine with paying {$600.00} which is 2 months ' worth of escrow as long as they could explain why. I was also getting charged for hazard insurance because they would not recognize XXXX as my new insurer. In XXXX of 2014, I switched from XXXX insurance to XXXX, but XXXX kept saying they never received any notice from XXXX. XXXX rep gave me the days and times of when they tried to notify XXXX. I had the same issue with XXXX until XXXX of 2014 when XXXX setup a conference call with XXXX and myself. So I know I was being charged for an inflated hazard insurance and I also paid for my own house insurance in 2014. Also, under RESPA I should have received notification from both parties ( current lender & new firm ) 15 days before the date my new lender takes over the administration of my loan. I am so frustrated because, of the lack of professionalism shown to me. I have been hung up on, disconnected after waiting on hold for XXXX and when I did get someone most could not speak XXXX and just wanted me to make a payment. No rep was willing to help resolve the issue. I did speak with a XXXX who handles my property tax and according to her, in 2014 my property insurance was paid by the time XXXX took over the account. Since that was the case and I was paying out of pocket for my house insurance, then why did XXXX want an advanced escrow payment of {$1500.00}? I am willing to work this out, but I think my account needs a full audit which XXXX refuses to do. Now I 'm on the verge of getting foreclosed on and I did nothing wrong.
