Complaint: MEMO : XXXX by Selene Finance The following timeline chronicles the ongoing administrative and accounting errors made by Selene Finance, a known predatory lender, re : the loan product for XXXX which has put her mortgage account in a default status and inc an " intent to foreclose '' notification.
Selene Finance purchased XXXX loan from XXXX in XX/XX/XXXX. XXXX scheduled on time/online bill pay through her credit union that same month. Since XX/XX/XXXX, Selene Finance has created a mortgage default/intent to foreclose event for XXXX due to its poor fiduciary and administrative errors which has created a significant hardship for XXXX. Their actions include the following : XX/XX/XXXX : Selene Finance XXXX reports to credit bureau a N/R rating for payment failure which was incorrect. XXXX sends Selene Finance canceled check of on-time mortgage payment.
XX/XX/XXXX : XXXX receives letter stating mortgage is in default citing XXXX missed mortgage payments XXXX XXXX XXXX / XX/XX/XXXX ).
XX/XX/XXXX : XXXX contacts XXXX to investigate and its determined that Selene Finance never notified XXXX of change in escrow for XX/XX/XXXX. XXXX makes one-time payment to bring account current.
XX/XX/XXXX : XXXX receives notification of change in escrow for XX/XX/XXXX ( six months later ) XX/XX/XXXX : XXXX contacts Selene Finance re : status and is notified that she is still in default as " payments may not be posted until after the XX/XX/XXXX. '' XX/XX/XXXX : XXXX reschedules online bill pay to send checks out earlier and with a monthly mortgage overpayment XX/XX/XXXX : Selene Finance reports to consumer credit bureau that account is current XX/XX/XXXX : XXXX receives notification from Selene Finance that account is in default XX/XX/XXXX : Selene Finance admits to incorrectly applying another lendee 's payment to XXXX 's account. XXXX 's mortgage payments are neither credited to her account nor returned to her. Selene Finance decides to process any payments sent since XX/XX/XXXX.
XX/XX/XXXX : With XXXX, XXXX files complaint with CFPB and requests payment modification from Selene Finance XX/XX/XXXX : XXXX reaches back out to XXXX who contacts Selene Finance who states that payment modification as denied in XX/XX/XXXX because XXXX " failed to provide requested documentation. '' All documentation requested by Selene Finance in XX/XX/XXXX was provided in a timely manner by XXXX on XXXX 's behalf. Selene Finance states all documentation must be updated and resubmitted in order to review request.
XX/XX/XXXX : XXXX receives " notice of intent to foreclose '' dated XX/XX/XXXX. XXXX contacts litigation XXXX.
XX/XX/XXXX : XXXX resubmits complaint to CFPB NOTE : XXXX has consistently paid her mortgage via online bill pay with Selene Finance since XX/XX/XXXX. She has overpaid her mortgage via online bill pay with Selene Finance since XX/XX/XXXX. Selene Finance has declined to post on time payments to XXXX 's account since XX/XX/XXXX. Payments have neither been processed nor returned to XXXX.
NOTE2 : My neighborhood is an " up and coming '' XXXX neighborhood which has seen tremendous growth despite the housing crisis. My property has almost doubled in value in 11 years. Selene Finance has created this " dynamic '' so it can steal my property.

Complaint: XX/XX/XXXX I purchased a home for $ XXXX with XXXX XXXX XXXX as the lender. At the time I was employed full time as a XXXX. However, in XX/XX/XXXX I was laid off from my position. This caused me to fall behind on my mortgage payment missing a my first payment XX/XX/XXXX. This was reported on my credit statement as a 30 day delinquency. This happened XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, progressing to 60 days, 90 days, and then 120 days til it was sold XX/XX/XXXX. I tried to work with the lender to complete a modification, but they refused to work with me even once I started back making regular payments. It was n't enough to cover the periods of times that I missed or tried to make a partial payment out of good faith. This caused my loan to be sold XX/XX/XXXX to purchaser Selene Finance, they have the same date of opening of XX/XX/XXXX, but everything is is in accurate. They reported first date of delinquency of XX/XX/XXXX after my 60 day grace period was over. Neither company is reporting my date of first delinquency in an accurate manner making it hard to put this difficult time behind me. Under FCRA 623 ( a ) ( 5 ) ( A ) This " date of delinquency '' determines how long the debt can be reported on a consumer 's credit report. Generally, a CRA may report a delinquent debt for seven years from the date of delinquency. I am requesting an investigation to get this item updated on my credit report since it is inaccurate under the law. My credit report accurately shows date of delinquency as well as date of transfer, and my account never being brought current after going delinquent. The home was recently foreclosed XX/XX/XXXX due to continued late fees that equaled half a month of mortgage. I was unable to pay due to unemployment that arose XX/XX/XXXX.

Complaint: This complaint is surrounding violations to the Dodd Frank Act of XX/XX/XXXX, the citations to Georgia 's foreclosure statutes and XXXX Code Annotated Sections 44-14-160 through 44-14-191.I 've never been late on my mortgage until this last year and for the first time during the life of my loan, I applied for mortgage payment assistance on XX/XX/XXXX.
Although I faxed my mortgage servicer Selene Finance ( SF ), a full and complete package. I had even sent SF, a copy of my divorce decree on XXXX XXXX, XXXX, which indicated that my ex-wife had no interest in the property. However, SF persisted that I provide additional documentation regarding this matter. Needless to say I was forced to have the co-borrower complete a quit claim deed for the property before SF, would review my loan assistance application. Due to my divorce and the fact that my ex-wife lives in XXXX, it took a little bit longer than I anticipated for me to acquire the necessary documents that SF, had requested.During this time SF, denied my request on XX/XX/XXXX, citing that I had missed a deadline date which was unbeknownst to me.I requested for an escalation to a manager because of the unfair treatment and the matter was reviewed by supervisor XXXX.To my knowledge the loan was then placed back under review, as of XX/XX/XXXX.On XX/XX/XXXX, we were told by XXXX agent of SF, that my loan was in the second level review for a standard modification agreement. On XX/XX/XXXX, I received both a letter acknowledging that SF received a full package for review and a decline letter dated 5 days later declining my review. The decline letter stated that I had until XX/XX/XXXX, to dispute the decision. According to the Dodd Frank act of XX/XX/XXXX, after a modification review has been completed in particularly after review for HAMP, it is required that I be given a minimal of 30 days in which I have to file an appeal. I did n't receive my denial letter, until after the appeal period had already come and gone. This illegal act further harmed me because it did not allow me due process under the terms of Dodd Frank.We then later discovered that our loan had been referred to foreclosure on XX/XX/XXXX, and assigned to a foreclosure attorney by the name of XXXX XXXX XXXX. on the same day.
To this day I have yet to receive a formal demand letter. This Notice is required by State and Federal law to allow me 30 days to respond or dispute the default within the office of XXXX XXXX Esq.. This is also a violation of my due process in every way, therefore no demand letter was received by the foreclosure XXXX XXXX XXXX, prior to this office establishing a sale date of XX/XX/XXXX.Now we 're being told the loan was denied for modification on XX/XX/XXXX and a letter mailed on XX/XX/XXXX. This completely contradicts what we were told by agents of SF, on both XX/XX/XXXX, when we spoke with XXXX and were told that the loan was in second level review for standard loan modification. This act is fraud and misrepresentation of the truth and extremely misleading.
No later than 30 days prior to the date of the scheduled foreclosure sale, the lender must send the borrower notice of the initiation of proceedings to exercise a power of sale. The notice must be sent via registered mail, certified mail, or overnight delivery, return receipt requested, to the property address or to any other address the borrower has designated by written notice to the lender. XXXX XXXX XXXX, the lender 's attorney also failed to send me a notice informing us that we have ten days from the receipt of such notice to pay the principal and interest without incurring attorneys ' fees. This notice would have given us a 30-day notice of sale.This was not done and these multitude of issues has been abusive and all levels of creditor abuse

Complaint: My mortgage is with XXXX and Selene Finance was the processor for my modification. I was approved XX/XX/XXXX, and trial payment were to be completed from XX/XX/XXXX - XX/XX/XXXX. Once completed, my modification documents were never sent back to XXXX for finalization. As of XXXX, Selene Finance is no longer a XXXX party vendor for XXXX and due to the servicing transfer, they were to send my complete file with financials to XXXX so that my HAMP modification can be completed. This was supposed to take place XX/XX/XXXX and it is now XX/XX/XXXX and Selene Finance is not responding. I need for my modification documents to be sent to XXXX so that my modification can be completed.

Complaint: I am writing this complaint due to the issues I have on XXXX/XXXX/2017 while calling the company who services my mortgage. I tried setting up our account online only to be told my account did n't exist. I then called Selene Finance and the rep who is attached to us was n't available so I help for customer service. The gentleman was very rude in telling me I should be happy the company is even working with me with me being so far behind on my mortgage. I then told him that I have no idea why he was making those comments to me being that we had just finalized our modification on the XXXX/XXXX/17 and the payment was made on XXXX/XXXX/17 of {$890.00}. He then continues to be rude and tell me I could n't talk to anyone and he would send a message for someone to call me back. Well that never happened. I even called XXXX our loan specialist and left a message for her on XXXX/XXXX/17 with no response back and today is XXXX/XXXX/17. I also left a message today but have tried at least 10 times to get a customer service rep but it wo n't even send me to anyone else even just a regular customer service rep. I 'm not sure what is going on but I do know that every document that needed to be signed was signed and dated by the due date and the payment was made on time. I do know that I am tired of going through the same things with this company and the treatment is so uncalled for. We have done everything asked even when you did n't hold up on your end. Just like you sent us a 1 day envelope with a 2 day posting. I even told XXXX about that and was told to not worry about it as long as the documents were dated by the time they were suppose to be. I was also told she saw the payment and everything would be fine. Well now I 'm finding out otherwise and not XXXX person will call us back. This is not how you should treat your customers.

Complaint: We received a letter fro our prevous lender, XXXX about a week or less prior to our loan getting transferred.
The letter noted the new servicer, stated all terms would stay the same including the loan number.
We reached out to Selene Finance, LP the date of official transfer which was XX/XX/2017. Selene had no record of the account by name, social security number, XXXX loan number or property address. The mailing- billing address was obviously not identified either.
We called XXXX, and they insisted that a letter from the new lender should have already been received. WE have not received anythign form slene finance.
We called selene finance a few time and XXXX week later they have finally acknowledged that there was a loan transer, but they would not give us any information such as the new payment address or even the loan number. They said XXXX did not authorize our names. So now they want a bunch of paperwork via email only, with original hard copies sealed by courts.
It will take us at least a week to get the paperwork they are requesting. Then they will take at least a week to review the paperwork in their legal department. By then, it will be well past our payment date.
We feel that they are stalling because we had delinquent balance with XXXX that we were trying to clear up prior to the lan transfer. We are just trying to make a payment. We are trying to give them money, They are not providing us a way to make payments.

Complaint: My mortgage servicer Selene Finance has refused to consider or review any options to save my home from foreclosure and I am facing auction next week due to their actions. I have owned my home for nearly 10 years and made a down payment of {$170000.00} at the time of purchase. I later refinanced into a government insured FHA loan and had no issue making the monthly payments until I was the victim of fraud in XX/XX/2013. Someone was able to gain access to my bank account and stole all of my money. This created a snowball effect, and soon I was drowning in debt and unable to keep up with my mortgage payment. I have tried repeatedly to resolve this matter but have made no headway. This is devastating ; I have a good job ( worked as a XXXX for 13 years ) and make enough money to afford a fair payment. The issue is that once I fell behind that no one gave me a chance to resolve this matter and the delinquency continued to increase.
At that time my loan was with XXXX and I tried to begin the process to resolve my delinquency and be reviewed and qualified for a loan modification or forbearance agreement or a partial claim program. It was very difficult to make any progress and just when it seemed that I was making some headway the loan was transferred to XXXX. I went through the same process with XXXX, poor communication, lost documents, denied access to government programs, etc. and then again when it seemed that I was getting somewhere the loan was transferred to Selene Finance. The entire time my delinquent amount continued to increase and put me into a deeper hole.
I have tried to engage with the agents at Selene Finance in order to get a review initiated. At first they acted like they did not even know they were holding my loan -- later it seemed that they were just disinterested. I have been told that Selene Finance accepted XXXX of dollars in government bailout money and is REQUIRED to conduct reviews of my current and correct financial information in order to assess eligibility for retention programs. Additionally, this is a government insured loan and I believe they are violating all protocol and procedure by failing to give me an opportunity to resolve this issue. I have a good job and have enough income to afford a reasonable payment, but was a victim of fraud and theft and need Selene to work with me.
I ca n't believe that I am in this situation. I want to pay, I can afford to pay, and it is so disappointing that being the victim of a crime has put me in a position where I am going to lose my house along with the {$170000.00} I have invested in the home.

Complaint: Please help us : We have a Home Mortgage with Selene Finance LP, XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX Texas XXXX. XXXX # XXXX. Since XXXX XXXX XXXX sold our loan to this company, we have never received the regular coupon for payment and every single month I have to go to our bank and make the payment On Time via a Wire Transfer ( {$35.00} ). I have spoken with a representative that told me that the issue was going to be resolved but now is already 4 months having to submit the monthly pay using a wire transfer. Plus, they keep sending us threatening letters saying that the account was not paid. Please, let them know to send the communication of Payment Received every month and to send the current payment coupon for normal payment. Trying to make payment online within their website is impossible because there is no option to do so.
