Problem with a credit reporting company's investigation into an existing problem

Complaint: Regarding Selene Finance : Recently I applied to refinance my home. The new company I'm working with says that I have a 30 day late payment for XX/XX/2017. I've submitted evidence of my XX/XX/2017 payment being paid on time yet they have continued to report it as 30 days late. They opened an investigation and somehow concluded that it wasn't paid on time, even though I sent them bank statements as well as the check from the bank, showing the date it was paid. ( This was last year when I tried to refiance then as well ) I've tried multiple times to speak with a supervisor of the company and every time I call, I'm told that I need to call back as they are too busy. I've called over 20 times now and still get the same response. Currently I have received a letter stating that they are investigating the situation again, just like they did back in 2017. This process takes up to 60 days and I'm currently trying to refinance my home with another lender, again. The new lender states that we are in jepordy of losing the rate lock due to the amount of time it is taking for my current company Selene Finance to fix their mistake. Please do something to get these people to fix what they messed up. Thank You, XXXX XXXX

Complaint: On XX/XX/XXXX I had a pipe burst in my house that caused a lot of water damage. My insurance company quickly handled the issue and by the XX/XX/XXXX I had the check for the damage in the amount of {$6700.00}. The check was made to myself and the mortgage company. I contacted my mortgage company on XX/XX/XXXX and asked them the process they said they would send out the appropriate forms and that I would need to send the check and the signed forms back to them. By XX/XX/XXXX I still had not received the forms so I called and they sent them again. On XX/XX/XXXX, I still had not received either set of mailings and called back. Someone faxed me the form to complete. On XX/XX/XXXX, I sent the signed form and loss draft in an express two day envelope with a prepaid one to send back. The check was delivered on XX/XX/XXXX, and I had it back to my house on XX/XX/XXXX. When I opened the envelope I found that the check had been stamped but not endorsed. I contacted them again on XX/XX/XXXX where after about 15 minutes of asking other people they confirmed that I needed to send the check back to them again because it needed to be signed. On XX/XX/XXXX, I sent the check with another prepaid envelope to send back. It was delivered on XX/XX/XXXX, I just called to get the status and they said the " process '' could take until Friday XX/XX/XXXX. They could not give me any other information. I just want to be able to fix the damage in my house.

Complaint: I am a XXXX yr old, 3rd generation homeowner who is having her home stolen by fraudulent and wrongful foreclosure and have the paperwork to prove it if someone could please help amicus curie before my home is taken for good. These documents clearly show that Loancare, its attorneys XXXX XXXX XXXX, XXXX, XXXX XXXX, and Selene Finance, are all involved in some manner in this fraud. XXXX and XXXX XXXX XXXX are caught by the lies that they have created. Attached is the real servicing letter I received on XX/XX/XXXX from XXXX to XXXX. The fabricated document created by XXXX ( dated XX/XX/XXXX ) is a lie that appeared on XX/XX/XXXX and exposes the fraud. This letter appeared on XX/XX/XXXX after XXXX fraudulently obtained standing and summary judgement. It appeared with the change of XXXX to Selene and was created for the sole purpose of backing XXXX 's Lie that they had the original note XX/XX/XXXX. But their lie backfired and exposed them because a genuine true servicing letter would have been from XXXX to XXXX certified with a stamp from the U.S. Postal Service on that date of XX/XX/XXXX. This shows that XXXX and its attorneys lied about their backdated assignment, their fake copy of a Note ( that was never attached to the complaint and didn't appear until XX/XX/XXXX ) The new evidence I have presented to the trial court of the fabricated letter I received XX/XX/XXXX along with the XX/XX/XXXX recorded transcript of my conversation with XXXX ( the real and missing servicer ) stating that XXXX XXXX was the investor not XXXX should allow the courts to prevent my home from being fraudulently foreclosed upon.

Complaint: I am writing to request assistance in an issue I am having with Selene. I really need my document from XX/XX/XXXX. I believe it will be XX/XX/XXXX. My underwriter has requested it and I can not find my copy. We were supposed to close XX/XX/XXXX and I called XX/XX/XXXX to request copy of this completed document to be emailed to me. The girl I talked to said she would put rush on it because my lender wants it. The sellers are anxious and have already worked with us and now are saying that they can not wait until Mid XXXX to find out if the document arrives. I say mid XXXX because today XX/XX/XXXX, when I followed up the girl I talked to said it was scheduled to be mailed XX/XX/XXXX. When I called in Monday I talked to a gentleman that said he would send it to printing and it would likely go out that day. Now I got a letter saying it could take 30 days to review request. The gentleman said he found it and do I dont understand the delay. I am begging you for assistance in this matter and praying it does not take 15 days to hear back from you. I can take a unofficial copy. I am renting house I am trying to buy do not getting means I have to move. Please help me. I eagerly await your assistance

Complaint: I have been applying directly, for hardship assistance with this Servicer ( Selene Finace ), since XXXX of XXXX. Previous to that, I retained legal counsel to assist me with the process. I have provided all items requested multiple times, yet have had no success with being reviewed properly, for hardship assistance. Despite cooperating fully, I have not been able to communicate with the assigned Relationship Manager, XXXX XXXX XXXX. Servicer has set several Judicial Sale Dates, claiming that I have not provided information in a timely manner. Servicer also submitted a denial letter ( dated XX/XX/XXXX ), claiming that I had been reviewed for assistance, but had insufficient income, as well as too much debt, to qualify. In reality, Servicer utilized erroneous information, possibly from another applicant, and has not reviewed my financial information correctly. I challenged those findings unsuccessfully, yet Servicer refused to review their decision, or cancel the scheduled Sale date set for the following day, XX/XX/XXXX. I was successful in canceling and having the Sale rescheduled to XX/XX/XXXX. I submitted all the supporting documents requested by Servicer, and none were reviewed. After numerous inquiries and internal escalations, I was informed by the Servicer, that my application would not be reviewed, due to there being insufficient time to review ( less than 37 days before scheduled sale date ). I was then reassured that if I could have the Sale Date postponed, Servicer would permit me to submit a new application, and that Servicer would properly review my application for all available options. I was successful in having the Sale rescheduled to XX/XX/XXXX. I then prepared and submitted a Hardship assistance application, as instructed, to Servicer. ( see below ) Mail to : Selene Finance LP XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, TX XXXX Or Fax to : ( XXXX ) XXXX Or Email to : XXXX I submitted the documents and information by email ( XXXX ) on XX/XX/XXXX - 39 days before the scheduled Sale Date of XX/XX/XXXX. One week later, I followed up with Servicer. Servicer claimed to have no record of receiving my application. I was advised to resubmit on that day ( XX/XX/XXXX ), and informed that the file was escalated. I submitted the application to XXXX as instructed. I then called again on XX/XX/XXXX, and was again advised that no record of submission existed. I was advised to submit again that day, for an expedited review. I submitted the application by email to : XXXX, XXXX, XXXX, and XXXX On XX/XX/XXXX, i again called Servicer. I was told that no record of a submission existed! I submitted once again, while the rep claimed to be monitoring the Inbox ( XXXX ). I asked for a callback from XXXX XXXX XXXX - as I've done multiple times, yet to date have not received a response. This Servicer has not acted in good faith, and I am pleading for your intercession.

Complaint: Selene Finance Mortgage & Account # XXXX, Property - XXXX XXXX XXXX, XXXX XXXX, XXXX, FL XXXX Dear Consumer Financial Protection Bureau : Thank you for being available as a critical vehicle to aid consumers subject to unethical and illegal practices employed by loan servicers. Unfortunatly now my lender, Selene Finance, is employing such practices through their force placed insurance practices. I am a Selene Finance customer whose mortgage Selene purchased, and has been, and currently is, in good standing regarding my loan repayment. Prior to last Spring, Selene Finance, as well as the prior servicers of my mortgage, concluded my association master policy provides sufficient insurance coverage to adequately protect the mortgagors interest in the property. By way of background, my unit is a small two bedroom, less than 1100 square foot condominium, in a 32 unit multi-unit building. Never in my 13 years of ownership has the master policy, which provides coverage for the entire building in the amount of approximately {$3.00}, been found insufficient by either Selene, or the prior servicers. In recent letters, the most dated XX/XX/XXXX, Selene demands I purchase an additional HO 6 policy. In addition, Selene has force-placed insurance against me charging {$2800.00} on an annual basis, an increase of nearly {$230.00} per month in my monthly housing costs! This action, if imposed, is without merit on multiple legal, equitable and financial fronts. First, Selene contends it may require insurance for the difference between my loan balance of approximately {$160000.00}, and {$110000.00}, a sum approximately of {$50000.00}. Selene contends it may require this because the HOA policy provides {>= $1,000,000} coverage, and dividing this amount by the total number of units in the building ( 32 ), results in coverage of approximately {$110000.00} per unit, in the event of a complete destruction of the building. Hence, Selene contends, it may require I purchase an additional {$50000.00} in coverage, or it will force place such coverage, and charge me the sum of {$2800.00} per year. First, Selene states in its XX/XX/XXXX letter that your hazard insurance policy expired, and we dont have evidence you obtained new coverage. Directly contradicting this statement are the actions of myself, and the XXXX XXXX XXXX. On 3 different occasions, XX/XX/XXXX, XX/XX/XXXX, and again on XX/XX/XXXX, we provided per Selenes request the governing master policy, which provides complete hazard insurance under a policy in force until XX/XX/XXXX. Clearly this statement by Selene on XX/XX/XXXX, when it had been provided proof of hazard insurance on XXXX different occasions, plainly violates Section 2605 ( k ) ( 1 ) ( A ) of the Real Estate Settlement Procedures Act ( RESPA ). Specifically this section prohibits Selene from obtaining force placed insurance if it has a reasonable basis to believe the borrower has complied with the mortgage/note requirements to maintain property insurance. 12 USC Sect 2605 ( k ) ( 1 ) ( A ). I reiterate, in XX/XX/XXXX I dutifully provided through the XXXX XXXX the complete Hazard insurance policy detailing extensive property replacement coverage. In addition, in XX/XX/XXXX on 3 different occasions I again provided the master policy expressly providing insurance coverage of my unit. Moreover, said coverage was acceptable to Selene in XX/XX/XXXX, and with each of its predecessors. Accordingly, Selene had no basis to conclude I failed to comply with our loan agreements insurance provisions, and now impose force placed insurance, in direct violation of 2605 ( k ) ( 1 ) ( A ) of RESPA. As you may be aware, the Consumer Financial Protection Bureau enforces this and other governing regulations, in order to protect borrowers from unwarranted force placement of insurance when a servicer lacks a reasonable basis to impose upon on a borrower. 78 Fed. Reg. 10,712 Second, under the terms of our mortgage loan agreement, Selenes legally secured interest is limited in the event of default and foreclosure to ownership through a foreclosure proceeding and, if ultimately successful in that action, physical possession of the unit. Nothing in our contractually binding agreement expands Selenes interest to the right to any chattels/furniture or other personal property of the borrower in the unit in the event of a foreclosure and transfer of possession to Selene. Nor does any term in the agreement provide Selene, or its predecessors, the right to employ the above formula, require the borrower to purchase insurance Selene deems necessary on any purported coverage shortfall, or impose force placed insurance in the amount noted above if the borrower does not submit to Selenes insurance purchase demands. In addition, well settled Federal and state law in all 50 states mandates, due to the unequal bargaining power between the parties that construction of such agreements is against the lender/servicer, and in favor of the consumer/borrower. Imposing such insurance coverage, based on a formula wholly absent from the agreement between the parties, exceeds Selenes rights well-beyond the intent of the parties, inventing such a right from whole cloth well-beyond what the parties agreed to, and memorialized within the four corners of the governing loan modification agreement. Indeed, Selene is so limited to only a transfer of ownership and possession through foreclosure of the unit, and not to unit contents in the event of default by the borrower. Thus it has no legal right through such foreclosure to take ownership of chattels/personal property. Accordingly, because Selene has no legal right in the event of foreclosure to acquire and possess the borrowers chattels/personal property, it can not require a borrower purchase additional insurance coverage on such items it lacks any legally secured interest therein. Provided & attached through your document portal are : 1. The master policy providing just under XXXX XXXX in replacement cost coverage for the XXXX XXXX building ; 2. Proof the policy was provided to Selene on 3 separate occasions this year when requested by Selene. T hank you in advance, and to those reviewing these issues, for your thoughtful consideration. Complaint: I am filing this complaint due to the frustration XXXX XXXX and myself had in getting a payoff for our mortgage. XXXX XXXX XXXX XXXX XXXX called Selene Financial on XX/XX/XXXX, requesting the payoff amount for our mortgage loan. They were told that the information was unavailable due to the fact that they had only started servicing the loan on XX/XX/XXXX but the information would be available on Monday, XX/XX/XXXX. However, when XXXX XXXX called on Monday they were told that the information was still unavailable but they were attempting to get it by later that day. Every day that week, several times a day, XXXX XXXX called for the information only to told that the information was still unavailable but Selene would call with the information later that day or the next day depending upon the time that XXXX XXXX call. On XX/XX/XXXX, I called Selene and was told that information was unable due to the transfer of servicing the loan. They were aware of the problem and they were working on it and would supply XXXX XXXX the information as soon as they had it. For every question I asked, I was repeatedly told they were working on it. It was like they were working from a script and would not deviate from their specific verbiage. On that same day, I called XXXX XXXX XXXX XXXX XXXX XXXX XXXX, to ask for any assistance they could give me so Selene would get the payoff information to XXXX XXXX. I was told that the matter had been escalated by Selene and they would do the same. On XX/XX/XXXX XXXX XXXX again call and were told the same thing, they could not access the information. That afternoon, XXXX XXXX told Selene that they were ready to report them to an agency who handles complaints regarding matters such as these. Within 5 minutes, Selene called XXXX XXXX with the needed information. With computers, even with the transfer of the mortgage from one company to another, it should not have taken this long to get the information. I feel that XXXX XXXX and myself were given the run around from Selene during this time and they were not trying to get the information we needed in a timely manner.

Complaint: On XX/XX/XXXX I filed a complaint with CFPB against my mortgage company Selene Finance for incorrectly reporting to the credit bureaus that I was 30 days delinquent on my XX/XX/XXXX payment, 60 days delinquent on my XX/XX/XXXX payment and 30 days delinquent on my XX/XX/XXXX payment. After filing this complaint with CFPB they contacted my mortgage linder for them to investigate my complaint ( which they would not have done had it not been for CFPB ). I have never been late on my mortgage payment and was not late when I entered into an informal Repayment Plan for three months to avoid being delinquent due to XXXX and being out of work. Selene Finance discovered they made an error and they confirmed that they incorrectly reported this information to the credit bureau. I received a letter of apology from Selene Finance with a promise to correct their mistake and have the credit bureaus to remove these delinquent payments from my credit report but after todays date they have not. Today I called them and was told I was three months behind and I broke the Repayment Agreement. This is not true at all. I made the last payment under this agreement XX/XX/XXXX and and was never late. CFPB Case number XXXX, Account number XXXX. Please assist me in getting this resolved. I will include a copy of the letter they sent me. Thank you

Complaint: We attempted to do a loan modification with XXXX XXXX XXXX in XXXX.they subsequently changed attorneys after we had submitted the application and also submitted an offer by my family to settle the debt directly -pay a lump sum to keep me in my home. I am XXXX XXXX having had a XXXX in XXXX and I am represented by my attorney in fact mother. I am XXXX, XXXX and XXXX. I have attempted XXXX more than once. this is the important factor that my life hunges on stability. So my family is making every effort to the last two years to try to keep me in my home. we hired an attorney and they were unsuccessful in properly submitting a loan modification. The attorney was distracted by personal problems of a divorce and XXXX. my family and I submitted an offer to the loan mitigation Department of XXXX XXXX. Never hearing from them, in XX/XX/XXXX, we received a letter saying that new law firm was representing XXXX XXXX. During all this a foreclosure proceeding was in the works. And XX/XX/XXXX we communicated with XXXX XXXX attorney that was in the loss mitigation department and they indicated that the offer was not acted upon because XXXX XXXX I had transferred the files to a new law firm. And XX/XX/XXXX, XXXX XXXX sold the note and the servicing rights into a program and investment pool and specifically an investor purchased the loan, and no one advised us of this until XX/XX/XXXX and then we got a package from Selene Finance indicating they were servicing it for the benefit of the new trust. th The attorneys for XXXX XXXX who had been substituted where also communicating that they were moving in the foreclosure for XXXX XXXX. We contacted them and they never returned our call, when we asked why they were moving forward with the XXXX XXXX foreclosure when XXXX XXXX did NOT own the loan anymore. No response Then we worked with Selene Finance who started a modification file in XX/XX/XXXX and in XX/XX/XXXX XX/XX/XXXX they sent a letter saying that they were missing documents and I had 30 days to provide them yet 6 days later, I received a letter saying that the loan modification was denied. Obviously a 30 day notice requesting documents and then a letter 6 days later did not allow us to respond. We sent in the docs that we knew they needed but some were absolutely not applicable for example tax returns when my income was significantly below the IRS threshold for filing. After the XX/XX/XXXX notice I received no communication from either the substitute Law Firm any other law firm or the court or Selene Finance or the investor who owns the loan now regarding Court proceedings suddenly two weeks ago I received a letter from the law firm still saying they represented XXXX XXXX indicating that they were going to take action. And then after that the next communication was two weeks ago saying that a scheduled hearing was adjourned on XX/XX/XXXX for pre-conference with XXXX XXXX and it was adjourned till XX/XX/XXXX. We had not received anything from any party about a pre conference with XXXX XXXX Despite the fact that we had answered all previous motions and and Communications from XXXX and the old attorney and the courts. we received no notice from any of the new parties who are now trying to move forward with foreclosure. And the most recent document that was received by me XX/XX/XXXX suddenly indicates that the lawsuit is from the trust, as plaintiff as opposed to XXXX XXXX. This is the first document that bears the name of the trust. So in summary I'm indicating that the Selene Finance procedure was not handled properly and that Selene Finance never gave us 30 days to submit missing documents, before they made their decision to deny a loan modification for me. In the interim we made another attempt 2 settle this with an outright purchase of the loan note or buy the home. again no one has responded to that communication

Complaint: Hello, We are trying to avoid foreclosure at all costs whether its through a modification or a deed in lieu. The servicing of our loan was recently transferred on XX/XX/XXXXto Selene finance from XXXX. We have been sending all requested information to XXXX prior to the transfer with no response only for XXXX to tell us this week that they can not answer any of out questions any longer since Selene is the servicer as of XX/XX/XXXX. We called Selene finance all week and they have sais they do not have the file in the system yet to help or answer our questions. I advised them that the letter says it transferred onXX/XX/XXXX and the sale date isXX/XX/XXXX and we don't ; have much time. the reps at Selene have been telling us that it might take another week for the loan to be up in their system to help us. I told them that will be too late. They didn't seem concerned or willing to help. they told us to call an attorney or the previous servicer which already told us they do not have the file. We attached the transfer notice. Reason for default was due to one of the borrower 's XXXX. We are now financially stable after the hardship and are looking for a modification or a deed in lieu to avoid a foreclosure on the credit report. Apparently the banks need time to review the docs but know one is willing to help answer questions since the file is not in their system yet. Who can help us. Accidentally caused XXXX XXXX XXXX to send out three paper checks for mortgage this month and you cashed them. Thereby causing my checking to be $XXXX Over drafted as of today. They were for new amount effective XX/XX/XXXX of $XXXX, XXXX and the old amount of $XXXX. I need the excess checks to be refunded to me in $XXXX and $XXXX. Today I called Selene and spoke to XXXX on XXXX and he said he could not find those payments in my screen. Called XXXX in Arizona at XXXX XXXX and she said I needed to get fixed with Selene. Second time called Selene and got XXXX. She listened and tried calm me and said she would check with supervisor on this. They will send up accounting request to fix this and get accounting back to rights. They need me to send details in email. They are waiting on that to help me with overdraft fees and bouncing checks situation. I havent heard back from you at Selene since I called and sent email a week ago on XX/XX/XXXX. Same day I sent the BBB complaint that XXXX also got. Can someone get back to me with an expected date for refund of the two checks I requested. Thank you.
