Complaint: My mortgage is currently serviced by Selene Finance. From XX/XX/XXXX to XX/XX/XXXX, Selene collected over {$30000.00} from the Indianas Hardest Hit Fund. This program is governed by the Indiana Housing and Community Development Authority, with original funding coming from US Department of Housing and Urban Development ( HUD ). HUD established these programs to offer mortgage assistance to unemployed workers, so they could avoid foreclosure. All funds distributed through this program are the product of US Treasury Funds, essentially taxpayer contribution.
The accounting records that have been provided by Selene are incomplete, since the entire payment history is missing to show application of the {$30000.00} Hardest Hit Funds distributed to them. Furthermore, since the mortgage note is missing, the derivative figures that compile the accounting records cant be determined. It is clear that violations of the False Claims Act ( FCA ), 31 USC 3729 - 3733, since they knowingly withheld information and reported false records to a Federal Government Agency ( see attached ).
Selene has also advised that they refuse to offer a standard foreclosure mediation, which is a requirement per Indiana law. This is a clear violation of Indiana Code 32-30-10.5. Per the IN statute, clear notification must be sent to the home owner, giving the option for standard foreclosure mediation.
Selene is in clear violation of False Claims Act, RESPA law and IN Code 32-10.5. Selene has imposed a foreclosure sale date on XX/XX/XXXX. Overall, I feel deceived by Selene on a number of counts and I am seeking your assistance on this matter. You can reach me via email at XXXX.

Complaint: We have attempted to modify your loan through Selene Finance. Selene claimed that they can not review the modification package because the package was not submitted within the required time frame of the sheriff sale date and that they wouldn't have time to review it. We have a pending sheriff sale which we got postponed twice and submitted a package in the appropriate time frame. We were previously working with a lawyer at the time that claimed he was working on this modification for us, but it turns out he never was. We are now taking proper steps to get this done and we are hoping to at least get a fair review for a modification this time around.

Complaint: Hello, XXXX XXXX is the original lender who financed our home in XX/XX/XXXX. I understand companies sell mortgages to each other but this incident will be at my expense. Selene Finance LP sent me a letter XX/XX/XXXX stating this servicer switch will be effective XX/XX/XXXX. Two months a year, 3 mortgage payments are deducted while the third payment is payed solely to principal. XXXX XXXX did not take a payment on XX/XX/XXXX and the company also has no information about my account. This leads me to believe the three payments will not be deducted this month and it will be at my expense because the mortgage will not benefit from the additional payment. This is not acceptable!! After a brief conversation over the phone it was clear Selene Finance LP will not take responsibility or do anything to fix the problem their company has caused.

Complaint: on XX/XX/XXXX my husband and I short saled our house. We have not received the XXXX to do our taxes. I have emailed and my husband called on XX/XX/XXXX about this matter. I called today XX/XX/XXXX and was told by customer service that we will get it by XX/XX/XXXX We found out that our credit reports were all messed up because of Selene Financial. We could not get another loan and I could not get a job because of this. I am still trying to find a job. We have all documentation for credit reports to prove that Selene contacted and put addresses that we never lived at. I still have a lawyer on my credit report that should not be there.We should have received our XXXX in XXXX. They had plenty of time to do this. Thank You

Complaint: We applied for a loan modification from Selene Finance after our mortgage was sold to them from XXXX XXXX XXXX. We timely made all 6 of the payments requested as contracted for during the trial modification period through XX/XX/2017. The amount that they put on the contract for modification included thousands of dollars of ridiculous fees but we agreed to it anyway just to get the loan modified. They sent us paperwork to finalize the modification which we signed and returned. They have now failed to send us fully executed modification documents. They have told us they would be coming. I will not pay the mortgage into the suspense account void that continues to incur bogus fees until I have the modification documents. We have been requesting them for 2 months. They are telling us to pay back due payments and it is not the deal that was agreed on. Now they are sending an intent to accelerate and foreclose. This is the same thing we went through last year. Now rates have increased and we believe that the Bank is trying to renegotiate their loan modification to increase the rate. I have all of the paperwork. I think they are crooks with terrible customer service.

Complaint: I found out recently my loan was behind and I had a new Mortgage company Selene Finance ( They had acquired the loan from XXXX ) Last week of XXXX. I was informed loan payment had not been received in over 12 months I have proof this is wrong that at least 4 payments were made and the rest was an accounting error by my accountant. I called and spoke to XXXX XXXX told me amount behind was XXXX. They would not take a good faith payment from me as the loan was in foreclosure but would have a reinstatement quote ready for me by the XXXX at XXXX XXXX. I called at XXXX XXXX they did not have it I called back every day several time a day. ON the XX/XX/XXXX XXXX said they could not give me information, XXXX told me it would be another day I had to beg to get the amount owed I was seriously getting the run around till a lady ( an XXXX ) name XXXX was able to give the amount and where to send it to. By this time the amount past due was XXXX before the lawyer fees .The total now XXXX. I wire transfected this amount to XXXXXXXX XXXX the next day XXXX XXXX XXXX XXXX XXXX New York Acc XXXX.
XXXX claims they do not have the money. The money left my account and went into account provided by Selene finance I called Thursday and Friday and they still could not locate it .I sent the copy of wire transfer to XXXX She is the ONLY person who has responded. Today the XXXX i received letters fro the title company that the loan was still behind and could be sold at any time.

Complaint: I have been going back and forth with my mortgage company Selene Finance for a very long time as I try to resolve my missed mortgage payments with them. I finally decided to just try and do a short sale and listed my home. We presented Selene with a couple of excellent offers that matched the market value but Selene would not accept these and has instead set a foreclosure auction date. I recently became aware of the fact that there are new homeowner assistance programs for borrowers with GSE loans backed by XXXX XXXX. I have asked Selene to review me for these programs and have cancelled out the short sale. Instead of working to review me for these programs, Selene has moved to sell my home I have owned for 30 years. I deserve a chance to be considered for these XXXX XXXX programs, and can't understand how or why Selene would obstruct my access to them. Additionally, Selene Finance has failed to offer mediation through the state of New Jersey as an option to resolve a dispute like this. I found out that they are required to offer this option so that an independent third party can intervene. Once again, Selene is not giving us access to these options.
My problems began several years ago. I worked as a self employed XXXX XXXX XXXX for nearly 30 years. I was diagnosed with major health issues and this led me to have cut down on my hours. In that same time frame, my bank account was frozen because of irregular activity. I had an international account and someone had gained access and was illegally withdrawing money. As a result my account was frozen. It took me a long time to straighten this out and as a result I fell behind three payments on my mortgage. I began trying to work this out with XXXX XXXX at that time. It was a mess and then they went out of business and the loan was transferred to XXXXXXXX XXXX who I tried to negotiate with. Then it went to XXXX, then to XXXX then back to XXXX and now it is with Selene Finance. Every time I was making progress towards a resolution my loan would get transferred and this has continued on for a long time. I have wanted to fix this problem and try and resume making payments but continue to run into issues from the lenders I have to deal with to make this happen. My concern at this time is that there are several new homeowner assistance programs that are available for borrower 's with GSE loans backed by XXXX XXXX. Selene Finance has not allowed me access to these programs and has not given me a chance to be considered for any options. I tried to sell the property as a short sale as Selene suggested for close to a year but they kept rejecting good offers. At this time I am very frustrated with Selene Finance and I want to be reviewed for ALL homeowner assistance options. Although I am XXXX and retired, I do receive a monthly XXXX disbursement as does my wife. We also have a tenant who shares our home with us. I believe we have sufficient income to make a reasonable mortgage payment if Selene would work with us.

Complaint: Im filing a complaint against, Selene Finance ( SF ) for refusing to process my loan modification under the National Mortgage Settlement ( NMS ) which encompassed loans which were serviced transferred from XXXX ( XXXX ). XXXX was and is bond by the terms and metrics of the NMS, as well.
As a response for to elder financial exploitation, CFPB and the terms of NMS, were implemented in order to insure that consumers are protected from unfair, deceptive, or abusive acts and practices and from discrimination.
I contacted SF, with the help of my third party agent early XX/XX/XXXX, after a timely process of having the co-borrower XXXX XXXX execute, notarize and record a quit claim deed on the above mentioned property. We spoke with XXXX agent id # XXXX that indicated the quit claim deed had been updated to SF, records, on XX/XX/XXXX. She also advised that in order for me to complete the modification process with only using my financials that I would have to undergo an interview with the loan resolutions department. This is when we began to experiencing the run around as to what exact steps were required in order for me to be reviewed for assistance utilizing my XXXX income along with my new renters. On XX/XX/XXXX, we were then directed to an agent by the name of XXXX agent id # XXXX, XXXX XXXX the single point of contact was unavailable and XXXX, stated that her manager advised that we must apply for an assumption modification, which was indicated as being much the same as a regular application request for modification assistance. So we commenced to gathering all of the requested documents that SF, agents and managers required for the review. Agent by the name of XXXX id # XXXX advised of the following : 1. ) Copy of Lease Agreements-Need 2 months ( rental income ) worth of payments 2. ) Letter stating that renters pay cash 3. ) Award letters for SSI and XXXX ( Bank Statements ) verifying income 4. ) Brief letter explaining why he has not filed taxes 5. ) Hand written hardship letter 6. ) XXXX 7. ) Property Inspection ( Inspector will contact our office to set up inspection date and time ) All documents were then faxed to SF, on XX/XX/XXXX, on XX/XX/XXXX, XXXX agent id # XXXX, that some documents were missing. Hardship letter, letter of explanation ( LOE ) that no taxes are required to be filed due to XXXX status. LOE, only income is SSI and rental income and bank statements showing rental deposits and finally an award letter for SSI Benefits. Between XX/XX/XXXX, and XX/XX/XXXX, we were repeatedly told over and over that more documentation would be required in order to complete a review. I responded to all of the requests until finally on XX/XX/XXXX, we were told that I needed to file taxes reflecting rent and ssi benefits to be reported in order for the SF, underwriting team to accept as bonafide qualifying income. The problem with this is that I just started renting out rooms within this past year XX/XX/XXXX, and per my tax professional Im not obligated to file an income tax return with my current XXXX status. SF, is being overly burdensome with their requests to prove my rental income and it is not required by the IRS, that I file a return. SF, is mis-representing themselves as an authority on taxes and the behavior demonstrated violates the terms of the NMS, the statutes under the Dodd Frank reform of XX/XX/XXXXand various statutes under the jurisdiction of the CFPB and state rules surrounding unfair, deceptive, or abusive acts and practices and from discrimination.
SF, also has an obligation to process the loan modification with transparency and clarity per the NMS, of XX/XX/XXXX. As a result of SF, refusal to process my request for assistance they have also issued a sale date. I would like to further point out that I have received no written notice of any such sale date nor has there been any publications run in our local newspaper indicating that a sale date will occur on XX/XX/XXXX. However there is a sale date pending for XX/XX/XXXX. Indiana, state law requires that the foreclosure sale process involves publishing an ad once a week for three weeks. The first ad must be run 30 days before the sale. At the time the first ad is run, each owner must be served with notice of the foreclosure sale by the sheriff.
