Complaint: Trying to get pay off balance for a VA loan from Selene Finance and given conflicting answers and no follow up correspondence. I was told they can not send emails to confirm request was received as they monitor everything internally, so unfortunately they hold all access to information and you are unable to confirm its accuracy. Could not even produce amount of interest owed each day of loan. Our title office trying to conduct businesses with them have ran into several issues as well, such as being told no one monitors the fax anymore even though it is provided as an avenue of correspondence.

Complaint: We ( My sister and I : Sister-On Deed/Not On Loan ) were given a payment arrangement, after the company ( Selene Finance ) stopped accepting our monthly payments. The POC ( XXXX XXXX-Point of Contact ) willfully made derogatory reports to my sisters credit bureau and stated that she was on the loan ; which she is not, so consequently she was not able to obtain a loan, which is why we are behind due to Selene 's derogatory reporting. This is the second attempt with a " Qualified Written Request '' to work with this company, which both times they did not properly respond. Selene Finance is liable for RESPA Violations, Fair Credit Reporting Act ( FCRA ) Violations, that have caused illness and stress to my sister ; which we've submitted doctor reports of them being liable for various damages and violations.

Complaint: I XXXX XXXX had a mortgage loan with Selene Finance, LP., located at XXXX XXXX XXXX XXXX XXXX XXXX, XXXX , XXXX XXXX Identified as Loan # XXXX, for property located at XXXX XXXX XXXX XXXX, XXXX XXXX XXXX. I sold the house and closed on XX/XX/XXXX. Selene Finance provided a pay-off letter to the closing agent, XXXX XXXX, XXXX in XXXX, XXXX, on XX/XX/XXXX at XXXX XXXX reflecting a pay-off balance of {$240000.00}. on the same day, on or about XXXX XXXX I made a payment in the amount of {$2100.00}. However, the payment was never credited to the pay-off balance and the pay-off letter was never updated. The closing statement reflects a payment made to Selene Finance for the full pay-off balance in the amount of {$240000.00}. When I made my last mortgage payment on XX/XX/XXXX, the statement reflected a pay-off balance in the amount of {$240000.00}. I contacted Selene Finance and requested a full refund of the last payment made in the amount of {$2100.00} since the payment was made after the pay-off letter was provided and was never credited to the pay-off balance. I also submitted a request in writing to Selene Finance, but I have been ignored and Selene Finance Refuses to send me the overpayment. By way of this complaint I am asking the Consumers Finance Bureu to assist me in recouperating my overpayment in the amount of {$2100.00}, plus the insurance reimbursement made by the homeowners insurance company. Additionally, Selene Finance, always charged more escrow that was required and never refunded any excess payments made on the account during the term of the loan. Complaint: XX/XX/XXXX To whom it may concern Our hardship began back on XX/XX/XXXX when my husband, XXXX XXXX lost his employment with XXXX XXXX XXXX. At this time we reached out to XXXX, XXXX XXXX XXXX, the mortgage holder, to inform them of the loss of employment and to seek out assistance and help. We were directed to there Loss Mitigation Department but they did not help us and the loan went into foreclosure. At this time, on or about XX/XX/XXXX we contacted our Community Legal Services for assistance, help, advice and guidance on resolving our legal situation. They assisted us with providing an answer to the Courts and arranging a mediation which took place on XX/XX/XXXX. A settlement was agreed upon but was never enforced. During this process we notified all parties that my husband, XXXX XXXX, became employed at XXXX XXXX on XX/XX/XXXX. In XX/XX/XXXX XXXX XXXX XXXX became the owner of the loan and again we applied and submitted documents for a loan modification. We received a preapproval for a modification in XX/XX/XXXX of XX/XX/XXXX in the amounts of {$2600.00} as an initial payment followed by a monthly payment of {$1400.00} which was to start on XX/XX/XXXX. We did not sign this preapproval and requested a reevaluation because we were not able to make this payment. The loan went into foreclosure again in XX/XX/XXXX and we hired XXXX XXXX XXXX XXXX to represent us. We were able to get the loan out of foreclosure and attempted many times to obtain a modification but still nothing happened. During this time the loan was sold again and went to Selene Finance and the process began again until legal representation ended on XX/XX/XXXX. During this time we applied to the different government programs available : XX/XX/XXXX- Hope for Homeowners XX/XX/XXXX-Florida Hardest Hits But we were not able to obtain assistance from anyone. We are now faced with the selling of our home which is scheduled for XX/XX/XXXX. This is why we are reaching out to you for help. We would like to see if you will be able to look into our case because after doing some research we believe that we may be a victim of predatory lending.

Complaint: A short sale offer and paperwork from the Homeowner intending to short sell her house was sent in by our authorized 3rd party company to the Mortgage Lender, XXXX XXXX, on XX/XX/XXXX. The property is in dire need of many, many repairs and the XXXX XXXX XXXX as of XX/XX/XXXX, has tacked on at least 8 city code violations on the property that currently incurs {$310.00} per day. Our company communicated with the Attorney that was handling the city code violations to try to work with them to reduce the fees and pause them tacking on fees on the house while we go through the short sale review process. We were unsuccessful in doing so but were told that they would only tack on a minimum of the {$310.00} per day fee instead of the maximum {$500.00} a day per violation per day that the Homeowner does not fix the violation issues. The homeowner has had financial difficulties paying for the mortgage and can not afford to fix the violation issues as well as fix the amount already accrued from the violations. XXXX XXXX initially told us that the value of the house was at {$230000.00}. Our offer was {$220000.00}. When the Buyer realized that the value was not far from each other plus all the violations and the repairs needed in the house, the Buyer informed us that he would be willing to raise his offer to the value the XXXX XXXX had ( {$230000.00} ). This was done on XX/XX/XXXX and we sent a HUD to XXXX XXXX along with an email stating to the Selene Negotiator that the Buyer could pay for full value as well as pay for half of the violations ( at this point in time, we prorated the HUD to 30 more days to close byXX/XX/XXXXand had a violations prorated fee of {$55000.00} ). After a few days, XXXX XXXX informed me that the Investor wants to get another value for a 2nd opinion which is strange because the value put forth at {$230000.00} was still current. We tried to get the Negotiator to cancel the 2nd opinion BPO especially since there was a current value that could be used. The Agent met up with the BPO Agent for a 2nd opinion BPO on XX/XX/XXXX. After 2 weeks of no responses from the Investor ( and many inquiries from us asking the Negotiator for an update ), we finally got a call from XXXX XXXX yesterday,, XX/XX/XXXXwith news that the Investor has decided to do a Deed-In-Lieu and that they would not allow the Short Sale to move forward. They would not agree to higher counter offer ( the 2nd BPO apparently came back at {$280000.00} ) or allow a short sale at all. This is concerning, because for deed in lieu 's to work, the property should have clear title ( other than the 1st mortgage that is deciding on the deed in lieu ). In this case, the property has a tax taking lien as well as the city violations that need to be paid before the repairs can be worked on. We asked for a letter fromXX/XX/XXXXregarding them agreeing to pay for the subordinate lien and pay off the violations, as well as informing the homeowner that a deed-in-lieu was what the Investor could only allow. The Negotiator with XX/XX/XXXX stated that she did not have a letter she could give me until the homeowner agreed to the deed-in-lieu. I have escalated this issue to a Manager in Selene to try to get a written confirmation that the subordinate lien and the violations will be paid, otherwise, a short sale can still be pursued and we still have a willing and able Buyer to purchase the house.

Complaint: I made three biweekly mortgage payments ( XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX ) to Selene Finance in XXXX. The last loan payment on XX/XX/XXXX was deducted from my bank account, but it was not deducted from the principal balance like it should have been. They will not resolve or even reply to the matter after 23 days now. I have attached screenshots of the current Selene Finance payment history and the payments made from my bank statement. The Principal Balance displays a {$220000.00} amount on XX/XX/XXXX. The payment reversal on XX/XX/XXXX is the problem because the funds were in fact deducted from my bank account and never returned. That payment reduces the principal because its the third payment of the month and Selene should never have had a " Payment Reversal ''. Therefore, the current amount in Suspense should be half the mortgage payment and the Principal Balance {$220000.00} as ofXX/XX/XXXX. On a side note to eliminate any confusion. Due to the lack of information Selene Finance provided me, I made a manual payment onXX/XX/XXXX. Unknowingly, two payments were then deducted from my bank account. One deduction was turned back for insufficient funds, but the other payment was accepted.

Complaint: On XX/XX/XXXX my father passed away. Shortly thereafter, during the same month of XXXX. I retained a probate lawyer. The law firm proceeded in contacting XXXX XXXX to inform them that I was the sole heir and wanted to keep our family home. When asked how I should go about keeping the home, they said, just make the payments. A few months later, when I went to make a payment, the teller refused to accept it. I was then told they could not discuss the situation with me because I was not on the mortgage. I then sought counsel with a foreclosure attorney who suggested the bank would not likely speak to me or come to any deal until probate was over ( unless through a litigation process with lawyers ). So, in order to have this dealt with properly, I retained him. Then, in XX/XX/XXXX Foreclosure began. While originally with XXXX XXXX it was later transferred over to XXXX XXXX XXXX XXXX, XXXX, DOING BUSINESS AS XXXX XXXX, NOT IN IT'S INDIVIDUAL CAPACITY, BUT SOLELY AS TRUSTEE FOR XXXX XXXX ( as plaintiff ) with Selene Finance as the servicer. This has gone on now for roughly 5 years. In that time, the only thing we have been able to work out with the financial institutions was a pay ahead in full, cash buy-out option or a trial mod which would increase the monthly payments to roughly {$3800.00} per month that included terms allowing them to then drop me afterwords for no substantial reason at any time. Neither of which are easily affordable and with the situation, not many cash lenders were keen on helping at an affordable rate. I still don't understand why someone would offer those " trial '' terms unless they never had any intention on actually working with you to begin with. At no time whatsoever did any of the financial institutions involved provide me with information or a means to assume the mortgage nor did they any of the 5 or so times I sent them the same paperwork, offer me a legitimate/realistic refinance option. Now the amount I would have to work with is much higher ( nearly double ) due to the time they have pushed this out. Clearly they have no concern about my situation, nor do they have any concern about the rules implemented by the CFPB. Instead, they insisted that I had no rights and in court even denied knowing anything about the CFPB rules even after multiple mentions to the plaintiff counsel through email. All this and during the entire foreclosure procedure, the mortgage/note they were attempting to foreclose with was Defective. As suggested by my legal counsel, I have refiled this complaint against Selene Finance, since there is no direct listing to file against " XXXX XXXX XXXX XXXX, XXXX, DOING BUSINESS AS XXXX XXXX, NOT IN IT'S INDIVIDUAL CAPACITY, BUT SOLELY AS TRUSTEE FOR XXXX XXXX '' and I inadvertently filed against an incorrect institution. My sincere apologies to " XXXX XXXX ''. The amount of stress put on a family who is trying to work out reasonable terms is hard to measure. To have to spend the money you would be financially securing your family with on an already over-worked legal system is non-sense. To be ignored as a sole heir and told you have no right to what has been left to you, when the financial institution could be conducting legitimate business instead, is bad business. I truly hope the CFPB is able to do what others have not been successful in. I'm unable to upload the files ( too large ). Original mortgage was under XXXX XXXX ( my father ) with/through XXXX XXXX ( I believe previously aka XXXX XXXX XXXX XXXX XXXX ) We did have our court date, at which time I was not allowed to defend my case. So, after 5 years of fighting the financial system the foreclosure sale date has now been set. Thank you, to whomever has taken the time to read this.
