Complaint: We have a mortgage with Rushmore Loan Management Company on a XXXX unit rental property in XXXX XXXX CA. This year we had a water damage incident that resulted in over {$4000.00}. in repairs. We paid for all the repairs as they were completed. Our insurance company then reimbursed us with two separate checks, but as required by CA state law, the checks were also made out to Rushmore Loan Management Services as well as our property manager. I endorsed XXXX of the checks before I noticed the other names on the checks. Wanting to make sure of the proper procedure for depositing the checks I called Rushmore Loan Management Services. Eventually I was connected with XXXX ( employee identification XXXX ) in the Insurance department. I took very careful notes on everything he said because my trust level with that department was already quite low -** important explanation to follow. He told me exactly where to send the checks, attention Customer Service etc. I verified the address with him. He assured me the turn around was normally 72 hours. I mailed the checks on XXXX XXXX, along with a letter outlining my conversation with XXXX and reiterating my desire that the checks be endorsed and returned to me as soon as possible. After several weeks, I started calling, no one could tell me anything about the checks. On Monday XXXX XXXX after many explanations and attempts to find out where the checks were I was transfered to the Loss Draft Department and I spoke with XXXX XXXX, initially she did n't know what happened to the checks. At that time I decided to call XXXX XXXX XXXX and see if they could issue new checks and they said they would be happy to do that. Except wait! The checks have been deposited into XXXX Bank! They were cashed XXXX XXXX. So now I am trying to get the money back from Rushmore Loan. At last they acknowledge they can see the checks, and they have to go into a Loss Draft Escrow account. No one can tell me how long that will take, XXXX will not return my phone calls. I am told there is no supervisor or anyone to talk with at a higher management level. So they have had my money for a month. They evidently are able to cash checks without all the signatures, even though it was clearly stated on the back of the checks that all signatures were required. They are not required to tell me how long the process will take or even return my phone calls. How much would they charge me if I had {$4000.00} of their money for a month? And no phone numbers or email for higher management personal? Seems like a poor way to treat a customer that is always one month ahead on the mortgage payments. ** Last year just a week before we were leaving the country for 6 weeks I recieved a phone call from XXXX XXXX telling me that only half of the insurance on this property had been received from Rushmore. The insurance has always been written in XXXX policies because it is a duplex and a single house. I immediatly called Rushmore, and asked them to look at our impound account, note the error and pay it I was promised they would pay it immediately. Just before departure I checked again, XXXX XXXX had not recieved the funds. Again I called Rushmore and the assured me they had paid it. Imagine how I felt returning from my trip to find that altho Rushmore had our $ $ in the impound account all along, and I had made numerous phone calls, the insurance policy on our duplex had in fact lapsed! We were in XXXX and our property was uninsured! I paid it myself and after another week and many phone calls Rushmore paid the insurance bill and XXXX XXXX reinbursed me. I can only imagine the legal mess it would have been if something had happened to that property while we were gone and it was uninsured! I have never experienced worse customer service. It seems they like to use our money and have no moral or legal ethics.

Complaint: In XXXX, my home and farm was appraised for XXXX XXXX. I borrowed {$140000.00}. This was done through XXXX XXXX. It was serviced by XXXX. Was then transferred to XXXX XXXX XXXX. I never missed a payment and was never late on a payment. In XXXX, XXXX, I received a letter stating that my taxes and insurance were in default and I had 30 days to produce proof of payment. The next day I received a lettered stating that XXXX XXXX XXXX had paid the taxes and insurance and that my payment had increased from $ XXXX to $ XXXX/month. My insurance had already been paid and the taxes were not due. I called and was told that I could get a modification and that I was to stop Making payment for 60 days and this would qualify me to get a lower interest rate from XXXX, smaller payments and longer term. That the entire process would be done in house and not affect credit. I agreed to do so. In 30 days I received a late notice. When I called I was told not to worry it was taking longer to complete mods because of the huge number of requests. The following month same. In XXXX, XXXX all of my credit cards went from 2.9 % to 32.9 % interest and I found that XXXX XXXX XXXX was filing this with credit reporting agencies. In XXXX, XXXX XXXX XXXX tried to foreclose on my home. I was able to get it stopped. They denied me on XXXX modification attempts, kept my trial payments and tried to foreclose 9 times by XXXX. During this time, I had XXXX XXXX, my daughter had XXXX XXXX, my son-in-law had a XXXX, and my son had to quit school to handle XXXX XXXX XXXX since they were threatening that if we missed a call, they would make decisions without us to take my home. Finally, i filed bankruptcy so that i could try to keep my home. Since i had always paid my taxes and insurance, I went to the tax accesor and my insurance company and paid them privately. At this point, XXXX XXXX XXXX transferred the account to a company named XXXX. They would not answer any phone calls or respond to me in any way. After a few months, XXXX sold the loan to a company with Rushmore as the servicer. Now they are trying to get a release on the property for the purpose of foreclosure with a court date set for XXXX XXXX. I need a resolution to this issue. I have. Complete paper trail from XXXX and a letter from XXXX XXXX XXXX that states that this loan only defaulted for the purpose of modification. That they are sorry for any inconvenience. I 'm XXXX. I need to retire. I have fought with all I have. Help.

Complaint: On or about XXXX XXXX, XXXX, XXXX XXXX XXXX XXXX XXXX, WA, posted a Notice of Default ( NOD ) on our door. We requested a mediation from the new " loan servicer '' ( XXXX " transferred '' or " sold '' the loan to XXXX Mortgage ). After several delays, we finally met with them XXXX ( over a year later ). They would not do a thorough analysis of our financial ability to cover the $ XXXX monthly mortgage, stating abruptly that they only went by our form XXXX tax statement for income. They refused to acknowledge that a home business has greater cash flow than the tax doc will show when a large percentage of the property/home/mortgage interest is written off. Another " meeting '' was scheduled for XXXX, but XXXX 's representative did not even call in to the meeting. After another 6 months, in XXXX, XXXX XXXX, started the foreclosure process again. It is our belief, in reading FDCPA rules, Truth in Lending Act Rules, et al., that XXXX acted in bad faith, not only stretching out the process in order to be able to foreclose on our sole domicile, but in refusing to analyze our actual finances that would have, without a doubt, shown our ability to resume payments. We filed suit in XXXX of XXXX to block a foreclosure, and were granted a XXXX by Judge Plese of the XXXX XXXX, WA, court system by showing " just cause. '' The suit was filed against XXXX XXXX Loans ( XXXX ), which was " merged '' with XXXX XXXX XXXX XXXX XXXX XXXX in XXXX, as well as others involved, which now includes Rushmore. XXXX attorneys remanded our case to the federal court in XXXX. Judge XXXX XXXX XXXX was assigned our case. He delayed the case from XXXX to XXXX, and after nearly 9 months, dismissed the case without good cause shown, denied our appeals, and finally denied our XXXX ( b ) motion with about XXXX words without apparently even reviewing it. We have appealed this to the XXXX XXXX XXXX XXXX XXXX XXXX, but Rushmore Loan Management Services and XXXX XXXX conspired to deprive us of our sole and only home, posting a notice on our door on or about XXXX XXXX, with a foreclosure date of XXXX XXXX, XXXX. I have attached files showing date discrepancies on the date XXXX took over our loan, the final XXXX stating they took over the loan on XXXX XXXX, XXXX, and posting a DOS on our door on XXXX XXXX, a clear violation of the 20 day rule on our requesting a mediation. Also attached are XXXX documents supporting our allegations of " bad assignments '' that were noted in our XXXX ( b ) motion to the Fed Court, " XXXX, in its individual capacity and without identifying its principal, executed a false/forged assignment of deed attempting to transfer interest in the XXXX ( Plaintiff ) loan to XXXX XXXX XXXXXXXX. ( Exhibit XXXX XXXX attached hereto and incorporated by reference ) on XXXX XXXX, XXXX. '' And again, " Defendant XXXX claims to be an equitable assignee by assignment of deed of trust ( Plaintiff 's Exhibit XXXX attached hereto and incorporated by reference ). The instrument relies solely upon the previous assignment instrument which has been shown to be rendered as void by operation of law. Thus, XXXX 's claim of equitable beneficial ownership of Plaintiff 's loan obligation is rendered void by operation of same laws. '' This is the proverbial tip of the iceberg. There are forged documents within our " loan process '' and other irregularities. XXXX has provided conflicting dates and undated allonges. If the XXXX XXXX XXXX XXXX reviews the forged instruments, irregularities, illegal actions, and bad assignments, starting with XXXX, XXXX, XXXX, and now Rushmore, it is our belief that these entities will be found to have committed multiple accounts of fraud and will be fined accordingly, or worse.

Complaint: I had financial difficulties in XX/XX/XXXX and filed for bankruptcy. I was not able to make the mortgage payments in the agreement and the bankruptcy was discharged XX/XX/XXXX. The Lender Rushmore Home Mortgage LLC proceeded with the foreclosure on XXXX XXXX, XXXX the day before auction I filed again for Chapter XXXX. Through an inheritance I now had the reinstatement amount due of approximately {$130000.00}. I then instructed my attorney to dismiss the case so I could pay back the reinstatement amount due. The dismissal was official XXXX XXXX, XXXX. I immediately called and left a message with XXXX XXXX XXXX regarding the procedure and reinstatement. I have XXXX XXXX emails XXXX/XXXX/XXXX stating, she received my voice mail and " I have requested the fees and costs for the Foreclosure. Once received I will forward. I have attached the wiring instructions to wire the funds. '' XXXX XXXX, XXXX subsequent email from XXXX XXXX states : " the reinstatement will be not completed until XX/XX/XXXX due to the foreclosure fees and costs. '' The next XXXX/XXXX/XXXX email states : I am sorry to say the foreclosure sale date was completed yesterday and the property reverted to the investor. ''

Complaint: I am continually having issues with my loan servicer, Rushmore Loan Mgmt Svs, but this issue is especially hard to swallow because it could have been prevented by them. They refuse to accept they made a mistake. I recd. a XXXX loan in XXXX of XXXX to pay the arrears balance and bring me current. When in the Mediation mtg., it was brought to Rushmore 's attention that I would most likely be approved for this loan and once I was notified, I would need an accurate figure to bring my acct. current. Once I was approved, XXXX notified Rushmore and Rushmore then quoted them the figure of just over {$27000.00}. The money was received as promised and to me like a XXXX mortgage. Not payable for 30 years or if I sold my home and " 0 % '' interest. The money arrived and credited to my acct. XX/XX/XXXX. My first payment being current was due XXXX XXXX, XXXX and every month thereafter. Not 2 weeks later I recd. a letter in the mail from Rushmore saying my escrow acct. was approx. {$2000.00} short and that my monthly mortgage payment would increase on XXXX XXXX, XXXX by approx. {$150.00} a month for a year or something. I have the exact figures but to tell you the truth, I was so angry that I pretty much just stopped breathing. I do n't remember much else that day. If I had a shortage in my escrow, why was n't that shortage or projected shortage included in the reinstatement figure they quoted XXXX. I had up to {$30000.00} I qualified for but I used the figure Rushmore quoted them and got the loan for just over {$27000.00}. They claim they do n't do escrow analysis 's on delinquent loans so as soon as I got current, they did the analysis and determined that would be the shortage. I know for a fact that my insurance and property taxes did not go up more than {$30.00} for the next year so where they came up with that {$2000.00} figure is beyond me and regardless, any shortage could and should have been included in the reinstatement figure, If I make a mortgage payment that includes escrow, they should have included that into their calculations. They refused to do another analysis after leading me on for 3 months and when XX/XX/XXXX came, I could not make the new mortgage payment with the increase. I pretty much lost it. I got a forensic review of my loan and found out its been securitized and I 've tried to talk to them about this but they refuse to do anything about it and continue to claim I 'm delinquent and wont reverse the additional monies they want each month. I ca n't even get into my acct. on line because they lock out all delinquent accts. I recently receive3d a letter of default at my house so now I 'm facing foreclosure and if I 'm forced out, that XXXX loan will become due and I have no way to pay that {$27000.00} off now. It 's just wrong that they can do this to people. I 'm sick of it and it needs to stop. How many complaints do you need to get on a company before they are shut down. I want to stay in my home and I want them to make this right.

Complaint: Rushmore loan services company repeatedly neglected to renew my wind insurance coverage then enstated their own coverage and charged my escrow XXXX for 6 months premiums. Hours on the phone since XXXX 2016 with the help of my insurance broker I got my own insurance reinstated but they still charged my escrow that XXXX dollars. For " my security '' that do n't do emails. Almost impossible to track my communications and faxes with them. I had to pay inspectors to inspect the house because they let my insurance lapse. I feel this may be a common practice for them to collect some extra revenue. It seems criminal to me. I 've never been blatantly lied to and ignored so bad in my life. Please help and make sure they 're not doing this to other people as well.

Complaint: I had a Mortgage that was owned by XXXX XXXX XXXX. It was then sold to Rushmore Loan services. I fell behind in making payments and they offered me a solution to " help '' make my payments current. They ended up adding over {$34000.00} in fees to my loan in XXXX XXXX. Keep in mind at that time they only had my loan since XXXX XXXX, so in less than 5 months they say I accumulated over XXXX in fees? I did n't even realize they were adding that at the time to my principal. I was worried and signed the paperwork as they threatened to foreclose on my home! I never realized they increased it until I looked at my statements XX/XX/XXXX after I have made successful payments to them, and thinking I might have made a dent in my balance. I was shocked to see such a balance.
