Complaint: XXXX XXXX, XXXX To whom it may concern : I am writing to you with great concern about the manner in which, Rushmore Loan Management Services, handled my situation, recently. Hopefully, you can rectify the problem, since I believe this company 's practices are not up to par. I have lived in my home since XXXX XXXX, XXXX ; at this stage in my life, it was never my intention to loss my home. Unfortunately, I developed XXXX, and had to decide between paying for medical treatment or saving my home. Prior to letting my house payment default, I 've made numerous attempts to have the house modified ; participating and attending XXXX. I was rejected continuously for either, making too much money, or not enough ; I 'm self-employed. My only option was to seek help from a HUD approved Housing Counseling Agency. XXXX XXXX from H.O. P.E ( Housing Options and Planning Enterprises. INC ) explained all my options regarding foreclosure, short sale, etc. I chose doing a short sale. On XXXX XXXX, XXXX, the exclusive rights to sell was given to XXXX XXXX, XXXX ; the house was listed on XXXX XXXX. On XXXX XXXX, XXXX ; I attended, mediation with Judge XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, Attorney for Rushmore, and via landline, XXXX XXXX XXXX, Servicer for Rushmore. I made my intentions clear ; I would do a short sale. The house was made available for showings, and the bank had the house appraised on two different occasions. On XXXX XXXX, XXXX ; an offer was submitted to Rushmore for approval. In XXXX XXXX, I received a letter dated XXXX XXXX, XXXX ; notifying me the ownership of the mortgage loan, had been sold. I received a letter dated XXXX XXXX, XXXX, from XXXX XXXX, for me to contact her to discuss the options available to me to either save my house or consider other alternatives. After contacting XXXX XXXX ( authorized XXXX party from XXXX XXXX XXXX ), to negotiate the short sale. She contacted XXXX XXXX XXXX, at Rushmore 's Loss Mitigation, the next day ; XXXX XXXX assured XXXX XXXX, the short sale was approved. She said, she would notify Rushmore 's attorneys, ( see emails attached ). This was before the XXXX of XXXX ; however, on this day, Rushmore now claims, the short sale was approved, and they auctioned XXXX XXXX XXXX. To add insult to injury ; the same bank bought the house. Therefore, this house has become an REO ( real estate owned. How is that possible? Rushmore failed to notify the attorney, that a qualified, prospective contract was available in XXXX XXXX. I am extremely concerned with the undermining handling of this situation. If Rushmore did not want to do a short sale, they should never have agreed to it ; during mediation. I did n't default on my home due to negligence ; I fought the battle, jumping through hoops for modifications, so I could maintain my home and get medical treatments. Every attempt, was in vain. Yesterday, I called Rushmore ; when I questioned how it was possible to approve a contract and auction a house, at the same time, on the same day ; especially after XXXX XXXX, assured she would contact the Rushmore 's attorneys ; the Servicer became annoyed with me. XXXX XXXX, during all this, has avoided all calls, and not returned any calls pertaining to this. She has been XXXX, since before I was notified with the foreclosure, finalized, court order. I would appreciate assistance in this situation, a lot of work went into that short sale. I am not the only one that was affected. There are agencies, that were involved in getting a qualified Buyer for the short sale, and seeing all requirements were met. The only participant that failed to do their job was the representatives of Rushmore, and the Law offices of XXXX XXXX.

Complaint: I applied for a loan modification in the XXXX. I was accepted into the program in XXXX at this point I believe I was one month behind. I was given a grace period for XXXX and stated making the trial payment in XXXX. I made 6 on time payments until my mortgage was permanently modification in XXXX. I think is unfortunate that my 6 on time payment are not being reported. The agreement states that the modification could adversely affect my credit report but does not state my on time payments would not be accounted for. It states the reporting that the loan being modified will affect my credit. Also, my modification was accepted on XXXX XXXX, XXXX but I was still be reported behind until XXXX. I have attempted several times through the different credit bureaus to have this changed but to no aveil. I understand that they payments are being considered partial payments but after a year of on time payments I believe I am justified in my request for my information to be undated.

Complaint: Urgent!!! Urgent!! It is with great fraustration and hysteria that I am asking that you review my file. My house just sold and my attorney was never notify of the sale day. I have recently submitted a loan modification package up dating all my information, for I was not aware of this sale. My attorney 's office after filing documentation was notify that this file had been transfer to four different attorneys. The First attorney was XXXX XXXX XXXX XXXX XXXX, and XXXX XXXX law firm .Please I am now requesting you reach out to Rushmore loan servicer who apparently did not inform me of the sale day. We have no place to go. I had requested a loan modification due to circumstance beyond my control. I lost my job and so did my wife. Shortly after she suffered XXXX due to the treat of eviction. We want our home. I am attaching my financial for review. We finally were able to get our finances in place and provided such to XXXX loan servicing.. We have made significant cut back to our budget ; eliminating many services to our home to be able to survive this set back. We now receive my pension and my wife social security income. Kindly confirm receipt of this request.

Complaint: Please Help!! Have a Buyer for my home, doing a short sale with Rushmore Loan Management Services, who in turn, has us negotiating with there foreclosure law firm XXXX, XXXX XXXX XXXX, PC only to find out we have the short sale denied, we have countered with a higher offer but have been shut out with no further communication from there attorney. We have attempted to reach out to Rushmore Directly only to find out that they will not talk with us because we are in litigation, and will only talk to us if we withdraw attorney representation which would leave us unprotected. At this point I can not afford any additional attorney representation and my options are dwindling. I still have my buyer who wants the home who is willing to go higher in price.I believe that the reason there foreclosure attorney will no longer negotiate with my attorney is because they will obtain a higher fees if they foreclosure on the home. I have contractor estimates and photos to show Rushmore but they will not look at it, just by way of background this was with XXXX and then transfered to Setarus, and on the verge of an approval and was transfered over to Rushmore. I have even attempted to reach out to XXXX XXXX, Rushmore 's Ceo '' s office but would not be put thru.
