Complaint: We were involved in a load modification with XXXX XXXX, the lender on our home, last year XXXX. Our home was severely damaged due to a broken pipe which mostly destroyed the walls and floors of the entire house, so every cent we had had to be put into trying to save the house. XXXX, the worse insurance company ever to exist, refused to pay. They had absolutely no grounds - nothing to claim was our fault. They just found a way to wriggle out of it in front of an impatient judge. So the damage persisted, from XXXX of XXXX. Since we had troublle paying the mortgage we fell behind and had to apply for a modification. We were approved once but could not pay because not only did we have to pay for repairs but both I and my spouse were unemployed for several months, We have XXXX children to support. We finally got back on our feet and requested a modification at the end of XXXX. XXXX XXXX was about to send it to underwriting when they noticed the hazard insurance was missing. When we called back to give them the hazard insurance, they informed us that they had decided to sell the loan to a well known customer-abusive company called " Rushmore '' XXXX. XXXX XXXX told us to just give the Hazard information to them. We called, and were told that we could ONLY speak with XXXX XXXX, XXXX, and that he was on vacation for two weeks. Unbelievable but true, This was in early XXXX. We had a foreclosure date at the end of XXXX with XXXX XXXX. XXXX 's outgoing voicemail message instructed callers to NOT leave a message, and to call him back on XX/XX/XXXX. This cost us valuable time which Rushmore is going to have to make good on. We were understandably upset at this treatment and demanded to speak to his supervisor, XXXX XXXX. We had hired a short sale specialist who had several interested investors interested in paying cash. All we wanted to do was a short sale and not foreclose to save our credit. XXXX said he would try to help but although he promised to call our short sale rep XXXX XXXX, he did not. XXXX called Rushmore several times daily to let them know he had several investors willing to pay the common appraisal price ( inducing damage ) of XXXX, vetted by XXXX XXXX. Rushmore never returned his call. Rushmore kept telling us that THEY COULD NOT CONSIDER US FOR A SHORT SALE BECAUSE WE WERE WITHIN 37 DAYS, HOWEVER WE WERE WITHIN 37 DAYS *****ONLY***** BECAUSE WE COULD NOT SPEAK TO ANYONE AT RUSHMORE TO START THE SHORT SALE PROCESS AS NOONE WOULD SPEAK TO US BUT XXXX XXXX XXXX Rushmore therefore BLOCKED our ability to be within 37 days and therefore blocked our ability to short sell with interested validated buyers. I called the Government HOPE line and this definitely scared XXXX XXXX because a rep from XXXX got on with me and Rushmore and asked them all the right questions. We were then directed to someone who was new and so incredibly helpful. We were told that XXXX instructed his team to GET ON THIS NOW!!!!!! as soon as he heard that I had government help on the phone. Suddenly we were given instructions, XXXX had the packed with offers all ready and sent it to Rushmore. It was still difficult for him to reach them as they ignored him for days. Finally Rushmore said their investor would only consider $ XXXX ( which would be the price if you did a drive-by appraisal - a real appraisal with the damage inside would lower the appraisal to XXXX ). I used my two adjournments, then on XX/XX/XXXX, my foreclose date, I went to court in New Jersey to ask for a postponement so that we could resolve a short sale, starting with a reasonable appraisal, which Rushmore claimed they had no time to get with the foreclose date coming up. Obviously they could have moved it. We had been informed that Rushmore makes its money through foreclosures so they are considered the worst and have no interest in working with the owner. The judge denied my petition and said the house would be sold that day on XX/XX/XXXX. Then, extremely oddly, the next day I found out that the sheriff sale date had been moved by someone to XX/XX/XXXX. Rushmore ( XXXX XXXX ) denied doing it but we eventually found out Rushmore lawyers did it. They were still refusing the verified appraisal on the house - a value corroborated by several sources, and refused the purchase offers by several vetted investors. They led us to believe they would negotiate during these 30 days given to us as a stay of execution, but they instead did nothing and in fact insisted again that the house was worth full price. Once again we do not have 37 days, we have now lost our investors who would have bought and we will be forced to foreclose on Tuesday for no reason other than they want to cause damage to my credit. Rushmore will receive no more than 350K at the sheriff sale, and if they take less I will sue them. This company has a strong reputation for tormenting homeowners. Please get them to stop this, give us the 37 days we need, accept the true value of the house, and let us find new investors.

Rushmore continue give us a lazy, careless, unprofessional single point of contact ( SPOC ) for my account, I think Rushmore just want to foreclosure my property and make more money than want to help me, most SPOC Rushmore assign to my loan they did not do their job, they make it hard for everything, when I submit the loan mod they have many reasons not review them or they said that missing doccuments, Rushmore people think that thay above the law, whatever they treat borrowers the GovermentS, Authority Agencies, the Federal Deposit Insurance Corporation ( FDIC ), the Comptroller of the Currency ( OCC ), the Federal Reserve System ( FRS ), the National Credit Union Administration ( NCUA ) the Office of Thrift Supervision ( OTS ), will not know, View all links customers talk about them : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Now they have another SPOC his name is XXXX XXXX, his office in California his phone number is XXXX, he said that my last payment is XX/XX/2016, Rushmore did not receive any payment from me from XX/XX/2016. That is not true, here are attached payments until it overdrawn when Rushmore increase payment from {$2900.00} to {$11000.00}. Moreover XXXX XXXX refuse to talk to my representative XXXX, even he did not know what he's talking about " he said that my last payment is XX/XX/2016, Rushmore did not receive any payment from me from XX/XX/2016 ''. Rushmore recorded the conversation, please review it for yourself. I am extremely disappointed and I do not know how to deal with Rushmore, they do not want to help the borrowers. I really need a new SPOC, I can not work with XXXX XXXX. Please help!!

The first one was on XX/XX/XXXX there was an assignment of mortgage filed with XXXX County Clerk 's office. The assignment of mortgage assigned the mortgage from XXXX XXXX XXXX XXXX XXXX XXXX as nominee for XXXX, XXXX XXXX. to XXXX XXXX XXXX, XXXX. The second assignment of mortgage was filed with the XXXX County Clerk 's office on XX/XX/XXXX. The assignment of mortgage assigned the mortgage from XXXX XXXX, XXXX to XXXX XXXX XXXX, XXXX. The third assignment of mortgage was filed with XXXX County Clerk 's office on XX/XX/XXXX. The assignment of mortgage assigned the mortgage from XXXX XXXX XXXX XXXX to XXXX XXXX XXXX XXXX. On XX/XX/XXXX XXXX XXXX, XXXX started a foreclosure action against me in the amount of {$270000.00} which is a {$16000.00} from the original loan amount. How is that even possible when I paid over {$100000.00} before defaulting. I have tried fixing the problem by submitting a loan modification on XX/XX/XXXX and XX/XX/XXXX getting denied both times. It seems like they do not care whether I pay them back or not, they just want me out of my home which I am working hard to repay. I am a victim of the housing crisis and I feel that there is fraudulent element to what is happening to my mortgage loan.

Complaint: My home loan was sold to Rushmore Loan Managment Services in XX/XX/XXXX with my first payment due XX/XX/XXXX. My previous mortgage company allowed me to make bi-weekly payments, which they would hold and then apply to my payment that was due the first of each month. They also applied any additional money I sent them over my payment amount to my principal. I was not aware that Rushmore didnt allow bi-weekly payments, so my first 3 months of payments were occasionally applied incorrectly. In XX/XX/XXXX, I noticed on my online mortgage account that they were showing I was a half month behind on my payments. I called Rushmore and they found 1 payment that had been applied 100 % to principal. They advised me they would reverse it and apply it to my payment amount and that I would then be caught up. I called two weeks later as I saw on my account that I was still showing behind and now I was a month behind as opposed to the half month it showed two weeks prior. Rushmore advised they would email the Cash Management department and have them review all of the payments I had made and they would call me in two days. I never received a call back so called again and went through the same conversation again. They again told me they would email the Cash Management department along with the Customer Service Manager and get back to me in two days. They still did not call me back so I called again and asked to talk to the Customer Service Manager. I went through everything with him again and he asked me to fax him my bank statements showing proof of all of my payments. I tried to fax him 10 times and the fax number he gave me didnt work. He also gave me his direct phone number and that also did not work. I mailed my bank statements with a written request for an account review, which they show they received on XX/XX/XXXX. They sent me their response on XX/XX/XXXX stating their records are correct and I am one month behind. I called them again and went through the same conversation again and asked for proof of what they did with every payment I have sent them. They told me to submit my request through their online message center and fax them my back records again and they would review the account again. I dont know what to do at this point as I have already provided them all of the proof of my payments many times since XX/XX/XXXX and they arent correcting anything. On top of all of the payment issues, they also did not pay my homeowners insurance automatically as they should have so I had to get them on the phone along with me and my insurance company so they could send them the check. Rushmore was typing up the check while we were on the phone and said the check would go out the next day. A few weeks later, I received a letter from my insurance company stating they cancelled my insurance as the premium was never paid. I called Rushmore and they admitted they never mailed the check. I had to get on the phone again with Rushmore and my insurance company so a rush payment could be sent which they finally did send this time.

I faxed Rushmore Loans all my mortgage reciepts of payments from present to past XXXX XXXX from Rushmore Loans said that it wasn't enough information that I have to contact my previous mortgage XXXX XXXX to get and update. Complaint: My mom purchased our home in XXXX, she was on mortgage only and I was on the deed. The company that got the mortgage for us put her in a horrible loan, we tried to modify or refinance but they would not let us.. In XX/XX/XXXXmy mother passed I continued to make payments on house until XX/XX/XXXXthe mortgage went from {$1700.00} a month to {$2200.00} being a single mom with XXXX kids I could not afford a {$500.00} increase, Again I tried to modify loan on my own but being self employed I dont show I make enough to support the loan, even though Ive been paying the mortgage for the full 10 years out of my checking account. When my mother passed I sent the mortgage servicing agent her death certificate at the time at that time it was XXXX XXXX servicing agent, the mortgage got sold again and the new company Rushmore refused to talk to me about anything because they thought my mom was alive still. The house is now going to auction on XX/XX/XXXX and even though I sent them her death certificate and a letter stating my Husband wants to by house or assume mortgage they still wont contact us or even talk to me. Im also concerned that all the steps in the foreclosure were not met, I was told they need to have the original note from original bank, which was XXXX XXXX XXXX of XXXX at the time, in all the foreclosure papers the bank that owns the loan now is XXXX XXXX XXXX XXXX. I was recently married and my husband is preapproved for the mortgage. During this whole process Ive contacted the lawyer involved in forcloser numerous times and so has my realtor. Not once have we received a return call. I didnt go to the forcloser hearing because I felt they would not help me or listen to me. I would really appreciate any advise you might have for me and how I can keep my house, like I said I have have XXXX children XXXX still living at home and run a XXXX out of home.. Thank you

Complaint: On XX/XX/XXXX Rushmore Loan Management Services made a payment from my escrow account for {$300.00} for Mortgage Insurance ( PMI ) due XX/XX/XXXX. The payment due XX/XX/XXXX was made by XXXX XXXX XXXX ( my prior mortgage company ) before the servicing of the loan was transferred to Rushmore. I spoke to Rushmore on the phone for nearly an hour attempting to resolve this and received nothing but the runaround from the representative as well as the supervisor that I spoke to. They said it was my place to prove that the payment was made by the prior mortgage company. These are records they should have received when accepting the transfer of responsibility. I paid to have proof faxed to them that the payment was previously made and have yet to receive any response. Rushmore Loan Services reviews speak for themselves. They are a terrible company to deal with and it is even worse that they were not selected, the loan was merely transferred to them. I find it absolutely crazy that they actually reside in Puerto Rico and are treating United States consumers in such a way. I hope the Federal Government steps in and shuts them down. I want the overpayment/duplicate payment of {$300.00} refunded to my escrow account ASAP!

Complaint: This is an update from my previous complaint from XX/XX/XXXX. Rushmore Loan Management Services did give me another Single Point of Contact person at the end of XX/XX/XXXX. His name is XXXX XXXX which I spoke with him on the phone XX/XX/XXXX. He was very demanding and had a sarcastic attitude and was asking for the full amount in past payments. Also he mentioned that my rental income wasn't included twice on one of the properties when I applied for a Loan Modification. XXXX XXXX mentioned that I was done and the next time he would only be speaking with my housing counselor on the phone. Then on XX/XX/XXXX I received a XXXX XXXX XXXX envelope at my front door which included a letter dated XX/XX/XXXX from Rushmore Loan Services it was a special Loan Modification offer which I did apply for and I was rejected. I was rejected because Rushmore has a lock on my account and that I can not apply anymore for a Loan Modification which I was told that on the phone XX/XX/XXXX. This is unfair business practices by Rushmore Loan Management Services and the denial was inappropriate. Also my income was taken incorrectly by Rushmore Loan Management Services for the Loan Modification.

Complaint: My mortgage is serviced by Rushmore Loan Management. Rushmore has been servicing my loan since XX/XX/XXXX and overcharges me every month. As of XX/XX/XXXX, the fraudulent charges from Rushmore reached {$43000.00}. My past due interest is {$94000.00}, unpaid escrow is {$21000.00}, and no past due principal. Totaling {$110000.00}. These figures are from a Rushmore payoff Statement and are consistent with the terms of my loan. However, Rushmore 's XX/XX/XXXX monthly statement states that as of XX/XX/XXXX, my total overdue is {$150000.00}. The overcharges stem from Rushmore multiple mistakes and fraudulent acts : 1 ) Overstating the past due amounts incurred before my loan was sold and Rushmore became the servicer. These overstatements are from XX/XX/XXXX - XX/XX/XXXX and total {$12000.00}. 2 ) Rushmore is collecting for a past escrow deficiency of {$21000.00}. This is legitimate. Rushmore bills me at least {$2300.00} each month to recoup this amount. When I do not pay it, Rushmore adds {$2300.00} to my past due amount. That is NOT correct. The past due amount of {$21000.00} remains unchanged and does not grow each month. This overcharge for 9 months is {$21000.00}. 3 ) I do not know what the remainder of the overcharge is. I have raised these issue with Rushmore multiple times and they do not address it and don't appear to have the competence to figure out that their systems are making mistakes. Rushmore 's gross $ XXXX overstatement of my past due charges has harmed my ability to be fairly considered for a loan modification. And Rushmore is reporting the overstated charges to the credit agencies, hurting my credit more than it deserves. I hired Consumer Arbitration Services to Help me after no success on my own, but XXXX XXXX XXXX is a fraudulent firm. A foreclosure sale has been scheduled for XX/XX/XXXX. Even if CFPB can't stop the sale, I need help so that Rushmore stops overcharging me and not giving me a fair shot at a loan modification. Also, XXXX XXXX XXXX XXXX XXXX needs to be disbarred and put out of business.

Complaint: We decided to prepay our XX/XX/XXXX county property taxes in XX/XX/XXXX, in anticipation of the changing tax laws for XX/XX/XXXX. We called Rushmore to confirm, and following their instructions, submitted receipts for the prepaid taxes shortly thereafter through their online messaging system. We were advised that once Rushmore 's tax department researched and confirmed the proper payment of property taxes, they would then issue a reimbursement check directly to us for the overage from our escrow account that resulted from Rushmore no longer needing to pay the county on our behalf. After not hearing back for several weeks, I called to confirm that the research had been completed and reimbursement check would be en route. I was informed that the research had been completed, and that our prepayment was verified. It was also confirmed then and on numerous occasions since then, that Rushmore 's scheduled disbursement to the county for our XX/XX/XXXX property taxes had been canceled, as the prepayment had been ( correctly ) confirmed by their tax department. However, no reimbursement check would be issued to us, as the borrower, until there was a " reanalysis '' of our escrow account. Clearly this made no sense, since the research had already been done and Rushmore 's previously scheduled disbursement to our county had accordingly been canceled as a result of that research. However, after talking to several more representatives over the next several weeks in repeatedly unsuccessful attempts to get it resolved, I eventually sent a secure message to Rushmore 's Department of Consumer Affairs ( per the telephone representatives ' instructions ) requesting in writing, as they required, that a new escrow account " analysis '' be completed. Last week, I received a letter in the mail in response to my message ( again several weeks later ), saying that my request had been denied and that our escrow account would not be re-analyzed until its regularly scheduled review date in XX/XX/XXXX of each year. So Rushmore has unilaterally determined that it would like to hold on to {$2800.00} of our money, that we paid in XX/XX/XXXX, until approximately XX/XX/XXXX ( following the scheduled re-analysis ). This is almost a full year, and of course comes without any intention of paying interest on their unlawful withholding of our money for that period. They continue to hold this position ( per their " policy '' and their " processes '' ) even though they very well know that the money does not belong to them, as evidenced by their agreement over multiple phone conversations that the money had been prepaid, they had seen appropriate evidence of such payment, and accordingly canceled their own scheduled disbursement to the county that Rushmore would have otherwise paid on our behalf in XX/XX/XXXX, BUT FOR the fact that they knew we had already paid it, as researched and confirmed by their tax department back in XX/XX/XXXX. They are knowingly and intentionally holding on to almost {$3000.00} of money that does not belong to them, for a period of almost a full year, and even though they acknowledge and do not dispute this fact, they have continuously refused ( over the past 2+ months of unsuccessful phone calls and secure messages through their website ) to rightfully reimburse me. I am hoping the CFPB can help get this resolved. Thank you.
