Complaint: My concern involves how my escrow account is being handled by Rushmore Loan Management Services. My property 's flood zone was updated by FEMA which no longer required me to carry flood insurance. I cancelled my policy with my insurance company in XX/XX/XXXX and contacted Rushmore to remove the flood insurance policy from my escrow account. I mailed in the cancellation documentation at Rushmore 's request. They confirmed receipt of this documentation and a customer service rep told that they would remove the flood insurance from my account and when an escrow analysis was done at the end of the year, my payment would be updated and I would be refunded for the funds that had been escrowed for my flood insurance. Instead, when the escrow analysis was done inXX/XX/XXXX, flood insurance was not removed and an account disbursement was noted for payment of flood insurance that was never billed. A customer service rep confirmed for me that funds were taken out of my escrow account to pay flood insurance but would not tell me where the funds went since there was no flood insurance bill to pay to the insurance company. I was told it would take 30 days for the funds to return to my account and then they could consider doing an escrow analysis to update the escrow account, refund me for overages paid and adjust my monthly payment. Upon further review of my incorrect escrow analysis, I grew more concerned when I noticed that myXX/XX/XXXX payment to my escrow account was not accounted for on the analysis. It seems that instead of reconciling my account and investigating why flood insurance was still a line item on my account, Rushmore conducted fraudulent activities to justify carrying and collecting an illegal surplus of escrow funds.

Complaint: I have had a very difficult time with XXXX XXXX XXXX. I have recently applied for a modification. I was denied after a 3 month attempt. I could never get a hold of my assigned rep XXXX XXXX. I would always have to resend the same documents over and over. Once I was finally in review after weeks of sending document I was declined. I was declined with the incorrect income. So after weeks of sending documents Rushmore reviewed me with the wrong income.

Complaint: In XXXX XXXX my mortgage was sold to Rushmore Loan Management. Since then I have made payments on XX/XX/XXXX and XX/XX/XXXX, of which, Rushmore states they have not received. I have provided them electronic transfer numbers as well as " Confirmation of Funds Transfer '' letters from my bank ( XXXX XXXX ), on numerous occasions, confirming they have received the funds and when the funds were sent. Rushmore keeps calling stating that they have not received the documentation nor the payments. They also state that if they do not receive a payment from us, we will go into default and will have negative reporting on our credit. Rushmore only allows you to fax the proof, and then claims they never receive. Surprised that they do not offer a more 21st century method of providing this information. For a servicer as large as Rushmore, they really need a better solution to their accounting of monies received. I have never missed or been late on a mortgage payment, and this is extremely frustrating that they can not seem to resolve the problem. It is companies like this that give the mortgage industry a bad reputation.

Complaint: Rushmore loan management services is not accepting any paymens at all from me, i am only 2 months behind in payments and they have already started forclosure proceedings which they claim a foreclosure letter has been issued. i have been trying to make my monthly mortgage payment to not go more than 2 months past due until i file my taxes to get my refund and to pay current but they refuse to take any payment whatsoever. they state only if i pay the current mortgage ( which isnt due yet til XX/XX/XXXX and the 2 month past due. they are intentionally trying to forelcose by not accepting a mortgage payment to escalade to trustee sale to foreclose. the rep stated there are notes on her account that i have a large amount of equity and to only accept full 3 months payment only, they are rushing to foreclose asap because they know amount of equity i have. this just happended on XX/XX/XXXX when i called to make 1 mortgage payment and they refused. my mortgage got transfered to rushmore loan management back on XX/XX/XXXX and they raised my new mortgage monthly payment from XXXX to XXXX per month with out any notice at all, and now they are refusing to allow me to pay. please some get involved becuase they are threating to foreclose because of my equity i have. im only 2 months past due and theyare not allowing any payment whatsoever unless i pay the current mortgage not due yet and the 2 months past due. please, this is urgent! i will get my payment caught up once i file my tax returns but they still have not sent my mortgage interest 1099! they stated will not be sent until next month when they all go out

Complaint: We had been applying for a modification with the original lender, XXXX XXXX, but then they sold the loan to a thieving deceitful company, Rushmore. We fell behind because there was severe damage caused to the house over 2 years ago by a pipe bursting ( not due to our actions we were not held at fault ) but XXXX refused to pay and we used all our money to save the house. The lawyers knew XXXX was wrong but they won anyway, not because they were right ( they finally came to court prepared to pay ) but the judge got " impatient '' with them and dismissed the case!!! So this disgusting company Rushmore is XXXX bent on foreclosing. They are snakes. We had been trying to reach them for months because the mod was not complete with XXXX XXXX, and XXXX XXXX told us just give them that last piece of info on hazard insurance to Rushmore. No Problem. Then we call Rushmore and find they have moved the foreclosure date from XX/XX/XXXX to XX/XX/XXXX, no reason, and have not allowed us to short sell which XXXX XXXX did allow. We had the 37 days required but they did not call us UNTIL IT WAS TOO LATE. Our realtor calls them every day now asking for a little extra time to short sell the house but they wo n't call back. They are forcing us to foreclose because it benefits them. We have been told that Rushmore has no interest in working with customers but makes their money on foreclosures. If this is not resolved and we are not given the few days we 're asking which would allow a short sale, we will take this to Federal court and all consumer agencies online and elsewhere. This is deliberate destruction of a consumers credit. I have now used both my adjournments to move the foreclosure date first to XX/XX/XXXX, then to XX/XX/XXXX.

Complaint: We had a modification agreement in place. We were hit by hurricane Irma. We requested a forbearance for 90 days. XXXX XXXX allowed us to make one payment before blocking our account. We we told to fax a document to them stating were not in litigation, we did. We qlso spoke with their attorneys XXXX XXXX XXXX in XX/XX/XXXX. He called XXXX XXXX and confirmed we were not in litigation. Rushmore refused to unblock our account. We received paper work on XX/XX/XXXX to resubmit modfication paperwork. I called today to let them know we were gathering the documents together and they would be faxed Monday XX/XX/XXXX. They advised we are back in litigation and have added {$6000.00}. To our already overcharged account. XXXX XXXX sold the bad debt while we were in bankruptcy proceedings, illegally. XXXX XXXX sent us a statement that XXXX XXXX had overcharged oyr account by {$3000.00}. Rushmore never corrected the account. They have charged us three times for attorneys fees, over {$15000.00}. We have not been in litigation ever with Rushmore. We qualified for the modification.

Complaint: I MOVED OUT OF XXXX XXXX XXXX IN 2004 BUT I AM STILL HALF OWNER OF THE PROPERTY AND ON THE MORTGAGE. I HAVE RECEIVED ABSOLUTELY NOTHING REGARDING THE PAST DUE ACCOUNT. I HAD RECEIVED NO NOTIFICATIONS OF THE IMPENDING FORECLOSURE I WAS NEVER SERVED ANYTHING DESPITE THE FACT THAT I HAVE WORKED AT THE SAME PLACE OF EMPLOYMENT FOR 15YRS. Complaint: They are foreclosing on my home when I have completed the Modification papers faxed them mailed them they claim to never have received them on 4 different occasions. They deliberately stalled with excuses until they could claim it was to close to foreclosure sale date to stop the Sale. I have repeatedly asked for verification because all the statements I have received from the 4 different servicers are different they just ignore my requests. They have called my former employer trying to collect the debt.

Complaint: My loan is currently being serviced by Rushmore. A lender/servicer can not collect on a debt that is transferred during the default of the loan, which is what happened here since the previous servicer was XXXX XXXX XXXX. Additionally, the main issue is that the BENEFICIARY of this is XXXX XXXX XXXX XXXX, whom was NEVER REGISTERED in the State of California. Because XXXX XXXX XXXX XXXX was NEVER registered in the State of California the Deed of Trust shall be void ab initio. My violations as a Homeowner in the State of California have been severely violated at this point and Rushmore has failed to reach out to me nor provide me with the opportunity to explore my options.

Complaint: Upon the transfer of this mortgage to Rushmore, our escrow was doubled due to an accounting error by Rushmore. We were in the process of disputing this when Rushmore refused to apply any payments towards the mortgage. We stopped paying during dispute but Rushmore was no help and we were then put into foreclosure. During the foreclosure process we then received an offer of modification for the exact amount that we originally should have been paying less the error n the escrow. The attorneys for both sides handling this came to a resolution and Rushmores attorney then sent us a letter for us to send to the credit agencies that have us listed negatively stating that this was an accounting error and we should not have this adverse credit. XXXX and XXXX have both sent in disputes numerous times to Rushmore to have them remove and update our credit to no avail. As of this date, I still have this on my credit as negative and I am currently under contract to buy another home and am working with a mortgage lender, however due to the low score stemming for this negative report, I am in jeopardy of either NOT getting the mortgage or paying a premium interest as well as other fees! Rushmore also does not have a direct line or person to speak to for any kind of help! Please not prior to this we have 2 mortgages with never being late as well as the one I question never being late prior to the accounting error on Rushmores part.
