Complaint: Last year I noticed a transaction in the amount of {$28.00} that was designated as an escrow transaction. I do not have an escrow account, by choice. I was assured that the account had been corrected. Again, this year another transaction for the escrow account in the amount of {$340.00} posted in XX/XX/2018. Since I do not have an escrow account, where is this money coming from to pay the insurance? Would not someone have noticed there is not an account to draw this from? I am beyond frustrated with this lack of follow through. See the attached document from the re-fi closing where the mortgage is designated as non-escrow. ( in yellow ) Now the insurance has been paid without my knowledge or consent and I am in the process of changing insurance companies. Now it is my burden to wait for a refund check from the insurance company that was paid in error. I paid more to obtain a mortgage as a non-escrow account and now I am spending my time to fix what should have been right the first time, or at the very least fixed when I inquired about it last year. When I contacted them last week, I requested that I be contacted via email within 24 hours regarding the plan to correct the issue, I have yet to hear from anyone at Rushmore.

Complaint: Rushmore opened an escrow account for an insurance that we paid in full on XX/XX/XXXX. Called and spoke with 5 different agents who guaranteed the fraudulent escrow account will be closed and the money will be added to the principle. This has been lingering for over 5 months and each month I call they promise the same and nothing is happening they are taking more money that they are supposed to my loan and still adding the money in an illegal escrow account. Lastly XXXX from escalation team and XXXX a call center supervisor mentioned they are working on it. NO resolution same invalid promises to be fixed and they keep depositing more money from my checking to an escrow account. Last contact was XX/XX/XXXX at XXXX PST and nothing is resolved.

Complaint: I refinanced my home mortgage in XX/XX/XXXX. The mortgage was with XXXX. They financed {$100000.00} & my home was only worth around {$50000.00} at that time & I only owed {$35000.00}. They said I could use extra money for whatever I needed it for. I have made monthly payments of {$840.00} since XX/XX/XXXX. I have repaid over {$120000.00} on this mortgage loan & it will not be paid of until XXXX. In XX/XX/XXXX XXXX sold the mortgage to Rushmore Loan Management Services. I have an interest rate of 9.6 % & the balance on the loan is {$89000.00}. I have tried to do something through the HARP program, but was told my mortgage did not qualify because it was not a XXXX XXXX or XXXX XXXX. Just wanted to know if there is anything I can do to get my interest rate lower so that I can pay of my mortgage in my lifetime. I am XXXX years old & married. My wife is currently going through XXXX treatment for XXXX XXXX. Any advise would be appreciated. Thanks!

A copy of this correspondence is also included as part of this faxed document set. The documents that Rushmore Loan Management Services attached to the CFPB response show in full detail that the PMI Payment made by Rushmore Loan Management Services on XX/XX/XXXX for PMI due XX/XX/XXXX is in fact a duplicate payment. The documentation provided by Rushmore Loan Management Services that was attached to the CFPB response shows : XXXX XXXX XXXX 's Loan History document reflecting the following PMI payments made : o XX/XX/XXXX for due date XX/XX/XXXX o XX/XX/XXXX for due date XX/XX/XXXX o XX/XX/XXXX for due date XX/XX/XXXX o XX/XX/XXXX for due date XX/XX/XXXX o XX/XX/XXXX for due date XX/XX/XXXX o XX/XX/XXXX for due date XX/XX/XXXX o XX/XX/XXXX for due date XX/XX/XXXX o XX/XX/XXXX for due date XX/XX/XXXX Rushmore Loan Management Services Loan History document reflects the loan activity since Rushmore Loan Management Services took over as servicer of the loan. Rushmore Loan Management Services Loan History reflects the following PMI payments made : o XX/XX/XXXX for due date XX/XX/XXXX o XX/XX/XXXX for due date XX/XX/XXXX o XX/XX/XXXX for due date XX/XX/XXXX Please help me understand how a payment by XXXX XXXX XXXX on XX/XX/XXXX for due date XX/XX/XXXX and a payment by Rushmore Loan Management Services on XX/XX/XXXX for due date XX/XX/XXXX is not a duplicate payment! These were both paid and appropriately noted for the EXACT SAME due date. Furthermore, the response letter provided to CFPB by Rushmore Loan Management Services states XXXX XXXX Companys payment on XX/XX/XXXX was for the XX/XX/XXXX premium. This is in fact INCORRECT! The XXXX XXXX XXXX Loan History report, as provided by Rushmore Loan Management Services, clearly reflects a payment on XX/XX/XXXX for due date XX/XX/XXXX as well as a payment on XX/XX/XXXX for due date of XX/XX/XXXX. In addition, this loan originated XX/XX/XXXX, meaning that at the time of the original complaint ( XX/XX/XXXX ) to CFPB, this mortgage had been in effect for 10 months, while at the same time there has been a combined ( between the two mortgage companies ) XXXX payments for PMI. How does one make XXXX payments when only XXXX payments are due without there being a duplication in payments? Once again, the documentation that was originally faxed to Rushmore Loan Management Services during the initial inquiry regarding this matter, the documentation attached to the original complaint to CFPB, the returned documentation that was received from Rushmore Loan Management Services addressing the CFPB complaint, as well as the documentation included in this document fax set, ALL prove that a duplicate payment has been made! It is ridiculous that I have to spend my personal time and effort in repeated attempts to recoup a payment that was obviously made in error by Rushmore Loan Management Services. Rushmore Loan Management Services needs to make an immediate reevaluation regarding their stance, argument and invalid evidence in order to make the appropriate correction to my escrow account. Rushmore Loan Management Services attempt at not refunding the overpayment will not be accepted, nor tolerated. My desire is that this will be the final piece of documentation ( provided by me three times & Rushmore Loan Management Services once ) needed in order for Rushmore Loan Management Services to make the appropriate correction to my mortgage escrow account by refunding the overpayment of {$300.00} to my escrow account.

Complaint: in XX/XX/XXXX we applied for the HARP Program and were approved. was the typical 2 % start to 5 % after 6yrs. all was going great until XX/XX/XXXX when our current mortgage company at that time ( XXXX ) sold our mortgage to ( XXXX ) but didn't inform us. we fond out when we started getting letters from ( XXXX ) that we were behind in our payment and if we didn't catch up our house would be foreclosed on. we were like what so we called ( XXXX ) to find out what was going on. after being shuffled between numerous agents and getting no where they said they no longer owned our mortgage and we would have to talk to ( XXXX ). so we did and thet said we needed to pay the back months owed plus interest or they would have to forclose on our mortgage. we told then we had been making the payments to ( XXXX ) and cant you get it from them sense we paid them. we started paying ( XXXX ) and they accepted it for a cpl months as we tried to get ( XXXX ) to give up the money to ( XXXX ). ( XXXX said they were able to get part of what they had but not all and that if we didn't catch up they would start the foreclosure on us. we contacted a lawyer ( XXXX XXXX XXXX XXXX ) XX/XX/XXXXafter explain what was happening they agreed to assist us while they were working on this my father had become severely ill in the XXXX and we had to go there. We explained to the lawyer ( XXXX XXXX XXXX ) that we had to go to the XXXX and our friend would be handling anything that needed if we were unable to from the XXXX. The mortgage company XXXX XXXX XXXX agreed to what ( XXXX XXXX XXXX XXXX ) asked for which was Take what was in the rears and put it at the end of the loan take the loan to 40yrs at a 2 % interest. They sent the document to our friend as they couldnt get it to us, he called us and ready it to us and I asked him to please send an email to the lawyer ( XXXX XXXX XXXX ) and specifically ask if what we are reading was correct 40yrs at 2 % which he did and they came back saying YES so we said ok. They wanted it signed before we came back from the XXXX which was in 4 days but there was no way we could so we had my friend ask for and extension fir 1 week until we got home ( XXXX XXXX XXXX XXXX ) agreed. As soon as we got home we signed the papers and sent them back to get this over with, but being so jetlagged we forgot to make copies so now we are assuming we are all set for the rest of the time we own this house. Now its XX/XX/XXXX and ( XXXX, XXXX ) has once again sold our mortgage this time to ( Rushmore Loan Management ) Now it is XX/XX/XXXX and we are getting letters from ( Rushmore ) and getting phone calls that we are in default on our mortgage because or interest rate has gone to 3 % then a few months later it has gone to 5 % So we called and was like what is going on they said the interest rate has gone up and we are like no we had a lawyer fix it back in XX/XX/XXXX to a 2 % for 40yrs and they stated they dont see that. And if we dont catch up we would be foreclosed on again we got scared and found a lawyer to assist us XX/XX/XXXX. This lawyer name is ( XXXX XXXX XXXX ) and they asked for {$4500.00} to fix it and we can pay in 3 instalments of {$1500.00} we said we cant afford that and XXXX from ( XXXX XXXX XXXX ) stated what most people do is not pay the mortgage and pay them instead we agreed and setup for them to auto debit our checking account {$1500.00} on a certain day each month, and they started to work on fixing us. On the 4th month I called and asked what was up with our case and XXXX from ( XXXX XXXX XXXX ) stated that they did not receive the last payment of {$1500.00} and I said yes you did my bank has already debited it. He asked me to send him a copy if the bank statement to show this. And also between XX/XX/XXXX and XX/XX/XXXX they decided to debit from my checking account {$490.00} which I did not authorize and when I called and actually got to talk to someone ( XXXX XXXX ) he stated that its on the contract I signed in the beginning I said I do not remember that and would you please send me a copy of that which I never received, four times or 5 times so my total I paid for this was {$6500.00} to {$7000.00} I sent it to him and he checked with their accounting dept. and said he was sorry but they would have to start over and would get right on it. ( XXXX XXXX XXXX ) asked for documents like last 3 months of our pay stubs, checking account, last 2 yrs of our income tax. We sent it all to them. I would call on occasion to see where we were and they would say working on it but they needed more pay stubs, checking account information this went 0n for a cpl months. Now it is the end of XXXX and they said they were waiting on ( Rushmore ) to reply to them. The end of XXXX we got an email with what they called a Loan Modification that ( Rushmore ) sent them, of a 3month payment of {$2800.00} and as long as we paid that onetime each month we would be ok and then we would get the % interest and monthly payment we would have to pay for the rest of the loan. I emailed back asking why a loan mod as we were not asking for that just asking them to continue the agreement from XX/XX/XXXX. ( XXXX from Rushmore ) and how can {$2800.00} help us as we have been paying {$1600.00} for the past 7yrs and how can they be saying that is helping us. ( XXXX from Rushmore ) stated that we should accept this as that is the best they can do. This was the first part of XX/XX/XXXX I said NO we do not accept this and I want to take them to court, she said that would be a litigation I said thats fine lets make it happen as we will not accept what they are asking, she ( XXXX from Rushmore ) said ok they will get back to me. I gave it a cpl weeks figured it is the XXXX and XXXX XXXX holiday and contacted by phone and email ( XXXX, XXXX and a man named XXXX from Rushmore ) in XXXX no answer. This went on for a month of many calls and emails with absolutely no answer from ( XXXX, XXXX and a man named XXXX from Rushmore ). I was getting very frustrated and nervous. Then in XXXX we started getting calls from other Real a state people and other lawyers saying that my house was in pre-foreclosure and I like what Again many emails and phone calls to ( XXXX, XXXX and a man named XXXX from Rushmore ) no answers and getting the letter in the mail that yes we were in foreclosure with a sale date of XX/XX/XXXX so here we are now hoping that this will help us to get this resolved.

However, I see that there are over 1000 complaints logged already. Therefore my first complaint would have to be with the CFPB. There are 1288 complaints on Rushmore. Thats 1 complaint every day for 3 years without any penalty. This has allowed Rushmore to continue predatory practices and offers no faith in CFPB

I do not care that Rushmore answered they only strengthened my complaint and you CLOSED the complaint????????????????? Excuse me???? They basically confirmed what I said, that THEY ARE NOT ACTING IN GOOD FAITH TO EXECUTE A VALID SHORT SALE FOR THE APPRAISED VALUE, BUT INSTEAD ARE DEMANDING A VALUE THAT IS NOT SUPPORTED BY FACT, OFFICIAL APPRAISALS AND CONTRACTORS ESTIMATES. They are going to foreclose on my house because they are behaving irrationally and rejecting solid, verified purchase offers for the official appraised price, basically covering their ears and saying " no no no no no I can't hear you '' when we say the offer is for the appraised value. There is damage to the house that XXXX was scummy enough to wriggle out of paying even though they admitted to the court that it was not our the owners fault. They are just garbage like Rushmore, acting against the consumer -- AND YOU SUPPORT THIS??? YOUR SOLE GOAL IS TO GET THEM TO JUST ANSWER????????????? WHAT THE XXXX VALUE IS THAT??????????? Complaint: Submitted Borrowwer Assistance Package XX/XX/XXXX Rushmore requested more info XX/XX/XXXX Send amended pages as requested XX/XX/XXXX XX/XX/XXXX submitted additional documents as requested XX/XX/XXXX received letter from Rushmore stating my home retention package is complete. Rushmore stated they will send a written determination for foreclosure prevention. XX/XX/XXXX received letter of intent to foreclose. Spoke to Rushmore representative XXXX XXXX who assured me that the letter of intent is just a formality and as long as my loan is with underwriting they will not foreclose. XX/XX/XXXX received request from Rushmore for updated property insurance naming Rushmore XX/XX/XXXX sent insurance via email, fax and fedex XX/XX/XXXX XXXX XXXX started he was in receipt of insurance XXXX page and my file was with underwriting and it should be no longer than another week for an answer. Rushmore LM had 30 days as per CFPB Reg X SS 1024.41 to respond to me with an answer about a foreclosure prevention alternative. 30 days was on XX/XX/XXXX. I have yet to receive a response.

Complaint: I have tried several times to communicate with Rushmore loan management services on their attempt to collect on a time barred account. By sending communication via US mail / fax and electronic submission though your portal on validation of debt as it relates to the FDCPA / FCRA. Giving out false information to the credit reporting agency to tarnish our credit. Failure to credit account as required by THE FAIR DEBT COLLECTIONS PRACTICES ACT, THE FAIR CREDIT REPORTING ACT and the credit acts of the state of Georgia. They pretended to be collecting on behalf of the original creditor. The original creditor was XXXX XXXX XXXX. I have taken it upon myself to contact the original party to settle any misinformation, in there response to me after I offered to tender payment to settle the account is that the account was credited in XXXX of XXXX, and they can not accept any payment. It was a recorded conversation with the approval of the agent named XXXX. According to 3-603. TENDER OF PAYMENT. ( a ) If tender of payment of an obligation to pay an instrument is made to a person entitled to enforce the instrument, the effect of tender is governed by principles of law applicable to tender of payment under a simple contract. ( b ) If tender of payment of an obligation to pay an instrument is made to a person entitled to enforce the instrument and the tender is refused, there is discharge, to the extent of the amount of the tender, of the obligation of an indorser or accommodation party having a right of recourse with respect to the obligation to which the tender relates. Rushmore Loan Management Services continued with the harassment of trying to enforce a time barred account which is uncollectible. They are using the U.S. Mail to present such fraud and false instrument ( s ) amounting to Mail Fraud, criminal conduct falling under Title 18 U.S.C. 1341-Frauds, Swindles laws. In any event, they refuse to stop contacting me, then sent a communication again through the US mail staing they are going to foreclose on my property if I dont make a payment, additionally they are accelerating the debt and all amounts are now due. First of all, this debt has deen discharged, I confirmed this by checking with the county land records department that shows a cancellation of " loan. '' It is not now, nor has it ever been my intention to avoid paying any obligation that I lawfully owe. So, when I requested the verification / documents I was complying in good faith with those request for validation and notice that I dispute part of, or all of the alleged debt. Anyone can access the land records information, it is a public domain. That is where Rushmore printed all those so called assignments and submit them as proof of debt. I decided to protect myself and my interest, because Rushmore is the fourth party that has tried to collect on a time barred account. I filed a bankruptcy ( 7 ) on XX/XX/XXXX. Rushmore elected to auction my property under " act of State '' and claimed to have bought the property through bidding at XXXX, cash I might add. In this deception of them being the creditor, they violated a bankruptcy stay, and pass on their fraud to the next entity under the ficticious name of XXXX XXXX XXXX XXXX, XXXX ( XXXX ), d/b/a XXXXXXXX XXXX XXXXXXXX XXXX, or XXXX XXXX XXXX. Now we have another law firm involved in this fraud called XXXX XXXX XXXX which took it upon themselves to file an eviction summons on behalf of XXXX et al. By using government agents to do their dirty work, saying they are the owner of my property, and label me as a " tenant of sufferance. '' According to Georgia law if a creditor elects to recover property they should go through the district court where the property is located, but because these debt collectors know they do not have any contract with me, they took the easy road. I am still under the bankruptcy protection during all of this. XXXX XXXX on behalf of XXXX, although their is no record of any power of attorney for services for the attorney 's on the record. By using a false " indexed deed '' clause. The magistrate court elected to give these debt collectors a writ of possession without due process. There is no Power of Attorney for me on the county records, I have revoked any and all POA / in fact from the record on XX/XX/XXXX and send to all entities that purported to have a contract with me. The magistrate did not request me to pay any amounts to the debt collectors, so I appeal to the superior court in a timely manner. Now comes a different attorney, filing claims of rent payment and asking the court to force me to pay rent. Another act of state, using a hearing to drag me into court on a voluntary hearing which I decline. The judge has took it upon himself to approve rent without a contract and wants me to pay by XX/XX/XXXX, or he will have the sheriff put me out. This is ludicrous, how a debt collector can obstruct the law and get away with it. I am not leaving my property because I am not responsible for that " debt. '' I had a prior purchase agreement with XXXX under a non recourse context. So now here comes Rushmore sending me a XXXX saying I am responsible for a debt and that I abandoned my property. I am still domiciled at the property. I believe the claim that there is a valid lawful debt owed by me to the principal ( s ) is a crime per 15 U.S.C. 1692 ( e ) false, deceptive, and misleading representation, in connection with the collection of any debt such as the false representation of the character or legal status of any debt and no evidence to the contrary exists, and a crime under 18 USC 1001>stating fraudulent information. no debt to any of the principal ( s ) and that noted principal ( s ) is/are engaging in fraud by stating that they are the creditor, that they loaned any money or that they are entitled to any valuable consideration from me to satisfy a debt that without restitution would otherwise create a pecuniary loss to them. The business practices of the principal ( s ) its agents, officers, employees, and attorneys to determine violations of the United States and Georgias criminal laws. I believe the principal ( s ) claim of right in collection of a purported debt appears to be founded upon a false record in violation of U.S.C. Title 18 1001, 2071, 2073 ( falsifying records ) and further ; claiming and possessing false allegations and counterfeit securities [ securitized promissory note ] as well as un-substantiated claims of obligation, in violation of the Federal Racketeer Influences and Corrupt Organization ( RICO ), U.S.C. She said it's no sale date set for the property. XXXX called back on XX/XX/XXXX talk to XXXX, XXXX said that some documents up load today and there is no sale date schedule. We call back later on XX/XX/XXXX talk to XXXX XXXX, he said he read the note that some documents come in. We call back on XX/XX/XXXX talked to XXXX ID # XXXX she said the Rushmore received the loan modification package on XX/XX/XXXX, we request the reinstatement quote and payoff information and she suggested to call back next week on Wednesday XX/XX/XXXX to check for account status with the reinstatement quote or payoff information. We call back on XX/XX/XXXX talk to XXXX ID # XXXX he said that the file on the review status, we call back talk to XXXX ID # XXXX he read the note that the loan modification complete, suggested to call back next week for the account status and no sale date. We call back on XX/XX/XXXX talked to XXXX XXXX she said that Rushmore need some missing documents : XX/XX/XXXX paystubs, 2 recent rent deposit, 6 month of business and explanation, proof of fund for down payment, the new single point of contact ( SPOC ) is XXXX XXXX and his manager is XXXX XXXX. We called back talk to XXXX ID # XXXX, she advised that borrower need to submit all missing documents during 15 days from XX/XX/XXXX. On Saturday XX/XX/XXXX Rushmore posted the Notice of Trustee Sale on my door. They set the sale date on XX/XX/XXXX. We call back on XX/XX/XXXX talked to XXXX, he said that Rushmore will not review my loan modification, Rushmore will not send any letter for the missing documents and he read the reinstatement quote issued on XX/XX/XXXX valid to XX/XX/XXXX is {$200000.00}. He said that Rushmore do not waive the late fee, the new SPOC is XXXX XXXX, his phone number is XXXX, XXXX said that my last payment is on XX/XX/XXXX, Rushmore did not receive any payment from me from XX/XX/XXXX. That is not true, here are attached payments until it overdrawn when Rushmore increase payment from {$2900.00} to {$11000.00}. Moreover XXXX XXXX refuse to talk to my representative XXXX, even he did not know what he's talking about " he said that my last payment is XX/XX/XXXX, Rushmore did not receive any payment from me from XX/XX/XXXX ''. Rushmore recorded the conversation, please review it for yourself. I am extremely disappointed and I do not know how to deal with Rushmore, they do not want to help the borrowers. I really need a new SPOC, I can not work with XXXX XXXX. Rushmore misleading the borrower and I did submit the loan modification complete package but Rushmore ignore it and rush to foreclosure on my property. Reinstatement Errors : Your company failed to provide an accurate mortgage Reinstatement that I requested on XX/XX/XXXX XXXX said that the reinsatemetn quote issued on XX/XX/XXXX vaid to XX/XX/XXXX is {$200000.00} when we received the email from the previous SPOC XXXX XXXX " This is confirmation of the following : I will waive {$16000.00} in late fees, if the reinstatement in the amount of XXXX received by XXXX.Please be advise that the reinstatement already includes late charges being waived. " how can the amount increase {$16000.00} ( XXXX XXXX XXXX XXXX XXXX XXXX dollars XXXX XXXX cents ) for the same month.
