Complaint: i'm the tenant living at XXXX XXXX XXXX XXXX, NY XXXX XXXX . XXXX. There was a certified letter from Rushmore Loan Mortgage company in the mail box, of which I left on the counter. The reason I'm contacting the CFPB is because I sent a letter to the SEC with a bunch of documents, because XXXX XXXX the condominium owner was XXXX and after one year the property is still in his name. and from XX/XX/XXXX to XX/XX/XXXX the property went through foreclosure. Some how the condominium board was able to collect the rental income from XX/XX/XXXX to XX/XX/XXXX from NYCHA while I paid my portion to XXXX XXXX. I was never served the required documents under RPAPL 1304 thru 1307. NYCHA can't produce documents showing XXXX XXXX XXXX compliance with RPL 339 : aa, z, kk. DHCR refuses to supply XXXX XXXX XXXX response to my complaint. So, my question to CFPB is Rushmore Loan Mortgage company so corrupt that they would open a mortgage loan in a dead man name? If the loan was taken out prior to XX/XX/XXXX ( the date of XXXX XXXX XXXX ) how did they receive the mortgage payments, because no estate file is filed with the XXXX Supreme Court. I haven't had a landlord in over a year and I'm curious why Rushmore Loan Mortgage Comapny would be sending certified mail to a decease person. I believe the SEC didn't investigate because the XXXX XXXX XXXX XXXX and the State of New York Retirement Fund was invested into the property,

Better yet, they deny even receiving the refund check which they cashed. My load is up for escrow analysis and they are fraudulently raising my monthly payment.

Complaint: XXXX XXXX XXXX XXXX Attorney 's for XXXX have foreclosed on my home they provided No notice that they were debt collectors, no notice that I had a right to dispute the debt No copies of the requested details of the debt. They committed fraud upon the court by affirming that tall the information provided was true and it was not. They never served my ex husband who has not lived with me since XX/XX/2003 they affirm the bank has the mortgage documents yet another Law Firm for XXXX " XXXX '' affirms that they lost the Note. This is just two instances of the numerous counts of fraud they have committed and affirmed to in documents to the Court

Complaint: Despite me repeatedly telling XXXX XXXX AND RUSHMORE that I do not live at XXXX XXXX XXXX XXXX NY but I do have an interest in the home and I am responsible for the mortgage giving them ALL proof that I have not lived there since XX/XX/2003 That I remarried and that is where my ex wife and children live they continue to proceed with an illegal foreclosure by giving me ABSOLUTELY NO NOTIFICATION of what was transpiring NO NOTIFICATION OF COURT DATES NO NOTIFICATION OF OPTIONS AVAILABLE XXXX XXXX XXXX XXXX even has other addresses where i lived in their files yet in order to move forward and illegally foreclose they keep sending everything to the XXXX address Even after I did find out about the foreclosure and told them in COURT MY ADDRESS HAS NOT BEEN XXXX XXXX they ALL CONTINUE TO SEND ME NO INFORMATION EVERYTHING STILL GOES TO XXXX XXXX XXXX XXXX NY The banks Attorney committed fraud upon the court by affirming that they served me The servicer and bank committed fraud upon the court stating they have the note when the banks other Attorney clearly states they do not have the note. I have repeatedly requested what was paid what is owed I get NOTHING yet they want to foreclose they told me on the phone you had 6 years to fix this you havent I could not fix a problem I WAS UNAWARE EXISTED

Complaint: In XX/XX/XXXX, my mortgage was transferred from XXXX to Rushmore Loan Management Services. I paid my regular mortgage amount ( XXXX ) with no problem. In XX/XX/XXXX when I attempted to pay my mortgage I was told that was the incorrect amount, that my mortgage was XXXX. I disputed this amount and asked that this discrepancy be investigated. On XX/XX/XXXX, I paid the regular payment ( XXXX ) and was advised that the reason for the additional amount owed was because I had requested and received a loan modification from XXXX that INCREASED my interest rate from XXXX to XXXX! I assured them that I had not requested a loan modification, that no one requests a modification to INCREASE their interest rate, and that Rushmore must produce the paperwork because I had NOT signed any such modification agreement. Rushmore said they would continue to investigate. I began receiving past due calls from Rushmore and on XX/XX/XXXX, under threat of Rushmore beginning Foreclosure proceedings, I paid the additional {$77.00} with the request my additional funds be refunded to me when Rushmore got this straightened out. Early XX/XX/XXXX I received an Audit letter from Rushmore dated XX/XX/XXXX acknowledging their error and saying my payment was correct at {$460.00}. They said the correction wouldn't take place until XX/XX/XXXX but if this created a hardship I should let them know. I let them know. In XX/XX/XXXX I continued to get past due calls from Rushmore saying they had not received any payment in XX/XX/XXXX. I disputed this and provided them confirmation numbers for my payments and I requested the {$77.00} over payment be refunded to me. Because I am on a fixed income on XX/XX/XXXX, I paid my loan for the regular amount ( XXXX ) explaining to the Representative that I had a letter confirming this was correct. After she put me on hold to research this and check with her supervisor, she came back and took my XXXX payment. The XX/XX/XXXX statement I have from Rushmore shows an amount due of XXXX showing the XXXX past due. The second page of the statement shows the two payments made in XX/XX/XXXX of XXXX and XXXX. I just received a letter dated XX/XX/XXXX from Rushmore that is " Notice of Intent to Foreclose '' stating the my mortgage is in default due to non-payment of the XX/XX/XXXX payment and stating that my regular monthly payment is XXXX. To cure this " default '' I must pay XXXX by certified check and that the total amount due is {$1000.00}. Failure to do so by XX/XX/XXXX will result in acceleration of the loan, foreclosure and sale of the property. I consider this harassment at this point. I have not only paid the XX/XX/XXXX mortgage and the additional error amount which they show on their XX/XX/XXXX statement, but I have also paid the XX/XX/XXXX correct amount noting that to pay the additional error amount would create a hardship. I continue to receive past due calls from Rushmore even though the letters and statements I have from them show my payments and correct amounts due.

Complaint: I paid my mortgage XX/XX/XXXX Friday XXXX & XX/XX/XXXX Friday XXXX via XXXX XXXX Rushmore Loan Mgmt states they did not receive the payments until the XX/XX/XXXX of the month I called Rushmore and they said I would have to send a letter about the payments via Fax only. XXXX XXXX is not a bank and the payment are transmitted immediately up until midnight the same day. The customer service dept is off shore - meaning possibly the XXXX XXXX The recent letter said I could be in default for less than {$200.00} is appalling when I also called Customer Service during the XXXX County wildfires in XX/XX/XXXX and the so called Customer Service said they could not assist with my hold of making a payment until XX/XX/XXXX which would then create a late charge.

Complaint: I received correspondence from Rushmore mortgage dated XX/XX/XXXX in regards to a modification agreement they want me to sign, that was dated for XX/XX/XXXX. My loan servicer changed to Rushmore XX/XX/XXXX during my modification trial period. Rushmore refused to honor the modification trial period that was completed though my old servicer XXXX XXXX XXXX they set my home for a property foreclosure sale. I recently received these modification documents dated for XX/XX/XXXX of which is out of date. I have not signed them because it will reflect I defaulted on the modification agreement of which I did not.

Complaint: 11 years ago we took out a loan with Rushmore Loan Management Services, XXXX XXXX XXXX XXXX, XXXX, Ca XXXX for the amount of XXXX. In XX/XX/XXXX they stopped accepting payments saying that our loan had " matured ''. They wanted the full balance of approximately XXXX. We started the process of withdrawing money from our XXXX. After the money was received we called to submit payment and our payment was denied due to our balance had grown to over XXXX with interest. We've made several attempts over the phone to make this payment plus mailed a check for the XXXX to try and stop the extremely high interest we are accruing. As of today ( XX/XX/XXXX ) we were once again told " No ''.
