Complaint: I received notice from XXXX XXXX XXXX that my home loan was sold to Rushmore Loan management.The problem with this situation is my name is not the power of attorney on my mother 's death certificate.This is still my deceased mother 's estate and my name is not on her death certificate as power of attorney.This is the second mortgage company that has tried to profit off my Mother 's Death.All the Rushmore had to do is check the information that they got from XXXX before they brought this illegal loan. I still owe XXXX XXXX XXXX XXXX over {$35000.00} Dollars for home improvements that XXXX lender placed insurance did not cover. XXXX was sued for their unfair practice of lender placed insurance price's.I was part of the {>= $1,000,000} classaction lawsuit and won. Now here 's Rushmore trying to foreclose on a home that I still owe XXXX XXXX XXXX XXXX for. Rushmore should have looked at the paperwork connected to this loan before trying to take my home. In about two week my XXXX brother who lives in the home with me is getting the bathroom and kitchen modified by the state to accommodate his XXXX.Rushmore has to look at my mother 's death certificate that they should have got form XXXX to understand how all this is fraudulent.Selling Death has to be one of the sickest things I have ever seen especially when it's my mother who was the Primary borrowerof the Loan.

For over a year, their promises of assistance were wavering. They had me to file what they said would be " fake '' bankruptcies, and they would only be on my credit for two or three weeks. Definitely, this was false. I paid them {$4000.00} and they totally mislead me. I tried to contact them several times and discovered they were out of business. They scammed ppmany people out of thousands of dollars. Complaint: Rushmore Loan ( servicer ) and XXXX ( alleged Investor ) claiming to somehow have a vested interest in my property located at XXXX XXXX XXXX, XXXX NY XXXX. Have entered and illegal sale date on my property for XX/XX/2018. Under The Federal Housing Act, all loans are covered by mortgage insurance. My property was insured, the insurance premiums were paid, and yet I have been defrauded. There has been an active engagement in constructive fraud by the mortgage insurance company and the financial institution against myself as a consumer. I am requesting information : *On how mortgage insurance paid out? *When the claim was made? *and who got the monies? The consumer protection laws are there to assist individuals such as myself when are harmed as a result of unscrupulous activities. The mortgage on my loan was not on my home, the mortgage was on the loan. The lien was on the home! I believe based on the aforementioned laws that the financial institutions have been duly compensated, in fact our agreement was that the home was not a collateral for a loan i.e. I use the loan to acquired a home, and until I acquired the home, the home was not mine for me collateralize, meaning that I could never place something I do not have the ownership as collateral. The mortgage-back security agreement permitted and /or allowed financial institutions to trade my property on the market in lieu of payment for the loan, because the stock market investments are construed as a risk, I agree to allow my home to be used as collateral in place should the financial institution did not receive the benefits of such transaction on the market. I forwarded my interest that was due to me as a result of my being a trust interest holder and an investor on that mortgage-backed security, so that those receipts would be applied to the balance of the account, this did not happened. I also have been giving information that the financial institution has received tax credits and other benefits as a result of charging off the account, yet those credits and or adjustments have not been applied to the account as is cognizable under Gen. accounting procedure. The failure on the part of the financial institution and or the securitization trustee to keep accurate accounting has resulted in in my being harmed, and I hereby protest such actions and interactions as a result of it being a violation my due process rights. The financial institution was asked to give a complete comprehensive accounting. Staments as proof there was some exchange form of value proving this financial institution are the owners of due cause, and their proof of tax registration certificate. I am by law entitled to a complete comprehensive accounting, and all of the others requested documents.

Complaint: My name is XXXX XXXX XXXX. I had a mortgage with XXXX XXXX XXXX XXXX ( " XXXX '' ), which was transferred to Rushmore Loan Management Services ( " Rushmore '' ) in XX/XX/XXXX. XXXX Loan # XXXX. Rushmore Loan # XXXX. Property address is XXXX XXXX XXXX, XXXX XXXX, NJ XXXX. In late XX/XX/XXXX I fell behind on my mortgage, but knew that I would be able to catch it up in early XX/XX/XXXX. On XX/XX/XXXX, I had the funds on hand and XXXX stated that amount to reinstate, including XX/XX/XXXX 's payment, would be {$8600.00}. I sent {$9000.00} on XX/XX/XXXX, which was received XX/XX/XXXX. On XX/XX/XXXX, the check was returned, stating it was insufficient to reinstate, and the amount was now {$12000.00}. My mortgage payment per month is only {$810.00}, so this increase doesn't make any sense. I later learned that XXXX had put homeowner 's insurance on my property, even though I was paying it directly and had provided them with proof that it was current and active. By XX/XX/XXXX, I was able to get XXXX to accept payments, but these were listed on the account as " Unapplied '', and I was still charged late fees and penalties. Not including the " unapplied '' that should be subtracted, the past due figure on this statement was {$2400.00}. Just after this ( XX/XX/XXXX ), the account was transferred from XXXX to Rushmore. Rushmore sent me a letter about how much total was owed on the loan, but did not have an address for where to send payments. This balance statement included a listing for " Other Charges '' for {$3600.00}, and Rushmore were never able to explain where this figure came from. They stated that the amount to reinstate the loan was now {$6500.00}. An actual billing statement was not sent until XX/XX/XXXX. Because I had the money and didn't want to deal with it anymore, I paid Rushmore the {$6500.00} they requested on XX/XX/XXXX. When I received the first normal monthly billing statement from Rushmore on XX/XX/XXXX, I saw that they had begun escrowing my real estate tax and that was why the number was higher. I called the local tax collector, who stated that Rushmore had already paid the first two quarters of XX/XX/XXXX taxes, which is why the arrears had increased so much. I fell behind again on payments due to the fact that I had put other bills on hold to pay XXXX and Rushmore more than they were owed. So I again sent a check to fully reinstate on XX/XX/XXXX. This check was returned to me, with the reason marked " OTHER, CONTACT CUSTOMER SERVICE ''. I did so, and they don't know why it was returned. In the last year and a half, I have paid XXXX {$14000.00} and Rushmore {$12000.00} for a total of {$27000.00}. This is for a mortgage that started at {$810.00} per month, and is now {$890.00}. Even disregarding how many times they have screwed up when I tried to do the right thing, and assuming the higher payment amount, I should have only paid about {$15000.00} in that time. And even with paying almost double what I should have, they say that I am behind and are threatening foreclosure.

Complaint: Mynhome was approved for a short sale in XX/XX/XXXX When it came time to close and finalize the process, I couldn't close because I hadn't found a job nor a place to live yet. The buyers on the deal backed out as they didn't want to wait anymore. Immediately following word that the short sale fell through XXXX XXXX XXXX began foreclosure proceedings on my home. In the meantime they also mailed me a letter offering me a deed in lieu of foreclosure process that was valid for a period of 60 days. The date on that offer was late XX/XX/ but I didn't receive until early XXXX. 60 days to decide if I want to do a deed in lieu would run me to lateXX/XX/XXXX However I subsequently received an foreclosure sale date notice dated For right in the middle of those 60 days they offered me. That is not fair to do to someone. My home is currently under agreement again with new buyers and my Attorney has submitted all the paperwork for the short sale to be approved to XXXX XXXX XXXX. We have not received a response yet. We have asked that the sale date be postponed in lieu of the pending sale. My Attorney nor I have received word on if the sale date is going to be postponed or not. Please intervene and do something to help. I have since found full time employment and can close on this deal. Thank you.

Complaint: Upon losing my job in early XX/XX/XXXX, I contacted XXXX XXXX to ask for assistance while I was trying to obtain another job. I first submitted loss mitigation paperwork as directed by XX/XX/XXXX in early XX/XX/XXXX. They continued to require one more document after one more document. I continued to call and check on the progress with little to no change. They failed to contact me or keep me informed on any level the only communication came from me contacting them. When they finally accepted the completed packet they had until XX/XX/XXXX to make a decision about how they could best support me. On XX/XX/XXXX they transferred my loan to someone else without making that decision. Now Rushmore loan management company is telling me I have to start this process over. In the meantime each month my credit gets worse and worse. I contacted XXXX in XX/XX/XXXX and told them I had obtained a part-time job and was able to begin making payments. There is still no resolution. I just received a letter Saturday XX/XX/XXXX regarding Rushmore wanting me to submit all my documentation over. I believe XXXX never had any attention of addressing my issue as they knew they were transferring my loan to someone else. I have an FHA loan. It is my understanding that FHA has a forbearance during unemployment where interest is put on hold. XXXX XXXX never offered this or suggested this solution to me. I just want to know how much to pay for my mortgage so that I can put my house for sale and clear out this debt.

Complaint: Our home loan was sold by XXXX XXXX XXXX to Rushmore Loan Management Services in XX/XX/XXXX. Taxes and Homeowners insurance were both escrowed by XXXX XXXX and Rushmore continued to escrow both. Our annual homeowners insurance was due the latter part of XXXX. I contacted Rushmore the beginning of XXXX to see if they had received the bill. They informed me that they had reviewed the Master Policy for our condo association and deemed it unnecessary to escrow our insurance. I was instructed to pay the annual premium that was coming due. A copy of the paid in full policy was sent to Rushmore. Since that time I have contacted Rushmore numerous times to be refunded the monies they were holding in escrow for insurance and to have our monthly premium changed so that it did not include homeowners ' insurance. I am not quite sure if they are just incompetent or if it is a way of keeping and using our money as long as they can, but as of today they are holding all of our insurance monies in escrow and our monthly mortgage payment still includes an amount for the homeowners insurance. I would appreciate any help you can provide regarding this issue.

Complaint: Hello, my name is XXXX XXXX. I have a situation that I can not do by myself anymore and I need help. I have been trying to receive a loan modification for a very long time now. I was transferred not too long ago to a new servicer RUSHMORE LOAN MANAGEMENT SERVICES, LLC. From my first bank, XXXX XXXX XXXX and they have denied me multiple times for a loan modification until XXXX XXXX XXXX transferred my loan to XXXX. I told XXXX I want to apply for a loan modification. They have told me to pay {$2000.00} for a Trial Period Payment of 3 payments. I told them I can not afford that and I asked them to apply me for a loan modification. XXXX sent me an application for a loan modification. I have filled it out and faxed the full packet to them. After 3 months they then have told me that I do not meet the qualifications for the XXXX loan modification and the representative told me to apply for the Keep Your Home California program. So I did. But the Keep Your Home California program has denied me. At this point I applied for the Making Home Affordable Program and faxed over a full packet to XXXX. After some time I yet again get transferred to another servicer which is now my current servicer RUSHMORE LOAN MANAGEMENT SERVICES, LLC. I recently sent over the a full packet to RUSHMORE LOAN MANAGEMENT SERVICES, LLC again in hopes for a loan modification review. I and my family are in a very tight spot with RUSHMORE LOAN MANAGEMENT SERVICES, LLC and we do not know what else to do. I can make monthly payments for this loan of around {$1300.00} for the loan, insurance and taxes. That is an amount I can afford. Please review this company as to why its taking so long to review and approve the loan modification process. Seems as though every company is prolonging the process as much as possible. RUSHMORE LOAN MANAGEMENT SERVICES, LLC are in Violation of my CALIFORNIA HOMEOWNERS BILL OF RIGHTS

Complaint: I recently was transferred from XXXX XXXX to Rushmore loan management. I have been trying to complete a loan mod with XXXX for several months without success. They continue to ask for additional documents that were not required during the loan review process. It isn't until I call in that I find out that additional documents are needed to " complete my file ''. My escrow payment increased in 8 months after my loan was originated due to an increase in escrow was not accounted for at origination. I have worked to lower my escrow by decreasing my insurance payment and filing homestead. I asked XXXX XXXX to run another analysis but was advised that I needed to complete the loan mod process as my payment has increase again. I called Rushmore today to find out that my loan was not even coded that I am in the Loan Mod process nor do they have any documents received from XXXX. I was advised that I can resend the package sent to XXXX XXXX or fill out a new package. I also attempted to make a payment and Rushmore refused to accept a payment. Advising that I would need to bring the loan current or they would not take payment. I am trying my very best to make payment and try to get my loan mod and they will not accept payment. Rushmore does not seem to be interested in helping the customer but wants to take homes. I asked the associate if this was an investor guideline. He stated no that it was Rushmore and that I need to complete the Loan Mod process. How about if I do not quality, then Rushmore will have placed me further in default because they just do not want to take a payment? This is ridiculous and needs to be resolved asap.
