Complaint: I have repeatedly requested copies of payments applied I have sent copies of cancelled checks for payments to XXXX that are not shown any where They keep sending the same printed report that gives no information that I am requesting. This is just a stalling tactic to continue the foreclosure. They are debt collectors and do not follow any of the laws nor does their legal counsel The property now has a Lis Pendis filed against it for a federal lawsuit to try and get them to comply with the law They respond to complaints but the response is never directly for the complaint

Complaint: I have been writing and complaining about Rushmore loans for a number of times to no avail. I have tried to contact them directly but every time you call you talk to someone in the XXXX! I have asked to talk to someone in the U.S. They put me on hold and then you just give up after waiting for XXXX minutes. They are a crook of a company. I had a loan modification with another crook of a company called XXXX and they sold my loan to them. I was paying for nearly 2 years without delay an amount of XXXX dollars a month. All of a sudden Rushmore changes that to XXXX and if you are late they add another XXXX dollars! I said I would pay my own taxes because they claim that this is because of negative escrow. I can pay my taxes on my credit card which I did just a few days ago. They also lied that the reason for this amount is because my taxes doubled. I went to the county and my taxes only went up by XXXX dollars a year so they are lying again. I do not want to pay almost 600 dollars a month extra when I just can't afford it. I did not sign up for the loan modification to pay this amount. I have also repeatedly asked them to have a lower, much lower balance. My note in 2006 when I bought the house was for XXXX. After 12 years of making payments to XXXX, XXXX, XXXX and now Rushmore, I still owe according to them XXXX plus late fees. This is bloody highway robbery. I want a reduction on the principal and I want my payment to be the same as before. Rushmore is doing an illegal business. I do not want them to pay for my taxes. Additionally, they all lie. I want a resolution to this matter which I have asked a number of times.

When I notified XXXX XXXX XXXX XXXX, the rep. did not recognize the name on file of a " XXXX XXXX '' as AVP representing XXXX XXXX XXXX XXXX. On XX/XX/XXXX, unknowingly and without notification to me, XXXX XXXX XXXX XXXX XXXX " Grantor '' transacted and recorded a mortgage assignment to " Grantee '' XXXX XXXX LEGAL Title Trust, XXXX XXXX XXXX XXXX XXXX. Complaint: Rushmore has not provided the breakdown of all the payments from the loan as requested the payoff amount they just sent is {$55000.00} higher than the foreclosure judgement amount and this is not the escrow taxes or insurance payments there is no explanation as to the additional costs and it is not included in the judgement award Rushmore to give me the accurate records requested. They denied my modification CLAIMING THAT IT WAS NOT RECEIVED IN A FAIR AMOUNT OF TIME YET THE REJECTION WAS BECAUSE THEY SAID THEY DO NOT DO MODIFICATIONS FOR LOANS IN DEFAULT THE AMOUNT OF TIME MY LOAN IS IN DEFAULT FOR. THEY HAVE BEEN ABUSIVE WHEN I REQUEST INFORMATION I WAS TOLD THAT I SHOULDNT HAVE BEEN SO FAR IN DEFAULT. THAT IF I HAD MADE MY PAYMENTS I WOULDNT BE IN THIS SITUATION AND THERE IS NOTHING I CAN DO THAT IS WHAT I OWE IF I DONT PAY IT THE HOUSE WILL BE SOLD Rushmore does NOT RESPOND TO THE ALLEGATIONS THEY RESPOND TO OTHER ISSUES. Complaint: Our mortgage was recently sold to Rushmore Loan Management company. We arranged online bill pay through our bank, XXXX, to send the payments like we always do. On XX/XX/XXXX, XXXX sent the first payment of {$3300.00} and it was received and applied to our mortgage. On XX/XX/XXXX, XXXX sent another payment of {$3300.00}. However, Rushmore is claiming they do not have the money. We sent this payment the same way the previous payment that they processed and cleared with the same account information, etc. They then said that if we didn't pay another payment for XX/XX/XXXX, since they never received the payment, we would be charged late fees. So, we used their online system to send the XX/XX/XXXX payment on XX/XX/XXXX, and then we also paid XX/XX/XXXX with their online system on XX/XX/XXXX. Yet, we still have not received a credit for the missing XX/XX/XXXX payment of {$3300.00} from our bank account. Every time we call Rushmore to try to resolve this issue, they never know what is going on and never have any answers. They tell us that they are researching until a certain date, then the next time, we get a new later date. It is extremely frustrating and the company representatives have not been helpful in assisting us to locate our missing {$3300.00}.

Complaint: Four months ago I contacted Rushmore in regards to cancellation of my PMI insurance due to the increase of the value of my home by 30 %. The increase was due to rising home values and property improvement modifications. The request was denied due to loan to value ratio. I contacted Rushmore back and explained my loan amount is XXXX and my home value falls between 276-300k. I was instructed that if I wanted to proceed I would need to pay for an appraisal from a 3rd party appraiser of Rushmores choice. I agreed and never heard back. I contacted them back after not hearing back after sending my agreement form to move ahead with the appraisal. Months have gone by with no word so I contacted them again on XX/XX/18 requesting the same. I was instructed that the concern was closed and I was denied with no communication. I explained that this is unacceptable under federal Homeowners Protection Act. I was advised I would receive a call back within 24 hours after it was investigated. I have contacted Rushmore today via online chat requesting my call back and was advised that it can now take up to 48 hours for a response. This insurance should have automatically been removed in light of my perfect payment history over the last 12 years. It seems that my only recourse is to take Rushmore to small claims court since no one in the customer service or PMI department can give me a clear answer as to why I am being charged an extra {$150.00} a month. My advice is to pursue small claims or talk to an attorney if you are ignored or wrongfully denied. Keep every letter and chat log, this will come in handy later on if it goes to court.

Complaint: I am writing to the Consumer Financial Protection Bureau as a final effort to resolve an issue I am currently having with Rushmore Loan Management Services located in XXXX California. Over a year ago I had applied for a loan modification due to a financial hardship. At this time I retained an attorney who represented me. We could not agree to a modification on both sides. With the direction of my attorney I filed a preliminary bankruptcy so I would not lose the house. Rushmore then presented a modification and I amicably agreed to their terms and the petition for bankruptcy was promptly withdrawn by my attorney. Rushmore asked for a good faith down payment which I complied followed by monthly mortgage payments wired directly to them by my bank for 6 consecutive months. These were the terms to satisfy this agreement. In spite of complying and sending timely payments a few days to a week prior to the due date and Rushmore issued auction dates and continued to record as foreclosure. I also wrote to the XXXX in an effort to remove the foreclosure by Rushmore. It was only after I contacted the XXXX that Rushmores attorney responded with a letter of apology and stating errors were made by them. I finally received the congratulations on your modification letter several months after the terms were completed dated months before. I am now still receiving multiple mail correspondence from attorneys stating that it is still recorded as a foreclosure by Rushmore. Bankruptcy was never completed at any time. I continue to be in good standing and this foreclosure issue has to be cleared. If something can be done by your agency it would be greatly appreciated.

Point of contact for them ( XXXX ) is never available, and has not once returned a call. We lost 3 potential buyers because they can't respond or keep documents in order. Now we get a notice to foreclose, but they can't explain why. We have proof of submitting the same documents up to 8 times, but still unavailable by them. They repeatedly yell and cut you off when you are trying to talk to them.

Complaint: I was making extra payments on my Home Loan with Rushmoore on their web site. I made a payment in XX/XX/2018 that my Bank ( XXXX XXXX XXXX ) provided me with a withdrawl fax, clearly showing that Rushmoore had taken the money out. I provided Rushmoore with the certified letter from my bank via FAX to the Consumer Affairs department. I have spoken with 4 customer service reps, and a manager called " XXXX '', each time they tell me its be " expedited '' and they are working on it. Its been 3 weeks, no return phone calls as promised and no response, as they dont have email???? I am actually a month ahead on my loan, but not according to Rushmoore and i cant get an answer. I feel like i am calling XXXX when i call. Please help.

Complaint: We currently have a Loan Forebearance with Rushmore Mortgage which was established via the Loss Mitigation Department through XXXX Mortgage and they are constantly harassing us on a monthly basis by continually sending a Loss Mitigation Packet! We have already been approved for Loss Mitigation and I have also spoken to the PoC in XX/XX/XXXX regarding our Forebearance which she finally acknowledged goes through XX/XX/XXXX. Therefore, we should not constantly receive a Loss Mitigation Packet Every Month! We should only receive the statement of account regarding monthly balance owed to ensure we have the same accounting/reconciliation of account. We also should not be receiving Notices Placed on our Front Door from Rushmore Mortgage Servicing, since we are currently in a Valid And Approved Loan Forebearance Agreement! Pleases stop harrassing us as if we have done nothing to remedy our Mortgage Account!
