Complaint: The property is located at XXXX XXXX XXXX. XXXX . XXXX XXXX, New York XXXX. The property went through mortgage foreclosure from XXXX to XXXX XXXX XXXX XXXX vs. XXXX XXXX . The property was also going through a foreclosure lien XXXX XXXX XXXX from XXXX to XXXX. The sworn affidavits presented to the court confirming that the tenant in occupancy had been served were false documents. XXXX XXXX XXXX Housing Authority allowed the Section 8 rental payments to be used to represent the tenants listed in the fake affidavit, and to hide my tenancy from the record to keep this apartment from being recorded as rent stabilized. I filed a XXXX complaint against XXXX XXXX XXXX notifying them that the mortgage was in default upon XXXX XXXX death and they transferred the mortgage loan to Rushmore Loan Management, but with out a record of the rental income ; which should've been listed during the mortgage and the lien foreclosure. Now the mortgage loan is in XXXX XXXX XXXX and the account is delinquent since XX/XX/XXXX to the present. I've been 1 year and 6 months without a landlord, and the XXXX XXXX XXXX Board has refused to comply with XXXX Administrative Code 11-243 and to enforce NYPAL 2429- Rental on the property.

Complaint: XXXX XXXX XXXX XXXX, based on the letter ( attached ), stating that they are the trustee for the Trust that owns the mortgage and note on my property. I have taken the initiative to request answers under a microscope. I have discovered ( referencing my property XXXX XXXX XXXX, XXXX, PA XXXX ) that there was not ever a loan because the money advanced by investors was subject to a set of documents supporting a bond in which I was not the payor and where I never signed. I was subjected to a set of documents that failed to disclose the real party or the real terms of the entire transaction aka- a black letter requirement of the truth in lending laws. The real purpose of this transaction was an investment scheme wherein the intermediaries took everything-the money & properties. Without my consent, I was converted from a borrower to a securities issuer and your investors were converted from being a part owner in a valid REMIC pool to being the alleged buyer of the security issued by my signature. The right of rescission and damages arouse not only from TILA but from the SEC rules and regulations. Moreover, while researching I just realized that I actually entered into an undisclosed investment contract, NOT a loan. XXXX XXXX XXXX XXXX and all banks affiliated securitization was and is an investment contract. I pray that the Pennsylvania Office of Attorney General request you ( XXXX XXXX XXXX XXXX, Rushmore Loan Mgt., and XXXX XXXX XXXX XXXX ) to produce a real copy of the XXXX form which was filed with the IRS , and the XXXX including the XXXX. These documents will prove that I am the creator. The profits made from the investment mortgage note, belongs to me. The Lender only lent their name to the mortgage loan transaction. The lender NEVER lent me the funds. It was an undisclosed third party who in fact provided the funds for me. Simply, I was tricked into thinking I was the borrower of a loan, when in fact I was a seller of a mortgage note into an investment Trust. The Investment trust never had a right to the mortgage Note. RUSHMORE, Please Note My Request For Detailed Information : I am requesting from Rushmore | " VP '' XXXX XXXX to forward copies ( via CFPB portal ) of the originators Power of Attorney and the chain of ALL mortgage assignments recorded and for the sake of XXXX XXXX with Rushmore unrecorded assignments. Secondly, I am requesting copies of the Power of Attorney on file representing ALL mortgage assignments from the original originator. Thirdly, I am requesting information of who originated my mortgage? Fourth, please help me understand based on the letter attached from XXXX XXXX, why isnt XXXX XXXX XXXX, XXXX affiliated with XXXX XXXX in any way but authorized to make decisions and take actions of foreclosure? In conclusion, please supply a properly dated trail of assignments to show that the originators legal right to collect and foreclose on my property has been passed from one organization to the next, to the current mortgage servicer who you state IS XXXX XXXX XXXX, XXXX.? I look forward to RUSHMORE response ( via CFPB portal ) without delay. Lastly, why did XXXX XXXX XXXX XXXX transferred and recorded a mortgage assignment using Rushmore Loan Servicing Loan Number? ( See Attachments ) In addition, XXXX XXXX XXXX XXXX did not utilize a Power of Attorney when conducting a real estate transaction. The XXXX XXXX XXXX XXXX XXXX indenture expired. Rushmore states that I surrendered property in Bankruptcy, Please note my case was dismissed.

Complaint: After losing my job in early 2010 to the downturn in the XXXX industry. It took me years to find good work and I did all I could do to take care of my family. Today we have fixed are problems my wife get her SSI and contribute that to the household and the only way I could get a good income was to start my own company. After a few years of startup expenses. I now have stable income to pay for my family Home and bills. We are asking for a modification payment with tax and ins we can afford that will let us keep are family home I know Rushmore did offer to put us in a repayment plan that we can not afford XXXX down and {$2300.00} a month for 12 months just to catch up and still not have a modification they say will deal with that then.

Complaint: Our mortgage was sold to Rushmore Loan Management effective XX/XX/2018. We were notified of this well in advance to pay Rushmore on the effective date. We set them up as a new bill on Bill Payer through our bank and made our first payment on the due date of XX/XX/18. With no problem of making the first payment, we scheduled our XXXX and XXXX payments in the same manner. Our XXXX payment was made through Bill Payer on XX/XX/18 and our XXXX payment was made on XX/XX/18. At the end of XXXX, after we had already made XXXX 's payment, we received a statement from Rushmore showing that we owed 2 months of payments ( XXXX & XXXXy ). I called Rushmore as soon as I received the statement and gave them all of the information for both XXXX and XXXX 's payments to include the confirmation numbers that Bill Payer provides. My husband and I have talked to Rushmore no less than 1 time every week to try to resolve this issue but have had no such luck. We have 3 way called them with our bank and Bill Payer several times and none of the representatives we have talked to have been able to do anything other than take a payment over the phone. Bill payer has faxed them over proof of payments, my bank has faxed them over proof of payment but again to no avail. We call 2 days after the faxes are sent and the representative tells us that they never received the paperwork. When we call, we are told that the information needs to go to the Texas office and then when we call back to follow up, they tell us that it should've been sent to the California office. Since all of this has been happening, I put together a packet of proofs of payments, copies of their statements, copies of the notes where we have talked to each representative as well as our bank statements for XXXX, XXXX and XXXX. I was smart enough to mail this packet via certified mail so I know they received it 2 weeks ago. They still can't find our payments! We have asked multiple times to speak to a supervisor or manager and are told that none are available. I finally was able to get put into a managers voicemail but after 3 weeks I have yet to get a return phone call. We have also received foreclosure paperwork ( more how to avoid foreclosure ) and tried to get in contact with the person listed on that paperwork also. Again, I called and left a voicemail and after 2 weeks have yet to receive a return phone call. I don't know what else to do and I refuse to continue to give them money when they lose it. We have placed our XXXX payment into a separate account to secure the funds so when this matter is resolved we can make any and all necessary payments. Please help since the mortgage company does not want to.

Complaint: We received 2 attached contradicting letters from Rushmore in response to my initial CFPB Complaint Number : XXXX. First of all, both letters were dated on XX/XX/XXXX - From both XXXX, CA Office ( which attached a PDF Response Document ) and XXXX, TX which included inaccurate information which does not attest to the full truth. Here are my concerns as follows : 1. PDF Document attachment again does not outline the Fact that we are currently under a Forbearance Program through XX/XX/XXXX via XXXX XXXX Transfer to Rushmore Loan Servicing. ( Please see Attached documentation which was sent over 7 times to Rushmore and original SPOC - XXXX XXXX ). Also, your excuse about posting a note on our door is contradictory as well because we were already in a Forebearance. We were also fully aware of debt obligation based on XXXX XXXX XXXX Forbearance information which was already sent to us and Rushmore during the Transfer, and there was no need to attach our Mortgage * & Deed information. This is another form of Retaliation because we filed a CFPB Complaint as U.S. Veterans. 2. The 2nd Letter received was from the XXXX Office with the same date of XX/XX/XXXX which is inaccurate full of untruths. Contrary to this letter, we reached out to correspond with Rushmore on several occasions via email and phone with no response from the original SPOC - XXXX XXXX - until XX/XX/XXXX. After several attempts and a prior CFPB complaint, XXXX XXXX, finally reached out in XX/XX/XXXX and we spoke about the current Forebearance and the fact that it goes through XX/XX/XXXX. We also specificallly spoke about the Loan Modification application being submitted by the end of the Forbearance to roll-in the loan balance/restart loan at 30 yrs, once we submit the application with updated income. Therefore, this letter is also a form of retaliation because we filed various CFPB Complaints regarding Rushmores treatment towards U.S. Veterans and XXXX Minorities. Although, Rushmore reassigned the case to another SPOC, does not negate the fact that they have discriminatory practices towards XXXX Minorities and U.S. Military Veterans.

Complaint: When the XXXX XXXX XXXX XXXX banned XXXX XXXX XXXX from doing business for a few years and fined them for, basically, stealing, they transferred my mortgage ( which they'd had since 1997 ) to Rushmore Loan Management Services LLC. I've never been late on a payment, so I asked Rushmore why all their correspondence, statements, etc. state they're from a debt collector ( the mandated usual notices ) and was advised that it was " just a legal requirement '' which doesn't really answer my question : how can I be turned over to a " debt collector '' for servicing when I was never in default nor asked for loan modification? XXXX XXXX XXXX should probably be the one answering this question, not Rushmore. Thank you!

Complaint: On XX/XX/2018 a dispute letter was received by Rushmore Loan Management Services in regards to the reporting on my credit reports. I had ask for evidence of there authorization under 15 USC 1692 ( e ) and 15 1692 ( f ) also authorization of law for there collection information also evidence of there authorization to do business or operate in the state of Florida also proof of the debit that they say I owe with my signature and lastly proof of a complete history including any charges added for collection activity that arrived to the balance that I owe. I received A response on XX/XX/2018. Under the Fair Credit Act, you must respond by 30 calendar days.I then responded to there response that they receive on XX/XX/2018 and got a response onXX/XX/2018, which they stated they have 30 business day to respond which is incorrect by the Fair Credit Act. They must follow and abide all rules on the Fair Credit Act and must remove the debit because they did not respond in a timely manner.

Complaint: This loan was sold to Rushmore Loan Management Services to be effective XX/XX/18. My account was set up for automatic ACH payments to be made by Rushmore on the 1st of every month. For whatever reason on XX/XX/18, they changed the ACH payment amount, without notifying me, and posted it under XXXX ... ..the dollar amount and the Payee were unknown to me and I stopped payment. Because of all the confusion and their questionable payment methods, that payment was late. From that point on, all payments have been paid by Money Order, as per Rushmore 's instructions. I have been late with a payment but I have NEVER missed a payment! As of the date of this writing, my account is current. They have reported me for missing two payments and that is FALSE. I can account for all of my payments. My account has always had sufficient funds in it to be kept current and in my opinion, Rushmore has mishandled my funds, and has shorted my principal payments by carrying excess funds forward as unapplied funds. They refuse to correct their reporting and acknowledge they are wrong. My Credit Score has dropped from 800+ prior to their reporting down to 600+ with their FALSE reporting. This is unacceptable.

Complaint: I have had ongoing problems attempting to modify my loan. I have mailed in the documents several times- but somehow some documents were received- but other documents were missing, although they were sent in together. I filed a complaint and in XXXX was assigned to a rep to help me with the process. The sam thing has happened, I send documents in, but Rushmore tells me to resubmit a document bc they sent me an old version etc. They never seem to have all my documents, I have to remind them and reference when they were received. It is so unclear and I am having a difficult time hearing back from anyone. I was denied for missing documents, which I sent over & over and for a XXXX from that they made an error in the one I was sent. The rep would ask me to send in on teh spot, but some documents I could not bc I mailed them in, such as statements, that I could not print. I do not have access to a printer that is mine to use. They have requested the same explanation over and over about my business taxes in writing, I send it in and they confirm it received and then as for it again. My rep emailed me and said that I need to contact him urgently, FOUR days asking for the same document again. I emailed and called back, it has been over a month, no reply. While I am working with the rep on my modification & turned in all REQUESTED docs, I am served w a notice of default and put in foreclosure. I ask the rep about a National Disaster forbearance, because my place of employment/residence were in a declared national disaster area inXX/XX/2018 & he has no idea what that was, how to go about it, if I could apply or not. I know this is confusing, but that is why I am so worried. I feel like I am getting the run around.
