Complaint: My home equity loan was sold by XXXX XXXXXXXX XXXX to Rushmore loan management services in XXXX, CA. in XXXX of this year. On their first billing Rushmore billed me {$50.00} each for annual fees for the years XXXX and XXXX. I told them that these fees had been paid to XXXX XXXX on a timely basis. They asked me to show proof. The only proof I have is that I was not dunned by the bank for. this payment. I told them repeatedly to talk w/XXXX XXXX on this matter. Surely they have proof since these payments were drafted from my checking acct along w/my monthly payments. They apparently have not talked to XXXX XXXX. I have made my first payment to Rushmore, including the {$100.00} in dispute for fear that not doing so would harm my credit rating. I would like this amount to be refunded. It appears to me that the subject of fees was overlooked by the parties in the negotiations concerning the sale of the mortgages.It is my position that XXXX XXXX collected the fees ; how they processed them, or applied them is their business, and not mine. Complaint: My wife and I had a loan through XXXX for a few years on our home then they sold it to a new company we have had since XXXX I believe. Our payment then was just less than {$980.00} a month then in XXXX it went down to {$900.00} due to us being caught up in escrow because we were a little behind due to insurance going up and property taxes going up and due to being all caught up on our escrow being caught up and in good standings and now I talked to the company we are with now which is Rushmore Loan Management Services because our house payment got moved up to {$1000.00} from {$900.00} they are telling us that they went up do to projected amount that might be owed next year but we are not behind at all in our mortgage at all. How can a company say that it might be more next year but they aren't sure yet? We aren't behind we are ahead in our escrow, so how can they do this? They also said if we are over paying by XXXX next year they would refund our money then but not till then. Our house insurance gets paid in XXXX every year and property taxes in XXXX every year I believe. Either way we are {$610.00} to the good in our escrow and every month we are paying {$400.00} into the escrow.

Complaint: The Lender did not notify us or our homeowners association of the hearing on XX/XX/2018. Subsequently on XX/XX/2018 we filed a motion to vacate and met with the Court MAGISTRATE whom granted us the motion and the lender attorney admitted that we were never notified. We submitted a complete modification package to the lender on XX/XX/2018 at XXXX XXXX However. The Servicer refused to provide information and provide us the legal contacting information to proceed. On XX/XX/2018 at XXXX XXXX we faxed a completed package to the legal office and we did the first follow up XX/XX/2018 at XXXX XXXX XXXX and we were told that a completed package was received and was being reviewed with no questions at the moment to follow up in 48 hours ; we did several attempts contacting the legal offices to follow up and I was unable to speak with their loss mitigation department, I wrote an email on XX/XX/2018 at XXXX XXXX The same day at XXXX XXXX we received the denial response due to : 1. The complete retention package was not received ( we have faxed completed package to the lender and the legal office with fax confirmation receipt ) 2. More than 37 days before the scheduled foreclosure sale ( we dont have a sale foreclosure sale scheduled )

Complaint: We have been set up to fail on this mortgage from the get go! I have been working with XXXX XXXX at Rushmore Loan Management to save my house and the only solutions I have gotten are loan mod trial payments that are increasing my payments instead of reducing them. A year ago I lost a $ XXXX job. I was out of work for 2 months with no income and only my wife 's {$55000.00} income. I asked for help and was told to do a short sale as Rushmore deemed I couldn't afford the house. I then got a job with a salary of {$55000.00} to match my wife 's. We get approved for a loan mod trial payment that is about the same amount as my current payment!!! ( The one that is already too high! ). Well they set up the mod trial payments to begin immediately a week after requiring me to come up with {$2000.00} down payment so immediately we are gon na run behind because they didn't calculate the extra month and give us enough time between payments. C'mon really???? That is just setting us up to fail! We did, we were never able to stay current because we started out delinquent on it. So I go get another job that pays more - {$60000.00} back at my old employer XXXX and I again petition for some relief on our payments and we get approved again. Again I had to come up with another {$2000.00} down payment and again was given only 7 days to make the 1st trial payment of get this {$2000.00}!!!!!! Again we started out delinquent on the trial plan - well now we just received the 10 day letter that the plan is being canceled because we fell behind! You started us behind and again we were set up to fail! OK we lost {$28000.00} income and now our mortgage payment gets raised another ball park $ XXXX. We are asking for a lower payment not a higher payment!!! Then I get told at least it will bring you current!! So we can default on the higher payment again. The idea is to fix it right the first time. I also was told if I can manage to pay it for 1 year on time we would be eligible for a refi. No one is gon na refi us with our credit like it is! We offered to pay $ XXXX for the house and was told not enough. That is 25 % of our net monthly take home pay. It would be on time every month. My wife does XXXX XXXX at XXXX ( she is an XXXX ) and they offer numerous alternative mods where they balloon balances on the back end to hit an affordable payment. They also set payment structures temporarily for say 60 months at reduced payments to help people get back on their feet and save their house. We have been offered no interest rate reduction, no term extension, no payment reduction. No nothing except pay more and the payment goes up, up, and up. It is almost as if Rushmore wants us to fail so they foreclose on our home of 11 years. We can pay and want to save our house. Please help us and please stop raising our payment so high it is un-affordable to us.

They proceeded over the next 6 weeks over a total of 7 calls to lie & make up Balone ... in which by the end of each phone call was obvious to me and also to them! They keep using the word escalate to a senior advisor to figure out how this could happen seeing as how I am on a fixed rate. They are now sending me threatening mail which I really dont appreciate. They want me to just pay them and theyll figure it out later, which I am unwilling to do because theyve had over 2 months and have not given any explanation or proof that my principal and interest shouldve rose $ XXXX

Complaint: In XX/XX/XXXX we signed a HFA refinance that contained a 60 month " Monthly Insurance Premium ''. The original mortage holder was XXXX XXXX XXXX XXXX That loan was subsequently sold to XXXX XXXX XXXX XXXX and then to Rushmore Loan Management on XX/XX/XXXX. I have contacted Rushmore on several occasions, plus sent them copies of our mortage that definitely shows that the " MIP '' was for 60 months only. Our paperwork indicates that as of XX/XX/XXXX we no longer have to pay a monthly " MIP '' premium. Rushmore will not honor this paperwork and continues to assess us a monthly " MIP '' premium. They state that our loan principal is not at 78 % " LTV, base upon the XX/XX/XXXX property appraisal that was performed after our renovation work had been completed, therefore our monthly insurance premium can not be removed. I keep explaining to Rushmore that our paperwork was processed prior to the XX/XX/XXXX " MIP '' changes and that our " MIP '' is only for 60 months, but they will not tell me why they refuse to honor the documentation that I submitted to prove this statement. Rushmore further states that since our mortage is FHA, we can not even request a property re-appraisal. At this point, they now tell me that they can no longer help me, nor do they send out the documentation that they say they will send. All contact with Rushmore representatives has been not only confusing, time consuming, but extremely frustrating as well. Please review my documentation and advise if I am correct in my assumption that we should no longer owe a " Monthly Insurance Premium ''.

Complaint: I took out a home equity line of credit on my home approx. 8 years ago with XXXX XXXX. I paid it off about 7 years ago and never drew on it again. In XX/XX/XXXX XXXX XXXX advised me that I would not be able to draw after XX/XX/XXXX. I understood this communication to mean that my account was closed, since I had a XXXX balance and wasn't able to borrow anymore. In XX/XX/XXXX I received a notice that my loan servicing was being sold to Rushmore. Since I didn't have anything to service and my account was scheduled to be cancelled in XX/XX/XXXXI took no action. In XX/XX/XXXX, I scheduled the sale of my home for XX/XX/XXXX. On XX/XX/XXXX, my attorney sent a fax to Rushmore to request a pay-off letter. Approximately a week later my attorney called Rushmore, who told him I had to sign the fax request. I signed it and he resent it on XX/XX/XXXX When we still did not receive the pay-off on XX/XX/XXXX, I called Rushmore and asked for the payoff. They were confused because I had a XXXX balance. I asked them to fax the pay-off to my attorney, and had to repeat the fax number 3 times because the Rushmore employee kept transposing the numbers. On XX/XX/XXXX, I called Rushmore again. I got an employee who said this was the first communication they had received according to their system. I told them they need to do a better job of updating their system. I asked to speak to a supervisor, and spoke to XXXX. I begged him to get the payoff out to my attorney so that money would not be escrowed at closing. He told me I needed to pay {$70.00} to issue a release. I paid it via credit card that day. On XX/XX/XXXX, my home sale closed, and we had no word from Rushmore. Due to the HELOC lien, in order to close we needed to leave $ XXXX in escrow ( for a XXXX balance loan ). The following week, my attorney contacted Rushmore, and now they told him they faxed the pay-off to the wrong fax number ( fax number still transposed ) and they couldn't deal with him because they had to speak directly to the borrowers. My attorney then received a letter advising that the status of the loan is XXXX, which is not a pay-off letter. So I am still unable to get my money out of escrow. On XX/XX/XXXX, I called Rushmore to see what was going on. I spoke to a supervisor named XXXX who told me that Rushmore has 30 days to issue the release according to XXXX XXXX, Illinois, so I can expect my release on XX/XX/XXXX ( which is not 30 days from my first request, or from the date I paid for the release. ) Due to XX/XX/XXXX sale of my XXXX balance loan which they had advised me they were closing, and Rushmore 's incompetence, I was required to pay a {$160.00} escrow fee as well as experience the escrow of over {$30000.00} despite not owing any money on this loan for many years.

Complaint: MY home equity loan was sold to Rushmore Loan Management Services LLC on XX/XX/2018. They called me on XX/XX/2018 in regard to my XX/XX/2018 payment. That payment was made to XXXX XXXX as instructed before XX/XX/2018. It was made on XX/XX/2018. Yet XXXX XXXX contacted me about this payment. I informed them that the payment was made and they should be following up with the institution that they bought the loan from. I also asked them where my payment coupons were for all payments going forward as none were sent to me. I received another call from Rushmore on XX/XX/2018 in reagrd to the same exact queries, where was my XX/XX/2018 payment? I informed them AGAIN that it was sent to XXXX XXXX as instructed by Rushmore 's only and first letter to me. I again stated to them that I have not received any payment coupons for what would be a XX/XX/2018 payment and here it is XX/XX/2018. I do not want to pay these clowns on line as I am not trusting them and they have very bad reviews online. I want to make my payment via US Mail but they wont provide me with a payment coupon to do so.

Complaint: Complaint against Rushmore Loan Management Services for unauthorized increase to my fixed mortgage payment apparently for lack of required insurance. My property is a condo, and the XXXX XXXX insurance policy includes flood and liability insurance. I have repeatedly sent this proof of insurance to Rushmore. However, in XX/XX/2018, Rushmore increased my fixed mortgage payment by approximately {$79.00} without explanation or any notice. I have tried to understand why in a phone but they couldnt explain why this action was take or even what it was for other than premium payment! Instead, they are attempting to verify coverage despite my mailing proof of coverage. Every year they harass me by claiming they havent received proof despite verification from XXXX, the website they use plus the receipt of hard copy proof. However, never have they charged me for a premium as they did in XXXX. I find this company as the most incompetent and fraudulent institution I have ever dealt with in my XXXX years on this earth. I was so sorry to see my loan was sold to them a few years ago as I have never had this problem with other banks on this loan. What used to be an annual routine submission has turned into a nightmare. Thank you.

My mortgage was reaffirmed with XXXX XXXX in XX/XX/XXXX when I filed chapter XXXX. I have always paid my mortgage directly to XXXX XXXX and when sold to Rushmore. My bankruptcy was discharged on XX/XX/XXXX I did not file for bankruptcy on that date as reported by Rushmore. Also my mortgage loan was paid in full in XX/XX/XXXX

Complaint: My actual complaint was not an available option. My complaint is against Rushmore Loan Management Services because they refuse to initiate a funding fee repayment. My VA XXXX status was pending at the time we closed on the account ; however, I have now been recognized as XXXX by the VA and can now request that my VA funding fee be returned. The VA stated plainly that the mortgage company that holds my loan must initiate the repayment through the VA funding fee payment system and that nothing else would change about my loan and that I did not need to provide any documentation to the mortgage company. I initially spoke ( XX/XX/2018 ) with XXXX ( ID XXXX ) and later ( XX/XX/2018 ) XXXX ( ID XXXX ) and they are refusing to submit this request and are requesting my XXXX paperwork. Rushmore Loan Management purchased my VA loan but is completely ignorant of the VA loan, and is unwilling to assist me in this matter.

Complaint: XXXX XXXX sold our home equity loan to Rushmore in California. I believe Rushmore is frauding their " new '' clients. It is difficult to get anyone at that company to answer the phone. They would only let me pay by setting up account on their website to do a draft from our account. I wanted to pay the balance in full. They would not let me pay more than {$10000.00} per day. I was charged a {$50.00} fee for them receiving our loan in the first place. The next day I tried to pay the remaining balance. It would not except full balance. I had to leave at least one cent remaining. I finally got a hold of someone there and said they have to have a cashier 's check for final payment and that we owed them {$68.00} transaction fee! They said I owe them that because they would have to go to the courthouse to get the deed. I live in Louisiana and Rushmore is in California. I wish someone would please investigate the practices of this company. I looked online for information about this company and all they have are really bad reviews. I fear the deed is being held hostage.
