Complaint: XXXX XXXX XXXX processed a mortgage modification for my residence. I made the 3 trail payments and my mortgage servicing was sold to Rushmore Loan Management. Rushmore would not honor the previous modification agreement they increased my monthly mortgage payment and referred my loan to a foreclosure attorney. I do not think I have been treated fairly I've been working with XXXX XXXX at Rushmore as the single point of contact. She is unwilling to assist me with my mortgage as well as Rushmore Loan Management. I don't want to lose my home. See Attached

Complaint: My mortgage was recently transferred to a new servicer Rushmore Loan Management and bought by a new lender. My mortgage was modified in XX/XX/2015 with XXXX XXXX XXXX and the terms of my payment changed to 480 months. Shortly after it was transferred to XXXX XXXX XXXX XXXX and terms were reported correctly.The new servicer Rushmore Loan management is reporting the terms at 648 months. I called to inform them that it should be 480 months not 648 months. I was told that it is being reported correctly at 648 months. I will include my modification agreement.

Complaint: Rushmore Loan Management bought out our loan was told I was 3 months behind my husband 's daughter paid the loans to catch it up. I paid off the loan early I thought logged into the web site it says I owe almost 16.00. I then received a notice that I owed a deferred payment of almost XXXX called and was told that I have three payments behind was told that I could make payments until it was paid because it is due in XX/XX/XXXX so I sent XXXX last month they kept the money it shows it is in escrow account sent XXXX More then sent XXXX to make sure the deferred payment was paid off. Noticed today the second payment of XXXX was returned plus the XXXX was returned. I called them was told we do not take partial payments but yet they still have the first XXXX I sent and I'm still getting letters that if I don't pay it off beforeXX/XX/XXXX they will foreclose on our home

Complaint: We paid off our mortgage on XX/XX/2018. We sent a wire transfer, as requested by the mortgage company, in the amount of {$24.00}. Our payoff statement stated this was {$4.00} for principal and {$20.00} for a recording fee. At that time we had an escrow balance of {$890.00}. On XX/XX/2018 {$20.00} was removed from our escrow account with the descriptive reason being " partial payment ''. This lowered our escrow balance to {$870.00}. The escrow account was for home owners insurance only, as we pay no property taxes due to my rating as a XXXX XXXX XXXX veteran. If our loan was paid in full, as well as the recording fee, what was this {$20.00} payment for? I contacted the mortgage company 3 times in XX/XX/XXXX via telephone to inquire why the {$20.00} was removed and what it was for. Each time I was told my inquiry would be forwarded to the correct department and I would receive a written response in approximately a week. No response. I sent two secure messages from my account on their website requesting the same information, one on XX/XX/2018 and one on XX/XX/2018. Each time their response was " XXXX XXXX Your secure emailed message is currently under review. We realize the urgency of your inquiry and we appreciate your patience. We will have a written response to your concerns. Should you have any questions, please feel free to contact our office at Toll Free XXXX, Monday through Thursday XXXX XXXX. to XXXX XXXX, Friday XXXX XXXX. to XXXX XXXX Pacific Standard Time. As of today, XX/XX/2018 I have yet to receive a reason for this {$20.00} being removed from escrow. It is now been over 2 months from my initial inquiry. I need to know why this {$20.00} was removed.

Complaint: My HLOC was transferred from XXXX XXXX to XXXX XXXX XXXX. I made my first payment of {$310.00} to Rushmore on XX/XX/2018 through XXXX bill pay. Subsequestley Rushmore called me and said they had not received the payment. I contacted XXXX and they verified that an ACH payment of {$310.00} was sent to Rushmore and cashed on XX/XX/2018 by Rushmore Rushmore continued their daily dunning calls and said they had not received payment. I obtained a proof of payment form from XXXX and faxed it to the fax number supplied by Rushmore. Rushmore informed me that they opened an investigation into the lost payment that would be completed on XX/XX/2018. I continued to receive daily dunning calls. I contacted XXXX and they called Rushmore on three different days and stated that my payment had been cashed. On XX/XX/2018 early in the morning I received a call from Rushmore about non payment and they informed me that there is no evidence that they had made any investigation of my lost payment.

Complaint: XX/XX/XXXX Rushmore Loan Management ( servicer for XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX CA XXXX Loan # XXXX ( XXXX ) XXXX Urgent complaint against XXXX XXXX, XXXX XXXX XXXX XXXX and Rushmore loan management svc. This letter is a dispute concerning all amounts charged by the Mortgage Company they do not correspond with a true amount and are inflated, you have charges that are illegal, unfounded, unverified and abusive beyond the normal status On XX/XX/XXXX XXXX XXXX XXXX filed a motion with the United States Bankruptcy Court XXXX XXXX of Florida XXXX XXXX XXXX case # XXXX XXXX XXXX XXXX the full approximate payment of arrearages was {$93000.00} due and owing in regards to the loan. The arrearage is what was due and owing at the time of the filing, according to XXXX. So XXXX filed a claim for that amount they are bound to that amount according to the motion they filed. Then We have the attorneys for XXXX XXXX saying that XXXX is owed, Then we also have Rushmore Loan management sending statements giving a different amounts. We have 3 organizations involved for one loan and none of them have an accurate amount of the true financial accurate balance, this is a factual financial controversy that shows the fluctuation of fraudulent amounts hindering and affecting the entirety and origin and continuance of the loan. XXXX added attorney fees, Rushmore added Attorney Fees, XXXX XXXX added attorney fees all at the expense of trying to hinder, abuse and discriminate the true status of the loan, infringements founded on inaccurate grounds and untrusting fees because of predatory actions conducted by these servicers, I Am requesting a Federal Government investigation and appropriate Authorities concerning this kind of injustice and ongoing corruption that can disqualify this status of greed and actions conducted by this institution and their assignees. XXXX XXXX said it was " very sorry '' for a computer glitch that caused hundreds of people to have their homes foreclosed on. The Fed has said it won't lift the asset cap until it's satisfied XXXX XXXX has cleaned up its act. XXXX XXXX remains in legal hot water beyond the Federal Reserve. Federal government agencies, including the Justice Department, SEC and Labor Department, and state attorneys general have launched inquiries into XXXX XXXX 's sales tactics, according to recent SEC filings that described the probes as at " varying stages. '' Not surprisingly, the Federal Reserve has yet to remove the bruising penalties it imposed on XXXX XXXX in XXXX for " widespread consumer abuses. '' The unprecedented sanctions handcuff XXXX XXXX by preventing the bank from growing. XXXX XXXX discovered that some workers altered documents about business customers a finding that reportedly sparked a Justice Department investigation. It paints the picture of a bank that has repeatedly abused its customers. XXXX XXXX has admitted to charging customers for mortgage fees they didn't deserve and forcing them into force over inflated amounts. Some people even had their homes repossessed as a result. I further certify that I refute, rebuke, contest, deject and submit my objection of all amounts charged against me from XXXX XXXX, XXXX XXXX XXXX and Rushmore loan management and all those involved in these constant corruptive fraudulent acts of violations and consumer abuse. XXXX XXXX - The laws concerning the securitization of notes is quite clear ; if you want to take a negotiable instrument like a loan note and convert it to something that can be traded on wall street such as a stock or a bond, which are " security '' instruments, you can do so, but then you can never change it back to a loan note or " negotiable instrument ''. Once these pools of notes are converted to stock they are supposed to be put into the loan pool, and they have 90 days from the closing of the pool to do so. However, none of this hardly ever occurs as in fact, the notes are destroyed and lost so that no one ever finds out the truth about the notes having been converted to a security instrument, because if a security instrument were to materialize concerning your home and they also have in their possession a loan note, that is admission of fraud on their part. They crooks also try to concoct missing assignments of these loan notes years after the closing dates on the pools, another XXXX fraud that constitutes a 10 % fine of the total value of the pools. This should be in the tens to the hundreds of millions of dollars per violation. FDCPA Fair Debt Collection Practices Act violations - the banks and mortgage servicers are simply ignoring FDCPA notices. TILA Truth In Lending Act violations - the banks and mortgage servicers are simply ignoring TILA notices. RESPA Real Estate Settlement Procedures Act violations the banks and mortgage servicers are simply ignoring RESPA notices. Insurance Fraud companies that have no ownership rights to the notes are forcing insurance while naming themselves as the mortgagee. Falsifying Notary Signatures - aka Robo signing - This practice has become well known throughout the country. A document with an authentic signature is photoshopped and copied onto other illegally created documents to make it appear legal. In other cases companies interested in stealing someones home just have someone else sign the documents in the name of a real signatory. In many cases the signature is simply an odd squiggle mark that is indecipherable as to what name is being written. Usually the notary stamp and signatory are on a separate piece of paper than what is purported to be notarized. Again illegal in all states. Robo Signing Trustees - A trustee is supposed to be in charge of your loan note and / or trust that the note is in, however, they oftentimes just signed everything in sight with no thought given to what they were signing and in many cases simply neglected to sign XXXX XXXX also Forged my signature XXXX XXXX XXXX, and XXXX XXXX Signature XXXX XXXX and XXXX signature on the HUD 1 Closing Statement. Complaint: My account has been overcharged in force-placed insurance which makes me pay twice for the same insurance. Charged on my escrow account an insurance value on the loan and they never sent me a notice of premium nor any insurance certificate. My property is a Condominium and has been insured since I bought it in 2005. I had to rely upon my insurance and my funds for any issue since I never had a certificate from them. IIf I had a certificate from them I could have contacted the insurance company for a refund in regards to that insurance since I have had always coverage in my property. They do not want either to refund those premiums or produce a certificate of that insurance. In essence, I am being charged for something that does not exist. It is illegal to collect double insurance on the same risks.Rushmore does not respond to my complains. This is simple an easy money earning for those who have a property. This issue caused a lot of our problems in the past.

Complaint: We are filing this complaint against XXXX, who violated their RMBS agreement with the federal government when they bought a HELOC debt from XXXX. They were obligated to negotiate a settlement fairly, but instead, instigated foreclosure in the midst of us applying for a negotiation, they committed modification fraud with false amounts, outrageously false property values, when we complained about their servicer Rushmore Loan Management to CFPF, Rushmore lied in their response to CFPB and submitted false documents to the CFPS, and then we were suddenly advised that this false debt amount they attribute to us, had been sold to XXXX XXXX XXXX, and then we received another notice that it was sold to a XXXX XXXX in Arizona. Essentially XXXX never met their RMBS obligation to offer fair relief, which they were obligated to do. Instead, they threatened us and has no intention of fair settlement, and have since cost us much more in legal fees and more. Regardless, XXXX only notified us a month after they sold the debt, that it had been sold, and we received two conflicting letters about the new owner of the debt, so we have no idea who actually owns it, but one of them has attorneys sending us threatening forceclosure documents. We also received conflicting contact addresses. XXXX aka XXXX XXXX, was obligated under the RMBS agreement to offer relief for debts they purchased from XXXX, instead committed modification fraud, false attempts at modification, lied to us, threatened us inappropriately, falsely sent an appraiser, who told us she had been hired to take photos to sell the house, not appraise. etc.. started foreclosure proceedings while they were pretending to negotiate a settlement, falsely appraised property ignoring legal issues attached, and boundary disputes, and threatened to sell our home, falsely reported amounts owed to credit bureau, and finally sold the " debt '' wildly false amount to different entities, who are now both harassing us, and threatening foreclosure, and XXXX never notified us that they had sold us, until a month after the alleged sales of the same debt to two different trusts? Complaint: Rushmore Loan Management Services recently purchased our mortgage from XXXX XXXX. Starting with last month, payment due XX/XX/2018, they have failed to record our payments for which we have canceled checks that were cashed before the due date ( for payment, cashed on XX/XX/2018 and for Escrow, cashed on XX/XX/2018 ) as of now these payments have still not been credited to our account. We called them on XX/XX/XXXX to try and resolve this payment matter we were greeted with a rude adversarial representative who could not verify any information forcing us to fax all our proof to them. They responded with a letter stating they needed 30 days to look into the matter ( this is absolutely unreasonable ). We have not received any statements for payment due XX/XX/2018, to prevent being delinquent we mailed a check for XXXX which was cashed on XX/XX/2018. Now on XX/XX/XXXX we have received a delinquent report and late charge assessment for the past two months. We have still not received any statement to pay our XXXX payment. We did not choose this company they are completely incompetent and our credit is being destroyed. I am trying to get this company to cooperate before things get out of hand and a lawsuit is the only answer.
