Complaint: This is an addition to my original complaint from back in XXXX XXXX with this company. Rushmore loan management Services. I did get a response that you sent me stating that a man named XXXX XXXX who was really another relationship manager. Well i did call him thinking that he was a CEO, or an administrator or some kind of an executive of which i ask for, that can be verified. But instead i only had this XXXX XXXX who said to me that the only person that could help me was the person that caused the problem in the first place. I could not believe what he was saying. But it came to me that he was protecting this person named XXXX XXXX. So i did tell this XXXX XXXX that i did not want to deal with him or any other relationship manager. Well after that i had so many relationship managers call as if to harrassed me. I ask to speak to an executive that i can verify that is who they are. This group of people have been playing games, until it makes me wander if there is a CEO, or is this just a group of people or working from with no supervisor. This has been going on so long to cover up what really did happen, and this XXXX XXXX is really trying to protect her. He has not been a very nice person. I have all the names of the other relationship managers who has been steady calling me. My complaint was to be able to speak to someone in charge, but what are they trying to hide or cover up. This is very strange for any company. Usually by now someone in charge would have called to find out the problem. The company is Rushmore loan management services. My loan number is XXXX. If you look back in XXXX XXXX you will see the complaint i did before. Nothing has change, it has gotten worst. I have a feeling that this complaint will go to XXXX XXXX the relationship manager. They go by your loan number and whoever that person is, is responding back to you. I do not feel that it ever got to an executive. I would like to know how you can find out to make sure this gets to the right person. And i would like a name and a contact phone number, so i can make sure of this persons credentials. Maybe there is only investors that put this company together. Please look into this. How is this protecting me if we can not get to the bottom of this, especially since i have told all of the relationship managers that i am not going to deal with them. The first two people i had seemed to be honest, but since them it has been a very hard ride and it seems as if no one cares. If you have people that are dealing with the public they would care about an complaint. But this has been too, too long. XXXX XXXX XXXX

Complaint: This company has been very deceiving. I received statements staying i was up to date with my loan for two to three month. Then i received a call stating that i have an agreement which i do not, and that i was behind. Then after the call i received a statement with a different amount. This is very confusing and deceiving and it 's damaging my credit, one month they report i am on time and not behind, then the next month they report foreclosure status all while i have been paying my monthly payments according to my statements. They need to make a forensic payments investigation with the underwriter department. In the state of MD they are required by law to send intent to foreclose and i never received such notice. I checked my credit and it was updated to foreclosure proceeding started on XX/XX/XXXX that 's how i know. They are illegally practicing collection efforts and taking advantage of the consumer.

Complaint: Borrower : XXXX XXXX XXXX Loan # : XXXX Property Address : XXXX XXXX XXXX, XXXX XXXX, CA XXXX Phone : XXXX Rushmore failed to pay my homeowner 's insurance in XXXX, XXXX. After several attempts to get Rushmore to pay my insurance, all of which seemed to fail, I determined that despite assurances of agents of Rushmore that it would be paid I elected to not go without my insurance any longer and pay it immediately. I was about to leave for 5 weeks ' travel in XXXX and could not allow non-coverage to continue. I financed this payment on a XXXX card and now owe additional interest on the sum because Rushmore has failed to reimburse me. I was told that only if I sent a demand for payment to the " Consumer Affairs Dept. '' at Rushmore could I be paid. I submitted the letter by FAX on XXXX XXXX, XXXX, as instructed, and received an acknowledgment letter dated XXXX XXXX, XXXX, stating that a response would be sent in 30 days. I have not received any response. I 've called again on XXXX/XXXX/XXXX and was informed that my claim was still being " researched '' and an expected date of completion would be XXXX/XXXX/XXXX. I received no communications and called Rushmore again on XXXX/XXXX/XXXX and was told that I could be sent a check for {$860.00}, not the {$990.00} for reasons that were unclear. I again explained that the amount was {$990.00} and that lesser amount offered was unacceptable. The agent assisting me said she 'd update the documentation and that she 'd call back on XXXX/XXXX/XXXX to update me on my request. No call was received. Now, XXXX/XXXX/XXXX, I 've again called and was told today that a " review '' was in progress and I could expect something on XXXX/XXXX/XXXX. The agent confirmed that the money was in our escrow account. All of this is unacceptable. Rushmore failed to pay the homeowner 's insurance, causing my insurance company to threaten to terminate my coverage. When Rushmore could not make any firm commitments as to when payment would be made on this matter, I determined to pay it out-of-pocket to maintain my insurance. Rushmore has confirmed to me that my escrow funds are in my account but can never finish any of its " reviews '' and " research '' on this matter. After being put on hold when requesting that to speak to a person with more authority to resolve this matter, no one ever picked up the phone and after a total of 59 minutes, my call was hung up on. I explained that I 'm sending a copy of my demand letter to the Consumer Financial Protection Bureau.

Complaint: My mortgage was transferred to this company in late XXXX. I sent them a payment, I am currently under a bankruptcy process here in NY. My original loan provider, XXXX XXXX, XXXX. sold my loan to this POS organization. I am required to send payments under a trail period before XXXX XXXX would agree to a permanent loan modification. Rushmore has claimed to never received my XXXX payment thus putting my permanent loan modification at risk or in fact now cancelling it out because they claim I never made the payment, which I did and have proof of. The payment amount was {$970.00} and was delivered to these XXXX onXX/XX/XXXX, I have the XXXX XXXX Mail receipt to prove they received it and a copy of the bank check stub that was sent in payment.

Complaint: My spouse started buying this home in XXXX. He XXXX in XXXX. He had mortgage insurance that paid XXXX on a house purchased for XXXX with XXXX being paid when we bought it. We do not have taxes included in house note just insurance and lender placed flood insurance. I am the spouse and my credit is not good. My interest rate on this loan started at 9 % and now it is 7 %. I owe XXXX according to their records. We had a thirty year mortgage. I do n't understand since we paid XXXX in XXXX and I am paying more than 300 in interest each month on such a low principal

Complaint: I have a foreclosure date set forXX/XX/XXXX and my modification has been going on sinceXX/XX/XXXX until now. Has gone through 3 servicer 's, started with XXXX for a year, they sold to XXXX XXXX XXXX for 3 months and I have had a lawyer for the last XXXX XXXX. The last servicer, XXXX has had it for 2 years and have been saying I do n't make enough money for a modification, not true the numbers show I make enough. I have written down and dated documentation of conversations and events through out the whole circus with these servicer 's. They say we did n't receive this or resend that, then they say we have everything and transfer it. My lawyer says my options are taking a chance with the judge, paying a XXXX to reinstate or foreclosure. From surfing the internet I have seen many ways to stop this foreclosure, this is how I found you. I just do n't trust my present lawyer anymore because he is not even discussing all my avenues. I just got married 2 years ago and it is really weighing in on my wife and I. I am XXXX XXXX, XXXX XXXX XXXX and maintenance and pretty rooted in here at my home with 2 garages, a lot of equipment and my snow removal route is designed to do a circle around the house. I have a commercial blower on the front of my tractor and just drive it around in a big loop at 15 MPH. I have 5 apartments, 2 buildings same location, and applied for a modification for that property in XXXX and got it so I decided to apply for a mod with my home. XXXX started reporting to the credit bureaus back in XXXX as being late and also said foreclosure initiated, this has dropped my score incredibly. I have equity in my apartments but ca n't use it to reinstate because I ca n't get an equity line because of the late 's on my report, so XXXX has really XXXX my. We desperately need to keep our house and I am willing to fight for it. I pay all my bills on time and just want to pay for the house as well.

Complaint: Since XXXX XXXX when we realized our mortgage had once again been switched over to another company ( XXXX XXXX XXXX ) ; we have faxed ( XXXX XXXX, XXXX ) them the information they needed to do our loan modification, emailed them XXXX times, and then mailed them all of the same information that was faxed to them on XXXX XXXX, which they received on XXXX XXXX, XXXX according to the tracking number. Every time I contacted XXXX XXXX services, after I had sent them the information they requested I was told they still had not received the information they needed to do our loan modification. When I spoke with XXXX XXXX on XXXX XXXX, that was when she informed me she still had not received the mailing, and then sent the email to the party who signed for it to try and locate that mailing. We then agreed upon a payment on XXXX/XXXX/XXXX Payment Applied {$1000.00}. When I then called in to see if anything had been done about the mailing I ended up having to call 4 times, and made sure they entered the tracking number with the persons name who had signed for it to be documented in our record. To this day nothing has been settled to have them modify our loan due to their negligence and inability to notify us of any help that we need so we can make payments we are able to afford. Even after calling that day 4 times, XXXX XXXX has not returned any of my calls even when I 've left messages for her to contact me. Thank you for your time

Complaint: My mortgage was sold to XXXX XXXX by XXXX XXXX and serviced by Rushmore Loan Management. My previous complaint to CFPB was to be sure that XXXX XXXX sends all my loan modification documents to Rushmore. C Today after sending email, leaving VMs to Rushmore to know the status of my modification, I talked to XXXX who continuously told me that they received only the XX/XX/XXXX package. Which was shocking so I told XXXX that I will be filing a complaint because I had a letter from XXXX XXXX stating that they had transferred all documents. He told me to speak to XXXX XXXX who is my account manager, that he was only reading whatever was on the notes. Then few minutes later I called XXXX XXXX phone number and was redirected to XXXX who confirmed that they received the XX/XX/XXXX modification transferred by XXXX XXXX and that Rushmore is working on my modification and that XXXX would return my call in next 1 or 2 days. I had left a VM last week to XXXX, sent her an email this weekend and left another VM this morning. Last week, XXXX ( @ Rushmore ) told me over the phone that XXXX was my account manager. Today XXXX told me that XXXX XXXX is my account manager

Complaint: XX/XX/XXXX got a call from a collector. Mentioned a payday loan that I did default. I paid them. Then today XX/XX/XXXX I got a call from another collector and said to pay the same pay day loan. Thinking this was another payday loan, I paid this guy. Later to realized I paid two collectors for the same loan. I paid {$760.00} in XX/XX/XXXX and {$560.00} today. I think the loan was originally {$300.00}.
