Complaint: I submitted a Borrower Assistance Application onXX/XX/XXXX.. I also told my single point of contact ( POC ) that i meet the eligibility criteria for one of Keep Your Home California Programs ( MRAP - Mortgage Reinstatement Assistance Program ) and all I need from Rushmore was the mortgage statement and modification. Her response to me was " If you do not qualify for the modification, will they still help you to get current ''. It appeared to me that she already knew that they would not approve me for a modification and that they were just buying time as we got closer to the foreclosure date of XX/XX/XXXX. She then told me that i will know if my application is complete in three ( 3 ) weeks and at that time i will get a decision. Three weeks will be XX/XX/XXXX and only Two weeks away from the foreclosure date. If the decision is negative, i do not have enough time to appeal it before the foreclosure date. The staff at Rushmore ( POC 's and Supervisors ) are notorious for misguiding customers on the modification process. They play by the rules by their calendar and are eager to have your home go to foreclosure. They do not like to work with other mortgage assistance programs such as Keep Your Home California. Rushmore is violating my home owner bill of rights and i 'm kindly requesting you to look into this matter. Complaint: My loan was recently transferred from XXXX XXXX XXXX to Rushmore Loan Management about a year ago. During that time XXXX sent me a letter that my loan was being transferred to Rushmore and the only thing I was instructed to do was submit my payments to Rushmore home loans, which I did. I received my statements for the first six months and made my payments on time. Shortly after I stop receiving my statements from Rushmore Loan Management. I called to notify Rushmore in regards to not receiving my mortgage statements, in which I 'm entitled. I spoke to a manager and notified him that I was not receiving my statements. The manager informed me that I was in a chapter XXXX bankruptcy, which was discharged XXXX years ago. I then asked the manager how I could start receiving my mortgage statements again in order to submit my payments in a timely manner, also, to have for my personal records. The manager told me to write a letter to give permission to Rushmore to send me my statements, which I did diligently. In addition, I attached my payment for XXXX XXXX. Rushmore sent me a letter in return that they received the letter I sent and payment, and told me they would get back to me in 30 days. Today XXXX/XXXX/XXXX I received a response in lieu of my request indicating that they are not able to send me my statements due to my Chapter XXXX bankruptcy. After my conversation today with another manager, they refused to send me my statements regardless of any legal documents and or receipts I send them. As a consumer I am entitled to receive my statements when submitting money to any company.

Complaint: I filed a case CFPB Case Number XXXX on XXXX XXXX, XXXX about issues with Rushmore Loan Mgt Services. They responded that the loan was sold to them by XXXX XXXX XXXX under false pretenses because XXXX XXXX XXXX was a 2nd not the first on the loan. XXXX XXXX XXXX was the first. We are now working with XXXX XXXX XXXX to try to close this short sale. XXXX XXXX XXXX has a XXXX XXXX, XXXX foreclosure date. Rushmore is not responding to calls from the lawyers to release/return/settle so that the sale can go through. I need help getting Rushmore to settle this loan with XXXX XXXX XXXX. I could also use help getting XXXX XXXX XXXX to move the foreclosure date out so that a reasonable closing can be processed.

Complaint: We been working with XXXX on short sale since XXXX of this year. Had 2 sale contracts with cash offer for purchase of our property. XXXX gave us verbal approvals and promises, But instead of officially in writing approving and closing short sale they send us letter and transferred loan to servicing to Rushmore Loan Servicing as of XXXX XXXX. My realistate agent has contacted Rushmore right away in order to process short sale transactions ASAP. Rushmore has send BPO agent to confirm value of the house. They do have a copy of appraisal that was done by licensed appraiser ordered from XXXX earlier this year ( with value {$830000.00} ) We have found out that Rushmore has send documents for property to go to forclosure sale on XX/XX/XXXX When we finally got hold of representative at Rushmore after leaving messages for couple weeks, they informed us that BPO value came in at XXXX. And they are not willing to sale it to buyer we have because Home worth more then XXXX lisensed appraisar appraised it at ( {$830000.00} ) They dont want to listen to our realtor explaining that Home has severe water damage and mold and need repairs for around {$200000.00}. Also that its been on a marker for several years at {$700000.00} + range and hasent sold. My realtor been asking Rushmore to Re-order new BPO, is explanating that the one thy got with high value over million, very incorrect. So two weeks ago realtor got a called from agent stating she been hired by Rushmore to do a BPO for our house. And last week when our realtor contacted this person back she said she appraised it at high {$500000.00} range considering repairs for almost {$200000.00} that need to be done. She also said that Rushmore was pressuring her and asking to raise up the BPO price to much higher then what she came up with. And she refused to do it. ( We have contact information for this agent and in writing info. She communicated/send to us as evidence ) My realtor got hold Rushmore this Monday, but they denied to have any knowledge ordering new BPO or a value of this new BPO. ( We have it in e-mail corespondents from Rushmore ) Also, Rushmore and there representatives refuse to even try to approve short sale or send us a counter offer with sales price they are willing to accept. We have forclosure date of XXXX XXXX. My Husband is XXXX XXXX XXXX VETERAN and recovering after XXXX XXXX XXXX in last 4 years. He is also has XXXX as pard of his XXXX. This forclosure and eviction situation and unwillingness of Lender to accommodate and help with short sale, causing him extreme stress and anxiety in addition to what he is dealing with XXXX. We BELIEVE that XXXX XXXX XXXX in COLLUSION with XXXX and determend for unknown to us reasons to foreclose on our home Insead of assisting us with short sale so we can eliminate, resolve and pay off all other debt agains this property and give us a chance of clean slate and new beginning. We found out throughout research that Rushmore owned by XXXX. Rushmore has posted on there Company site that they under umbrella of Parent company Well we researched that that company is XXXX XXXX XXXX XXXX that is registered in XXXX in county of New York as an Foreign LLC. And its registerd under XXXX of XXXX XXXX XXXX. PLEASE HELP! We are getting ready to send this information and ask for help and investigation to the President Office at White a House. My Husband didnt serve this GREAT country for 25 years and became XX/XX/XXXXto be trited like this, to get evicted with his family and to get Foren companies like XXXX, Rushmore and XXXX colluded instead of helping and abiding by American Laws that protect XXXX veterans.

Complaint: I am trying to fight through roadblocks put up by my mortgage lender XXXX XXXX XXXX. They took over my loan from XXXX and have consistently lost paperwork, changed account managers and failed to review my current financial information and give me access to the government and internal programs they have so that I can save my home. They recently claimed that they had reviewed my financial information but stated I was denied because my monthly income is only {$1400.00}. That is not even CLOSE to accurate. I receive pension as well as XXXX and it is over {$2000.00} per month. It seems that Rushmore is just making an excuse to foreclose as they have set a sale date for XXXX XXXX. I have lived here since XXXX and XXXX XXXX XXXXXXXX XXXX for just as long. Approximately one year ago I began having serious health issues and was forced to be hospitalized for XXXX XXXX XXXX. By the time I got out of the hospital I was behind on the mortgage, and unable to work. I have now been classified as permanently XXXX and I am on a fixed income. I have repeatedly tried to get Rushmore to engage in a fair and transparent negotiation so that I can resolve the matter of my delinquent payments but this has proven to be difficult. It is a constant runaround and paper chase and it seems that they are intentionally trying to stall so that they can foreclose on my home. I think it is wrong to mislead a US veteran who is now XXXX and try to force me out and not even give me chance to fix this situation. I needed to take some cash out and was steered/duped into a predatory high interest rate ARM loan by XXXX. When I realized what was happening at the signing table I objected but they told me not to worry, I could always refinance into a fixed rate loan later. It wasnt long after that property values tanked because of the recession and the hope of refinancing was gone. As my payment adjusted up I struggled and tried to get XXXX to help me at that time. They did offer me a modification, but it was a temporary fix, and after a few months my payment became higher than it was BEFORE the loan modification. XXXX was difficult to deal with and it is not surprising that they were fined and sanctioned by the Department of Justice for unethical foreclosure practices. When XXXX went out of business they sold my loan to Rushmore for pennies on the dollar and I feel that Rushmore is obligated to work with me to put a plan together so that I can save my home ; I was duped by XXXX at origination and then put into a modification that they said would lower my payment but they told me it was permanent and six months later the payment was higher than it had originally been! I cant afford my payment, it is close to half of my monthly income and I am significantly underwater and need help because Rushmore is ignoring me and trying to auction off my home!
