Complaint: I had a repayment plan with XXXX XXXX XXXX in order to keep my home. I have made payments on time every month since XX/XX/XXXX. I filed a complaint with CFPB towards the end of last year against XXXX because they would not work with me in regards to the balloon payment. I requested extra time because I am on a leave of absence from my job because of a XXXX XXXX. After filing the complaint, XXXX agreed to work with me and stretched out my payments. I received a letter in the mail XX/XX/XXXX stating my mortgage has been sold to Rushmore Loan Management Services. I called the relationship manager assigned to me, XXXX XXXX. I left a message on her voicemail asking when and where I need to send my check for XXXX 's mortgage. I have never received a call back from her or anyone from Rushmore. I have received paperwork stating my house would be in foreclosure, again. I only have about six months left and a balloon payment left on my repayment plan. I do not want to loss my house or start this over again.

Complaint: Rushmore Loan Management Services ' Loss Draft Department has repeatedly and unnecessarily delayed disbursing insurance funds to repair my house in the wake of Hurricane Florence damages. It took three months for Rushmore to make the initial disbursement of any funds from the insurance company to cover repairs I had covered out of pocket in the four months since the storm. I am currently waiting for Rushmore to disburse the final insurance funds to our contractor for my roof repair, and I see them delaying again in a similar manner to the initial disbursement. I contacted Rushmore on XX/XX/2019 to conduct a final repair inspection, which should happen within 3-5 business days according to their procedure. It is now XX/XX/XXXX and their inspector still has not contacted us. We need help speeding Rushmore up to pay our roofing contractor. During this three-month period it took to get the initial insurance disbursement I had several phone communications with Rushmore where they made commitments to pay a portion of the money then failed to keep them. In the first phone conversation after sending in my paperwork, the Loss Draft Department told me they had a note on my account to endorse the insurance check and send it back to me. I said that would work great, I can manage the repairs myself. They never sent the check or told me that they changed their mind. I called back a few weeks later to ask where the check was and they said they could not send the check back. When I asked how I could get money to cover the repairs that had already happened they asked that I send in receipts for which they would reimburse me from the insurance funds. I sent in receipts and again did not get any insurance funds from Rushmore or notification that they changed their mind. The next phone conversation happened about two weeks later when I had completed all the repairs with the exception of the roof replacement. Rushmore agreed on the phone to come inspect the repairs and then they would disburse that amount from the insurance funds. Their inspector came out and agreed that 30 % of the repairs were complete and filed the report back to Rushmore. Rushmore again denied making a disbursement from the insurance funds for the repairs. The Rushmore agent I spoke to on the phone claimed they tried to call me at my number which she read the first 7 digits correctly, then paused, then switched the last two digits. I recited my phone number to Rushmore correctly on each of my phone conversations with them. After a few more phone conversations a supervisor at Rushmore told me that she could send a check for 30 % of the non-roofing repairs which would be roughly 9 % of the total claim. I had to explain that it was 30 % of the total repairs that are complete, not 30 % of 30 % ( aka 9 % ) of the repairs. Eventually, Rushmore agreed and over two weeks later finally sent a check for the non-roofing portion of the insurance funds to cover those repairs. Background information : Our home was struck by a tree in the hurricane resulting in roof, porch, and interior damages. It took one month to get the insurance claim check, so when I scheduled a reputable local roofing contractor I was already 6-8 months back on the waiting list. I performed repairs to shore up the house and avoid mold damage by tarping my roof and removing wetted drywall and insulation before I began the conversation with my mortgage company. I later completed all the repairs myself with the exception of the roof replacement. The roofing contractor finished work on XX/XX/2019. We have remained current on all of our mortgage payments since the loan was originated, even through the additional repair expenses.

Complaint: My mortgage was sold to Rushmore Loan Management Services last year. I received a packet explaining how to set up online payments, but this process has never worked. I would get an error message saying that the information I entered did not match what they have in their records, but did not indicate what information might be incorrect. I contacted them after a couple of months of having to send checks for my payments, and the support person I spoke to said that they would speak to their support department and someone would contact me. After another couple of months with no response, I contacted their support number again and the agent had me read back the information I was entering in the online account setup page, and thought that my Social Security number might be incorrect in their system. Rather than fixing it on their end, I had to fill out and mail in a form with the SS number and other information that should already be in my account so that they could " correct '' my information. It's been another couple of months with no response and I've tried twice to set up the online account with the same error message each time. I am not comfortable with a company having this much trouble handling online accounts, and not making an effort to fix the problem handling my mortgage, and if this issue is not resolved soon I will find another financial company to handle my mortgage.

Complaint: Rushmore Mortgage has applied illegally insurance to my escrow account which has obligated me to pay twice for the same risk and coverage. This is illegal. I have contacted them several times and They only answer with no technical explanation. I have provided insurance for the structure of the building were my unit is built and they referred to that insurance as a blanket which is not. This insurance covered the unit as stated in the certificates I have sent since I own that unit.Condiominium policies have specific ISO form the Insurance Service Office which it is not remotely what Rushmore Mortgage intend to portrait. They are requesting an HO6 form which esentially is, content of the unit coverage which for a 800 sqf unit is no more than {$10000.00}. They illegally charged me for insurance for the same value of the loan. Insurance is for the replacement cost value as I have explained them several times. In this case the unit has full coverage of the structures and evrything under a special form insurance which they can obrtain from ISO but They believe that they can do this to offset his own blanket policy which basically is an insurance for their business. CFPB needs to act in this complain because it is damaging many middle class homeowners increasing their monthly payments and creating another recession which at the end of the day damage middle class since the investor receive a bail out which would be also charged to the middle class taxes.

Complaint: On XX/XX/2019 I submitted my mortgage payment online and it was deemed " effective '' on that same day. The monthly statement states that payments must be made before the XX/XX/XXXX of each month or late payment penalties would apply. The company did not process the payment until 3 or 4 days later and proceeded to send a threatening letter on XX/XX/2019 stating our loan was " delinquent '' and that our loan was presently in " Default '' despite the digital portal used to make the payment stating our effective date was on XX/XX/2019. This happened almost identically in XXXX and I called the company and stated I didn't want this threatening letter sent, that also threatens a negative credit report sent to credit reporting agencies, when the system I used is digital and the payment date should be readily available for them to determine that threatening delquincy and negative credit reporting is unfounded in this situation. Moreover, this company does not practice as a typical mortgage company. Their practices are more aligned with that of a collections agency even to the point of attaching a notice stating they are " a Debt Collector ''. We have never missed a mortgage payment and due to the terms of our employment and how we are paid by said employment, this is how we have to make payments at this time. I do not appreciate these threatening letters and I do not deserve to be treated as though we're not paying our mortgage. I want my mortgage sold to a proper mortgage company and not held by this falsely labelled Debt Collections Agency. I should not have to pay for a refinance to have this company removed from my loan for their dishonest practices.

Complaint: My home was damaged in a storm on XX/XX/XXXX. I could not live in it. Insurance did not pay until XX/XX/XXXX. I hired a contractor but he did not do a good job so he was fired before completion leaving almost {$15000.00} on the insurance payout. I asked mortgage company to send check to another contractor. They sent it in the name of the first contractor. During that time it went into foreclosure so I couldnt get the insurance. It sold on XX/XX/XXXX. When it sold I owed XXXX but it sold for XXXX. For some reason it was reduced after foreclosure and was told I owed XXXX and it sold for XXXX. I wouldnt sign the hold harmless because of the insurance. In XXXX it was transferred to RUSHMORE LOAN MANAGEMENT and they started trying to collect from me. I called and asked about the collection explained the foreclosure and asked about the insurance funds which were being held in restricted escrow. For two months no one could explain. Then I was told I would not get it it would be sent back to the insurance company. I received another request that I pay and called again. This time I was told I owed nothing and but they were putting a claim against the insurance funds and would not give me any information such as how much or why.

Complaint: I started talking to Rushmore home loans about a possible modification in XXXX of last yr because I was having trouble making the mortgage payment a 9 % interest rate. I am upside down on value and can not refinance without having to pay the mortgage down. By XXXX, no resolve had been made. They kept asking for updated financials about every 30 days and said their review process takes 30 days more. I got frustrated with waiting on their answer and contracted with XXXX XXXX who said they could negotiate a lower payment with Rushmore since my rate was 9 %. I had to go through the same process of submitting financials in XXXX, update in XXXX, XXXX and XXXX, when finally Rushmore has offered a modification to change my payments from {$1800.00} to {$2400.00}. How does this help me???? I am at a complete loss, because I started this process as a hardship request to lower my payments an stay in my home.

Still no assistance in helping. Therefore, I went to my bank and REWIRED ANOTHER PAYMENT. XX/XX/XXXX - XXXX CST resent ANOTHER wire transfer with an additional cost to me of {$25.00} -- Also, contacted XXXX XXXX on XX/XX/XXXX and they have record from XXXX , Rushmore Loan Management Services received funds XX/XX/XXXX. Trace # is XXXX. XX/XX/XXXX - again called Rushmore to give them information that I just wired ANOTHER PAYMENT and was told to call back on Friday, XX/XX/XXXX to verify they received. XX/XX/XXXX - called and they verified payment received and closed account. I asked about next step in resolving credit reporting and also let them know they now have received TWO payments from me. Gave them additional information again for THEIR bank with a tracking # XXXX. Their records indicate a follow up is needed by me next Wednesday, XX/XX/XXXX. Asked them to report to credit agencies their reporting that the account was not delinquent which affected my CREDIT SCORE greatly. They indicated they would send to consumer affairs department for investigation however it is still under investigation. They offer no customer service to assist in rectifying the situation other than the customer doing all the calling ; following up. I was told to call XX/XX/XXXX, or I can mail/fax communication and wait again for reply. There is no other communication other than the one customer service line and you are unable to speak with anyone else ; no supervisor or anyone other than the rep on the phone. This loan was first taken from XXXX XXXX XXXX and the account was turned over in XX/XX/XXXX to Rushmore Loan. In six years paying the mortgage for a payoff amount of {$0.00} this company has ruined my credit and is making no attempts to assist in correcting the problem. As of today XX/XX/XXXX, Rushmore has now an additional {$73.00} due to the double payment in which they can not tell me how or when the payment will be reissued back to me. Again, no one to speak with at all to assist in resolving issue. I have made every attempt possible to rectify the situation with no assistance whatsoever from Rushmore other than being treated like an individual who is trying NOT to pay a {$0.00} debt when I clearly paid a {$15000.00} debt I owed timely. I am looking for restitution of my {$73.00} over payment ; in addition to clearing my credit report of false information.

Complaint: I have received a loan modification packet from Rushmore Loan Management Services and have submitted all documentation they have requested to them fax. Im in review but my foreclosure sale date is still showing online as active on XX/XX/XXXX. Im scared and do not know what to expect from the company. Im working with them but do not know if they are willing to do the same and follow the California Homeowners Bill of Rights Act. As part of this bailout, on XX/XX/XXXX, the United States Government took over XXXX XXXX and pumped billions, which in XX/XX/XXXX, then Treasury Secretary XXXX XXXX said as much as {$200.00} XXXX would be pumped into XXXX XXXX and XXXX XXXX, each, which was separate from the {$700.00} in TARP funds given out to other lenders. 1. The guidelines issued by the United States Treasury set forth a detailed process whereby a participating servicer, either action or not acting through its subsidiary, must : a. identify loans that are subject to modification under the HAMP program, both through its own review and in response to requests for modification from individual homeowners ; b. collect financial and other personal information from the homeowners to evaluate whether the homeowner is eligible for a loan modification under HAMP ; c. institute a modified loan with a reduced payment amount as per a mandated formula, that is effective for a three-month trial period for borrowers that are eligible for a modification ; and d. provide a permanently modified loan to those homeowners who comply with the requirements during the trial period. Whether the homeowner qualifies for a modification or not, participating servicers are also required to provide written notices to every mortgage borrower that has been evaluated for a loan modification, whether or not the borrower has been found eligible. HAMP and its associated directives also set prohibitions against certain conduct including demanding upfront payments in order to be evaluated for a loan modification, instituting or continuing foreclosures while a borrower is being evaluated for a loan modification, assigning a single point of contact, maintaining an adequate level communication with borrowers, maintaining proper caseload to ensure HAMP objections are met, and restrictions on the way a servicer may report the borrower to credit reporting agencies. All servicers have systematically failed to comply with the terms of the HAMP directives and has regularly and repeatedly violated several of its prohibitions. Now that HAMP is over and expired due to servicers prolonging these modifications they are now proceeding with other alternatives. Under HAMP, the federal government incentivizes participating servicers to make adjustments to existing mortgage obligations in order to make the monthly payments more affordable. Servicers receive at least {$1000.00} for each HAMP modification. However, this incentive is countered by a number of financial factors that make it more profitable for a mortgage servicer avoid modification and to continue to keep a mortgage in a state of default or distress and to push loans toward foreclosure. This is especially true in cases where the mortgage is owned by a third-party investor and is merely serviced by the servicer. However, this incentive is countered by a number of financial factors that make it more profitable for a mortgage servicer such as Rushmore Loan Management Services, LLC to avoid modification and to continue to keep a mortgage in a state of default or distress and to push loans toward foreclosure. This is especially true in cases where the mortgage is owned by a third-party investor and is merely serviced by Service companies because Service companies do not carry a significant risk of loss in the event of foreclosure. California Business and Professions Code 17200 et seq., also known as the California Unfair Competition Law ( UCL ), prohibits acts of unfair competition, including any unlawful, unfair, or deceptive business act or practice as well as unfair, deceptive, untrue or misleading advertising. Rushmore Loan Management Services, LLC and all other previous servicers and their Investors conduct was unlawful in that : They illegally began and prosecuted the non-judicial foreclosure based on the lien to the 1st Deed of Trust, despite i was not in breach of payments on said lien ; They engaged in the uniform practice of requesting unnecessary documentation, seeking repetitive submissions of the same documents, and never rendering a decision, and in doing so, such activity provides the basis for an unfair inquiry and could deceive the public because it places burdensome requirements on me that served no purpose but to provide a basis for either engaging in Dual Tracking by selling my home and by denying loss mitigation options, such as loan modifications ; They failed to properly consider loan modification applications before trying to sell my home. 1. On information and belief, Rushmore Loan Management Services, LLC does not own a significant majority of the loans on which it functions as servicer. 2. Economic Factors that discourage Rushmore Loan Management Services, LLC from meeting its obligations under HAMP by facilitating loan modifications include the following : a. Rushmore Loan Management Services, LLC may be required to repurchase loans from the investor in order to permanently modify the loan. This presents a substantial cost and loss of revenue that can be avoided by keeping the loan in a state of temporary modification or lingering default. b. The monthly service fee that Rushmore Loan Management Services, LLC, as the servicer, collects as to each loan it services in a pool of loans, is calculated as a fixed percentage of the unpaid principal balance of the loans in the pool. Consequently, the modifying of a loan to reduce the principal balance results in a lower monthly fee to the servicer. c. Fees that Rushmore Loan Management Services, LLC charges borrowers that are in default constitute a significant source of revenue to it. Aside from income Rushmore Loan Management Services, LLC directly receives, late fees and process management fees are often added to the principal loan amount thereby increasing the unpaid balance in a pool of loans and increasing the amount of the servicers monthly service fee. d. Entering into a permanent modification will often delay a servicers ability to recover advances it is required to make to investors of the unpaid principal and interest payment of a non-performing loan. The servicers right to recover expenses from an investor in a loan modification, rather than a foreclosure, is often less clear and less generous. e. Fixed overhead costs involved in successfully performing loan modifications involve up-front costs to the servicer for additional staffing, physical infrastructure, and expenses such as property valuation, credit reports and financing costs. 3. Rather than allocating adequate resources and working diligently to reduce the number of loans in danger of default by establishing permanent modifications, Rushmore Loan Management Services, LLC has serially strung out, delayed, and otherwise hindered the modification processes that it contractually undertook to facilitate when it accepted XXXX of dollars from the United States. Rushmore Loan Management Services, LLC delay and obstruction tactics have taken various forms with the common result that my loan serviced by Rushmore Loan Management Services , LLC, in which im eligible for permanent loan modifications, and have met the requirements for participation in HAMP, have not received permanent loan modifications to which iam entitled. 4. By failing to comply with the California Homeowner Bill of Rights ; specifically, by engaging in the unlawful practice of Dual Tracking, Rushmore Loan Management Services, LLC has left me in a state of despair and panic as I seek a loan modification from Rushmore Loan Management Services, LLC, only to have my home wrongfully, oppressively and illegally sold out from under my feet. Here is some information from previous servicers and what has happened. I received a loan modification package from XXXX XXXX with a proposal trial period payment for 3 months in the amount of {$3600.00} which is around {$1700.00} over the amount i used to pay before to XXXX XXXX XXXX. My payment was {$1900.00}. How can i afford to pay more then what i couldn't pay before in the first place? I have spoken to a lot of my close friends who were in the same situation as me and around the same loan amount and property size, they have received a very good loan modification of around {$980.00} a month, another friend received a loan modification in the amount of {$660.00} a month. How can this be that they are receiving loan modifications to help them stay and pay for their home while i can not even get a close amount to my old payment of {$1900.00}? Please help me as this is getting out of hand and Im worried for my family and losing my home to this banking scam. It seems to me that they are just transferring loans to get away from giving out a loan modification. I have sent Rushmore Loan Management Services my full Request for mortgage Assistance package and they have received it with no error. But while in review I still show that the sale is scheduled and coming up.

XXXX I received the attached denial notice from Rushmore today. I am going to escalate this with another CFPB complaint in addition to the attorney general. Rushmores opinion of fair market value is not cohesive with the facts which we provided to demonstrate the true fair value of the subject property. Failure to lower the value expectations is going to cause a foreclosure when there was a viable alternative available via a short sale and consideration of the offer we submitted that is fairly priced based on current market conditions. Complaint: This loan was transferred on XX/XX/XXXX from previous lender XXXX. I received an escrow analysis dated XX/XX/XXXX, that stated the shortage amount was {$1700.00}. I started pulling documents since neither my hazard insurance or real estate insurance had gone up significantly. By doing this I learned that between my hazard insurance and real estate tax the difference from XX/XX/XXXX was a {$32.00} increase, which is significantly different than the shortage amount shows, that is {$1700.00} difference. So where did the money go? I called Rushmore since the numbers were not adding up, I finally spoke with a supervisor name XXXX, who determined when the loan was purchased from XXXX the PMI insurance was never removed and continued to be paid. XX/XX/XXXX I applied for the PMI to be removed from the loan. I received a letter from XXXX stating that as of XX/XX/XXXX the PMI insurance would be removed and the monthly payment would be lowered. XXXX, stated she had the documents stating the PMI insurance had been paid for 12 months, apparently XXXX adjusted the amount of the payment to reflect no longer having PMI, but did not ever stop paying it. When Rushmore purchased the loan PMI continued to be paid. XXXX did get the PMI removed from the account and since I have not been billed, however I have not been reimbursed for the 12 months worth of PMI taken from my escrow account. This problem was discovered in XX/XX/XXXX, initially XXXX communicated well, however I left multiple messages that were never returned and even tried to contact customer service supervisors and would be promised a call back which I never received. XXXX informed me that the incorrect payments made would have to be refunded and then would be applied to escrow if there was a overage I would be refunded. XX/XX/XXXX I called Rushmore back and spoke with supervisor XXXX XXXX, he said he would file a refund request with FHA to be reimbursed the amount of {$1400.00}. I received one follow up call with no additional information. I then received another escrow analysis that states I had a shortage of over {$1900.00}, and that my mortgage payment will go up in XX/XX/XXXX. I left XXXX several messages without reply. XX/XX/XXXX I called Rushmore once again, I spoke with supervisor named XXXX, who insisted he would look into this and return my call XX/XX/XXXX, I never received a call back. XX/XX/XXXX I called and spoke with a manager named XXXX, who promised to look into this situation and call back XX/XX/XXXX. She followed up with at least a phone call but no additional information. This is not a mistake of the customer but of the loan provider. Im demanding the money that was taken from my escrow account to be accounted for. I have gone months without contact or resolution to this problem. Please reply with written correspondence to resolve this issue.
