Complaint: PREVIOUS COMPLAINT : XXXX SUBMITTED ON XX/XX/2019 Our present offer of a price at {$290000.00} that does not request seller concessions is beyond reasonable and shouldnt be declined when your own BPO value is less and values the property at {$280000.00}. CFPB has regulations in place to enforce servicers/investor to allow foreclosure alternatives such as short sale when a fair market value offer is presented. When we submitted the current buyers original offer of {$290000.00} which included a request for 3 % seller concessions ( closing costs ) and you said the 3 % they requested wouldnt be approval so in return they removed their closing costs request and because of that reduced the offer amount as they are not willing to pay so much above the market value when having to pay so much out of pocket in addition. I have attached the offer and supporting documents again to the reply. I ask that you PLEASE SUBMIT and encourage approval. Our present offer of a price at {$290000.00} that does not request seller concessions.

Complaint: My previous loan servicer XXXX XXXX had sent me documents that they were transferring my mortgage to Rushmore Loan Management Services in XX/XX/2019. The transfer took affect on XX/XX/2019. I made my XXXX monthly mortgage payment on XX/XX/2019 to XXXX XXXX. It was an online payment.The documents that came from my new servicer, Rushmore said I had not made a mortgage payment in XXXX. XXXX improperly applied my entire payment to principle. I have been calling Rushmore and XXXX since early in XXXX to get this matter straightened out. Both companies keep telling me the other company has to correct the issue. XXXX told me numerous times they would handle the matter and would give me a call back. Each time they lied. Now they say they can not do anything about it. My loan is showing that I am behind every month and is reflecting negatively on my credit report.

Complaint: We refinanced our home loan in XXXX. We did a no escrow loan and paid our insurance and taxes in full when due. In XX/XX/XXXX we paid our flood insurance in full in the amount of {$700.00}. In XX/XX/XXXX our insurance company received a check from the mortgage company for the flood insurance. Since the policy was paid in full a refund check was sent to the mortgage company which they never cashed. They notified us in XX/XX/XXXX that they were putting escrow on the account for the flood insurance and that our payment would increase in XX/XX/XXXX. We notified they and they acknowledged that this was a non escrow loan and that the escrow amount would be removed. In XX/XX/XXXX I received my XXXX statement with the escrow amount on it and the payment increased. We had our insurance company issue another refund check which was sent to them on XX/XX/XXXX. On XX/XX/XXXX they returned the check. I had another check sent on XX/XX/XXXX. The company is refusing the refund to force escrow on a no escrow loan.

Complaint: Rushmore Loan Management Services has arbitrarily imposed " personal insurance '' policy on my account when I have already provided insurance policy. They are charging my escrow account {$100.00} per month since XXXX. They refuse to stop stealing my escrow money for this fraudulent insurance policy. My insurance policy provides all coverage required by my loan and has been in place constantly from XXXX. I have XXXX loans with Rushmore, all originated with same lender, all have identical insurance provider BUT Rushmore is illegally stealing from this one account with their self imposed " personal insurance '' policy. I want these withdrawals stopped and all funds returned to my escrow account.

Complaint: This is XXXX XXXX with XXXX XXXX XXXX XXXX XXXX. I have been attempting to obtain a payoff from Rushmore Loan management and continue to get the runaround. I have faxed 3rd party authorization multiple times i have fax confirmations. I am only trying to get a payoff statement so we can close on the customers sale and payoff rushmore. They are bouncing me around, no response no ETA. Again I am trying to PAY THEM OFF i am with a title and escrow company and can wire their funds to them by tomorrow if they would just issue a payoff statement. They are so consumed with negotiating debt they don't know what to do when someone just needs a payoff statement

Complaint: I have filed a complaint in the past regarding XXXX XXXX utilizing wrong information to calculate my request for a loan modification so I could keep my house after my divorce. Due to this error, which really should be checked into for private investor loans not just XXXX, XXXX, and XXXX, my house was put into foreclosure as I had to stop paying in order to procure a short sale that the divorce courts ulitmately ordered because XXXX XXXX would not work with me to get my ex husbands name off the loan. Ultimately, during the right to reinstate period I ended up with a short sale in XX/XX/XXXX. I have just been notified that my " LOAN '' was sold to Rushmore Loan Management Services effective XX/XX/XXXX, 3 months after the approved and closed short sale. I have been in touch with Rushmore Loan management XXXX XXXX XXXX as well as a general Loss Mitt representative regarding the sale of the house multiple times already. Now they are threatening foreclosure and hurting my credit rating instead of doing their due dilligence. Between XXXX XXXX and Rushmore Loan Management, I have incurred more XXXX issues and feel this is XXXX XXXX retribution against me because I have filed multiple complaints against them. This is causing additional stress to myself and my family not to mention now I have to watch my credit for false reporting AGAIN!!!! This is continues Harrassment on the part of XXXX XXXX and now Rushmore Loan Management.

Complaint: My mortgage loan transferred from XXXX XXXX to Rushmore loan Management Services LLC on XX/XX/2019. At the time I was only one month behind in my mortgage but due to an escrow problem on taxes I was unable to make the payment because the amount was not correct and I was being transferred to Rushmore loan Management Services LLC. As of today I owe XXXX and XXXX payments. I made a payment with Rushmore loan Management Services LLC on XX/XX/2019 at XXXX in the amount of {$520.00} with my account number through XXXX XXXX XXXX XXXX as instructed by the company. The attached letter shows it in writing that I can send my payment that way. I paid an additional {$9.00} for money in minutes. I called Rushmore loan Management Services LLC as soon as I made the payment and reported the mtcn number to the representative. The representative stated the payment would post by the end of business day since it was made before XXXX XXXX. as their website States as well.. it is now XX/XX/XXXX XXXX p.m. and I called Rushmore loan Management Services LLC and they told me it could take up to 4 days to post. I told them that was against the law I paid extra money to get it to you as you instructed and you're not accepting my money from XXXX XXXX. I have been hung up on numerous times while trying to call Rushmore loan management Services LLC. I spoke to a supervisor named XXXX at XXXX this morning in regards to that payment and why it has not posted. I'm told again it could take up to four days which is really an ACH a routing and account number transaction not a XXXX XXXX XXXX XXXX XXXX in minutes I paid extra for. I spent 5 hours of my time yesterday trying to find out the correct information in regards to the payment I sent. I spoke with a representative XXXX XXXX on XX/XX/XXXX the day I made the payment late before they closed and she stated it would post by the end of business on XX/XX/XXXX. XXXX also told me she would give me a call today by end of business day with an update on my payment. I have yet to receive that phone call I am told I have an assigned single point of contact named XXXX who has never called me. I had a cease-and-desist on my account and I sent XXXX via email the right to lift the cease-and-desist and I still have not received a call from my single point of contact that I just found out about today whose name is XXXX and his number is XXXX - XXXX - XXXX in which I got voicemail. I have received false and misleading information from this company, I have been hung up on numerous times, I feel they are sabotaging my mortgage and trying to throw me into foreclosure. I told the representative I had XX/XX/2019 payment as well but I was afraid to pay because you won't post the payments. The representative keep saying I owe three months and until it post that's what she has to tell me even though they are able to call XXXX XXXX hit option as receiver and verify my funds very easily in which they refuse to do so I told the representative I was 1 month behind when I transferred and due to their in accuracy, unprofessionalism, and refusing to post my payment is pushing me into foreclosure. The representative said they have a cash Department that posts the payments and that they are behind. I told the representative that is not my problem and that you have no right to hold my money and not post it. I also was given an email address to send my revised tax information and a picture of the XXXX XXXX receipt in which I did XX/XX/2019. XXXX told me she would give me a call today XX/XX/2019 and verify that the payment was posted and I never received that phone call.. I just got off the phone with XXXX XXXX tracking my payment and Rushmore loan Management Services LLC still has not accepted the money. I just got off the phone with a representative at your company the Consumer Financial Protection Bureau and he stated I definitely need to file this complaint definitely ASAP. I am sending an attachment of a letter from Rushmore loan Management Services LLC showing proof of the quick collect at the bottom of the page showing code City and code state. I have also attached the XXXX XXXX receipt payment as instructed by the representative I talked to at the Consumer Financial Protection Bureau. I told the representative Rushmore loan Management Services LLC that it was money in minutes and I paid for that all she can state is doesn't know when it'll post but it should within 4 days. The representative at the Consumer Financial Protection Bureau stated if they try to throw me into foreclosure by filing this complaint and sending you the proper documentation it would not hold. I am absolutely livid to the fact that I can not receive accurate information from this mortgage Servicing Company. I feel they are doing this on purpose and want to foreclose on my home. I'm scared to make my XXXX payment because they don't post the payments. Rushmore loan Management Services LLC are the ones causing me to be delinquent and reporting negative and inaccurate information to the credit bureaus in my name.

Complaint: My mortgage was purchased from XXXX XXXX by Rushmore Loan Management. Rushmore has seemed sleazy from the get-go. As a result, I send all my mortgage payments " 2 day mail '' in case Rushmore lies about when they receive my payment and charge me late fees. Well, sure enough, they have charged me late fees when they have received the payment on time. I have documentation from Rushmore that they assessed late fees on XX/XX/2018, when they had already received my payment ( they received my mortgage payment at XXXX XXXX on the XX/XX/XXXX ). Rushmore was only to assess late fees on payments received after the XXXX of the month. Even though they had my payment on the XXXX ( they admitted to it ) they assessed a late fee of {$100.00} I have never paid late!!! Rushmore has assessed me a total of {$540.00} in late fees even though they have always been paid on time. I continue to faithfully pay my mortgage on time ( for 20 years ). Never late! But Rushmore has assessed late fees on payments they receive on time. Now, Rushmore has put my loan in default for not paying their bogus late fees ( All payment have been made ... and made on time ). I have no doubt that Rushmore has planned this all along. I see that your bureau has received 1,251,852 complaints about Rushmore. I have tried repeatedly to have Rushmore take care of this, but they won't fix it. I need your help! They need to be shut down, fined, etc.!! Thank you
