Complaint: XXXX gave Rushmore Loan Management my loan to service. Even though they are a little bit better than XXXX, I dont care for this company. For about two years, they have been reporting a deferred interest payment as a balloon payment on my credit file. The deferred interest payment is {$6100.00}. They are a mortgage company, so they are aware that both are two different things. I do admit to falling behind due to medical illness since late 2017. But, I always bring my account up to date. My account has been up to date since late XXXX. But, on my XXXX file right now, they have my actual payment amount of {$1600.00} ; when my payment is {$760.00}. This is a false actual payment and should not be there. I requested a billing statement mailed to my home. They said that they sent it. But, I have not received one yet. I notified Rushmore that I won my property tax appeal. The escrow department said that I have to wait for a bill for them to modify my mortgage payment. I am so sick of them trying to make me and people like me pay more interest. I consider the fact that they are reporting false adverse information as discrimination. They want to keep me paying this ridiculous interest rate. But, I will be out of their clutches before the end of the summer!!!

Complaint: On XX/XX/XXXX I sent a letter to my mortgage company Rushmore Loan Management Services ( RLMS ) requesting release of my Private Mortgage Insurance ( PMI ). The letter is attached. I stated that my current loan value was {$78000.00}, and my property value was {$100000.00} according to the appraisal that the loan was based on. RLMS responded XX/XX/XXXX stating that my request was denied because the loan-to-value ratio had not reached 80 % based on the original value of the property. The response is attached. I then submitted a dispute via online secure message on XX/XX/XXXX explaining that I disagree with their loan-to-value ratio calculation. The correspondence is attached. I stated that the appraised value of the home was {$100000.00} ; the negotiated purchase price was {$90000.00}, and the original loan amount was {$85000.00}. Based on this information, my loan-to-value ratio was less than 80 %, thus I am eligible for release of PMI per Federal law and the Homeowner 's Protection Act of 1988. RLMS responded on XX/XX/XXXX saying that my current loan to original value is 78.2 %, but that they were still not releasing my PMI, but they wanted me to pay $ XXXX {$1000.00} to have an appraisal first. The response is attached. I am asking the CFPB to review this case and request that RLMS release my PMI as required by Federal law and the Homeowner 's Protection Act of 1988.

Complaint: Rushmore took over servicing from XXXX I requested verification of the debt and payments from XXXX of XXXX. Only verification I ever received no matter how many times I disputed the debt with XXXX XXXX & XXXX and the servicers was a printout of payments charges fees. There were over payments that were never applied to my mortgage the amounts were just adjusted out of the account. I entered in to 3 modifications each time they held the payments in suspense ( in one instance the payment was not applied to the account for 2yrs ) Because the payments were put in suspense they claimed I defaulted on the modifications. The balance they say I owe as of XX/XX/XXXX was {$120000.00} yet I made modification payments after XX/XX/XXXX. XX/XX/XXXX the foreclosure judgement was entered by XXXX XXXX and XXXX while I was completed a modification plan with Rushmore. XXXX XXXX and XXXX were also Dual tracking when I was in a modifcation with XXXX and with XXXX. They never served the 90 day notice they never acknowledged the numerous debt disputes. XXXX of XXXX Rushmore denied a modification but did not provide information as to the rules regarding the modifications they also claimed they could not consider it because it was less than 37 days when the sale was not until XX/XX/XXXX Despite the mortgage stating that I had the right to payoff the mortgage up until 5 days before the sale XXXX and XXXX XXXX and XXXX did not send the Payoff until after the sale despite the request being made in XXXX giving them ample time to send the payoff. They effectively breached the contract. The County Supreme Court disregarded the blatant lack of jurisdiction did not request a traverse hearing despite proof XXXX XXXX was never served Rushmore XXXX XXXX and XXXX also have ignored this fact. They are now trying to evict me after breaking the law numerous times causing me emotional distress. They have broken numerous laws in the Frank Todd Act

A forensic audit shows an identity thief used my personal information without permission to create mutual fund investment account securities violating the Privacy Act 1974. I have enclosed : 1 ) proof of my dispute letter to Rushmore Loan Management Services, LLC. 2 ) My Federal Trade Commission Identity Theft Report. 3 ) A copy attached the police report case # XXXX I filed with the XXXX Police department. In accordance with the Fair Debt Collection Practices Act, I am asking you to immediately stop all collection activities about this debt, ALL TRUSTEE SALES, including reports to credit reporting agencies. I also ask that you tell the business where the account was opened that this debt is the result of identity theft and to stop and correct. Complaint: My wife and I just applied for a new loan and learned an existing loan with Rushmore LMS was showing to be included in a bankruptcy. We have not filed bankruptcy and we are current on our loan without ever being late. I called Rushmore and was told my account is in good standings and it's not their fault it shows this way. I was told to call the credit bureau. I asked for a letter and was told I was told I would have to mail a letter to them and then they could respond with a letter. I went on to explain I am applying for a loan and this mistake is very time sensitive. I asked to speak with a manager and was told no, but someone would call me but no promises it will be today. I called XXXX and was told I can file a dispute since Rushmore reported it this way but it would take 30 days. At this time my wife and I can't proceed with a purchase contract due to this mistake and my credit rating is suffering which will cost me a higher interest rate once this is resolved.

Complaint: I originally refinanced my home back in XXXX of XXXX, with an XXXX XXXX XXXX XXXX fixed/variable rate loan. This loan was to be eligible for an adjustable interest rate re-lock every five years, contingent on borrower ( me ) maintaining good credit and repayment record. When my loan was transferred to XXXX XXXX ( due to XXXX XXXX being purchased ), XXXX XXXX respected these terms and offered me a rate renewal lock at the end of my first 5-year period. Fast-forward another four years, and now XXXX XXXX has left the mortgage loan business and handed my loan over to Rushmore Loan Management Services. I am almost at the end of my second 5-year term of the loan, and I spoke with Rushmore on Tuesday, XX/XX/XXXX, to verify that I would in fact be offered a rate renewal at loan-term maturity. I was told " We don't do that '' and instead was directed to download their loan modification application from their website, a multi-page document requiring very detailed information regarding every aspect of my finances -- clearly a new loan application that would require going through an extensive underwriting process. Frankly, I don't care to apply for a new loan at this time, or go through a refinance loan, either. I am current on all of my payments, and have maintained a spotless repayment record throughout the entire term of my loan to date. My credit status has also maintained a very high rating. I have a perfectly good existing loan, and I see no reason why my loan 's original terms and benefits should not be honored and upheld. I am very disappointed that a mortgage service provider should arbitrarily decide to change a customer 's existing loan when they have no right to do so. Thank you for your attention to this matter.

Complaint: I was approved for a modification in XXXX for 40yrs in the amount XXXX a month. This was being paid to XXXX and then it was transferred to Rushmore in XX/XX/XXXX. I was never late with my payments. I received a letter stating I had to reapply since the transfer of servicers took place or pay all the amount I owed on the loan. I am currently sending them my payments which I originally was approved for and my statements shows the amount going into a special account versus lowering my principal. I did send the application they requested along with additional docs although i keep getting calls of the same missing paperwork.

Complaint: 1. We did have a loan modification approved XX/XX/XXXX XXXX. XX/XX/XXXX hardship hit again because of a decrease in overtime at work and a stall in the pay increases that were promised from the collective bargain agreement and the cost if legal fees for my wifes abusive ex husband for custody of the children. 3. Between early XXXX to XXXX of XXXX infield numerous loss mitigation packets to when I was told and denied modification because they said I had to wait 3 years since the last modification XXXX. This is when I was with XXXX and was also denied forbearance because I was not unemployed. 4. XXXX of XXXX I filed for chapter XXXX to save my house and do good business by bringing XXXX to the table to negotiate a good faith deal in both of our favor. Even during that time I bankruptcy, another loss mitigation packet was denied because they said it has not been three years since last modification, even in knowing that the debt to income would have been favorable because the debt would be wiped clean and I also had two cars voluntarily repossessed to improve the debt to income ratio. 5. Due to legal counsel and what XXXX wanted, it forced my bankruptcy payments to increase therefore I saw fit to let the chap XXXX be dismissed and best to wait the 180 days and file a bankruptcy XXXX. The chapter XXXX was dismissed in XX/XX/XXXX and in XX/XX/XXXX our new mortgage serving company was XXXX XXXX. 6. Even before the bankruptcy dismissal before and after, XXXX XXXX mentioned on numerous time to me that they can contact the VA and get the 3 years waived and get the modification packet and they never contacted the VA when I called the VA. I wish I would have gotten it in written. XX/XX/XXXX XXXX. Then in XX/XX/XXXX I filed a bankruptcy XXXX. The bankruptcy was successful and XX/XX/XXXX all debt secured and unsecured was discharged for except for the mortgage with Rushmore ( current servicing company ) and student loans. 8. Late XXXX, I found out that Rushmore was my new servicing company and once I contacted them they informed me that it was not a 3 year wait. I was told my them that the VA loans wait time between modification is one year or 3 years. I was denied a forbearance because I was not unemployed by Rushmore. 9. XX/XX/XXXX, after the chap XXXX was discharged I submitted another loss mitigation packet with Rushmor. I was informed XX/XX/XXXX. Via telephone and letter by Rushmore that I was denied a loan modification because my income to debt ratio to them was inclusive, which was a lie because they knew that all debt was discharged in chapter XXXX. 10. Then they were always aware of my increasein income of {$12000.00} to XXXX ( not including overtime ) a year because of my promotion to be a supervisor and this was made known in the loss mitigation packet. I submitted supportive documents. Just again to reiterate that I was told numerous times by Rushmore that I was misinformed that I had to wait 3 years. Now from my understanding I thought that the past balance of what I owed for the mortgage was supposed to be discharge becaue no one argued it from Rushmore. That also throughout the whole process between XXXX, XXXX and Rushmore I had been lied to on how a loss mitigation packet could be approved and how long to wait in between a loan modification. Between XXXX and XXXX they have intentionally lied to me about how to get approval so they can get a foreclosure sale and for me to lose my home. With Rushmore sent a packet with the appraisal of my home in the middle of my packet review that I submitted with the intention of not approving the packet. They use the lie of insufficient income to debt ratio as an excuse to get a foreclosure sale knowing it was discharged. Also if see attached files. Page 7 that I uploaded from the loss mitigation packet shows my income. When you look at there denial letter you will see they intentionally lowered my income reported to deny me. Also they lied about my debt because they knew all of unsecure and some secure debt was wiped out in the bankruptcy XXXX. They never took my pay increase with guaranteed bonus of XXXX dollars each year.

The mortgage servicer changed from XXXX XXXX XXXX to Rushmore Loan Services XX/XX/2017. Rushmore refused to honor the modification with XXXX XXXX XXXX after I made all trial payments. Rushmore Customer Service stated I would be receiving the permanent modification agreement. I never received those papers Rushmore has increased my mortgage payment to {$2100.00} and scheduled my home for foreclosure sale. I requested they please correct my mortgage payment. They have been difficult to work with and refuse to assist me. I do want to pay my mortgage and I don't want to lose my home. Please! Please! Please Help
