Complaint: Rushmore Loan Management Services bought my $ XXXX home equity loan for home remodeling. In the middle of remodeling, we detected water damage to the floors, and XXXX XXXX issued a {$25000.00} check to replace the floors. Instead of paying for bun engineered floors, Rushmore deposited the check to their escrow. Thus I had to pay my contractor for urgent demolition ( to prevent further damage ) and materials. After a fight, Rushmore paid {$16000.00} to my contractor ( now the contractor completed the floors and is paid in full ). XXXX was satisfied with floor repair and released the additional {$2400.00} depreciation check. However, Rushmore fails to release the remaining {$8700.00} to me ( I had to use my money designated to remodel the bathroom ). Thus I can not rent or live in my condominium as the bathroom is not finished.

Complaint: Rushmore refuses to verify the accounting of my loan they have NO RECORDS from the preious Servicer 's and no one knows where my overpayments were applied. I have REPEATEDLY REQUESTED MY SERVICING FILE AND TO DATE HAVE NOT RECEIVED IT. They fraudulently foreclosed on my home and are trying to evict me despite denying my right to redemption, my right to have the debt validated, my right to know where my Money went There is over {$96000.00} in payments that someone has.

Complaint: I have had problems with Rushmore Mortgage, my payments keep going up - I paid the shortage amount for escrow but this was not applied, instead the payments went up by almost {$200.00}! I spoke to customer service rep, on XX/XX/XXXX, I was on the line with them for over an hour, I still do not have an answer as to why my payments are going up, I would like to have my mortgage account audited and find out why this is happening. Complaint: I can not convey how inadequate this company is. They bought my home mortgage loan from another provider three months ago and have screwed up my payment two out of the three months, XXXX and XXXX of 2019. Two out of the three months they have had my loan Ive had to go get a copy of my bank statement and the canceled check to provide to them to get it straight. If what has happened to me thus far is any indication of what the future holds I wouldve been much better off taking out a loan through my local savings and loan and paying {$15000.00} more over the life of the mortgage. Not worth the savings to have to deal with the XXXX they put you through.

Complaint: I purchased an FHA home 2 years and I was told that my loan is assumable. When I contacted Rushmore loans they told me that they don't do assumable loans and that FHA doesn't do assumable loans. They called XXXX and told me that i could call XXXX and they would tell me that FHA doesn't do assumable loans. When i contacted them they said they don't know why they would say that then they gave me me FHAs phone number. I'm looking to have someone assume my loan because I'm moving out of state and I'm told they don't do that.

Complaint: Rushmore is refusing to open my loan modification review because they state the " investor which is XXXX XXXX XXXX XXXX. We had a 2nd loan modification review which left out a great portion of our income and now Rushmore is stating there is a hard stop on the file which wont allow for another review. We never got approved for a loan modification in the past and the 2 reviews we had were done so without the full income as Rushmore ignored some of what we earn. The last review should not count towards my second review or at the very least the second review should be re-opened and the correct income should be looked at. We are prepared to make payments starting today and we can even put down {$15000.00} as a good faith deposit. I called the investor and they said they have no such rule. XXXX XXXX XXXX still continues to block my loan modification review which is a violation of federal guidelines and is doing an unjust harm to my family.

Complaint: The original loan amount of XXXX started with XXXX XXXX in XXXX. The questionable loan balance of $ XXXX was transferred to Rushmore in XXXX of XXXX. with my payments to Rushmore over the life the loan, the balance fluctuated respectively to $ XXXX XX/XX/XXXX, $ XXXX XX/XX/XXXX, $ XXXX XX/XX/XXXX. with no itemization of hidden fees and charge, depending who you talk to the balance id different each and every time. Rushmore refuses to sit down with me in person to hash this up for good. XXXX XXXX, the VP of mitigation at Rushmore ( nice guy ) has been my only contact over the years regarding the ups and own of my life. They mailed a DEBT VALIDATION NOTICE, which I disputed in wiring. While XXXX and I were executing our mutually agreed upon course of action, and now pending out court hearing on XX/XX/XXXX, they preemptively filed NOTICE OF DEFUALT on me. MUTUALLY AGREED UPON ACTION PLAN From : XXXX XXXX XXXX Sent : Wednesday, XX/XX/XXXX XXXX XXXX To : 'XXXX XXXX ' Subject : RE : [ EXTERNAL ] Call ACTION PLAN Hello Mr. XXXX As mentioned on our call today, its always good to talk to you, here are our takeaways : 1. Youre going to provide me with a dispute letter regarding the Credit Bureau reporting and the details behind what / why is being disputed a. I will provide you with my address to send the dispute XXXX XXXX XXXX XXXX. XXXX CA XXXX ( please send to my attention ) b. You will also include your updated mailing address in the dispute 2. Complaint: I have made payments that were not applied to my Mortgage and loan modifications which in turn caused the me to be considered to have defaulted on the agreements I have requested that XXXX XXXX XXXX Such and XXXX and XXXX to show me where the payments went. Not XXXX of the Servicers showed where the payments went and they foreclosed and sold the house and are now trying to evict me. The only verification I have received was a print out of payments received by XXXX which show payments that were received but not applied to the mortgage principal. They claim that the balance was {$120000.00} as of XX/XX/2010. They show payments received after that date yet they did not come off the principal and they show I did not default on the modification. They also don't show an XXXX payment they received. XXXX claims they have repeatedly verified the debt yet they show NO PROOF OF WHERE THE PAYMENTS WERE APPLIED NONE. All they do is claim I have supplied no proof yet i repeatedly supply it. I HAVE ONCE AGAIN ATTACHED PROOF OF THE PAYMENTS RECEIVED WHERE IS PROOF THE MONEY WAS APPLIED TO MY MORTGAGE TO MY MODIFICATION!!!!!!
