Complaint: We are closing on our home and were well aware our escrow would be paying our school taxes around the same time of closing. So i proactively called my mortgager Rushmore loan management on XX/XX/19 inquiring if my escrow payment could be held in order to close on my home in a timely manner. I was told by rushmore that they could not hold my school tax payment, i was told that they had not received my tax bill at that time either. I called back on XX/XX/19 inquiring what can be done as the funds have been withdrawn from my escrow account and was told they will not be sent until the following week of XX/XX/19 and there is nothing they can do. We are now scheduled to closed the week of XX/XX/19 and this is preventing me from clsoing. My attorney needs documentation that the taxes have been paid in order to close and Rushmore now indicates they made a mistake and that the funds could have and should have been held as i requested on XX/XX/19. My closing is now being held up due to their error and my sale could potentially be lost due to their mistakes. I need this fixed, they need to be taught to properly manage my loan. If i lose the sale of my home due to this i will be requesting the full sale contract price from them.

Complaint: I've been struggling for the better part of 8 years, with my mortgage and modifications to it. I've been XXXX since XXXX. XXXX XXXX, XXXX, XXXX XXXX ( XXXX ) has taken their toll. In that time, My mortgage was transferred 3 times in 1-2 year period. In XXXX, XXXX had my mortgage. They accepted my Modification App. and off we went. Not soon after, They returned a my next 2 payments. requiring some additional fees. I was notified by my State Rep. about the EHLP program. ( mortgage assistance ). I applied at several HUD facilities, only to be denied. I filed an appeal to the main office of EHLP, in XXXX and after review, I was accepted. My program was for two years of assistance or {$50.00}, which ever came first.My projected assistance was around {$35000.00} ... I signed the Doc 's. in the summer of XXXX. However the program didn't start until XXXX. The financial partner was The XXXX XXXX XXXX XXXX XXXX. I was still working with XXXX ( Hud council XXXX XXXX, XXXX ) through this process. All the while XXXX was threatening foreclosure. I was {$9000.00} +- in arrears. I was told by XXXX that the first check issued would be to take the mortgage out of default. Then my payment process would start.The program was for me to send XXXX 31 % of my SSDI monthly payment and XXXX would send in the full mortgage payment ( {$860.00} ) per my Modification. All was fine for the first 11 months, my payments to XXXX and from there to XXXX. In XXXX of XXXX, I received a letter from EHLP stating my account was exhausted. That week I also received a letter from XXXX asking for a {$34000.00} +- remittance for ancillary fees and auxiliary fees. The fees ( {$34000.00} ) +- were already taken. After doing some research, it seems all the big lenders had Liaison Officers working in EHLP. The next month my APR. jumped from 3.25 % to 9.85 %. My mortgage payment went form {$860.00} to {$1600.00} a month. I called EHLP ( the Director herself ). Very very helpful. Her EHLP coordinator mentioned to me that some lenders would add fees and such knowing that Federal Assistance was involved. Also it would take monjths and months to audit the transaction and recover some or all of the funds. Nowhere did this $ 34,000+- show in my P & I balance which at the time was {$170000.00}. Still to this day ... The very next month, XXXX changed their name to XXXX XXXX XXXX.The investors changed as well. After several months of discussion, XXXX offered me a Modification. The trial period ( 3 months payments ). Then when my first actual mortgage payment was made, they returned it asking for money for fees and such. Here we go again ... ... Also after inquiring about the {$34000.00}, I was repeatedly told ( by a single point contact ) he had " no idea " nor did the other 3 ( single points of contact ). After months and months of Where's Waldo, I get a notice that my servicer has been changed to Rushmore Home Loans ... and the investors changed as well. XXXX and I decided to contact Sen. XXXX XXXX XXXX office. We applied for a new Modification which was reviewed by XXXX and the Senators office for presentation. The Docs were sent to Rushmore and after several weeks,,, nothing..XXXX called and asked if I'd heard anything ... '' NO " .. XXXX called Rushmore inquiring and was told it's under review. Several weeks later, Rushmore 's underwriter contacted XXXX for some Doc. info. She returned the call with no response. Now I get a call from Loss Mitigation, ( XXXX ) asking what my intentions were with regards to my house. I'm here forever. I asked how the " Modification was coming .... Her response was " What Mod. App. '' I've sent in no less than 5 applications from XXXX XXXX. All denied for one reason or another. Time ran out, My non-borrower contributor ( excellent credentials ) turned down and my daughters $ 400+ board was not accepted. They sent a letter stating my App. reviews were exhausted. Yet I received 2 more in XXXX .... I have most All correspondence since XXXX pertaining to all mentioned above. Now they are Preparing for foreclosure once again. It's been 4 years or so No payments accepted. I've not gotten any foreclosure notices as of Today ( XXXX ) Please Help ... Between keeping up with my health and more so this .... not sure how much is left in the tank.. Thanks for reading ////

Complaint: We called Rushmore Loan Management Services in California on XX/XX/XXXX to request a payoff amount on our home improvement loan. Spoke with someone named XXXX. He said that he could not give us that. I asked why not, & he said it was their policy that they could either fax it to us or mail in about a week. So, today, I tried paying the monthly premium online, and then paying the balance of the amount shown on the page online. It would not let me pay it. We have the funds in our bank account to pay it off. Please help.

Complaint: I contacted Rushmore Servicing and ask to speak with the refinance department. I was told they didnt have one but they would give me to someone that did refinancing for them. I called that company gave them all my information only to be told that they couldnt help me. XXXX XXXX sold thus mortgage to Rushmore. I need to refinance this loan that XXXX XXXX gave me because I am a Senior Citizen and the monthly payment us getting to high for me to handle. I had asked XXXX XXXX to give me a forgiveness refinance loan because the house was inside down. But it isnt a fixed loan so the interest rate and the payment is too high. Complaint: On XX/XX/2019, I received a letter confirming the intent of Rushmore LM to provide me with a repayment plan agreement. The first installment was a down payment of {$2000.00} due on XX/XX/19. ( Incidentally, I did make this payment as per terms. ) Nontheless, the mortgagor 's attorney and forwarded a Notice of Seizure to the Sheriff 's Office, mandating the sale of my primary residence, breaching our agreement. I was served on XX/XX/19. I contacted the attorney and mortgagor, but a cancellation of this notice remains on-hand by the sheriff, who will not release this order. I request a full cancellation given that the foreclosure process was taken to additional steps while I was in agreement. This began after I successfully completed a Trial Modification and was allowed to begin an initial payment plan. The plan offered ( in XX/XX/2019 ) included a Petition of Foreclosure and Sheriff fees at a time when nothing had been filed ( or was in the process of filing ) with the Court. I asked that these fees be re-evaluated given that these legal actions were not taken and fees had not been incurred. Rushmore continued to accept my regular full payment amounts, sent me another Trial Modification package to complete, and then proceeded to file the petition with 10 days of sending the Modification information. I was 101 days past due and making payments at that time. I have faxed my request for re-assessment, and even though I have proof of transmittal, the refuse to acknowledge my request. The lender has repeatedly refused

We have received no statements from Rushmore or information. I had to contact them on XX/XX/2019 for info and sent in a " Will '' and " Death Certificate. This is whole situation is absurd.

Complaint: We submitted a mortgage assistance packet to Rushmore mortgages for a loan modification and was denied based on my credit & says that I have insufficient income. The denial based on my credit does not specify a reason so its unknown and I have no way of defending my self on this, but the denial based on my income is incorrect I am a taxi driver so my income fluctuates every week or daily and I feel its unfair they based their decision on a lower amount instead of looking at the whole year and determining what my average income is. If they would have used my average income I could have easily qualified. It's very unfair that I may lose my home due to someones bad mathematics

Complaint: On XX/XX/2019, I called my HELOC loan servicer, Rushmore loan Management Services, to request that they no longer withdraw this amount of additional principal that I had requested several months before. I requested Rushmore stop withdrawing $XXXX additional principal. I instructed them to only withdraw an additional principal of $XXXX. Their customer representative informed me in XX/XX/XXXX that it was too late to make the change before the XX/XX/XXXX payment was due, but the change would take effect in XX/XX/XXXX. However, in XX/XX/XXXX, Rushmore withdrew $XXXX more than I had authorized. I disputed the additional principal with my bank which upheld the dispute. On XX/XX/19, I received a letter from Rushmore threatening to put me a "certified funds only" if it happens again.

Complaint: Our mortgage was transferred from XXXX to Rushmore Loan Management at the beginning of XXXX. We received a request in XXXX for our HOA condo insurance declaration, which we submitted to Rushmore 's vendor imcovered.com/rushmore. I uploaded the hazard insurance declaration and received an email confirmation that it had been successfully verified. In early XXXX I received another notice asking for verification and again uploaded the hazard declaration to imcovered.com/rushmore. Again I received a confirmation that it had been successfully verified. On XX/XX/XXXX I received a letter from XXXX stating that hazard insurance had been added to my account and I needed to pay an extra {$120.00} starting in XXXX! I spoke with " XXXX '' in the insurance department and was told they couldn't verify the insurance from the declaration, so I gave them the number of our insurance agent and he said he spoke with them and verified our coverage. Afterwards, we received a letter stating that our payments starting in XXXX included the insurance premium of {$120.00}! I called and spoke with " XXXX '' who said we needed to provide our personal condo policy declaration page, which I did. Today I received a letter that we were receiving no refund and on the phone, " XXXX '' said we owed {$580.00} for the " time the policy was in force at the beginning of the year. '' This is extortion! We proved that our policy was in force since XX/XX/2019 and I don't know if this is some kind of collusion between Rushmore and " XXXX XXXX '', their insurance carrier, but it is not a productive way to maintain customer service.

Complaint: Last year, my loan was transferred to Rushmore Loan Management for servicing. At that time, my loan was already seriously past due. On XX/XX/2019, I submitted my first request for modification. After consideration, my request was denied based on their determination that my > {$5000.00} monthly income was insufficient to support a mortgage and other existing debt. My failure to provide a deposit towards the arrears was also sighted as a reason for denial. Now, I am on a pre-foreclosure list and everyone in my family is receiving unsolicited mail, text messages, and phone calls about filing bankruptcy and/or fire sales. Besides the fact that this is my home of 15 years and I want to live the rest of my days here, moving is really not a reasonable option for me because I am a single parent, struggling to support XXXX XXXX child in XXXX and XXXX child with XXXX and XXXX XXXX who is living with me and attending XXXX XXXX in the only town he has ever known. In addition, I myself am XXXX and XXXX XXXX and just underwent major XXXX which left me unable to XXXX independently. I did explore the possibility of refinancing with another lender but I have been advised that it is not an option for me due to my current arrears and the existence of a second mortgage lien against the property. With filing bankruptcy being my only other option to keep my home, I did re-apply for a modification again on XX/XX/2019. It is my understanding that mortgage companies are supposed to work with families to develop a modification plan to help them keep their homes and that hasn't been my experience thus far. Since I do not know what the outcome will be of my most recent application and I am so close to foreclosure, I feel the need to better understand the company 's modification process and why, if it so happens that I am denied again, I would not be given the opportunity to at least make trial payments prior to sending me into foreclosure, especially where I do, in fact, have a stable income sufficient to pay a reasonable mortgage.
