Complaint: In XXXX last year, XXXX XXXX transferred our Loan Servicing to Rushmore Loan Management Services and we were on a 1 year deferrement which did not require payments and should not have been reported as late on our credit report. We have since then successfully completed our loan modification trial payments and the account should have been restated as a new loan with the old account information deleted or bought current based on the newly approved loan modification. We completed our trial payments in XX/XX/XXXX and all 3 of our Credit Reports needs to be updated as current. Our loan is not being reported correctly as stated in the letter issued by Rushmore LM on XX/XX/XXXX, after I reached out to them to raise our concerns via faxed letter to their Customer Service Department in XXXX.

Complaint: In XXXX of 2019 I refinanced my home with LoanDepot. They transferred my load to Rushmore Load Management Services Inc. After doing so LoanDepot withdrew the XXXX Payment from my bank. XXXX said they sent this payment to Rushmore. Now Rushmore says they have no record of payment. I am being charged a late payment every month that I do not owe as well as the missing payment.

Complaint: For over one year now I have been asking Rushmore loan management services to reappraise my house so that I can avoid PMI. I have asked Rushmore loan to arrange their home appraise and Ill pay the cost - they have time and again refused to appraise my house- they have never given me any legal reason as to why they are not appraising my house in Arizona XXXX this communication started in XXXX and this is XXXX XXXX. I believe my house value has significantly increased in past couple of years and LTV ratio is way better than threshold of 70 % This company is fraud and deliberately denying my right to reevaluate through appraisal

Complaint: I have been discussing my loan and how it is ( unfair ) with Rushmore. I have sent letters, emails and talked to several people. But nothing seems to work. I bought my house more than 15 years ago and with a downpayment of XXXX I have so far paid nearly XXXX. Now my principal is at XXXX which apparently goes up every month. I tried to reach out to them to see if they would reduce this but they have refused because it is not to the interest of their investor! Who is their investor? Why don't they try to let people keep their only home instead of charging these fees and letting you lose brick by brick of your house. I get payoff letter but it is not clear. One says XXXX, one says XXXX and one says XXXX!!! So which one is it. Why does Rushmore treat its customers this way? There are dozens and dozens of complaints against this company which is no different than the ones before, XXXX, XXXX XXXX XXXX and XXXX. All crooks who are there to steal people 's assets. I am demanding a lower principal balance and a speedy resolution in this matter

Complaint: Rushmore Loan Servicing appears to be RED LINING for the XXXX XXXX, Florida and XXXX area. We believe that the servicer has a high very percentage denying loan modifications for the XXXX part of XXXX Florida and should be investigated by the Florida Financial Regulator as well as other agencies. The company ( Rushmore ) will always find an excuse to deny ANY LOAN MODIFICATION for the XXXX part of XXXX, Florida. We have come across other homeowners in the same situation where Rushmore have denied the loan modification. In this particular case Rushmore have denied the loan modification request claiming that a complete loan modification package was not received within the Florida guidelines, which is 7 days prior to the schedule sale date. The company have denied the request in bad faith. The denial letter is dated XX/XX/2019, we spoke to a Rushmore representative on the same day and he stated that we had until Saturday to submit the rest of the additional documents needed. The initial application was submitted on XX/XX/2019, and the servicer called very next day to request additional document which were furnished on XX/XX/2019. See attached herein. Per Treasury guidelines a servicer must provide a letter to the homeowner requesting additional document and allowing 30 days for the homeowner to comply. This is not what transpired, instead a representative called the next day after receiving our request and giving just three days to comply on which we did and it was denied anyways. Servicer could not be more hypocritical for lack of better words. This company has engaged in Floridas deceptive business practices and should be investigated by the Florida Attorney General. The Consumer Financial Protection Bureau should notice that on the same day the letter is dated, the servicer spoke to us and requested additional documents giving until Saturday to provide on which we did. See attached proof herein. The servicer is acting bad faith. All loss mitigation process or protocol are subject to the Treasury guidelines. The Servicer is correct in that a loss mitigation package must be sent within the seven day before a schedule sale date, see MHA Handbook 3.3. However, our property has a sale date of XX/XX/2019, and if you can count days we are beyond the seven day mark therefore within the guidelines to be considered for a loan modification review.

Complaint: Rushmore declared that is a loan servicer and not the owner of the loan. Therefore not a real party of interest : it can only collect the money and pass to the owner. Also, do not have the right to enforce the loan Please refer to US Code Title 12, Part 226- Truth in Lending. It defines who a lender is, and what the rights of service are. Specifically, it refers to 226 ( a ) 1 that a servicer is not treated as the owner of the obligation

Complaint: Rushmore Loan Management Services is the mortgage servicing company on a mortgage secured by property in XXXX, NC which property was damaged by Hurricane Florence in XX/XX/XXXX. Insurance proceeds in the amount of {$200000.00} were delivered to Rushmore of which {$36000.00} have been disbursed to the general contractor.On XX/XX/XXXX I requested a check in the amount of {$15000.00} by email payable to me and the contractor who lifted the house. XXXX is the person assigned to the claim by Rushmore.When I last spoke with her on XXXX XXXX she said the check had been requested. The check has not been received and the contractor has demanded payment as they have done the work. It is my belief that Rushmore intentionally slow walks payments so that they can benefit from the float.I have called the CEO, XXXX XXXX as well as XXXX XXXX, the VP but neither was available.. I requested a call back and advised the receptionist of the urgency of the payment as the contractor will not lower the house on to its foundation if not paid. The house is in jeopardy if another hurricane strikes the area as it is elevated and not on its foundation. I need the $ XXXX.draw from MY insurance proceeds and I need it now. Telephone :.

Complaint: My mortgage was sold to rushmore loan. I sold my home after 2 years. My refund escrow check has become an issue. It's been over 3 months and I have not recieved it. According to rushmore they have sent it 3 different time but are unable to provide any type of verification or tracking numbers. I called immediately after selling my house in XX/XX/2019 to inform them of my new address to receive my refund. Month later I called again to see where it's at and I was informed it was sent to my old address I would need to update my address. Which I did again .I spoke to new owner and asked if I had by chance got a letter that for some odd reason didnt get forwarded like every other piece of mail. I called again XX/XX/XXXX to ve told they mailed and I should have gotten it by now . They will cancel and reissue again . I called yesterday XX/XX/19 to be told it would be escalated after being told it was escalated on the XX/XX/XXXX. I called today XX/XX/19 and after requesting speaking to the manager . The same girl came back on the phone with a basic script please wait 10 business days . I asked not to speak with her as I wanted my concerns to be heard by a supervisor or manager and XXXX put my on a slight hold and hung up. I called back immediately and asked to speak to a XXXX office branch. I have all conversations recorded. As I felt I've been getting the run around. I today am told it will take another week to be approved. To call back next week" monday by latest "I have requested a tracking number as of last monday XX/XX/XXXX on this next check they are sending . She acknowledged that as it was in the notes.

Complaint: I'm attempting to get on the loan of my mother that passed. And the bank is not allowing that. I have sent in all requested docs. At one point they were accepting my payments then stopped saying only the person whos name is on the loan can send in a payment. I have sent in the requested docs more than 10 times
