Complaint: My mortgage was transferred to Rushmore in XX/XX/XXXX from XXXX XXXX XXXX XXXX. I have an ARM Mortgage with the original loan amount of {$450000.00}. There are 3 issues : 1. Payment History I was concerned about the principal and interest amount being charged by Rushmore so I asked them for my payment history. I was told they only have my history as of XX/XX/XXXX, I contacted XXXX XXXX who said that everything was transferred to Rushmore. I would like to see my payment history since XX/XX/XXXX when I first acquired the loan until today, This will allow me to see the interest rate, the principal and interest payment., All of this information is with Rushmore and I have been asking for this information for nearly 2 years. 2. Principal and Interest The principal and interest being charged is high. When I first got the loan the interest rate was over 7 % on a principal balance of {$450000.00}. I can not remember the exact payment amount but I think it was about {$2700.00} including escrow ( this is why I need my payment history ). Today the interest rate is 6.125 % and the principal balance is {$360000.00}. Yet the principal and interest is higher than when the interest rate was 7 %. I will be able to provide specifics if I could get a copy of my payment history. The current calculation is wrong and is making my payments unaffordable. This has resulted in me being unable to pay. 3. Notice of Intent to Foreclose In the District of Columbia, a Notice of Intenrt to Foreclose is typically send 120 days after the borrower has stopped paying the mortgage. Here, Rushmore the note is 45 days past due, I plan to call Rushmore to work out a plan but the Notice of Intent is premature.

Complaint: Rushmore Loan Management, XXXX, XXXX, XXXX XXXX all violated my rights by ignoring my requests to validate the debt. I have repeatedly stated that the amount Due is incorrect. By Law I am supposed to receive an explanation of the debt of the payments received when they were applied and where they were applied. I requested it from all of the servicers and from the Law Firm XXXX XXXX XXXX XXXXXXXX. They foreclosed on my home sold it without ever validating the debt and EVERY SERVICER is guilty of Dual Tracking. Rushmore states they did not receive a completed modification packet more than 37 days before the sale so the modification was denied. They received the first packet in XXXX and the second on XX/XX/XXXX. The sale was XX/XX/XXXX that is more than the 37 days allowed by Law. I repeatedly requested a payoff, according to my Mortgage documents I have up until 5 days before the sale to pay off the mortgage. Rushmore and their Attorneys ignored this repeated request and mailed the payoff XX/XX/XXXX with a letter stating the payoff was good until XX/XX/XXXX. THEY MAKE NO MENTION OF THIS IN THEIR RESPONSE. Along with all their other inaccuracies they have repeatedly stated that I filed bankruptcy and no longer owed this debt THAT IS UNTRUE I never had ANY DEBT discharged in Bankruptcy they should review their records for names and addresses on those papers. Rushmore also states that I only made one payment on the trial modifications this is also inaccurate along with the dates they state in their letter ( which is all PROOF of how they have tried to defend what they have done with one inaccuracy after another ) had they provided the debt verification I had requested numerous times they would see that the second payments were made but they were placed in a suspense account causing the modification to be considered in default. Rushmore also states that I provide no proof of the inaccuracies in payments when I supplied the only debt validation I have received which was a print out from XXXX showing that they received the payments and placed them in suspense took payments then made general ledger adjustments to debit the payments. Had Rushmore bothered to review any of the information they would see how many times they broke the law. I HAVE AGAIN ENCLOSED A COPY OF THE RECORDS RECEIVED FROM XXXX REGARDING PAYMENTS AND CHARGES. How this can be perceived as no proof of payments not being applied is inconceivable. Even the Justice department could see the BLATANT misapplication of payments. The Justice department has requested and reviewed more information than Rushmore has to investigate what occured with XXXX XXXX XXXX XXXX and Rushmore. They have questioned the suspense payments and the overpayments yet Rushmore denies them. Rushmore is currently seeking to evict me with the proof I have of all the laws they have broken that they choose to ignore the eviction would only add more damages to a lawsuit should they not correct the mistakes they have made along with XXXX XXXX XXXX XXXX

Complaint: I had opened a flood insurance claim on XX/XX/19 that was investigated and damages were paid by my flood insurance company to my mortgage servicer at the time ( Rushmore Loan Management ). The check was sent to Rushmore, and issued with my name on the check as a joint payee, but apparently the bank didn't need my signature to deposit the check which I find strange. Moving forward, I was in the process of refinancing my mortgage with Rushmore prior to the flood happening, closed on the refinance with a new company, and paid the previous loan through Rushmore off in full. Rushmore was still handling the flood claim as they were my lender at the time the insurance claim was initiated on XX/XX/XXXX. I have called both customer service and the loss draft dept. at Rushmore at least 50 times in the last 3+ months to find out where this insurance money is and why it hasn't been distributed to me as the property owner. I had already paid for all of the damages caused by the flood out of pocket due to the negligence throughout this entire process. Every time I contact Rushmore, I get a different person and a different answer. On several occasions I was told my mortgage and my insurance claim is no longer their problem or in their interest. Rushmore representatives also denied ever receiving or depositing my insurance check until I confronted them with a copy of the check I obtained from the insurance company that clearly showed their " for deposit only RLM '' stamp on the back of it. Prior to that I was also given a runaround that the check was mailed to my new mortgage lender, however after contacting them several times, they knew nothing about the claim or the check. After endless attempts and threats to hire an attorney to resolve this, customer service FINALLY acknowledged yes they did indeed deposit my check and would be distributing the funds on XX/XX/19. That was 30 days ago to date. I have called over and over again, and every time I am given a different answer as to when or if at all, a check was mailed. I asked for tracking or to speak with someone who would know, but apparently not a soul at Rushmore knows who handles the outgoing payments or who takes care of the mail. When I called on XX/XX/19 to check the status as I hadn't received a check, I was told it was probably lost and that I would have to wait until Monday to have one reissued. I was then told I would receive a call around XXXX XXXX. by the same agent I was speaking to. Monday rolls around, I waited until XXXX XXXX., surprise no phone call. I call Rushmore and they say OK we will issue you a new check and elevate the status to put a rush on it. You should have it by the end of the week. 7 days go by, no check. I call on Monday XX/XX/19. I get transferred multiple times and no one knows anything about a check. Big surprise. I finally ask to speak to a manager as I am sick of dealing with this. I get put on hold for 15 min. Someone picks up who I assume was a manager and says yes a check was issued on XX/XX/XXXX. But the last person told me it was issued on XX/XX/XXXX I say? He says you should have it by Friday. Frustrated yet again, I wait another week. As of today it is XX/XX/XXXX and I still have no check. They verify my mailing address every time I call. From California to Wisconsin takes 3 days on average for first class mail. I am done hearing excuses. I don't believe anyone is, or has ever issued a check. I believe that Rushmore is holding the escrow money that it owes to me in hopes that I just give up and stop pursuing it, as my loan is paid in full and they can no longer profit from my monthly payment.

Complaint: I had a voluntary escrow/impound account for the property taxes and hazard insurance. In XX/XX/2019, I split my payment, making my principal and interest payment by the XX/XX/XXXX of each month which meets the terms of my Note and I made my escrow payment before the end of the month and I wrote and explained to the mortgage company what I was doing and why. They have assessed me late charges that are unwarranted. I cancelled my voluntary escrow account in XX/XX/XXXX, and sent them the payment for the negative balance ; which they have cashed. They have failed to correctly update their records to show the payment due of the principal and interest only on the monthly mortgage statements. Again, I have called, sent secure emails on their website and have written letters to no avail. Their response time for each piece of communication is unacceptable ; taking weeks or months to respond. Now they are in my opinion harassing me, by sending notices stating that I am delinquent when in fact I am not. Again, the escrow account was voluntary and the payments were made before the end of the month, no late charges should have been assessed.

Complaint: Received a letter in the mail because our loan was sold for the 2nd time ( 3 mortgage lenders so far ) 13 days before payment is due. We are only into our 4th month of being homeowners. But I have yet to receive info on how to pay my mortgage payment via this nee company and I can not access my account threw them because it doesn't exist yet. Old mortgage lender was Rushmore new is XXXX. New lender starts XX/XX/2019, today is XX/XX/XXXX. Still no information on the lender or how to pay my bill.

Complaint: On XX/XX/2019 my mortgage was transferred from XXXX XXXX to Rushmore loan management services LLC. When I received the letter informing me that my account had been transferred I called Rushmore to inquire about making a payment. My new account number was not on the letter that they sent me so I asked them for my account number. They provided me with an account number of XXXX. I made my payment through my online XXXX checking account and it posted to my account on XX/XX/2019. Rushmore has not been able to confirm that they have received my payment. They told me that they made a mistake when they told me my account number and that my account number is actually XXXX. They are saying that I will incur late fees now because they still have not received the payment for XXXX. They are also telling me that this could take weeks to fix. I am concerned because if they do not acknowledge my payment within the next 10 days then they will mark my mortgage as being 30 days late. I need confirmation from Rushmore that they have received my payment and that they have credited the payment to my proper account number for XXXX XXXX XXXX, XXXX, MD XXXX. I need confirmation that I will not incur any late fees because I did in fact pay my mortgage before the XXXX. In the future Rushmore should send an initial statement to transferred loans that has the account number on the statement. I do not know what to do. From my research online Rushmore has a history of poor customer service and I am not confident that they are able or willing to correct this problem before they mark my mortgage is 30 days late.

Complaint: I have a home equity line of credit that Rushmore loan Management Services took over last year. I had a payment due on XX/XX/XXXX of 2019 for {$140.00}. I made a payment on XX/XX/XXXX with check number XXXX on my checking account and the Credit Union says that that payment was taken out of my account on the XXXX of XXXX. Rushmore has called me on XX/XX/XXXX XX/XX/XXXX XX/XX/XXXX XX/XX/XXXX XX/XX/XXXX XX/XX/XXXX XX/XX/XXXX and XX/XX/XXXX claiming that I did not make my payment for XX/XX/XXXX. On XX/XX/XXXX I spent hours on the phone calling and trying to reach someone at Rushmore. After calling them 29 different times I was finally transferred to a supervisor named XXXX XXXX. XXXX admitted that they showed I made a payment of {$140.00} on XX/XX/XXXX. He stated he would have to look into it and get back to me. XXXX gave me his name phone number and extension I've tried to call him back three different days never been able to reach him or a voicemail for him. I made the payment for XXXX my bank shows they took the money they admit they took the money and they continue to harass me every single day claiming that I owe them {$140.00} for my XX/XX/XXXX payment. This is not the first problem I have had with Rushmore they tried to do the same thing to me with my XXXX payment also they tried to charge me hundreds of dollars a month in XXXX and XXXX for hazard insurance after I proved to them months before that I had Hazard insurance on my property. Trying to reach anyone at Rushmore loan services that can help you is impossible. The only people you can get a hold of are in the XXXX.

Complaint: Rushmore under an assignment received a defaulted loan secured by the property located at XXXX XXXX XXXX. XXXX XXXX XXXX XXXX, New York XXXX. I was sent a foreclosure notice dated XX/XX/XXXX under index number XXXX. The owner XXXX XXXX was murdered on XX/XX/XXXX, and we are now approaching two years and four months in which the debt collection company Rushmore has refused to accept my XXXX XXXX rental payments which now total XXXX which leave roughly XXXX left of the outstanding debt. What concerns me is that Rushmore is acting as a debt collector in name only, because for two years and 6 months no foreclosure documents can be found in the XXXX Supreme Court. I fear that Rushmore is attempting to use its name to prevent the property from complying with state law under NY Public Auth Law 2429 and NYC Administraive Code 11-243. They're a conduit used to shield property required to be listed as rent stabilized. They keep writing me stating they can't discuss the loan, but I need repairs. How long can they keep acting like a debt collector ; who doesn't collect the rental income?

Complaint: The mortgage is in my deceased Mothers trust ; XXXX XXXX Trust. I am one of 4 executors of the trust and have been living on the premises and making payments on the property since purchase. Out loan was sold by XXXX XXXX XXXX to RUSHMORE LOAN MANAGEMENT SERVICES for a profit last summer ( XXXX ) and since then I have been : 1. Falsely accused of missing one whole month payment 2. Falsely charged interest and Fees 3. Subject to late Fees 4. Advised I may be subject to Foreclosure 5. Subject to increased unnecessary Stress due to not being able to contact the Mortgage Company to resolve the nightmare of their mistake. I continued to make my monthly payments to XXXX XXXX XXXX until I received a new loan payment statement from RUSHMORE LOAN MANAGEMENT SERVICES and then started and continue to make my payments to RUSHMORE LOAN MANAGEMENT SERVICES Since I had not missed any payments In XX/XX/XXXX I noticed that a payment was missing on my RUSHMORE LOAN MANAGEMENT SERVICES statement. Since I had not missed any payments I assumed that RUSHMORE LOAN MANAGEMENT and/or XXXX XXXX XXXX had an error in sending over my payments. As the XXXX statement from RUSHMORE LOAN MANAGEMENT SERVICES showed the same error that I was missing a payment. I called XXXX XXXX XXXX and was told they had closed their mortgage dept. in XX/XX/XXXX. I dtried to find out who to contact and was sent in circles until I gave up. This whole scenario is very stressful for me. I am a XXXX XXXX XXXX woman with health issues .which have been amplified due to their predatory actions and now worry about being foreclosed upon. When I reached out to RUSHMORE LOAN MANAGEMENT SERVICES i never got to someone who could help They want me to prove that they are wrong. I would like a forensic accountant to go through the paperwork and find the banks error. have gone through all of my statements and found every payment made. RUSHMORE LOAN MANAGEMENT SERVICES has increased my payments a few times this past year whether or not interest rates have gone up or down. while they only increased once a year while with XXXX XXXX XXXX. I am not the only victim in this process of selling my Mortgage from XXXX company to another for profit. I am sure there are millions of other home owners who have been victimized by XXXX XXXX XXXX or RUSHMORE LOAN MANAGEMENT SERVICES when selling their mortgages to another company for a profit. I would love to hear how they feel. To me it feels like another shakedown happening like the shakedown in XXXX and XXXX. I need the help of the CFPB to help me resolve this issue and find the missing payment, reverse the FALSE, MIS-LEADING and PREDICTORY FEES I am being charge. In conclusion, I am asking for a complete forensic accounting to reverse the false interest and fees I have being charged and a call from whoever is responsible for this mess as I have proof of all payments.

Complaint: XXXX XXXX held mortgage until we were eligible for a modification ( two month window ), they transferred loan to Rushmore Loan Management Services after modification application and told two months until eligible. Rushmore also inspected and burglarized property upon loan transfer. I started process of filing complaint but the stress for me unbearable dealing with them as I am disabled. They have continued to create a financial hardship as they refuse to accept pay-off. Rushmore was paid in full by XX/XX/XXXX after disregarding application for loan modification. ( property had appraised for {$46000.00} and not XXXX as owed ) So we paid full amount owed. They dragged out each payment and I kept paying trivial amounts to pay off and they still would NOT release lien. Rushmore continues to bill us with XXXX in escrow in their hands and our loan paid off, including charging late fees and higher mortgage payments. It is XX/XX/XXXX and they continue to place fraudulent charges on this paid-off account.

Complaint: We have been trying to sell our home in a short sale since XXXX. We received an offer and our negotiator submitted it to the lender. They came back with an extremely high counter offer. The buyer and our negotiator submitted a value dispute. Several times the lender confirmed receiving it but never had an update to provide. The pipes burst in the property in XXXX creating a huge water damage and creating a lot of mold to grow in the property. This information was sent to the lender but they lied and said they had just been in the property a week ago and the property was in perfect condition ( a different representative later told my negotiator that they had not been inside the property since last year ). We finally just received a response today ( after 2 months!!! ) and they lowered the value just a little bit. The buyer revised their offer to a slightly higher offer but we're concerned the lender will not look at it since they took 2 months to respond to the value dispute and gave several inaccurate updates and all out lies to us and our negotiator. Please help us to postpone the auction so that we can sell the property on our own terms and avoid foreclosure. The buyer is a cash buyer and can close immediately if and when approved.
