Complaint: In the Fall of XXXX, I tried to apply for a HARP refinance loan only to find that XXXX XXXX, who serviced the loan, had " bank errors '' which forbid me to do so. Hence, it was recommended that I apply for a " Loan Modification '' instead. The problem was ( as countless other consumers have experienced leading to even foreclosure ) this process was flawed with delays, incompetence, and never ending re-applications. ( In fact the Attorney General for the XXXXtate of Minnesota intervened at one point to shut down an illegal foreclosure date! ). Though it took a long time, it appeared that XXXX XXXX had " finally '' reached an approval of {$1100.00} per month modification ( my current 5.25 % loan at {$1700.00} payment ), but inexplicably before signing off the 3 month trial period, transferred the loan to Rushmore Loan Mgmt Services of XXXX, CA. in XXXX, XXXX. That is when the insanity became even worse! After several applications, the underwriter presented questions never asked in my 35 years of finances which even my legal counsel could not rectify ( counsel had worked countless times with Rushmore who has had nothing but documented nightmarish experiences for consumers nationwide ). Even though I have presented financial numbers that more than qualify me for not only a Loan Modification, but even a Refinanced Loan, they refuse to " approve '' or even consider any option but either : ( 1 ) Foreclosure or ( 2 ) Repayment of back payments which would be insurmountable at approx. {$100000.00}. I have endured countless monetary losses from legal fees, not to mention did not receive a lower a 2.75 % APR as well as my credit report was ruined! My health has also taken a toll from the endless stress and hours over the years battling for what " never should have been ''. Now I am faced with a Lawsuit '' and even possible " Foreclosure '' when I have the Employment ... Qualifying financials ... to make payments and qualify for a modification. On XX/XX/2019 I sent a request via fax to remove mortgage insurance premium on XX/XX/2019 since I meet the the borrower initiated cancellation guidelines that includes : 5 year loan time period ; no late payment within the last 12 months and reached 78 % threshold or less of home value. Mortgage service denied request onXX/XX/19. I resent information for rebuttal and dispute on XX/XX/2019 and received correspondence on XX/XX/2019 that it has been denied.

Complaint: Rushmore loan services is in violation of federal and state regulations regarding loan processing, financial services and real estate procedures. At issue is a short sale request that was submitted to Rushmore on XX/XX/19. Rushmore ordered a property evaluation which came back at XXXX. Rushmore is required by law and regulations as the seller to pay for fees associated to a transaction such as taxes, settlement fees, real estate commissions, etc. Fees typically equal about 9 % of the purchase price of a property as commissions alone are 6 %. Rushmore is illegally demanding that they only have to XXXX or about 2 % of the purchase price. This is unethical, illegal and in violation of several regulations regarding financial transactions, acting in bad faith and real estate procedures. It appears Rushmore is attempting to make such a ridiculous demand so they can illegally violate the CAHBOR which requires lenders and servicers to help homeowners avoid foreclosure. By making illegal and unethical demands they are in fact denying borrower 's right to avoid foreclosure. These violations must CEASE and DESIST immediately. Federal regulators must investigate Rushmore to see how many other borrowers are being violated in this manner. This is an outrageous violation of laws and regulations.

Complaint: On XX/XX/2019 I received notification dated XX/XX/2019 from Rushmore Loan Management Services LLC ( Servicer ) that they the servicer are requiring a copy of the Hazard Insurance Policy on my condominium. I called the phone number indicated on the notification, and spoke to a representative who instructed me to upload a copy of the Master Indemnification Policy declarations page to the system indicated in the notification letter. I at that time, not only indicated to the agent on the phone that I needed to request that information from my HOA / property management company and as well that the requirement for Hazard Insurance is a LENDER requirement and NOT a servicer requirement. The agent then indicated that they would need to research. Upon receipt of the declarions page form my HOA / management company on XX/XX/2019, I uploaded this information to the system as I was instructed. On XX/XX/2019, I received notification via email that my insurance information was successfully verified which read as follows : " This message is to acknowledge the successful verification of the insurance information, that you provided at XXXX. Thank you for your assistance. Please remember to include the reference number that appears on your letter, on all future inquiries. '' On XX/XX/2019 I received a letter dated XX/XX/2019 indicating that Rushmore has not received my insurance information and was going to force place insurance of NOT my choosing at a much higher premium on my property. I again reiterate ( as per above ) my insurance information which includes ample proof of insurance was received and acknowledged by Rushmore via email indicating " successful verification '' on XX/XX/2019. I attempted to call Rushmore Loan Management Services on XX/XX/2019 but their office was closed. I attempted to contact Rushmore Loan Management Services LLC again on XX/XX/2019 and spoke with an agent named XXXX who indicated that they needed proof of property insurance and that they are " force placing '' insurance which is at a much higher rate. I informed her that I sent in that proof, would send it again and that I had already received an email indicating " successful verification of the insurance information. '' XXXX said that they NOW needed a different type of insurance as they did not have verified insurance information on my property. Again, they do and have acknowledged via their system. I offered to send this information again. XXXX indicated that that would not matter as they would not remove the flag on my account to " force place '' insurance as it was not verified. Again, this is untrue as I explained, I received notification of verification and as well, she acknowledged receipt of the insurance information as she was looking at it on her computer screen and would not remove any force placed insurance or system flag. Rushmore Loan Management Services LLC is obviously trying to profiteer by charging consumers for much higher insurance premiums from their contracted insurance carriers as they are NOT accepting the consumers compliant, complete and satisfactory insurance that is provided. They as well, do NOT understand how condominium associations function and master indemnification insurance as required by HUD. They have an received is acceptable insurance coverage as required multiple times. My condominium complex is a HUD, XXXX XXXX, XXXX XXXX, FHA and VA approved property. Rushmore Loan Management LLC is intentionally rejecting sufficient insurance that is legally binding to illegally charge me for a HUGELY expensive insurance policy by a provider of their choosing from which they are profiteering. This underhanded and deceptive practice needs to be immediately cured and my insurance needs to be accepted as again, it is sufficient coverage and has been by every lender / servicer for the 15+ years that I have owned my property. Complaint: Rushmore LM has continually called my cell via an automated dialing system. My phone has prevention of automated or robo calls. Allows to ring once then sends to voice mail. The message left on the voice mail is an automated computer generated voice in violation with Section 5 of the Federal Trade Commission Act, 15 U.S.C. 45 et seq. prohibits unfair or deceptive acts or practices in the marketplace. The Fair Debt Collection Practices Act ( FDCPA ), 15 U.S.C. 1692 et seq., ( which is enforced by the FTC ) provides that debt collectors may not, in connection with the collection of a debt, place telephone calls " without meaningful disclosure of the caller 's identity. '' 15 U.S.C. 1692d ( 6 Never is the number have any description of the company name nor when they call me home number. They were removed from calling my cell phone 2 years ago only to contact my landline. This violates laws under both FDCPA & TCPA laws.

Complaint: Hi we were approved for a mortgage in XX/XX/XXXX for a house in XXXX, GA. We were financed by XXXX XXXX XXXX. They sold the loan to XXXX and then we refinanced with XXXX. Eventually XXXX sold the mortgage back to XXXX. XXXX placed deferred interest on our loan, but we were never late and could not understand why this was done to us. We filed bankruptcy around XXXX and continued to make on-time payment. After the bankruptcy, we were still with XXXX and they tacked on more to the deferred interest going up to {$20000.00}. We are still paying the interest and not just the principle. We believe we are the victims of predatory lending. We have tried repeatedly to talk to XXXX about it, but they went out of business. We tried to talk to XXXX and then they went out of business with no resolve. Now our loan is with Rushmore and they are referring us back to XXXX to address this problem. Please help. Thank you.

Complaint: My husband and I were unaware until XXXX that our mortgage company did not remove title and that they did not foreclose on XXXX XXXX XXXX, XXXX XXXX, CT XXXX. Our bankruptcy was completed XXXX of XXXX, we moved out of the house XXXX and moved to Florida. On our bankruptcy our attorney checked retained to give us a year to complete our XXXX XXXX and have our children placed with other families. We contacted XXXX XXXX who was our mortgage lender to let them know to foreclose on the property. We did not hear anything from them until last year when I learned that they didn't re-title until XXXX. I informed Rushmore XXXX that we had a bankruptcy and provided them with the documentation. I have recently learned XX/XX/XXXX that they are reporting the debt on our credit report and refuse to remove. I filed a dispute and they are being uncooperative. We need help to remove this debt and also change the date in which we owned the property to XXXX. We were not in the home and it is not our fault that the loan was sold several times and that XXXX XXXX was being sued. We did what we were suppose to do and now they are preventing us from purchasing a new home.

The new lender then proceeded to report the account late to the Credit Bureaus. That is how I found out about the location to send payments. I immediately paid the accounts.

Complaint: This is not a duplicate. This is about case # XXXX. This complaint is in reference to that case #. I have a family member helping me and she called today because Rushmore loan mgmt. postponed the foreclosure sale from XX/XX/19 to XX/XX/19. We verified that the supporting documents for a loan modification and that the last will and testament and executor ship documents were received on the XXXX of XXXX. Today they are stating that they will not be reviewing any documents because it is less than 37 days prior to the foreclosure sale. Well if the addition in my mind is right excluding weekends that would make it 47 days prior.These people are very evil people. It is my understanding that there are people in the court system that state they want to buy the house at foreclosure and sell it for profit. This is not fulfilling my parents wishes.
