Complaint: XX/XX/XXXX XXXX XXXX XXXX takes over my mortgage from XXXX on XX/XX/XXXX after 5 years with XXXX and zero issues. XX/XX/XXXX my homeowners insurance was to be paid by the Mortgage company ( XXXX XXXX XXXX ) the money was in my escrow account {$1500.00} i was notified that my insurance was not paid because of an issue with my address. I checked my escrow account and it showed the {$1500.00} was in fact deducted from the account. I went to my insurance agent and they in fact have never received the payment, so i paid the insurance out of my pocket and had them fax the insurance documents to Rushmore. again i am notified that i have no insurance and Rushmore is getting an outside insurance to add to my house. again i call and have my agent fax the documents to Rushmore. I call and talk to Rushmore and they say that it isn't their fault that the insurance was not paid, so i ask where the {$1500.00} is from my escrow account with nothing but run around from them. i tell them have the statement where the money was withdrawn from escrow and it was never paid. it still does nothing to help my case. I pay a lawyer to advise me, and he tells me to send the documents return receipt requested. and i in fact do send them the insurance documents on XX/XX/XXXX and i then get the return receipt back that they signed XX/XX/XXXX, and still they add insurance at {$41.00} a month. and Rushmore still says that it was added because i let the insurance expire? They are charging me {$310.00} a month to my escrow account and the only things they pay are {$41.00} for their added insurance, {$50.00} for taxes and {$92.00} for PMI. which i asked them to drop because i have kept up my payments for 6 years, and they replied no because i had let my insurance expire. which was actually them.

Complaint: i filled this out it mustv erased. wow so my mortgage mod app was denied. was innappriate, was just denied this month. it took almost a 4 month application process, and they still never asked me to send verif of the XXXX down payment amount they had already approved. they denied in writing for not enough down payment but they told me the amount was sufficient, but they called the bank before they made decision of denial, to see if money was therw. i told them that i keep money at home, i dont use bank. they say a whole lot diff than they write. also, my past and recent XXXX XXXX XXXX XXXX, XXXX, XXXX XXXX, XXXX XXXX approx, tRV ying to fix or get the correct therapists, prescribers, primary, and now i need a revision XXXX XXXX, i have a XXXX XXXX, and XXXX/XXXX, i finally have fixed 85 percent of tge issues i lived with for 38 yrs. i now feel like ia reas l person, the drs and prescribers have saved my life, after so many yrs of failed Doctoring. repeatedly. Real Hardship ... also, added i have a XXXX XXXX. and had to stop working because of all these problems compulated. but i finally have enough income, plenty, and feel normal which il never miss a payment, esp now w even more fixed income, and a straight, and focused mind, and they deny my app for modification. does not make sense please call me, XXXX XXXX XXXX, thet y already hsd approved foreclosure, stopped and now resumes process becasuse of the denied app for modif. so they are past many points and close to fi foreclosure sale. please help

Complaint: Rushmore my mortgage servicer mailed me a Proprietary Modification saying 1st trial payment due XX/XX/2019 amount XXXX. The escrows are incorrect because my Homeowner insurance monthly payment is incorrect. XXXX XXXX the relationship manager was contacted of the payment being incorrect because my homeowner insurance premium was reduced. per XXXX XXXX she was going to provide this information to the processor so my mortgage payment could be reduced and adjusted for the correct payment. Complaint: Most of the information in regards to this complaint are written on the legal binding documents that were submitted to you buy me from Rushmore loan Management Services LLC.. Received documentation from Rushmore loan Management Services LLC insurance department asking if I had my own policy, if not lenders place policy would be added. Called the insurance department as soon as I received the FIRST letter and told them it would have to be lenders placed the representative stated she would document the account now and lenders placed insurance would be added. But I keep getting letters asking for my insurance information. Talked to Rushmore loan Management Services LLC representative XXXX XXXX on XXXX XXXX in regards to my escrow due to a change in the amount of my lenders placed Insurance policy. XXXX XXXX told me that an escrow analysis was being ran and to call back on XX/XX/2019. I spoke with XXXX XXXX on XX/XX/2019 and he stated that the information given to me by XXXX XXXX was not true and did not see an escrow analysis being ran. After receiving a letter dated XX/XX/2019 I called Rushmore loan Management Services LLC and spoke with representative XXXX. She verified that my homeowners insurance policy was {$780.00} annually and the taxes were the correct amount and I would be receiving another letter XX/XX/2019 with my evidence of insurance. XXXX also stating that my monthly payment would be around {$370.00} and I will receive a refund of {$2400.00}. After receiving the letter dated XX/XX/2019 I talked with XXXX on XX/XX/2019 again at Rushmore loan Management Services LLC. XXXX stated the information is not uploaded yet but she would escalate it to do so and call me back on XX/XX/2019. XXXX from Rushmore loan Management Services LLC did call me back on XX/XX/2019 and stated the escrow analysis is being ran and has been ESCALATED due to the fact that I notified the insurance company to go ahead and place lenders Placed insurance. XXXX stated the escrow analysis would be done XX/XX/XXXX or XXXX of 2019 and the escrow analysis and REFUND check would be mailed that day. I called Rushmore loan Management Services LLC late in the evening on XX/XX/2019 and spoke with XXXX whom stated escrow was still being ran. I called right back and spoke with XXXX at Rushmore loan Management Services LLC who stated that XXXX did not do her job correctly and XXXX had to escalate the escrow analysis so now my escrow analysis will not be finished till XX/XX/2019. I have received nothing but false and misleading information from the representatives at Rushmore loan Management Services LLC and representatives that omit factual information in regards to my mortgage. This is the second complaint I have filed they did not post my XXXX XXXX payment for FOUR days even though I paid extra for money in minutes but thanks to the cfpb my payment was posted as soon as my complaint went through. I feel that Rushmore loan Management Services LLC should have ran an escrow analysis last month or the month before due to the fact that I gave them the information and told them to go ahead and do lenders placed insurance. The letters I am receiving from the insurance conflict with each other and do not make any sense as you can see with the legal binding documents I have sent. I feel Rushmore loan Management Services LLC is refusing with malicious intent to not give me my refund and lower my monthly mortgage payments. I read in one of the letters that the new lender and mortgage servicer which is Rushmore loan Management Services LLC has 45 days to place lenders placed insurance if I do not provide my own. That date would have been XX/XX/2019. I feel like I am being sabotaged by Rushmore loan Management Services LLC in regards to MY escrow refund and my lower monthly payments. I want my refund on the date they stated which was XX/XX/2019 but I have a feeling they'll just come up with another excuse in regards to why it has not been issued. I want my refund through my escrow sent to me now. Rushmore loan Management Services LLC has had ample time to service this mortgage correctly. They went over the 45 days of sending the legal documentation I need on a mortgage I am paying for.

Complaint: This file, XXXX, for myself, XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX, NY XXXX, initial review was from an application submitted XX/XX/2018. Then, in turn, denied for modification based on lack of a lower payment available per investor guidelines. The income that was reviewed by Rushmore was reduced from our application by more than {$2500.00} a month. We knew the appeal would be denied but we were told by XXXX XXXX XXXX at Rushmore, to submit anyway. We did so and were denied appeal. Thereafter, with the income proof on my bank statements, we feel confident my income will be honored from the application. We re-entered the process to reapply for modification and were Permanently denied PREMATURELY, without any real review of income/loan details. We have only had one formal chance to apply and have a reapplication based on a change in circumstance. We believe it is illegal to deny customers the right to modify or at least the opportunity to be reviewed for modification. Rushmore is now denying these rights many more customers than just this one. We are following up with the State Attorney General to insure you are abiding by the proper protocol for XXXX Banking Department, HUD and any other regulatory institutions that may apply.

Complaint: We have an insurance claim that was paid & damages were completed in XXXX of XXXX for {$30000.00} for our roof. The roofing company has completed the work they have received 2 disbarments of payments, the final inspection has been completed since XX/XX/XXXX. We have given Rushmore Mortgage Company all the documents they needed EVERY month we certified mailed and emailed them to them ( the same documents over & over ). They have dispersed some of the funds and every time we call it is a new issue they make up as to why they haven't released all the funds. They have received every document necessary, the job has been completed since XX/XX/XXXX. They still owe us over {$25000.00} The insurance company released the funds to get the house fixed and Rushmore has made it impossible for any of the parties to get paid. I have contractors threatening me that they are going to put a lien on my house & I am going to get lawyer fees because the accounts are almost a year old. Rushmore has made this process very difficult for me as the homeowner and for all the contractors involved that have completed the work the house needed.

Complaint: I recently became a successor in interest on this loan. I am now trying to assume the losn as I was awarded the house through the divorce and since my ex husband has recently passed away I am trying to assume the mortgage so that I can be obligated on the note. Rushmore Loan Management has told me over the phone on XX/XX/XXXX and also through secure messaging sent to me in late XXXX that they do not allow Assumptions and they are trying to force me yo refinance. My loan is with XXXX XXXX and I believe that they allow Assumptions under certain conditions. I am a single mom with two kids who now no longer have a dad and I am struggling to ensure that not only we keep our home, but ensure I can sell it if I need too. Please assist me in getting this mortgzge company to allow an assumption. I am currently not behind on my mortgage, but they just raised my payments again in the last year due to an escrow analysis and I would not be able to complete a modification if I cant assume the note. Complaint: This complaint is in reference to the mortgage on my personal home. On XX/XX/XXXX I filed Chapter XXXX Bankruptcy to protect my home and other assets. I completed the case on XX/XX/XXXX after paying XXXX to XXXX and other debtors ( Please see PDF titled XXXX RESPA Response XXXX ). During my bankruptcy, my payments were increased several times and to prevent dismissal I was required to pay over XXXX in three months see image ( XX/XX/XXXX XXXX XXXX ). Upon completion of the bankruptcy case, my mortgage was sold to Rushmore and I was instructed to continue my payments. Rushmore would not allow me to set up auto-draft and when I called to make my payment in XX/XX/XXXX, they refused to take and told me my account had been turned over to the foreclosure department. At that time my bankruptcy attorney XXXX XXXX informed that he had done all he could do and referred me to the XXXX XXXX XXXX XXXX Attorney XXXX XXXX. I have worked with one of Mr. XXXX associates but my home has been placed in the paper for foreclosure twice and is scheduled to be placed in the paper again tomorrow. As an XXXX and community leader, this has caused much humiliation to me and my family. I thought we were on track see ( XXXX and XXXX images XXXX ) to get this matter resolved and I have been saving the payments. I simply want to continue to pay for home ; however, it seems everyone is giving me the runaround. And now, my home is scheduled to run in the paper again tomorrow and a sale date of XX/XX/XXXX.

Complaint: On XXXX XXXX, 2019, the property associated with this mortgage was placed on the market to be sold. On XXXX XXXX, two days later, the property was placed under contract with the closing date set for XX/XX/2019. At this point, the lending agency, Rushmore, was contacted to ensure closing protocols were in place. An inquiry was made concerning the upcoming XXXX mortgage payment. We asked if the final payment that would be made upon closing would suffice in lieu of XXXX 's mortgage payment. We also asked if this would create a negative report on our credit. We were assured by Rushmore that the final payment upon closing would be acceptable and that no negative report would be made showing a missed payment. As such, a final payoff amount was requested to complete closing paperwork. However, Rushmore failed to submit the final payoff as requested by both the loan holder and the closing attorney. This resulted in a delay in payment. Upon closing, the closing attorney secured an anticipated payoff amount from the purchasing lending agency and held all funds awaiting Rushmore 's response. Numerous requests were submitted by both us ( the loan holder ) and the closing attorney. We were informed by Rushmore that the payoff amount could not be emailed nor provided over the phone. It had to be faxed, which they failed to complete. After weeks of repeated attempts, the secured payment that was being held was finally made and we were assured that any overage would be reimbursed. In addition to the delay, Rushmore, in turn, reported missed mortgage payment ( s ) causing a negative impact on our credit score. As of recent, we are still receiving notices and mail at our current address offering assistance with our missed mortgage payment ( s ). This is quite disheartening since the advanced notice was provided. We have never missed a mortgage payment. Throughout the duration of this loan, we have included additional money in attempts to repay this debt in advance. We have worked hard to maintain an upstanding credit history and feel that the reporting and current credit score does not reflect the efforts we have put forth. We have contacted Rushmore on several occasions and have been assured that our file will be noted to reflect the most accurate information. However, little effort has been made on their behalf to depict accuracy in this matter. We are requesting reparation be made to ensure our credit score to repaired to reflect our diligence towards this account.

Please send all the documents you used to send payments to the crim with the receipts that the property had debt. As you view the payment on the internet increases in XXXX. I tell you that they can not continue sending payments to the crim because according to their analysis and my payments I have a credit in the crim of a full contributory year. I need to send everything done to my crim account. Evidence of payment made to crim in XX/XX/XXXX and XX/XX/XXXX and all the complete evidences of the reason for which they sent payments to crim. Please verify my " escrow '' account carefully again and I will wait for answers no later than the 45 days by law that you have. That high payment would greatly affect my family 's financial situation. Claim for my " escrow '' account since according to your system there is an unpaid payment for the Crim.
