Complaint: Previous to this incident I have never had a missed payment or any issues so this is my first incident with the company. I am currently undergoing treatment for XXXX XXXX XXXX XXXX XXXX and because of this was given a {$500.00} check from the XXXX XXXX to help towards my mortgage. On XX/XX/XXXX I sent the check for {$500.00} along with the remainder of my mortgage payment by personal check in the amount of {$730.00} to total the payment for my XX/XX/XXXX mortgage. Unbenounced to me, Rushmore sent the {$500.00} check back to XXXX XXXX claiming they were unsure how to apply and held my personal check in a suspense account. Nobody ever called me to tell me about the mistake I only found out the issue because somebody was taking pictutres of my home related to Rushmore and I called them myself to figure out what had happened. I was able to get the XXXX XXXX to cut another check and sent it in again to Rushmore with a detailed description of how the mistake had occurred and how to apply this check to clear up the XX/XX/XXXX payment. This was sent in XX/XX/XXXX. I have no received multiple letters about how they are starting the forclosure process on my home if I do not pay the balance, but they have the money to cover the payment. I have called and gotten no return phone calls and they are unwilling to help. I need them to apply the payment that they have and stop the forclosure process. It is very sad that this all started because a foundation was graciously trying to help me during this very difficult time in my life. Such a travesty and we need help.

Complaint: My loan was transferred to a new servicer Rushmore Loan Management Services. I have received a loan modification packet from Rushmore Loan Management Services and have submitted all documentation they have requested to them fax. Im in review but my foreclosure sale date is still showing online as active on XX/XX/2019. Im scared and do not know what to expect from the company. Im working with them but do not know if they are willing to do the same and follow the California Homeowners Bill of Rights Act. Here is some information from previous servicers and what has happened. I received a loan modification package from XXXX XXXX with a proposal trial period payment for 3 months in the amount of {$3600.00} which is around {$1700.00} over the amount i used to pay before to XXXX XXXX XXXX. My payment was {$1900.00}. How can i afford to pay more then what i couldn't pay before in the first place? I have spoken to a lot of my close friends who were in the same situation as me and around the same loan amount and property size, they have received a very good loan modification of around {$980.00} a month, another friend received a loan modification in the amount of {$660.00} a month. How can this be that they are receiving loan modifications to help them stay and pay for their home while i can not even get a close amount to my old payment of {$1900.00}? Please help me as this is getting out of hand and Im worried for my family and losing my home to this banking scam. It seems to me that they are just transferring loans to get away from giving out a loan modification. I have sent Rushmore Loan Management Services my full Request for mortgage Assistance package and they have received it with no error. But while in review I still show that the sale is scheduled and coming up.

Complaint: Have been contacting the company non stop since XX/XX/XXXX. Customer service is the poorest & get different information with every representative I speak with. The collection company is no help & dishonest & when requesting contact with their superiors is a waste because they won't return messages. I requested a payment arrangement & was advised I didn't qualify. An modification was suggested & when I called the number provided to request a packet I was advised I did not qualify. What am I to do at this point & it seems as if rushmore loan management is a problematic company who doesn't listen or truly try to assist consumers. I am positive there ultimate goal is to complicate as many transfer loans as possible so that they can ultimately foreclose & sale for an higher profit.

Complaint: We are currently working on a refinance with another company. Rushmore services our current mortgage because XXXX XXXX closed their mortgage division and rushmore took over the servicing of the loan. To complete our refinance, we needed a 24 month verification of mortgage ( VOM ). The company we are refinancing with, has completed everything else for the loan and has our borrower 's authorization on file, to communicate with rushmore. The refinance was supposed to close the XXXX of XXXX. Rushmore only sent a 12 month VOM when they should have sent a 24 month VOM. The company I am working with, XXXX XXXX, has called over a dozen times to Rushmore and been promised over and over the correct VOM would be faxed that day. This has gone on for nearly two weeks. These calls are all made on recorded lines and Rushmore continues to lie about faxing over the correct VOM by the end of business. We have had many problems with Rushmore in the past, but this feels like they are lying and deliberately trying to make sure we aren't allowed to refinance. We were told by XXXX XXXX they have seen this problem with Rushmore with other borrower 's as well. We have had multiple problems with them in the past obtaining information about our mortgage. The customer service person always seems nice, but there is always a person above them that is supposed to do the work and never completes the task. You are never allowed to talk to that person and over a dozen calls and nearly two weeks and they have never completed one task they said they would.

Complaint: Rushmore has intentionally obstructed the loss mitigation process for our home, has engaged in unethical and illegal foreclosure practices ( pay to play?? ) as well as denying access to mediation as required by New Jersey state law. My family has owned our home for 41 years and have attempted on multiple occasions to work out a loan modification or sale of the property. Instead of considering options and conducting a fair review Rushmore has blocked us at every turn, attempting to sell the house while still under federal bankruptcy protection and informing us that we can't be considered for any type of compromise or work-out solution unless we pay $ XXXX in cash upfront??? Rushmore along with foreclosure firm XXXX XXXX have engaged in unethical and illegal foreclosure practices and have my family facing a foreclosure sale date scheduled for XX/XX/XXXX. This was set up even though our home is still under bankruptcy protection but they have attempted to file a motion to remove stay so they can steal our property. My husband was a very successful XXXX who XXXX XXXX XXXX XXXX XXXX and we never had a problem with our mortgage until Hurricane Sandy. When we struggled financially we tried to work things out with Rushmore but my husband passed away last year and they refused to continue negotiating with us. I provided them with the legal paperwork showing I was the rightful heir and executor and that they should negotiate with me but no progress. We gave them a good faith payment of $ XXXX in hopes this would break the logjam, but we found ourselves back in the same situation -- no review of our current and correct financial circumstances and a rush to auction our property. We have some equity and have also been trying to sell the property but they won't give us time. We took out this adjustable loan through XXXX in XXXX and then switched to XXXX. Hurricane Sandy destroyed our home and the government got involved and XXXX dropped our payments from {$8500.00} a month to {$5000.00}. In XXXX the loan transferred to Rushmore and they suddenly raised our payment to {$13000.00} a month. This corresponded with my husband 's health issues ( XXXX then XXXX ) which limited the amount of time he could XXXX XXXX -- this was exacerbated by a servicing transfer on our boat loan to XXXX XXXX. We had renewed the loan every 7 years but when XXXX took over they called the note in ( XXXX XXXX balance ) and we had to sell the boat. At that time the boat market was soft and we could not find a buyer to pay full price -- we found one who offered 75 % and XXXX XXXX said they would accept that but they wanted to use their own broker on the deal so they could double-dip. When that fell apart XXXX called the note and seized our assets and bank accounts. This began the problem with the mortgage and ultimately when my husband passed away Rushmore blocked everything.

Starting with XXXX XXXX that account is reporting wrong. The first thing is why were they reporting charge off after my charge off date. This account was charge off in XXXX but they reported every month in XXXX c/o. The other issue is why are they showing a balance when it was charge off. I want this account removed off my credit report under FRCA guidelines. The other account is with XXXXXXXX XXXX XXXX XXXX. They report my charge off date is XXXX actual my charge off date is XXXX. Why they were reporting every month after that c/o. That does not make sense to report c/o every month after that. They are violating my rights under FRCA guidelines. Please delete this from my credit report. This is another company I am having problems with. I was on a payment plan to get caught up on my loan but they were not to report me being late on my credit report, It was in the year of XXXX XXXX, XXXX, XXXX, XXXX. Please delete this from my credit report due to reporting wrong on my credit report under the FRCA guidelines. XXXX is another one why if this account was charged off in XXXX, why would you report after that date c/o every month after that. I should have one c/o date. Please delete this off my credit report. under the FRCA. It is paid now. The other one is XXXX, I only should have one charge off date not several. Why would you still report c/o after my charge off date. Please delet this from my credit report under FRCA guideline.

Complaint: Im writing today to express my sincere disappointment in Rushmore Loan Management Services regarding the Deed In Lieu of Foreclosure process. I worked with a representative who was helpful and courteous, so my complaint is not with her. To begin, I filed Chapter XXXX bankruptcy in XX/XX/XXXX which was Discharged in XX/XX/XXXX. Since that time the mortgage on the property in question was sold by XXXX XXXX XXXX to XXXX XXXX XXXX XXXX, then from XXXX XXXX XXXX XXXX to XXXX XXXX XXXX and finally to Rushmore Loan Management Services. Not only did I receive collections phone calls ( after bankruptcy ) from every one of these financial institutions, but I went through agony over the last 6 years in my attempts to fully remove the propertys title from my name. My major complaint with Rushmore however, stems from the Deed in Lieu which proceeded as follows. I first received an offer on XX/XX/XXXX regarding the Deed in Lieu process. The letter stated the offer was valid for 60 days. The verbiage of the offer letter states verbatim : The best part of the program is that Rushmore Loan Management Services LLC will give you a one-time payment to assist you with relocation expenses in the amount of {$2500.00} which will be paid to you at the time the deed-in-lieu process is complete. I have provided a copy of this document for your review. As I corresponded with my representative, I was also advised I needed to complete a XXXX to receive the incentive. I was provided a copy and returned it as requested. I have also provided copies of my email correspondence to show where I was advised of the necessity of this document as well as the confirmation that it was received. After having my attorney review the documents, I met with a notary on XX/XX/XXXX and signed the Deed in Lieu, which was sent out to the third-party servicer by the notary the next day via XXXX. The Satisfaction of Mortgage was recorded with the county on XX/XX/XXXX. I have also provided a copy of this document for your review. I followed up with my representative several time over the next few weeks in an effort to get copies of the signed documents and to find out about receiving the incentive I was offered. Today, much to my surprise and dismay, I was advised that I would not be receiving the incentive as it had been denied by the investor. Nowhere, in the documents I was provided did it state ( or did I see ) that the incentive was subject to approval after signing of the documents, and that it could be denied. To the contrary, over the course of the entire process, I was led to believe that I would be receiving the incentive upon completion. I firmly believe that I was misled to coax me into signing the Deed in Lieu documents. I was offered an incentive only so Rushmore could get me to turn over the property. As requested, and agreed, I followed through with the process which was fully completed within the 60-day time frame. I held up my end of the agreement, but once Rushmore got what they wanted from me, they refused to follow through on their end. If there ever was a practice that truly defined unfair and deceptive, this is it.

Complaint: I requested PMI removal from my home as it has been two years and my LTV is 78 %. I will need an appraisal to prove this, which is fine. But the Company demanded my LTV is 75 %, which is against the law. I need you to contact them and demand they comply with the law ( 80 % LTV ). I refuse to order an appraisal through them as they asked if they are only going to deny me when the appraisal comes back as 76-80 % LTV. I can provide proof of their letter demanding the 75 % LTV if you would like. Please contact me for the letter.

Complaint: My wife and I opened a Home Equity Line of Credit with XXXX XXXX NA in XX/XX/XXXX. In XX/XX/XXXX, XXXX XXXX sold this HELOC to Rushmore Loan Management. Now, I am trying to obtain a copy of the Loan Note from either party ( Rushmore Loan Management or XXXX XXXX NA. ) XXXX insisted they faxed me this document on 4 separate occasions and that they also mailed it to me. To date, I have received no faxes nor any mail. Today, they ( XXXX ) told me over the phone that they do not have the loan note and never received a copy of it from XXXX XXXX XXXX. They offered to contact XXXX XXXX and see if they can get a copy. I am starting to think they are purposefully delaying sending the documents in an attempt to keep me from refinancing. XXXX XXXX offers no help whatsoever, only a PO Box that you can write to. Their customer service centers have no information about the loan, nor do they provide any suggestions, other than writing a PO Box in XXXX, Minnesota. I have been working on collecting this information for 3 weeks and have been continually told by XXXX that they had the info and were faxing it over. Today they've changed their story and said they do not have the document I need.
