Complaint: I signed a contract for a used car loan on XX/XX/XXXX, before leaving the dealership I asked if the deal was closed, both the managers and financial manager said yes. I left thinking everything was great. I get a call XX/XX/XXXX that the loan was not approved and I need to return the car. I contacted the bank and theyre telling me that the dealer is not accepting their terms. I asked the dealer and theyre said that the bank did not accept their terms. I have reason to believe that the dealer is pulling a yo-yo scam on me. Please help. That car is my only means of transportation for school and work and I can not just return it, especially since I signed a previous contact.

Complaint: In XX/XX/XXXX, Nissan Motor sent me my account to a collection agency and listed it as a charge off, without notifying me. Upon contacting them as to find out why my credit report was listing a charge off with them, they told me XXXX had finally submitted payment in full to them for my XXXX XXXX ( which had been totaled in an accident ) and the remaining balance was sent as a charge off. I asked why I had not been notified in order to pay the balance in full or make arrangements. I have never been late on any payment with any company. I continued sending payments to Nissan to pay for my XXXX even when it was totaled and I was the one staying in constant contact with them. For Nissan to think it is okay to list customer accounts as a charge off is no way, shape or form ethical. I have tried settling this disagreement with both Nissan and the major credit reporting agency ( XXXX ) to no avail. XXXX has said it must be Nissan who requests the removal that is affecting my credit. I have attached proof of making payments to Nissan even when I no longer had my car, I continued paying in order for a situation such as this not to occur. The statements you will see note the electronic payments of {$400.00} deducted by Nissan from my account every month. This year ( XX/XX/XXXX ), I even spoke to a supervisor at Nissan in the credit collections department asking what could be done to remove the negative charge-off affecting my credit. I was told to pay the balance in full and the charge off would be removed. I even received a written letter from Nissan stating this would happen. I paid the balance in full and still Nissan has refused to remove the negative charge-off from my credit report. You will see my past credit history reports excellent credit up until the events leading to this situation. You may contact me if you have any questions at XXXX.

Complaint: Illegal practices and consumer reporting. Company uses third-party to harass you and terrible customer service! On XX/XX/2018, a stranger showed up at my home stating that he worked for a third party that handled Nissan accounts in Collections. He stated that he needed to connect me with Nissan to discuss my account. He refused to identify himself or the company he worked for and had documents with him that he would not let me see and would not allow me to contact Nissan myself. He called Nissan on his phone and I spoke with a rep who was rude and told me if my payments were made on time they would not have had to send anyone to my home. He stated that my payment was 45 days late and in collections and I told him that was false because I made a payment on XX/XX/2018 ( a few days late from my XX/XX/2018 due date ). He placed me on hold and came back about 5 minutes later and said they had sent me letters to my address and I explained that I never received those and that the payment I made in XX/XX/XXXX was for Principal & Interest and asked if that was what was causing my payment to appear late. He continued to talk over me. I asked if he could send me copies of the letters they supposedly sent and he refused. Finally, I was transferred to a supervisor who was much easier to communicate with. She confirmed that payments made to principal & interest don't reflect as a regular payment and was willing to reverse and post it as a regular payment so that the account could be caught up. I told her I only did it that way because I am upside down on the loan and want trying to refinance. Today XX/XX/18, I received alerts from XXXX indicating that Nissan has alerted them of my account being 30 days late. I was already planning to make a payment on XX/XX/18 for my XX/XX/XXXX payment ( due XX/XX/XXXX ) so I went to their website to set up the payment and decided to chat to ask about the inaccurate reporting. I chatted with a person named XXXX and explained my situation, advised that I would be paying the past due on today and he still would not assist me. Apparently, he could not see that while chatting with him I had set up the payment for XX/XX/XXXX to be drafted from my account. He asked me repeatedly if I would be taking care of the balance and each time I told him yes and copied and pasted confirmation of the payment made. After having him threaten to disconnect the chat twice, when I gave him confirmation of payment, he said he would forward my concerns to their Credit team and they would send me something in writing. This is unacceptable! First of all, the last time they " sent me something in writing '', I did not receive it. I was not provided with any resolution or real support to address my concerns. He was very rude and disrespectful to me and did not show any signs of empathy or even wanting to assist me. Nissan illegally reported inaccurate information that will hurt my credit rating and scores I am working hard to improve. I want this fixed and I do not want to be given the runaround to reach a resolution. When I try to contact them and get help they clearly show that they do not care and because your account is only a few days late they treat you poorly and make comments like " Well if you had paid your bill or if you pay on time ''. I live off of an income that allows me to pay my rent and bills when I get paid. I do not purposely pay late. I have never had to deal with anything like this, ever. I have worked in finance and customer service for years and never treated anyone to this standard. With today 's economy and the world that we live in you would think that they would try to put themselves in the consumers shoes and be a bit more understanding but unfortunately that's not the case. I hope that I can get out of this loan with Nissan and refinance my car with my credit union. I need them to fix my credit reporting immediately within less than 30 days. I need confirmation of the error sent to me in writing to my home address and to all three credit reporting agencies and also via e-mail to XXXX to ensure delivery.

Complaint: I receive Social Security income and worked a job. I obtained a loan with Nissan Motor and paid faithfully. I allowed Nissan Motor to automatically deducted the monthly payment from my checking account. Due to other collection agencies threatened me daily. I was advised to file a chapter XXXX Bankruptcy XX/XX/XXXX. There was NO Lapse in payments to Nissan Motor only a reduced payment from {$390.00} to {$310.00} throughout the Bankruptcy plan XX/XX/XXXX until XX/XX/XXXX. As of today, I was made aware of how this negatively affected my account. I understood my attorney to say that there were full payments made to Nissan Motors. This has become and issue because I suffered injuries in automobile accidents and income from part time job no longer applicable. The Chapter XXXX case was voluntarily dismissed effective XX/XX/XXXX. Currently, I await a monetary settlement from my injuries. I contacted Nissan on XX/XX/XXXX, to check the status of my account and resume monthly payments for the month of XX/XX/XXXX. Representative XXXX advised me and my authorized third party advocate that the account had been charged off XX/XX/XXXX. The rep advised us that there was no way to resume payments without paying {$23000.00} or surrender the car. Furthermore, XXXX advised us that the account was due for the months of XXXX, XXXX, XXXX, and XX/XX/XXXX. I explained that partial payments of {$310.00} via Bankruptcy Trustee had been paid to Nissan Motor for those months. XXXX stated she would have the account reviewed. If the account was current at the time that the Bankruptcy was filed. XXXX stated that I would be able to pay the past due payments current and resume {$390.00} thereafter. I was told to call back on Monday. It seemed we would clarify that the payments were paid to Nissan and there would a small balance to resume payments. My third party Advocate called back Monday XX/XX/XXXX and spoke to XXXX, XXXX, and finally XXXX direct line XXXX. XXXX stated that the payments for XXXX, XXXX, XXXX, XX/XX/XXXX were not showing paid. We asked XXXX to check with upper Management to see if I could get an extended period of time in which to verify the balance owed and arrange to pay once we understood billing. Meanwhile, it was established that we would verify with Bankruptcy Trustee office that the payments were paid to Nissan Motor. On XX/XX/XXXX, XXXX with Eastern District Bankruptcy Trustee Office confirmed that Nissan Motor had been issued payments for the months in question and the checks had cleared. We immediately contacted Nissan Motor and spoke to XXXX who advised that he would call back by the end of the day XX/XX/XXXX. My third party advocate called back at end of the day XX/XX/XXXX to find that XXXX had left for the day. There were no new notes made on the file, per XXXX. Again, my third party advocate requested that the 10 day deadline be extended due to the ongoing review and consumer dispute of outstanding balance owed. We asked for a copy of the pay history on the account. XXXX explained that it would take 48-72 hours to process the request and the document would be mailed out regular mail. XX/XX/XXXX, Nissan Motor was contacted and My Third party Advocate spoke to XXXX who advised that the {$2100.00} owed is from the difference from the partial payment paid by the Trustee from the beginning of the BK Filing. Even still the past due balance does NOT calculate to be {$2100.00}. Nissan rep 's did not accurately communicate where the outstanding balance came from. Also, the recent explanation is also in dispute and without disclosure of how Nissan arrive at this number. The Rep advised that there was no way to get around the 10 day rule or they would have to make exception for everyone. Third Party Advocate requested a supervisor and was transferred to a Ms XXXX. Ms XXXX was very abrupt and gave us through the end of the day XX/XX/XXXX by XXXX XXXX CST to have payment made or the entire balance would be due or Repossession of the vehicle would go out. Ms XXXX gave a 1/2 day extension. Ultimately, I am in dispute of the past due amount verbally quoted by Nissan Motor representatives and await a pay history.

Complaint: My car was deemed a total loss after I was hit by a driver who ran a stop light. The driver of the other vehicle was ticketed and his insurance company took full responsibility. However, my insurance company, XXXX, took control of the issue and, to date, has paid XXXX {$38000.00}. There are 2 more payments pending, both of which XXXX is aware, which covers the remaining balance of {$6300.00}. XXXX is threatening to negatively-report me to the major credit bureaus, as my " payment '' is now 27 days late. They are forcing me to make a payment on a vehicle I can no longer use ( total loss ) and of which they absolutely know that payments have been submitted and are being submitted. The {$38000.00} should have certainly brought my account " current ''. Logic would dictate that.

Complaint: I sold my truck after having XXXX put a new engine in my vehicle.A week later the engine light turned back on. This should have been my red flag to disassociate myself from the XXXX brand. With my XXXX issues, I decided to lease a vehicle to prevent maintenance issues and concentrate on my health. After a year of having the vehicle, XXXX mails me a statement requesting approx. {$900.00} which includes a monthly payment and two years of personal property taxes and they sent another statement from the City of XXXX stating I should pay this bill. Not only did they send me a bill but they also charged my account. As a result, I sent a payment to the City of XXXX only to have them return those funds. Once again, not feeling well I just wanted to satisfy the debt because I had never been late with car payments or tax payments. I had to pay personal property for the car I sold so why am I paying for the entire year of 2016 when I took possession of the vehicle in XXXX. Why isnt that prorated? Why is this company gathering all personal property taxes and sending it to me? I am financially drained ; hence why I leased a vehicle. This is my first and last time leasing a vehicle at least with XXXX. This has been a very stressful experience. Once this lease is over I will never step on a XXXX lot ever again.

Complaint: My lease was about to be up, so I went in to obtain a new car. I spoke with representatives, came to an agreement, then on the day I was supposed to come in and pickup the new car, I received a phone call that they werent going to honor the deal that was reached. I went in and spoke with the manager who at first was not going to honor the deal, but once he realized it was the representatives error and not mine, they honored it. Or so I thought. I went in finally a week later to get the car and of course the lease terms had changed. They were only going to honor the price, not the mileage that was agreed to, but a this point, my lease was due to be up, so I didnt have a choice but to take a lower mileage lease or be stuck with no car and rushing to find transportation. After all this, my problems were just beginning. They took my lease turn in and then threw an $ 1800+ balance on my credit report. After finally getting that taken care of after weeks of going back and forth, theyre still reporting a $ 480+ balance. This is all after I disputed multiple times because they continuously marked my payments late because of a late fee that they added, even though my payments were on time. I want the late payments removed from my credit report and I want this false $ 480+ balance removed.

Complaint: I had problems " making on-time payments '' due to a very " Bad Divorce '' which led to a difficult Financial problem, as a result, NISSAN-XXXX XXXXXXXX has reported " Negative Reporting - Late Payments '' which has and is currently damaging my credit reports. But now things have turned around for me financially, I have made ( " Extra Payments in XXXX XXXX and XX/XX/XXXX ' and caught up with ALL my car monthly note payments and have kept on being Current on my monthly payments ). And, because of my hard work to improve my credit with them and consistent monthly payment as well as my future plan to build and request more credit from NISSAN-XXXX XXXX I had called in several times to Customer Service to ask if they can please work with me by " Removing the Negative Late Payment Reporting on my Credit Reports '' but unfortunately the Customer Service of NISSAN-XXXX XXXX has declined my request even though I was told by a rep in the past that if I catch all my payments and make consistent payments that my late payment history will be forgiven. So, as noted above I kept calling and calling but I kept getting passed around on the phone with absolutely no result or remedy to my situation. Furthermore, NISSAN-XXXX XXXX is reporting that my " Payments are Late '' from ( XX/XX/XXXX - XX/XX/XXXX ) in All 3- Credit Bureaus which is NOT correct nor consistent, because I have doubled up to catch up any lates that occurred and made all of my payments on-time so I will not be late.

Complaint: I used to send a few months at a time by mail to pay my loan payment with Nissan. I noticed and started get calls from Nissan that my payments had not been received. It started taking longer and longer for my checks to be cashed by Nissan. I received another call explaining my account was about to be late for my XX/XX/XXXX payment. I explained my check was in the mail. The collector said he could take a payment over the phone but at the time I could not afford for the check and the phone payment to clear. Magically my check cleared shortly after the phone call. I immediately stopped mailing checks and started using their online system. It must be nice to be able to hold checks to create late payments. As you can see from my electronic payments always timely. Either this company is trying to create extra money with late fees, trying to discourage people from mailing checks to use online payments, or there was a mailing issue. I spoke with XXXX on XX/XX/XXXX and was told I would get a response in 15 days. I did not. I contacted XXXX XX/XX/XXXX and was told Nissan could not change it without getting fined by CFPB As one can see from my 30 plus years of credit history there has never been a over 30 day late. How is it fair credit reporting with most of my payments are over 30 days in advance and they don't report that.

Complaint: I would like to file a formal complaint with the Consumer Financial Protection Bureau against XXXX XXXX XXXX and lenders for engaging in deceptive business practices, racial profiling, enabling and assisting their preferred lenders to charge higher interest rates to minority consumers with excellent credit. I am in receipt of my XXXX, XXXX, XXXX XXXX credit reports dated XX/XX/XXXX, I noticed the following credit inquires on my report : ( See attachment ) The ( 5 ) five following unauthorized hard inquires which impacted/lowered my credit scores were placed on my credit reports by XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, XXXX, MD XXXX, ( XXXX ) -XXXX, without my knowledge or consent : XXXX XXXX XXXX XXXX XX/XX/XXXX XXXX XXXX XXXX XXXX XXXXXX/XX/XXXXXX/XX/XXXX XXXX NMAC XX/XX/XXXX XXXX XXXX XX/XX/XXXX XXXX XXXX XXXX XXXX XXXX XX/XX/XXXX XXXX On XX/XX/XXXX, I went to this dealership to look at and possibly purchase an advertised XXXX XXXX . Although I had arranged for my own financing I was told in order to discuss and agree upon pricing I had to complete an application, I could not negotiate a deal without first completing XXXX application. I specifically and repeatedly told the salesperson I did not want to run credit reports, place any unnecessary hard inquires on my reports which would had an immediately impact on my credit scores or apply for any credit with their lenders, just wanted to negotiate and agree upon pricing on a vehicle. We could not reach an agreement on pricing and by the time I returned to my residence I received several notifications from credit protection companies someone had accessed credit reports/files without my consent or knowledge. XXXX first deceptive business practices was their advertised price of the car which included rebates with full knowledge 95 % of the consumers would not qualify for said rebates therefore could never obtain said car for their advised pricing. XXXX second deceptive business practices demanding the consumers complete lending applications just to obtain actual selling price of their vehicles even if consumers had arranged their own lending/financing. XXXX refused to disclose the actual sale price of their vehicles unless consumers obtained financing though their preferred lenders and complete application. I immediately reached out to XXXX XXXX and inquired who authorized the credit checks, why applications were sent to several different lenders without the consumers consent with full knowledge of immediate impact on consumers credit scores without an commitment or authorization for actual purchase. XXXX third deceptive business practices was refusing to provide the consumers with copies of applications, companys response or acceptance of said loan showing finance rates charged, instead roll this cost into the pricing of the vehicle and never disclosed the actual finance rates. After I filed several complaints I obtained copies of financing agreements. Although I had excellent credit with no late, missed payments or negative accounts all of their lenders wanted to charge up to 8 % percent finance rates when I qualified and obtained 3 % percent rate and was offer 0 % down 0 % finance charge on a new vehicle by other lenders. XXXX fourth deceptive business practices steering consumers to preferred lenders with full knowledge minoritys consumers with excellent credit would be charged a higher finance charge/rate and attempted to lock consumers into lenders higher rates by placing multiply inquires on consumer reports with full knowledge of the impact on credit scores. XXXX fifth deceptive business practices denying consumers the right to accept or decline lenders offers/finance rates prior to submitting applications to additional lenders and refusing to disclose simultaneous application would cause multiple inquires immediately lowering the consumer credit without an actual purchase. I reached out several times to owners, management and lawyers representing XXXX XXXX all promised to contact credit bureaus, remove all hard inquires. To date this has not happen impacting my credit scores and blocking my ability to obtain financing at lower rates. See attached email dated XXXX XXXX, Finance Director, XXXX XXXX letter dated XX/XX/XXXX. I am requesting with the assistance of XXXX XXXX the following Lenders immediately contact all credit reporting agencies and remove the below listed inquires from my report. XXXX XXXX XXXX XXXX XX/XX/XXXX XXXX XXXX XXXX XXXX XXXX XX/XX/XXXX XXXX NMAC XX/XX/XXXX XXXX XXXX XX/XX/XXXX XXXX XXXX XXXX XXXX XXXX XX/XX/XXXX XXXX Please be advised some will argue hard inquires can not be removed from consumers credit reports which is inaccurate. The Federal Government ruled inquires are considered inaccurate information if not authorized, therefore can be removed upon directive from parties who placed said inquire. I also asking all lenders send request to credit reporting agencies via certified mail and return receipts showing verification letters were actually sent and received since this action was promised almost a year ago. Unless the lenders can prove an request was sent, received and acknowledged by credit reporting agencies and their removal requests were denied or refused I am holding all parties liable for blocking financial transactions, ability of the consumer obtaining lower finance rates. I am also seeking damages in the amount of {$2000.00}, for each unauthorized inquire from all parties involved in this deceptive business practice and blatant violation of the FCRA. Frequent or repeated calls
Complaint: So I have been contacted almost every day and multiple times a day about my car loan. The first time I answered I tried to get transferred to a supervisor and while on hold I was hung up on. So I immediately XXXX the number and most people said it was a scam ( as they ask for your social security number before you can talk to someone ... not to mention you can barely understand who youre talking to ) I repeatedly kept getting calls. Hadnt answered after that and I never received voicemails. I never received anything about it in the mail. Two years down the road I applied for a mortgage. My credit was horrible and the guy trying to get me a loan told me it was my car loan. He told me I should call Nissan to get clarification on the 25 late payments ... as Im sure Ive payed every month the correct total. ( Its been on auto pay since the day I bought my car ). They tell me A year into my loan I missed one payment. Im still not sure how thats possible as Ive set up auto pay years back .... and they can see Ive made auto pay payments months after that ... so somehow my payment for 1 month wasnt processed and now for the past two years Ive been apparently making ( auto pay ) late payments. It has taken my credit score down further than I even thought it could go.. and now Im terrified I will never be able to fix it and get a mortgage. Ive tried to disputed it through the company and they continued to call me and not inform me if my request was denied or accepted. Extremely frustrated, I answered again and requested to talk to a supervisor. He told me that my request to dispute was denied because its my fault my auto pay didnt get processed properly. I have gotten nothing in the mail notifying me ... nothing for 2 years!!! Now they will not stop calling me and Im apparently stuck with a big bill of late fees and a horrible credit score that I feel is incorrectly reported.
