Getting a loan or lease

Vehicle loan or lease: Loan

Problem with signing the paperwork
Complaint: I purchased a brand new XX/XX/2015XXXX XXXX from XXXX XXXX XXXX in XX/XX/2015. My financing is through Nissan Motor Acceptance Corp. My total purchase was {$28000.00} with 18.81 % interest and I have already paid {$19000.00} with only {$4600.00} going toward my principal balance as of today. So my current pay off balance is {$24000.00}. I agree that I did sign the contract because Everything was moving fast, the dealer did not take time to go over the documents, it literally took 10 minutes for me to sign all the paperwork. I feel like I was taking advantage of. I was approved for this loan with a credit score in the low 500s, {$500.00} down making {$40000.00} a year who rented and had XXXX small children. I was a prime target to default on my loan and potentially lose my car and ruin my credit. The dealer nor the bank even asked for proof of income.

Fraudulent loan
Complaint: On XX/XX/XXXX I went to look at a XXXX XXXX XX/XX/XXXX used SUV on the lot at XXXX XXXX XXXX Georgia. When I got there I informed the 1st person that talked to me his name was XXXX that I had emailed with XXXX XXXX and XXXX XXXX and that I had my own financing of up to {$14000.00} he joking said {$15000.00}. He got XXXX out to talk to me and I informed him of the financing and he opened the vehicle for us to look at. XXXX comes out and I tell him about my financing and then XXXX comes back and says you do not want this vehicle it takes synthetic oil and premium gas. Ok I was getting ready to leave as I only came in to test drive the XX/XX/XXXX XXXX SUV. XXXX says come in and let me see if Nissan has better interest rates than XXXX. He said it would be maybe a half point on the credit score as he was doing soft inquiry. I also explained to him that I was still shopping and had an appointment to see a vehicle in XXXX XXXX at a dealer I also explained this to XXXX when I saw him, I was only doing preliminary shopping for a used SUV. I also told him if he had a used manual transmission on the lot he needed to get rid of to let me know. He gets my information and disappears for about 30 minutes. When he comes back I specifically asked him are you checking with BANKS on my behalf and he said NO and left again and went back into another office. Another 30 minutes passes and I was getting ready to leave as I did not think it took that long to find out what Nissan interest rates were. He then takes me over to XXXX XXXX desk and XXXX writes on a scrap piece of paper that he can get me a XX/XX/XXXX new XXXX XXXX manual transmission for {$480.00}. a month. I started laughing and was getting up to leave and he said what can I do to get you to buy this vehicle today. I laughed even more I thought this was all rather funny as I had told him now on several occasions that I had my own financing even showing both XXXX and XXXX the email from XXXX and that I was still shopping and had plans to see more used SUV 's in the next several days. He said we can get you the new XXXX XXXX manual transmission for {$11000.00}. and it will be {$480.00} a month. I said no thanks and left. My XXXX year old son was with me and will attest to these facts also. The next day XXXX calls up and says good new we can get you in the Versa for {$390.00} a month I was like what ... I told him that I had already told him on several occasions I was not ready to buy nor was I shopping for a new vehicle. Then I get notification from my bank that several hard inquiries had been run on my credit. I contacted the 3 lending institutions that I saw and inquired if any were Nissan financing none were. I contacted the manager of the dealership to give him a chance to correct this wrong. He said he was not there that day and he would check for me. He called back and said that XXXX had not informed the assistant manager that was there that day that I had my own financing nor did he tell him that I was shopping for a used vehicle. That XXXX had informed him that I desperately needed a vehicle. I did not give any one permission to try to get me financing nor did anyone ever ascertain from me the terms I would want to obtain a loan or even how much down payment I had as this information was already in my loan application with my bank XXXX and I had been approved for a loan through them for up to {$14000.00}. on a used vehicle of my choice. The manager said he would not contest when I sent my letters to the credit bureau that they ran unauthorized loan applications without permission using my information. But I find this practice very unethical and they lied to me and I am sure running someone's credit information without permission is wrong and should be prosecuted. I have further received a letter from XXXX that says they declined to give me a loan. I called them and told them I did not apply for a loan with them. They were not interested in finding out that XXXX XXXX XXXX Georgia ran this without my permission. It would seem that every bank that XXXX XXXX XXXX Georgia pulled into this scheme of illegal behavior would also be culpable. I am not sure of the number of times they applied for credit for me without my permission or knowing how much I had to put down or any terms that I would want to complete a loan. The manager said XXXX never checked Nissan financing and that would only take a phone call and he did not need my information to ascertain the interest rates from Nissan. This seems to have been deceptive from the beginning nor has anyone informed me the interest rate or any other relevant information that I would need to make a determination. This was deceit from the beginning and these actions have been detrimental to me. These actions have harmed me as now the interest rate of my approved loan will be adversely affected by the deceitful actions of XXXX XXXX XXXX Georgia. I will be happy to provide any and all information that you will need along with the contact information for my witness.

Confusing or misleading advertising or marketing
Complaint: XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX, GA XXXX ( XXXX ) XXXXCONSUMER COMPLAINTCFPBConsumer Financial Protection BureauWashington DC, Re : 2016 XXXX XXXX purchased XX/XX/2016VIN # XXXX I have been unsuccessful in my efforts to solve this problem with NISSAN.I was sold two 2016 XXXX XXXX vehicles last year and I believe it happened due to Unfair or Deceptive Trade Practices. I purchased these vehicle in Georgia which under Georgia Code 10-1-372, states that : A person engages in a deceptive trade practice when in the course of business, he ; ( a ) ( 2 ) Causes confusion or misunderstanding of goods and services to another ; ( a ) ( 8 ) Disparages the goods, services, or business of another by false or misleading representation of facts. ( a ) ( 12 ) Engages in any other conduct which creates the likelihood of confusion or of misunderstanding.I was engaging in my first purchase of a vehicle at NISSANS new car dealership and feel with the level of understanding and expertise of their sales people I should not have had the experience I had of being tricked into the purchase of my two vehicles. On or aboutXX/XX/2016 I bought my first 2016 XXXX XXXX from N|ISSAN.About two weeks later, I contacted NISSAN after the purchase of my first vehicle because I felt with my credit score I was given too high an interest rate. After about two more weeks of phonecalls, I finally began receiving emails and phone calls from NISSAN about how I could refinancethe car at a lower interest rate. I finally found time to meet someone NISSAN, I think her name was XXXX XXXX. She wassomeone who contacted me about refinancing for a lower interest rate. When I arrived at the dealership I was met by a salesman, XXXX XXXX. I explained to him why I was there and gave him the name of who I wanted to see, but he said he could help me because the lady was not available. From the inception of the deal for the second 2016 NISSAN vehicle, the salesman was telling meand leading me to believe the first NISSAN that I currently owned would just be picked up. He made me to understand that there wasnt anything more to the deal other than me purchasing a new 2016 NISSAN vehicle and then having the first car picked up by the company. I was not clear who would be picking up the vehicle until I called my finance company and they explained the situation to me. I was told that I would be doing a voluntary repossession. This was a term that was never used by the Salesman at the NISSAN dealership. At no time did he offer the option of a trade-in which I later found out should have been offered by the Salesman. At my young age and due to my inexperience, he knew I wouldnt know every option available to me. Ifeel he should have mentioned the trade-in option. But if his intention was to deceive me into a new car deal I can now see why he wouldnt mention the trade-in. I feel he took advantage of my lack of knowledge and inexperience. He then misrepresented the transaction of the new car purchase by hiding that I would have to voluntarily repossess my first vehicle.I have made every effort to remedy this issue. I went back to the dealership a few weeks late andthe salesman, XXXX XXXX, no longer worked for the dealership. I wrote letters to XXXX XXXX, General Manager, at NISSAN. I went in person on several occasions, to see Mr. XXXX, but I was always told he wasnt there. I left messages, but he didnt return my calls, so I believe he just refused to see me on this issue and will not help me. As a result of the unfair sale both cars were repossessed and it is currently poorly reflecting on my credit score

Lender trying to repossess or disable the vehicle
Complaint: On Wednesday, XX/XX/2018 I went outside to get in my car to go to work and the car was gone. I called the policy who informed me that my car was repossessed. They gave me the number to the place that took my car. I contacted them and they told me to contact the XXXX people. I contacted the XXXX people who told me that my XXXX and XXXX checks bounced and they repossessed my car. I asked them what did I need to do to get my car back and they told me that I could not pay what I owed and get the car back because it was a new lease and the only way I can get my car is to pay the total worth of the car which is around $ 52k or get my own financing. They gave me the address to the place where my car was taken and allowed me to go get my belongings from out of the car. I spoke to 2 supervisors and both of them told me that it was nothing they could do. I asked them why wasn't I informed that my payment was past due in writing she said you were by the monthly car note statement. I asked well you don't send out letters stating that the payment is late and she said no they do not. The only correspondence they send is the monthly statement.

Billing problem
Complaint: Our automobile leasing company, Nissan Motor Acceptance Corp. ( NMAC ), began paperless statements. I did not know this. We don't use computer that often. I realized that we did not get a recent bill and contacted them. I was informed that we were 2 months in arrears nearing a third month overdue. I immediately paid 3 months to become current and requested they return me back to mail statements. I found out shorlty after it was reported to the credit bureau as delinquent and our credit score was reduced almost 100 points. NMAC should have contacted us by phone or mail to alert us we were late with a payment so we could have paid our bill, for sure, less than another passing month. Also notify us that if we didn't respond it would be reported to credit bureau. There is no customer service here at all.

Problems at the end of the loan or lease

Vehicle loan or lease: Lease

Excess mileage, damage, or wear fees, or other problem after the lease is finish
Complaint: End of lease return for XXXX XXXX was due XX/XX/XXXX around XX/XX/XXXX, I noticed online terms said 3 year XXXX mile, but the contract we signed and executed said XXXX miles. I contacted XXXX immediately ( via chat ), and they said I would have to discuss with dealership. XX/XX/XXXX, we returned the car to the dealership ( XXXX XXXX ) and they said they would look into it. XX/XX/XXXX XXXX XXXX from XXXX XXXX said I needed to submit the final liability statement to him and that he had received approval from XXXX to credit us for half the over mileage fee ( car had XXXX miles ). XX/XX/XXXX I responded stating that half did not make sense to me. I signed a XXXX lease agreement, why should I pay for mileage I didn't agree to. This was for my daughter while in college ( 5.5 hours a way ) and we knew she would need more than XXXX miles. In fact, we bought an all-inclusive warranty product through XXXX that went through XXXX miles. XX/XX/XXXX XXXX responded with documents from the point of sale ( typical car dealership notes on paper ) saying XXXX was agreed upon. I had already discussed with him in person that we discussed both options in the initial sales discussions. He could not produce an executed contract that showed XXXX miles. Around XX/XX/XXXX, I received a call from the original salesperson asking what I intended to do with the car. Now I am really confused ... I emailed XXXX and the general manager asking what was going on again? I followed up two more times ( XXXX and XXXX ) wanting to know what was going on? I started receiving collection calls from XXXX finance. XXXX, XXXX XXXX, the general manager responded to my email saying the lease was returned and grounded and any remainder in balance would be sent to me by XXXX XXXX. XX/XX/XXXX, I received my final liability statement. It now includes the entire mileage overage charge of {$1300.00} ( XXXX miles ) and is due on XXXX. I am being charged for mileage I paid for through the lease contract. In addition, the process of " turning the car in '' was unclear, not efficient, and took way too long. I feel as though turning the car in is a bad thing and they want to use the initial contract to force me into another XXXX product. That was the very first question I was asked when I told them about my contract issue. It seems very deceptive and unfair for the consumer.

Confusing or misleading advertising or marketing
Complaint: On XX/XX/2018 we went to XXXX XXXX Dealership in XXXX XXXX, NC to buy an XXXX XXXX. I have a credit score of XXXX and was immediately approved for a loan. During that time XXXX was running ads on television for a 0.9 % financing on new vehicles. So we were prepared to finance the loan until they presented us with an interest rate of 3.9 %. On insisting why, they explained that because we got deep discounts on the vehicle, they could not give us financing at the advertised 0.9 %. We bought the vehicle cash cause WE NEEDED one for my parents. I'm reporting this to the CFPB so that you folks can investigate on why this is not made clear when XXXX runs advertisements on television. We bought the car for a total of {$42000.00}. Our plan was to payoff our current debt on another car so we could pay a lower interest rate. Now we are still making payments on the old car. COMPLETE MISLEADING ADVERTISEMENT!!!

Billing problem
Complaint: In XX/XX/XXXX I purchased a XXXX XXXX XXXX from XXXX XXXX in XXXX XXXX, CA for approximately {$21000.00} after down payment receiving financing from Nissan Motor Acceptance. Upon purchasing the vehicle I set up auto-pay in order to make direct deposits in order to pay off the vehicle. From XXXX until XXXX I had never missed a single payment and was well on my way to paying off the vehicle. Upon the final payment, which should have been XX/XX/XXXX, I checked my account and saw a {$0.00} balance. At that time the account was closed out and I was no longer able to log on to the website. I had figured everything was taken care of and my debt was paid. About 8-months later I received information that I still owed {$410.00} ( the last month 's payment and the final balance ). Keep in mind I move around a lot being in the military so if they had sent me letters it was probably to a prior residence. After finding out the information, I called Nissan Financing and they were unable to help me, stating that my balance had been turned over to a collections agency, which I just recently found out wasn't true when I finally paid the remaining {$410.00} balance. I have recently disputed the claim just to get it taken off my credit report after paying off the final balance, but they acknowledged my payoff and refused to take the negative information off my report. My question is, what would be the sense in paying 59 payments of {$410.00} over the course of nearly 5-years, then simply disregarding the final {$410.00} installment? {$410.00} isn't worth not receiving a title or my credit being destroyed. Why in the world would I invest that much money into something I didn't intend to pay? Why would 59 payments be made at the same exact time each and every month during the duration, then suddenly stop on the 60th installment. I just want a clean credit report as all of my other accounts are clean and never late.
