Problem with personal statement of dispute
Complaint: I am a co-lesse for my wife 's car. The due date for this account is the XXXX of each month. We normally pay via website. On XX/XX/XXXX, my wife made a partial payment. On XX/XX/XXXX, we experienced a power outage due to severe weather. She attempted to make the rest of the payment and thought it went through via cellphone data. On XX/XX/XXXX, the payment was registered as 30 days late and reflected on my credit report. I was alerted via a credit monitoring agency. I contacted the creditor. They acknowledged that the payment was now posted on XX/XX/XXXX. We surmise that the remnant payment did not go through due to the WiFi failure during the storm on XX/XX/XXXX. They offered to restore it to " Current '' with the credit bureaus. As a precaution I also filed disputes. On XXXX, the dispute results came back " Current, was 30 days late ''. This registers as derogatory. On XXXX, I called the creditor and spoke with a supervisor. She said that their information is accurate and can not be removed. I asked to speak with manager or director. She said that her level is the last word. We've been longtime customers with a perfect payment history. There should be another review. Also they noted the full payment as late, even though part was paid on XX/XX/XXXX. Their information is not accurate as they claim.

Complaint: On XX/XX/2019, the request was made to apply for an auto loan with a specific lender with whom I've already had an established positive lending relationship, being XXXX XXXX XXXX.
It had been made clear that a security freeze was in place on my credit for safety purposes and avoidance of abuse of process.
In good faith, I temporarily lifted the credit-freeze for 24 hours with XXXX for the dealers to contact the requested lender who approved the loan in the amount greater than what was requested.
The dealers subsequently proceeded to create an additional 7 to 10 hard inquiries against my credit score by other lenders despite my choice lender already approving the loan for a greater amount than requested and without my knowledge or consent. Immediately following this action, the dealers demanded I unfreeze an additional credit profile with XXXX where they posted additional hard inquiries against my score without reason. XXXX was lifted for 24 hours at my request, however, upon leaving the dealership without my vehicle, I discovered that the XXXX freeze had been held open against my request of 24 hours by the dealers who were intending additional postings against my score unnecessarily.
The dealers refuse to release the vehicle me under the disclaimer of insurance until the hard inquiries had in fact been declared as posted to my account greatly reducing my score.
The following action was not only unnecessary but heinous.

Complaint: I purchased a new vehicle XX/XX/2018. In order to receive a rebate for electric vehicle I had to buy the car the day I went to the dealer. I was rushed to close the deal and pick up my kids and didnt realize I had signed for extended services for {$3300.00}. When I discovered what had happened I called the dealer to cancel. I went to the dealer and signed the cancellation on XX/XX/2018. When I hadnt heard anything after a couple of months I started calling the dealer and my calls were not returned. After several days and not identifying myself I was able to reach a manager. They were going to look into it. Since then I have been getting the run around by their sales manager and today he passed me off to their accounting department. They have not returned my call. In the meantime I have paid the car off.

Complaint: On or about XX/XX/2019 I was contacted on my home phone by someone claiming to be from Nissan, an auto lease that I had while on XXXX XXXX. This car was repossessed and given to creditor willingly. Payments we not made due to severe automotive accident with XXXX. Personally was not aware of my responsibilities. I explained this to the company at that time. On the above date I was called by the company being told if I dont pay them the total amount due in a lump sum they will sue me. I am a non working XXXX veteran. This was explained to the creditor they told me the didnt care I had to pay them in full that day or they would sue me. They also stated the would take my income until the debt was paid. Upon hanging up on the called I called the credit back. They claimed that they could do what they want to get their money. So what if you are a XXXX veteran.

Complaint: On XX/XX/XXXX, my credit was ran without my permission. I had been lied to and deceived by XXXX XXXX XXXX XXXX XXXX, who had already previously ran my credit on XX/XX/XXXX. There was no need or permission given to Nissan to run my credit check a second time. As a result of Nissan 's violated action against me, my account received multiple hard credit inquiries from various auto lenders, which stay on your credit for 2 years, not to mention a reduction in credit score. I have attempted to contact Nissan, lenders, and credit bureaus, but I have only gotten the runarounds between these entities, with no resolution in sight. I was even told to file a police report from one credit bureau against these lenders if they were not willing to cooperate with me and help me remove unauthorized inquiries from my credit. I have not filed a report and hope that my complaint here will be resolved successfully, without any need to file a police report against these lenders- especially since Nissan was the one in charge and at fault in allowing this to happen. What's so disheartening is that after I was lied to by a Nissan rep and he ran my credit against my knowledge and permission, I was told by his boss that he would help me resolve the duplicate and erroneous hard inquiries made into my credit report ; but he flat out lied as well, and that left me with little to no option unfortunately.

Complaint: I am in the process of buying a new car, calling around various dealerships and getting price quotes. Throughout the day yesterday, I spoke on the phone to XXXX XXXX, salesman at XXXX XXXX in XXXX, Illinois. I explained to him, in no uncertain terms, that I am looking for an out-the-door price on a 2019 XXXX XXXX XXXX XXXX. I explicitly stated that I will not be financing through Nissan so DO NOT include any rebates or special offers that are dependent on financing. He indicated that he understood and said he would call back after speaking to his sales manager. He called a few minutes later with a price quote of {$23000.00}. I asked for repeated confirmation that this was the car I was looking for, that the price includes all fees/taxes/registration/etc., and that he understood that I would absolutely NOT be financing through Nissan. HE thought my persistent need for confirmation to be amusing and assured me that he is honest, straightforward, and was not going to give me the runaround.
Low and behold, I arrive at XXXX XXXX a few hours later and it goes something like this : XXXX : Sorry, the price I gave you is only if you finance through Nissan.
Me : XXXX I told you a thousand times that I would NOT be financing.
XXXX : Yeah, I know, my bad. It will actually be {$1500.00} more if you're not financing.
I understand that car salesmen have a reputation for being XXXX but this is getting into very deceptive territory. If you are and entity selling a product ( cars ) AND financing, and a customer calls asking for only the product, it is dishonest, deceptive, and outright XXXX to lure them in with a price that you know you will not sell for. I gave XXXX every opportunity and all the information he needed to give me an accurate price and he chose not to. It is possible to negotiate without being outright dishonest but it looks like this isn't a principle that Nissan holds its employees to.

Complaint: Below is a summary of events involving our account, detailing how Nissan Motor Acceptance Corporation ( NMAC ) failed to timely invoice our account for amounts owed, resulting in avoidable late fees / charges from a third party, as well as duplicative and excess charges from NMAC.
In XX/XX/XXXX, my wife and I drove our leased vehicle through Texas, incurring tolls of {$15.00}. The XXXX XXXX XXXX XXXX ( XXXX ) subsequently mailed a bill for that amount to the XXXX. XXXX address of NMAC, on XX/XX/XXXX. Neither my wife nor I received a bill from NMAC, on our billing statements or separately, for this amount. On XX/XX/XXXX, the XXXX sent a Notice of Nonpayment to NMAC at the same XXXX XXXX address ; for the original amount owed of {$15.00} plus a {$10.00} administrative fee. The amount owed on this notice was invoiced to our account four months later, on our statement dated XX/XX/XXXX. NMAC added a {$2.00} administrative charge to that bill for a total of {$27.00}, which was promptly paid on XX/XX/XXXX. In addition to adding the amount to our statement, NMAC mailed us a letter notifying us of the reason for the charge and included a copy of the Notice of XXXX.
In reference to case / reference # XXXX, I am disputing all amounts paid on the referenced account in relation to charges from the XXXX above {$15.00}, and request an immediate refund, on the following basis : The XXXX mailed to NMAC a billing statement for {$15.00} on XX/XX/XXXX. NMAC failed to take timely action to pay the bill in full prior to the due date. In addition, NMAC failed to notify me or my wife of the original charge, preventing us from settling the amount in a timely manner. When NMAC did notify us of the charge, they only did so after late fees had been imposed and well after the original due date. NMACs negligence not only resulted in late fees / charges and wasted time for me and my wife to resolve this matter, but also put us in legal limbo with the XXXX. An unpaid traffic citation could have resulted in additional fines / penalties if either of us had been in the state of Texas, as well as other legal ramifications. This is a matter that XXXX must take seriously not only for the financial protection of consumers, but also because of the legal implications.
On XX/XX/XXXX, NMAC sent my wife and me a second letter notifying us of a traffic citation from the XXXX. The letter included a Third Notice of Nonpayment from the XXXX, with an amount due of {$50.00}, comprised of the original charge of {$15.00}, the {$10.00} fee from the original Notice of Nonpayment, and an additional {$25.00} fee. This amount has also been added to our account billing statements. Not only was this strange because I believed I had settled the matter when we paid {$27.00} in XX/XX/XXXX, but it was also strange that this was the third Notice of Nonpayment from the XXXX ; yet it was only the second piece of correspondence that had been forwarded to us by NMAC.
On investigation, I found that the XXXX had mailed a Second Notice of Nonpayment, for an amount owed of {$50.00}, on XX/XX/XXXX, to NMAC at the same XXXX XXXX address as the previous two notices. This notice was never forwarded to my wife nor me by NMAC, nor was the amount owed added to our billing statements. I then found that the Third Notice of Nonpayment, which my wife and I were forwarded along with the letter from NMAC on XX/XX/XXXX, was actually provided by the XXXX to NMAC on XX/XX/XXXX, again four months before it was forwarded to me for payment. I found this information, as well as the information related to the original bill and the original Notice of Nonpayment, by contacting the XXXX directly on XX/XX/XXXX. I also learned, from contacting the XXXX, no further amounts are owed in relation to the toll or any associated citations / fees after XX/XX/XXXX, the date that NMAC sent a check to the XXXX for the amount of {$27.00}.
In relation to reference / case # XXXX, I am disputing the full amount of {$50.00}, and for the record I will not be paying this amount as long as it shows as due on our account, for the following reasons : as the attachments A, B, D, and E clearly show, the charge of {$50.00} is in relation to the same charges referenced above which were paid promptly by me on XX/XX/XXXX, after I was notified of the charge by NMAC. NMACs failure to promptly notify me of the charges and take appropriate action to prevent late fees / additional charges prior to that date is not my responsibility, and stems back to NMACs egregious failure to notify me of the original amount owed of {$15.00} back in XX/XX/XXXX. In addition, the XXXX recognizes the amount of {$27.00} paid by check on XX/XX/XXXX and does not show any further amounts owed. For NMAC to collect an additional charge from me of {$50.00}, multiplying amounts already paid, for the supposed purpose of paying amounts that are in fact not owed, is plain thievery.
It is needless to say that I am extremely disappointed in NMAC for the clear negligence and failure to act responsibly in this case. I contacted NMAC by telephone twice on XX/XX/XXXX in an attempt to dispute these charges and resolve the matter. In the first instance, the NMAC representative was combative and refused to assist in the situation other than a vague commitment to an investigation ; furthermore, the representative would not commit to taking the same steps that I took today in contacting the XXXX directly to determine the root cause of the charges and follow the trail of correspondence and payments. The second representative was helpful, providing me with the case numbers and assuring me that she was escalating a complaint on my behalf.

Complaint: To Whom It May Concern : I started paying extra on the loan on XX/XX/2018. Then I notice the payment amount going down and the due date getting further away. On the first occasion I spoke to the company, Nissan motor acceptance corp, the rep told me that my extra payments were being applied correctly and that if I payed extra it went to the principle. I asked why does my payment amount change and the due date get further away. He gave me an unsatisfactory explanation about some customers like that so if they need to pay latter or pay less they can. I told him I didn't want this, I didn't ask for this and I wanted my bill to go back according the loan contract. It did not, as you can see in the attached documents, the payment keeps getting less and the due date further away.
In my opinion, they are doing this to trick people into paying less so they can earn more interest. This should not be allowed, I have a loan contract and they should be bound to follow it.
I called again and told them I wanted to see how my payments were being applied, and they sent my an amortization schedule instead. And as you can see, it is the same payment amount and the same due date every month. This made me more suspicious that they were hiding something.
So I called back and made sure the rep this time understood that I want to see how my payments were being applied and the interest paid, the accounting in other words. When I got that, as you can see, the interest payments go up and down. It should be going down continuously not up and down like this. I feel Nissan is not applying my extra payments correctly, not applying the payment consistently on the same date, and they are not following there own amortization schedule.
I need someone to look at this that knows how this should be, it just doesn't look right to me.

Complaint: On XX/XX/XXXX I was involved in an auto mobile accident that ended up a total loss for the used XXXX XXXX XXXX loan. I was deeply injuried but I had to leave the next buisness day to arizona for a work project. I submitted all necessary statements and paperwork to the insurance same day. My insurance at the time and still is XXXX XXXX as I have full coverage and gap insurance provided through nissan for peace of mind in which I paid top dollar for, never payment missed. The insurance gave a huge run around not wanting to do the leg work to process this claim effectively and efficiently. They didnt even get out to XXXX, fl where car was transported to look at it to clarify it a total loss till aftet a month. Finally they reported a total loss to nissan but nissan still needed paperwork and to be paid so they could clear my payments. I had to do all the faxing, preparing, and paperwork for both companies speaking hours at a time daily just to get these companies to process the gap so nissan would stop billing me. The same company nissan and location as of XX/XX/XXXX put me in a new XXXX XXXX XXXX and payments were higher because gap insurance still didnt clear off my credit even though it was being processed and bills paid on time and in compliance followed. They have reported my debt to credit charging my gap insurance paid never missed a payment XX/XX/XXXX loan for the amount of XXXX charging me from XX/XX/XXXX through XX/XX/XXXX of me not having the car and both companies in communication. I pay top dollar and bought several vehicles through nissan and have a huge family account there. I need someone to help clear this off, its not valid

Billing problem
Complaint: During XXXX of 2017, my wife scheduled but failed to hit submit on our auto payment with XXXX XXXX XXXX XXXX Payment was due on XX/XX/17. On or about XX/XX/17, I discovered this oversight and immediately logged on to XXXX 's website and scheduled a payment for the full amount plus late fee. The payment was not posted until XXXX making the XXXX payment 31 days late. I have full records showing all transactions and can show never missing a payment with them and in fact have since closed the account. I have seen on their website where they state that they will show a payment on the day that it is scheduled not on the date that it is posted. Had they shown this date as XX/XX/17 this payment would have been 28 days late instead of 31 days late.
I am disputing them showing a late payment on my credit report since this payment by their definition XXXX scheduling date vs. posting date ) is not 30 days late. I have full documentation except for the statement from their website. I am unable to show this at this time since the account has been closed. I have disputed this with them on XXXX separate occasions with no results other than " they are required by law '' to report this late payment.

This time I had a considerable amount of negative equity on the vehicle that I wanted to tread in, and I don't thought was possible to buy a new car without covering the balance. He said that the only give this option to loyal customers, and the negative equity would get write off. By doing this way I would start a new loan, without the negative equity amount. I was hesitant to agree at first, but they ensure me that everything was going to be fine. He said that will affect my credit score. What they don't tell me it is that now the bank still require that I pay the remaining amount of the loan that was suppose get write off. Complaint: The letter is dated XX/XX/XXXX, however I just received this notice of a debt collection from XXXX XXXX XXXX for a debt from Nissian. I never heard from Nissian or received anything just this notice that I got from my family today XX/XX/XXXX. It states I owe for excessive wear and tear and unpaid lease payments but I paid all the lease payments and there was no excessive wear and tear to the car. When I turned in the car I was not told of any unpaid lease payments of any kind. I stayed up to date on all payments, therefore this is odd and unexpected. I had an inspection done on the car prior to turning it in. The car was ranked under good conditions, inspection person did state that the rims on the tires may be counted as excessive wear and tear due to minor scratches, however, he did state this can be disputed because the rims stick out past the tires due to the rims not properly fittings the tire size. I called Nissian regarding my concern prior to turning in the car and stated that the rims they installed are not the standard and are after market part which doesnt properly fit on the tires and stick out beyond normal which will cause scarthes for any minor or slight bump on a curb or just driving on a road that may have loose gravel. I also informed Nissian that if they should try to make me Pay for something thats their fault for installing rims that stick out past what they should the. I want to disput the charges. Nissian never extended me the courtesy to call, email, mail or notify me of their intent to charge me for anything. They sent this to collection without giving me proper notice, or even giving me the chance to resolve the problem. I heard nothing from Nissian or about this until it was already in collections. This is not fair to me as a consumer. I want an investigation and to take this matter to court.
